Place where every voice matters and every effort, no matter how small. 01:06:19
Help shape our future. 01:06:23
Your presence here tonight. 01:06:24
Is a powerful reminder of the spirit that makes our city unique. 01:06:26
By showing up. 01:06:30
Raising your voices and participating in these important discussions, you helped shape the future of Port Waneni. 01:06:31
Your engagement is the heartbeat. 01:06:38
Of our democracy and the foundation of our community progress. 01:06:40
We recognize that at times controversy, budget restraints and present day uncertainty. 01:06:44
Can test our resolve. 01:06:50
In recent times, we have also seen how immigration raids cast a shadow of fear and uncertainty over our families, reminding us. 01:06:52
Of the urgent need for compassion. 01:06:59
Understanding. 01:07:01
And Unity. 01:07:02
As we strive to keep our whole community strong. 01:07:03
In these moments. 01:07:07
Let us stand together with compassion. 01:07:08
And courage. Our strength lies in our unity and our unwavering commitment to respect. 01:07:11
And dignity for every resident. 01:07:16
When we support one another and celebrate our diversity. 01:07:19
Port Hueneme becomes the beacon of hope. 01:07:22
And. 01:07:24
Economic development, safety, sustainability and inclusion are not just council priorities, they are shared goals. 01:07:26
That require all of us to work together. 01:07:32
Every question you ask and every idea you share. 01:07:35
Moves us forward. 01:07:38
Together we can create a city. 01:07:39
That reflects our highest hopes. 01:07:41
And values. 01:07:43
Thank you. 01:07:44
Great. Thank you. Councilmember Hernandez will now move on to Madam City Attorney. Please provide a closed session report. 01:07:52
Thank you, Madam Mayor. 01:08:00
There is no reportable action for the this evening's closed session. 01:08:02
I also need to report. 01:08:06
That from the July 21, 2025 closed session meeting. 01:08:08
Which went to. 01:08:12
After the general meeting went to wee hours of the morning, there was number reportable action. 01:08:14
Great. Thank you. We're now going to move to. 01:08:21
Your public comments. So these are public comments, not not. 01:08:24
On the agenda. And so you'll have 3 minutes. Madam Clerk, do we have any public comments? 01:08:28
Yes, we have several public comments. First, we'll start with Lamont Hayes. 01:08:33
Followed by Donnie Akin. 01:08:38
Good evening. 01:08:44
To the distinguished. 01:08:45
Panel, Madam Mayor. 01:08:47
And Councilwoman. 01:08:49
Mark Misty Perez, Laura Hernandez. 01:08:51
Mr. 01:08:54
Pro Tem Jesse Lopez God bless and. 01:08:57
My friend CB Gamma in his absence to the distinguished members of our community. 01:09:00
Thank you. 01:09:05
As well as a county. 01:09:35
For housing and assistance. 01:09:37
On September 13th at the Boys and Girls Club of Port Wineemi and. 01:09:39
Greater Oxnard and Port Winey, me Boys and Girls Club, 1900 W 5th St. in the city of Oxnard. 01:09:44
We will be hosting our annual Resource Day. 01:09:50
It is the clean energy initiative also, so a lot of the. 01:09:53
Clean energy, low emission vehicles and staff will be there to talk about the things that we need for our community. 01:09:57
So we've reached out to a lot of the dignitaries and politicians and those who are influential in our community to find ways that 01:10:04
we can better clean our community. 01:10:08
With that, we do have several. 01:10:13
Other resources that will be there on hand. We have a stage with a lot of entertainment as well as food. So all the children and 01:10:15
gets there. We have lunches from habit, we have lunches from Lazy Dog. We have a lot of things that a lot of the children enjoy. 01:10:21
We have a crane that the kids would be able to practice. 01:10:27
Than longshoreman's. 01:10:33
At the event. So this event is for the community. 01:10:35
The one thing we want to do is encourage our community port. Why need me to come over and see that there is resources for all of 01:10:38
us? 01:10:42
The other part of us, we have two divisions helping hands and we do have the NAP port now port is also a navigational port that 01:10:46
helps others that are having issues with navigating through governmental issues with housing. 01:10:53
Unemployment. 01:11:00
The massive issues work. 01:11:02
So that's part of our website. The website is VC. 01:11:04
Resource Center org Look at the videos. Look at the. 01:11:08
The response? Look at the reviews and we're here for you in the community. 01:11:12
If you're senior, if you're disabled, Donnie Aiken is going to talk to you about that as well. 01:11:15
Thank you. 01:11:20
Thank you. 01:11:21
Good evening, Port, we're near me. 01:11:31
Marin City. 01:11:33
Council members. 01:11:34
How are you guys this evening? 01:11:35
Hope all everyone is as well. 01:11:36
I am director Donnie Akin. 01:11:41
I am up. I am coming to you. 01:11:43
Everyone today because we want to introduce. 01:11:45
A new program into the community. 01:11:48
This new program is called Helping Hands. 01:11:52
What we are trying, what we are trying to do is connect senior citizens and disabled individuals with volunteers who would like to 01:11:55
share their time. 01:11:58
By helping out with medication pickup. 01:12:02
To just sitting and to have a friendly conversation. 01:12:05
We would try our best to supply whatever is needed. 01:12:08
But in order to do that. 01:12:11
We need help from within the community. 01:12:13
We need donations. 01:12:15
Now in order to. 01:12:19
Fund this program or get it off the ground. 01:12:21
What we did is start up moving. 01:12:23
A sort of moving service. 01:12:26
A lot of the seniors in the county have been trying to move their storages or downgrade their storages because of the price 01:12:28
increases. 01:12:32
What we started to raise donations is. 01:12:35
I've been taking a team and talking to some of the storage units and we go out and we move those storages forward to senior 01:12:38
citizens and they can donate to the Resource Center. 01:12:43
It's not a charge. They donate what they can. They donate what they think the work is worth and if they don't have any. 01:12:48
Any funds to donate or whatever? 01:12:55
Than the person who donated. 01:12:57
Previous to them just took care of. 01:12:58
So this is of. 01:13:01
Very great program. I've had a lot of. 01:13:04
Input about it throughout the community. 01:13:07
We just really, really need. 01:13:10
Some help to get it off the ground. We've been doing what we can and helping out we've helped about. 01:13:12
5 to 10 senior citizens and disabled individuals in the community. 01:13:18
From moving out of their house to a new place to. 01:13:22
Moving storages are to just going to their house and sitting with them and helping them with things they need to do around the 01:13:25
house. 01:13:28
So this is a great program, I think for Ventura County and we are hoping to do great things here. 01:13:33
Thank you very much for your time tonight and God bless. 01:13:40
Thank you. 01:13:43
Becky Bruni. 01:13:50
And then followed by Johnny, Garcia, Vasquez and Sarah. 01:13:52
Work Siski. 01:13:56
Wilcheski. 01:13:57
Mayor, Mayor Pro Tem, Council staff. 01:14:01
An audience I'm here representing real guppy outdoors. 01:14:03
Last month Kevin and I took 7. 01:14:08
Teenagers. 01:14:11
To Florida. 01:14:13
And believe it or not. 01:14:16
They amazed us. 01:14:18
They did exactly what we expected out of them without having to tell them. 01:14:20
And they made a lot of contact with. 01:14:26
Prospective sponsors. 01:14:29
And we are very proud of them, as a matter of fact, one of them. 01:14:32
Just became a staff member. 01:14:35
So we're really proud of these kids. 01:14:38
Sunday is our family fish day out at Winnie Me Pier. 01:14:41
From 8:00 to 11:30. 01:14:45
You don't need to forget. 01:14:48
Furnish anything. We furnish everything and it's free. 01:14:49
So bring your kids out and enjoy. 01:14:53
Thank you. 01:14:57
Johnny Garcia Vasquez. 01:15:01
Good evening, Port Whitney mayor, councilmembers, city staff and residents. My name is Johnny Garcia. 01:15:09
Vasquez I am an educator and special education and a 4.0 doctoral candidate. 01:15:15
My resume consists of formerly serving California as a two term Student Aid Commissioner appointed by former Governor Jerry Brown 01:15:21
and was confirmed on bipartisan support by the California State Senate. I have also worked for two. 01:15:28
Two of Ventura County, California State legislators that have or are currently representing the City of Port Hueneme within their 01:15:35
legislative districts. 01:15:40
I am a. 01:15:45
Port Hueneme resident who lives at. 01:15:45
Park Apartments on Madera Circle that are managed by Gardner Management Limited. 01:15:49
Since last year. 01:15:54
I have been a target. 01:15:55
And victim of ongoing landlord. 01:15:57
Property management staff. 01:15:59
And other tenant harassment and retaliation. 01:16:01
That has LED for me to report. 01:16:05
Hate speech. 01:16:06
Hate incidents and harassment to the local Port Wyoming Police Department and other state. 01:16:08
Government agencies and departments. 01:16:14
Under California tenant rights laws, a landlord. 01:16:17
Agent. Staff member. 01:16:20
Or even a family member of the landlord should not harass or retaliate against any tenants. 01:16:22
After a tenant has asserted their California tenant rights to complain to a government agency. 01:16:28
Such as the local code enforcement. 01:16:34
Hearing Port Hueneme. 01:16:37
That has the legal. 01:16:38
Government authority. 01:16:41
To follow up on behalf of the tenants concerns. 01:16:42
So that the. 01:16:45
Landlord and property management staff can address. 01:16:46
Unhabitable living conditions such as mold. 01:16:50
Just to name a few. 01:16:57
Yet here. 01:16:59
Friendly city by the sea of Port Hueneme, CA. 01:17:00
Reside what Webster's Dictionary defines. 01:17:04
As slumlords. 01:17:07
Who care more about making a profit? 01:17:08
Over the basic human public health and safety of your constituents. 01:17:11
That includes single parents, children, the elderly and hard working taxpaying residents. Therefore tonight I asked you council 01:17:15
members to request the city manager and staff to explore and agendas agenda eyes a future anti landlord harassment ordinance topic 01:17:21
at a future meeting for City Council to adopt. 01:17:27
That strengthens current state statute law and reflects a similar local tenant protections of the Anti Landlord Harassment 01:17:34
Ordinance of the City of Los Angeles. Thank you. I yield the remaining of my time. 01:17:40
Thank you. 01:17:47
Thank you. 01:17:51
Good evening. 01:17:57
Good evening, Madam Mayor and council members. 01:17:59
Our community is hurting. 01:18:02
As an unpaid volunteer with 805 and Docu Fund, I see the pain and fear our families friends. 01:18:04
And neighbors are experiencing every day. 01:18:10
One of the things I do in my role as a volunteer is I sit outside the ice office at. 01:18:13
321 Cortez Circle in Camarillo. 01:18:19
Where we document the comings and goings of their RAID vehicles and provide support to. 01:18:22
Community members there for appointments or to get information about their detained family members. 01:18:27
The other day when I was explaining my presence there to a gentleman. 01:18:34
I pointed out where I was parked and told him if he needed anything. 01:18:38
That's where I would be. 01:18:41
He responded I could use a lawyer. 01:18:43
This is 1. 01:18:48
Of the most common questions I get asked when I introduce myself to people there. 01:18:50
Are you a lawyer? 01:18:55
The community has been rallying support for those impacted. 01:18:57
They are opening food collection sites. 01:19:01
In businesses organizing. 01:19:03
Rides for those two scared to leave their houses alone. 01:19:06
And putting on events to help. 01:19:10
Start the school year. 01:19:11
But we can only do so much. 01:19:13
Without the support. 01:19:14
Of our local leaders. 01:19:16
With your support. 01:19:18
We can help get these people lawyers. 01:19:19
We urge you to. 01:19:23
Support Supervisor Lopez's proposal to the Board of Supervisors. 01:19:25
On August 26th. 01:19:29
File an amicus brief in support of the. 01:19:32
Plaintive in Vasquez Perdomo. 01:19:34
Host a Know Your Rights workshop similar to the one hosted in Moorpark. 01:19:38
By their City Council and include local businesses in it. 01:19:43
And put these requests. 01:19:47
On the agenda for the next meeting. 01:19:48
And also support the local Boys and Girls Club. 01:19:51
Thank you. 01:19:54
Thank you. 01:19:55
Joan Tharp. 01:20:01
Luis Mendez and then Mitchell Disney. 01:20:03
Stop it. 01:20:13
Good evening Mayor, Mayor Pro Tem, City Council and staff. 01:20:16
My name is Joan Tharp, and I'm here tonight representing Surfrider Foundation, Ventura County. 01:20:20
To update you on our port or Nimi. 01:20:26
Programs. 01:20:28
1st thank you for having us at the beach festival. Our volunteers had great conversations about our mission to. 01:20:29
Protect the oceans. 01:20:36
The world's oceans, waves and beaches for the enjoyment of all. 01:20:37
In Port Winimi, we now have. 01:20:42
31 cigarette **** recycling cans for the From the Beach Promenade through Bubbling Springs Greenway into Bubbling Springs Park. 01:20:44
Since 2016, our volunteers have collected and recycled nearly 1,000,000 butts across Ventura County. 01:20:52
While our beach cleanups focus mostly on Ormond Beach and wetlands, we had two cleanups of Bubbling Springs Creek this year. 01:21:00
One in May, a bubbling springs park where 50 volunteers picked up to 170 lbs of trash. 01:21:08
That was shortly after the. 01:21:14
Park reopened. 01:21:16
And one along the Creek at Miranda Park in Lot F. For this one we had 16 volunteers pick up 106 lbs of trash. 01:21:17
A lot of it bread bags from feeding the ducks and smaller pieces of plastic. 01:21:25
With a lot of help from city staff, we've launched the coastal dune restoration project at the East End of the beach park. 01:21:29
So far we've had. 01:21:37
Three events with 100 and. 01:21:38
3 volunteers. People like pulling out invasive plants I guess. 01:21:40
Installed 150 feet of sand fencing and added informational signage. 01:21:44
At upcoming events on September 6th and October 4th. 01:21:49
We'll expand the fencing. 01:21:53
Remove more invasive plants and prep for native plant seeding in November, which will be right before the rains. 01:21:55
Hopefully we have rains. 01:22:02
A million thanks to Rick Cervantes and his crew for providing dumpsters for the plant material we. 01:22:04
Removed. 01:22:10
They do an awesome job. I feel like I'm always giving a shout out to Public Works, but I mean it because they're awesome. 01:22:11
More information on these three programs and all of our work can be found at Verinton Ventura Surfrider org Thank you for your 01:22:17
time. 01:22:20
Thank you. 01:22:24
Good evening, council members, staff and residents here. My name is Luis Mendez. I'm actually here as a resident, not as part of 01:22:32
any particular organization. 01:22:36
And I just wanted to briefly speak on the immigration issues that were going on recently. 01:22:40
For four or five hours, I think I watched the last week's. 01:22:44
Ventura County supervisors meeting. 01:22:47
Where our local supervisor was promoting the immigration policy. 01:22:50
I want to In those four hours, I didn't see really, man. 01:22:54
Many members of. 01:22:56
The city of Port Hueneme or our leaders speaking, You know, I don't know if there's any written comments. 01:22:57
You know, I've lived here for 40 years. 01:23:02
I've ran for City Council before and I've gone door to door in our communities. There's a lot. 01:23:04
Of immigrants that live in wine and me, we may not have fields here. 01:23:08
But going there, seeing families living together, I can see why they're afraid to go out in public. 01:23:12
I have relatives that are teachers in schools and they've definitely seen the impact of attendance. 01:23:18
From students. 01:23:22
Going to school because of their fear. 01:23:23
Personally, being an organization, we raised money. 01:23:25
When those raids happen in Camarillo. 01:23:28
To provide food and even money to the. 01:23:31
Farmers. 01:23:33
Coalition or whatever that Friends of Farmers organization. 01:23:34
But uh. 01:23:37
My ask here to you guys is to please consider supporting that immigration initiative to show our local community that we are here 01:23:38
to support them. 01:23:41
I've had relatives that. 01:23:45
Are immigrants and it'd be really nice to see you guys support them as well. 01:23:46
Thank you. 01:23:50
Thank you. 01:23:51
Good evening, Mayor McQueen. Legend. 01:24:00
Council members, staff. My name is Mitch Disney. 01:24:03
I serve as president of the Pacific Collection Homeowners Association. 01:24:06
And as chair of the safety committee. 01:24:11
Of the Winimi HO. 01:24:13
Coalition. 01:24:15
I want to take a moment tonight to publicly thank. 01:24:17
And acknowledge. 01:24:20
The excellent work. 01:24:21
Of Port Oneima police officer Zach from. 01:24:23
City Manager James Vega. 01:24:26
And Police Chief Michael Federico. 01:24:28
They collaborated closely with the property owner. 01:24:31
At the Mandalay Village Marketplace shopping center, the Ralph Center. 01:24:34
And their private security team there to. 01:24:40
Address ongoing problems. 01:24:43
That were directly affecting our community. 01:24:45
As a result of their efforts, we have seen. 01:24:48
Significant improvements. 01:24:51
Loitering and late night noise in the alley behind the shopping center. 01:24:54
Adjacent to Pacific collection have been reduced. 01:24:59
And the persistent panhandling and day camping. 01:25:03
At the Wheelhouse Ave. entrance have finally come to an end. 01:25:06
On behalf of our residents, I want to express our sincere appreciation for their leadership. 01:25:11
The quality of their responsiveness. 01:25:16
And commitment to community safety. 01:25:19
These changes have made a real difference. 01:25:22
In our community. 01:25:24
And in our neighborhood. 01:25:25
We hope that these efforts will continue. 01:25:27
To produce successful results. 01:25:30
And finally, thank you. 01:25:33
To the Council. 01:25:35
For supporting these partnerships and continuing to prioritize. 01:25:37
Community Safety. 01:25:40
For the residents. 01:25:42
Of the city of Port Winnie, me. 01:25:43
Thank you. 01:25:46
Yeah, Steven. 01:25:51
Followed by Zach Bolivia and then Greg Ross. 01:25:53
Good evening, Council. 01:26:00
Mayor, Mayor Pro Tem, City Council. 01:26:02
Like some of the speakers before me. 01:26:06
Shared uh. 01:26:08
We're experiencing A humanitarian disaster. 01:26:09
In greater Oxnard and in Ventura County. 01:26:12
Over 1000 people have been impacted by immigration raids here locally. 01:26:15
360 taken in one day alone. 01:26:19
Food lines stretch around the corners, just one block outside of city limits. 01:26:23
Children are missing their parents. 01:26:28
Rental evictions will begin shortly. 01:26:30
For those who aren't able to pay their. 01:26:33
Rental dues. 01:26:35
All this is happening. 01:26:38
Without any action. 01:26:41
Formerly UMM. 01:26:42
By the City Council. 01:26:44
Discuss what's happening. 01:26:45
Other municipalities all around us have taken an action. 01:26:48
They have worked collaboratively, worked with other council members, the mayors have been in conversation with each other. 01:26:52
And I think we are uniquely positioned to enter into that conversation. I know. 01:26:59
Eight months in and been absent from most of those spaces, but I think this city should be in those spaces and I think the council 01:27:04
majority supports being in those positions. 01:27:09
So I urge you, Council Majority. 01:27:14
To support that. 01:27:16
To show up in those spaces. 01:27:17
Find where the city can have a voice. 01:27:19
The council minority has made their opinions known, just look in their social media. 01:27:21
They call them activists. 01:27:25
They say that this is, this is. 01:27:27
6 Supervisor Lopez proposal, the most concrete proposal to help our immigrant community. 01:27:28
They call. 01:27:34
Bankrolling activism. 01:27:35
Could not be further from the truth. 01:27:38
So what do you do when you hear misinformation? You correct the record. 01:27:40
That's on the council majority. 01:27:44
To do that. 01:27:45
What's the truth? 01:27:46
The proposal by Supervisor Lopez. 01:27:48
Expands the Public Defender's office to represent those. 01:27:50
Do not who do not have a means to afford an attorney. That is the core function of county government. 01:27:54
That is the function of Public Defender's office. 01:27:59
It supports migrant education. 01:28:02
That's so vital to our community. 01:28:05
Where the Council minority calls it activism. 01:28:07
Council members Misty Perez and Steve Gama call it activism. 01:28:10
We know what it really is. It's supporting the community. 01:28:14
So that's why I'm looking to you. 01:28:16
Majority umm. 01:28:18
Take action. 01:28:19
To the council minority, I hope you get informed. I hope you stop spreading misinformation. 01:28:20
Just look to their social media pages, it's all over there. 01:28:24
Anti immigrant. 01:28:28
Anti immigration resources. 01:28:29
So Council majority please. 01:28:31
Request an item be placed on the agenda to talk about, if nothing else. 01:28:33
What your neighbors are doing. 01:28:37
To come up to speed. 01:28:38
Because I don't want this city left behind, and right now it is left behind. 01:28:39
Earlier you heard about rental eviction and rental rights. 01:28:43
Another area in which the city has been left behind. 01:28:47
I hope you request the anti harassment ordinance be brought forward in the city. 01:28:50
Take a look at the city of Oxnards. 01:28:54
And fit for the city of for Port Hueneme. 01:28:56
Lots to be learned from our neighbors. Thank you. 01:28:59
Thank you. 01:29:01
Thank you. 01:29:02
Zach Bolivar. 01:29:04
Excuse me? 01:29:07
I don't appreciate being called out. I haven't made my opinion stated whatsoever on social media, Councilmember Hernandez. I mean, 01:29:09
thank you. 01:29:12
Perez, we're not. 01:29:16
We don't respond to comments. 01:29:17
Can we get back on track please? 01:29:21
Good evening, Madam Mayor and members of the Council. For those that don't know me, my name is Zach Boliva. 01:29:27
I'm the public information officer at the Port of Winimi. 01:29:32
Before I continue to my other remarks, I'm so pleased to see many members of law enforcement here tonight. 01:29:35
More important than anything else that I'm going to say, I want to thank all of them for the response when we had an armed 01:29:40
intruder unfortunately entered the port. 01:29:43
Recently they responded very quickly, Officer Harbin and some of the others. 01:29:47
Were there within seconds and did a lot to keep us safe. We're greatly appreciated. 01:29:52
Of that. 01:29:57
And really shows I think. 01:29:58
What good partnerships can do, I hope that we continue to strengthen our partnership with the city, with law enforcement, and with 01:30:00
others around. But a sincere thank you to each of you and those who aren't in attendance tonight. 01:30:04
In a recent meeting, there were questions and comments regarding the rail crossing at Channel Islands Blvd. in Paterson. 01:30:10
During which some concerns were raised that the train activities sometimes blocks the road. 01:30:16
And could impede law enforcement response times. 01:30:20
I wanted to correct the record and ensure there's awareness that there is indeed a special dedicated task force that communicates 01:30:23
regularly. 01:30:26
Via group chat. 01:30:30
Regarding the train activity. 01:30:32
The port was able to ensure that all relevant parties that need to be in this chat message were involved and we were able to 01:30:33
connect. 01:30:37
The GM of the railroad and the Police Department to ensure that communication stays open. 01:30:40
The arm was originally hit by a driver experiencing a medical emergency. 01:30:45
Repairs are ongoing and during this work, flaggers are on site at impacted crossings. 01:30:49
Which does result in a 3 minute delay, but we understand the task force has identified alternate routes and is not concerned about 01:30:54
delays. 01:30:57
Secondly, we are aware that there have been questions in City Council. 01:31:01
Meetings about how the public can weigh in on port activities. 01:31:04
The contracts between the city and the port were crafted with some foresight. 01:31:08
Regarding this. 01:31:11
If volumes go up at the port as move. 01:31:12
Many of you know another EIR. An environmental impact report is required to supplement the one. 01:31:15
Already completed. 01:31:20
After methodical and intentional growth, we have reached that threshold and thus the port is embarking on a supplemental E IR. 01:31:21
It is out to bid and we will administer the report in full compliance with Sequoia, the California Environmental Quality Act, and 01:31:28
we hope. 01:31:31
And intend for this to be an open and transparent. 01:31:34
Process during which there will be a time for the public to make comments. 01:31:36
Lastly, I would like to take this opportunity to address why the joint city Port Washington DC trip was rescheduled. 01:31:41
The trip was not intended just for the port, but also for the benefit of the city. 01:31:47
And with important support from the county. 01:31:51
Unfortunately, more time than was. 01:31:53
On hand would have been required to write and produce the white papers and other content so that the city and port items could be 01:31:55
presented in the best light. 01:31:59
And reach the most ideal outcomes. 01:32:02
We hope to discuss a new timeline for the trip at the next Port City meeting. 01:32:04
Thank you for the time. 01:32:08
Thank you. 01:32:10
Frieda Anderson, you'll be after Mr. Ross. 01:32:16
Hello Port Wayne, ME. 01:32:25
Mayor. Mayor Pro Tem. 01:32:28
Distinguished City Council members. 01:32:30
And City Manager Vega. 01:32:32
I'm a long time. 01:32:36
Resident of Ventura County since 1970. 01:32:40
Before you, I hope you have. 01:32:44
This little sheet. 01:32:46
About the trucks from the port. 01:32:47
I'm noticing there's a lot of. 01:32:51
Work on the on the roads. 01:32:54
On Wayne. 01:32:56
Probably in South Ventura County, not really Port Hueneme. 01:32:58
But nevertheless. 01:33:02
80 plus percent of the trucks on the road in Port Hueneme. 01:33:03
Belong to the port. 01:33:08
OK, so they're the ones that are chewing up our roads. 01:33:10
I'm wondering who's paying. 01:33:14
For this. 01:33:16
I don't really know the answer to this. 01:33:17
But who's paying for this? 01:33:18
New road construction. 01:33:20
Maybe that's a question I have to ask tomorrow. 01:33:23
In Ventura County supervisor meeting. 01:33:26
Nevertheless. 01:33:29
The port has. 01:33:30
They've got accountability to offer. 01:33:32
For these trucks. 01:33:34
All right, so I'm going to, I'm going to get off that for a minute. 01:33:36
I have to echo. 01:33:38
The statements of a couple other speakers about. 01:33:40
The city at its responsiveness. 01:33:44
Particularly. 01:33:47
The the the. 01:33:49
Police chief and his. 01:33:50
Group. 01:33:52
You know, Mr. Chief Frederico. 01:33:55
They've been very responsive. 01:33:58
And I know there's a survey about parking. 01:33:59
For the city. 01:34:02
Guess what? 01:34:04
In the last week, I did not have to call one time. 01:34:05
To say. 01:34:08
There's a trucker on our city streets. 01:34:09
First time for one week. 01:34:12
The week before I had to call a couple of times. 01:34:15
At least. 01:34:17
But thank you to the city, to the Police Department. 01:34:18
For taking care of our city. 01:34:23
Like they do. 01:34:25
And I hope. 01:34:26
That it continues because. 01:34:27
This this Police Department is responsive. 01:34:30
To what we need. 01:34:33
And I appreciate your time. 01:34:34
Thank you. 01:34:38
So my name is Freda Anderson and I am a new addition. 01:34:49
To the Ventura County Resource Center. 01:34:54
You've heard of, heard who they are. 01:34:58
Thus far they is in place. 01:35:00
Help people in need. 01:35:03
With the. 01:35:04
They've covered everything from using help, their division, helping hands. 01:35:06
Delivering. 01:35:10
Mothers with with with. 01:35:12
Pampers and whatever the need might be. 01:35:14
For the most needy, but my division is a little different. 01:35:16
Is called an F port. 01:35:19
And as the name of notes. 01:35:21
Is designed to help. 01:35:22
Regular individuals navigate through. 01:35:25
Complex systems. 01:35:27
Every single branch of government. 01:35:30
Say an elderly person is having a problem getting their money back from a. 01:35:32
From a commercial establishment. 01:35:36
Or they've been scammed online. 01:35:38
Or they're having problems. 01:35:40
Escalating an insurance issue. 01:35:41
It's not legal services per se. How? 01:35:44
But however we are aligning ourselves in creating a database. 01:35:46
Of attorneys that when it. 01:35:50
When the issue gets to that level, so I'm not ever accused of practicing law without a license, we're able to partner and pass 01:35:51
those cases over to. 01:35:56
A. To an attorney to a qualified attorney in that particular industry. 01:36:02
But bottom line is. 01:36:07
You know, these days everything is AI and it's electronic. 01:36:09
In folks 707580 years old. 01:36:13
We're used to. 01:36:16
Seeing people face to face and hailing it face to face. 01:36:17
Are the online like so? This division is designed to help people and it's not based on. 01:36:20
Race. 01:36:26
Gender, Age. 01:36:27
Income. 01:36:30
You could be a wealthy person. 01:36:31
In a 75 year old wealthy person who's having trouble? 01:36:33
Navigating through an insurance system. 01:36:37
You know and. 01:36:41
Need to get protected from. 01:36:42
Being scammed and taken or someone that's facing the question of a reverse. 01:36:44
Mortgage. 01:36:48
How many people get scammed with that kind of thing? So that's what Navport is. 01:36:50
Any of those kinds of problems that. 01:36:53
Come, come before a person. 01:36:55
We want to embrace those. 01:36:58
And help people. 01:36:59
Helping the homeless, but again. 01:37:00
It's not bait. You don't have to be poor. 01:37:02
To get the help. 01:37:04
You just have to. 01:37:05
Need that kind of help. 01:37:06
So I hope that shares and hope you'll share the word, you'll spread the word about it. 01:37:08
We want to do our best. 01:37:13
Thank you. Thank you. 01:37:14
Thank Councilman. I'm sorry Mayor McQueen legend. We just have 3 written comments, so I'll just go ahead and read this real quick. 01:37:20
The first one is from Blanca Ortega. 01:37:27
Mayor, Council members, thank you for the opportunity to comment. 01:37:29
I want to acknowledge that Councilmember Laura Hernandez was the only Port Winnie Me official who showed up at last week's Ventura 01:37:33
County Board of Supervisors meeting. 01:37:37
To support agenda item 69. 01:37:41
That meeting drew hundreds of residents and hours of testimony, and no final vote was taken that day. 01:37:43
Meaning the board now has a second opportunity to. 01:37:48
Please add port wine, Amy's voice and support before the item returns. 01:37:51
And then they have a link to KCLU and News Channel 3 through 12. 01:37:56
Why this matters to Port Winnie me residents. 01:38:01
Who we are Our city has about 21. 01:38:03
1700 residents, roughly 1 in four Port wine ME neighbors are foreign born. 01:38:06
Median household income is about 76,700, and roughly 11% of residents live below. 01:38:12
The poverty line. 01:38:18
These are the families who would be most directly impacted by Agenda 69's legal help and education support. 01:38:20
And they have a link to Census reporter. 01:38:27
What Agenda Item 69 does, per public reports. 01:38:29
Creates a county immigration legal defense fund. 01:38:32
Add 7 positions to the Public Defender for Immigrant Defense and supports migrant education outreach and sets county protocols for 01:38:35
responding to federal enforcement actions. Estimated investment 3.4 million county wide. 01:38:42
Smart public safety policy. When people have lawyers, they show up. 01:38:50
Or nationally, immigrants with council appear for hearings 9097% of the time. 01:38:54
That builds order and due process rather than chaos. 01:39:00
Trust based approaches also improve crime reporting and cooperation. 01:39:04
Which helps every officer do their job and keeps all residents safer. 01:39:08
There's a link to the Vera Institute of Justice Police. 01:39:12
For Melissa. 01:39:15
Jao, Jacomb. 01:39:17
Smart Financial Policy. 01:39:20
Universal representation programs like New York's have increased successful. 01:39:22
Legal outcomes from about 4% to a projected 48%. 01:39:26
Keeping wage earners with their families, stabilizing local businesses and avoiding costly downstream disruptions. 01:39:31
Independent fiscal analysis find that right to counsel investments. 01:39:38
Yield Annette public benefits by preserving tax revenue and reducing turnover. Turnover and social and service costs. 01:39:42
My today. 01:39:49
Please place an item on your next agenda to send a formal city letter. 01:39:51
Urging the Board of Supervisors to vote yes on agenda item 69. 01:39:55
Direct staff and two council members to deliver live or written testimony to the board in support. 01:39:59
And three, Share the Counties know Your rights and legal aid information through city channels so residents know where to turn 01:40:06
when federal activity effects their families. 01:40:10
Councilmember Hernandez modeled what leadership looks like. 01:40:16
The board now has a second chance to do right by Ventura County and Port Winnie me can help them get there. Please act. 01:40:19
The next comment is from Jeffrey Scarberry. 01:40:29
I was disappointed to learn that one of our council members is currently suing our chief of police. 01:40:32
In fact, that council members should have been sued herself a couple of years ago when she accused a CAC member by name. 01:40:37
From the dais of challenging flying the pride flag at City Hall. 01:40:45
Which was totally false. 01:40:48
She should have been reported and sanctioned for repeated Brown Act violations when she announced the results of items on the 01:40:50
agenda before any discussion, deliberation or public comments took place. 01:40:56
She is often rude and condescending towards residents, speaking during public comment as she rolls her eyes. 01:41:01
Make spaces or scrolls on her phone. 01:41:07
On many occasions she has been rude to her colleagues on the dais and has tried to undermine their effectiveness behind the scenes 01:41:09
in violation of Council policy. 01:41:13
She has been rude to our city manager and other staff members. 01:41:18
When her micromanaging attempts have been unsuccessful. 01:41:21
She has made some tone deaf. 01:41:25
In sensitive remarks directed at groups of people within our community. 01:41:27
While trying to serve her own patronizing self-interest. 01:41:31
It seems apparent that serving the best interests of Port Hueneme is not this Council members highest priority, as it should be. 01:41:34
As long as she is on the council creating drama, there will be good people in the community avoiding it. 01:41:41
The next comment is from Kim. 01:41:48
By Kunka Good evening mayor and council members Residents near Surfside Drive, Ventura and the Surfside Seafood lot are facing 01:41:50
nightly speeding doughnuts and late night loitering after the lot closes at 10:00 PM. 01:41:56
Police respond, but the activity simply shifts and returns. We respectfully request preventative measures such as closing the law 01:42:03
after hours with the barrier and adding speed bumps to restore safety and peace in our neighborhood. 01:42:09
We want to be part of the solution and help create a safe, welcoming neighborhood. 01:42:16
We respectfully ask for your support and action on this issue. Thank you. 01:42:20
That concludes public comment for general. 01:42:24
Great city manager. 01:42:27
Staff will respond to that last. 01:42:31
Comment about the. 01:42:33
Parking lots will respond directly to the resident and see what can be done. 01:42:35
But I just wanted to take a moment. I know we have a lot of speakers. I think the council knows this, but maybe for the benefit of 01:42:39
the speakers is there's a lot of requests for future agenda items and so the council. 01:42:44
Has a portion of the agenda at the end of the meeting to talk about whether to add future agenda items, but they can't talk about 01:42:49
it. 01:42:53
Now, because it's not on the agenda for now, so just to give everybody an expectation that although the Council can't. 01:42:58
Respond or get into a debate. They can consider future agenda items at the end of the meeting so. 01:43:05
Thank you. 01:43:10
Great. Thank you. 01:43:11
We're going to move on to the agenda approval. 01:43:12
May I have a motion and a second to approve the agenda? 01:43:15
Move to approve. 01:43:19
Great, Madam Clerk, all in favor. 01:43:21
Aye, all opposed. 01:43:23
Hearing none, motion passes unanimously. 01:43:25
Thank you. Do any members of the Council have a conflict of interest to disclose for any item on the agenda? 01:43:28
If not, we'll move on to our presentations. 01:43:37
Umm. For the first presentation, I'd like to welcome our Human Resource Risk Manager. 01:43:42
Frankly, to the podium. 01:43:47
This is a quarterly employee recognition and step in when you need to city manager. 01:43:48
Good evening, Mayor. Mayor Pro Tem. 01:43:56
City Council. 01:43:57
My name is, frankly, HR Risk Manager. 01:43:59
Each quarter when we look back, we try to recognize employees who had significant milestones with the city. 01:44:03
And looking back in the quarter we had. 01:44:10
Lynette Adams, who's currently a public safety dispatcher. 01:44:13
Who hit 25 years of service, which is pretty significant. 01:44:16
And given that. 01:44:20
We wanted to see if she was able to make. 01:44:21
Today's council meeting and unfortunately she was not so. 01:44:24
On her behalf, Chief Federico will be talking about her tenure. 01:44:27
The city. 01:44:31
Good evening everyone. I think the last time you remember that. 01:44:37
Lynette Adams. 01:44:41
Your public safety dispatcher was in front of you. She was receiving the Dispatcher of the Year. 01:44:42
This year earlier, and unfortunately she can't make it this night. 01:44:47
Why is that? She's been super busy lately and. 01:44:52
Flying out to see if you recalled she was talking about. 01:44:55
Excited that she had a grandbaby on the way and the grandbaby is here. 01:44:58
So she's had some very busy, busy days. 01:45:02
In the information questionnaire for the employees. 01:45:08
Lynette was asked. 01:45:11
What do you like best about working for the city of Portland? 01:45:12
And she said, I began my career with Fort Wayne Police Department at the age of 19. 01:45:16
During my time here, I have. 01:45:21
Made lifelong friends with coworkers and other employees throughout the city. 01:45:23
The family like environment I work in. 01:45:27
Is also a plus. 01:45:30
She was asked what is your favorite work moment thus far in your career in the city? 01:45:33
And she said. 01:45:38
My son Brandon. 01:45:39
Sharing the law enforcement experience with me and becoming a Police Explorer at the age of 14. 01:45:41
That is the new dad. 01:45:46
And she's super proud of not only her son. We're all part of Brandon. 01:45:48
Who is an active Marine? 01:45:52
And he and his wife just welcomed their first child, Which? 01:45:55
Lynette is super excited. 01:45:58
When that's become a valuable in our com center, she not only helps with. 01:46:01
Training all of our new folks. She's a very tenured trainer. 01:46:05
But everything from. 01:46:09
Policy and environment and stepping up whenever we need an extra body there so. 01:46:11
Your city staff is filled with great people like this and Lynette is just a. 01:46:17
One that has made at these 25 years and made the city and the department a much better place. 01:46:22
Thank you. 01:46:28
Great. Thank you, Chief. We do have a. 01:46:29
Certificate of recognition for her, but it needs to be signed by Councilmember Comma, so we'll hold on to it. 01:46:32
You got it. Thank you. 01:46:37
Thank you. 01:46:39
And I think you can come on back the introduction of the senior officer, Anthony Martinez. 01:46:45
And reserve officer. 01:46:51
Angel Ortiz. 01:46:52
OK, I'm getting my steps in after dinner. It's part of our Wellness program. 01:46:54
So first we're going to talk about senior officer promotion. 01:47:00
For Anthony Martinez. 01:47:04
Most know him as your first motor officer in years that came back. 01:47:08
So just to remind everybody what our senior officer position is, it's the first rank. 01:47:13
First step in. 01:47:19
The role of leadership for a sworn officer. 01:47:21
They are your your two stripe officers. 01:47:24
And they are chosen and selected, they test. 01:47:26
It's a very. 01:47:30
Serious testing process very involved, just as it would be for Sergeant. 01:47:32
And they are chosen based on their work experience, job knowledge, and leadership abilities. 01:47:36
Your senior officers act. 01:47:43
In the role of an acting Sergeant in the absence of a Sergeant. 01:47:45
They're your Ftos training new people and they handle projects. These are the folks that are your beat coordinators that you reach 01:47:49
out to when you have a specific problem in your neighborhood. 01:47:54
So that's why the. 01:48:00
The role is very important because it's. 01:48:01
Going to be the future leadership. 01:48:03
Of the department. 01:48:05
So with that. 01:48:07
During this testing process. 01:48:08
Anthony Martinez was selected and promoted. 01:48:09
Anthony graduated from. 01:48:13
The Rio Hondo Police Academy. 01:48:15
And began his career. 01:48:18
With the Montebello Police Department. 01:48:19
I love that we get people, we steal people from departments all the time. 01:48:22
Because. 01:48:26
It's a friendly city by the sea, but we have a beach and so many other great amenities. But the city and the department have a 01:48:27
great reputation. 01:48:30
So during his. 01:48:34
Four years here. 01:48:36
Anthony's. 01:48:38
Been recognized not once, but twice. 01:48:40
As the. 01:48:43
Matt Award, the DUI arrest award recipient, twice. 01:48:44
He served in multiple specialized roles, including Advanced Traffic Collision investigator. 01:48:48
Your motor traffic officer. 01:48:54
More recently, he's taken on the role of an Explorer Advisor. 01:48:56
And we've sent him to the last to explore academies as. 01:49:00
Lower tax staff in the Academy. 01:49:05
So kids as young as 14 have to look up. 01:49:09
To that mustache. 01:49:12
When he's walking the ranks and. 01:49:13
Trying to teach them to be disciplined and better young people. 01:49:16
So he's been a great. 01:49:21
Tax staff and we get great comments back from the explorers after the academies. They really appreciate and look up to him. 01:49:22
And he's been a failed training officer. 01:49:29
Because what is? 01:49:31
The important role the future of the department is having. 01:49:33
Good trainers to train our folks the right way. 01:49:36
Anthony's special grateful. 01:49:41
For the continued support of his family. 01:49:43
His son TJ, who I can hear over my shoulders. 01:49:45
Julie Martinez. 01:49:49
And his younger brother, Stephen Martinez, who serves as a firefighter in San Diego. 01:49:51
Ladies and gentlemen, present to you senior. 01:49:56
Police officer. 01:49:58
Anthony Martinez. 01:49:59
Well, thank you all for this opportunity. 01:50:09
Chief commander for. 01:50:12
Allow me to be a supervisor for the department. 01:50:13
All my support from officers in the back there, they've all helped me through my career. 01:50:17
My field training officers. 01:50:22
Lopez, senior Sergeant. Lopez junior. 01:50:24
And Sergeant Hamrick, they've all. 01:50:26
Gave me the tools to have the success to be. 01:50:28
Able to promote. 01:50:30
My traffic team, Sergeant Bates. 01:50:33
Henry Montalongo. They've all. 01:50:36
Been great role models for me and taking me into that traffic team gave me. 01:50:38
The knowledge that. 01:50:41
I'm applying today. 01:50:42
In the field for the Traffic Safety. 01:50:44
Also council mayor. 01:50:46
For giving me the opportunity. 01:50:48
Be a motor. 01:50:49
And keep the streets safe. 01:50:50
Also, you know a very special thanks to. 01:50:54
Julie for. 01:50:58
Through hard times and everything through the department. 01:51:01
I don't know if you know this but she's AUS Navy veteran. 01:51:04
And when it came to the Academy? 01:51:07
She taught me. 01:51:09
How to shine my boots? 01:51:10
How to March So it was. 01:51:13
There's they said you're going to Academy in two weeks. 01:51:15
Had to learn it real quick so I'm always thankful for her and her support and. 01:51:18
Obviously where our sign. 01:51:22
So thank you all for this opportunity and. 01:51:24
I'm looking forward to being a supervisor and providing. 01:51:27
Great, great. Do we have any? 01:51:30
Any comments? 01:51:33
So I have it on good authority. 01:51:37
That you are a great example of just hard work, dedication and just good old fashioned police work. 01:51:39
And I want to thank you for your dedication to the city of Port Hueneme. 01:51:46
I also heard that before you even became the Moto officer. 01:51:50
When you heard that the position was opening, you went out and got your bike license without even having ridden a motorcycle 01:51:53
before. 01:51:57
And you passed it. 01:52:00
Like right away. 01:52:02
So thank you for your dedication in that. 01:52:03
Community members love you. 01:52:06
I hear it all the time about the motor officer that they see. They love seeing you out there. 01:52:07
And your great visibility. 01:52:12
Your peers love you. 01:52:14
And are you're well respected in the department? So thank you for. 01:52:16
Your continued dedication and be safe out there. 01:52:19
Thank you. 01:52:22
Officer Martinez, it's been a joy watching you grow up. 01:52:26
And move up in this department. I remember when you first got hired. I remember being in dispatch where you were expecting your 01:52:30
first born. 01:52:34
And in meeting your wife, it's just been a pleasure watching you. 01:52:38
Promote up the ranks and congratulations, we're happy to have you here. 01:52:42
Thank you. 01:52:46
Congratulations on your promotion. 01:52:51
Seeing you driving up and down Ventura. 01:52:54
Blvd. 01:52:57
I always, I always know it's you. It's you know, I could see the stash, but. 01:52:59
Thank you for keeping our city safe. 01:53:04
And it was well deserved. 01:53:07
Thanks so much. 01:53:10
Yes, and I'll just say Ditto. Just congratulations on your promotion. I will say. 01:53:11
It's not driving, it's writing. 01:53:16
And so I also just want to say. 01:53:21
You know. 01:53:24
I think what we have. 01:53:25
Really, what's a great thing that we have in the city of Port Hueneme is that our police officers are approachable. 01:53:27
And um. 01:53:34
That you can tell that they care. 01:53:36
And so I just really appreciate just your personality when it comes to meeting people in the city, in our community. 01:53:38
And so just congratulations and, and to your to your wife, thank you for your service and your service to your husband and getting 01:53:46
those boots clean. 01:53:50
But just thank you very much for all that you do. 01:53:55
Thank you. 01:53:58
Thank you. 01:54:02
Want a photo? 01:54:02
Photo. 01:54:03
Yeah, come on. 01:54:11
What's my TJ? 01:54:13
Did you want to go down? 01:54:18
1/2. 01:54:31
OK, we're going to move to our third presentation. This is a Wine Amy Beach Festival recap. There's a I'm sorry, I'm sorry. 01:54:45
There's another person. 01:54:49
My apologies, we've been busy. 01:54:53
My apologies for multiplying like rabbits over in the Police Department. 01:54:55
So. 01:54:59
We've also added. 01:55:00
AI can't really say new reserve officer. I got to say he's new to the reserve officer position. 01:55:04
But this is going to be for reserve officer Angel Ortiz. 01:55:10
So reminder on our reserve officers, I started out as one. 01:55:14
Rick Perez, a lot of people that did entire careers in law enforcement careers here. We start out as reserve officers and we're 01:55:18
very young. 01:55:21
Volunteering our time. 01:55:25
Prior to becoming a full time police officer. 01:55:28
And that's what Angel has done. 01:55:30
He is. 01:55:32
He's budget neutral. 01:55:34
Right, that's one of my favorite words because he volunteers his time until that day he becomes a full time officer. 01:55:36
Angel, Angel. 01:55:44
Ortiz is 21 years old. 01:55:45
He was born in Oxnard and raised in the Oxnard Port Rainham area and he attended Santa Clara High School and he participated in 01:55:48
boxing. 01:55:52
Before starting his law enforcement career. 01:55:57
As a reserve officer. 01:56:00
He was an explorer for us. 01:56:01
For seven years. 01:56:03
He grew up here. 01:56:06
So he was a natural fit to step into the next role. 01:56:08
And why? That was because he had an opportunity last year to attend the Reserve Police Academy with the Los Angeles County 01:56:12
Sheriff's Department. 01:56:16
Although he was one of the youngest members of his class. 01:56:21
He performed. 01:56:24
Very well. 01:56:25
When I was down there. 01:56:27
Speaking to the staff. 01:56:28
They they. 01:56:30
Really praised his abilities and maturity. 01:56:32
For being somebody so young. 01:56:35
He successfully completed the Academy and began his journey as a reserve police officer here at Wynnum PD. 01:56:38
He's currently attending Auction our college and majoring in Communications. 01:56:44
He wants to further his career by becoming a full time officer here at Port Winding Me PD. 01:56:49
Outside of law enforcement in school. 01:56:55
He is an assistant coach for the Oxnard Panthers youth football. 01:56:58
And he likes spending time with his younger brother and family. 01:57:10
Ladies and gentlemen, Reserve Police officer. 01:57:14
Angel Ortiz. 01:57:16
So first, I want to thank Chief. 01:57:24
So thank you for giving me this opportunity, Chief. 01:57:27
Thank you so much. 01:57:29
Next, I want to thank my family. 01:57:30
And my girlfriend. 01:57:32
Thank you for being a. 01:57:34
Good support system to me. 01:57:36
It means a lot to me. 01:57:38
And. 01:57:40
Those kids right there, deal with them at least 5 to 6 * a week. 01:57:42
I want to say thank you for coming. 01:57:48
It means the world to me. Thank you, coach you. 01:57:49
Thank you. 01:57:52
My partner's. 01:57:54
Thank you. 01:57:57
I wanted to give a special thanks to UMM. 01:57:58
Officer Megan. 01:58:00
And where is he at? 01:58:02
Officer Taro. 01:58:03
Those are my FTO officers on. 01:58:05
Outside of law enforcement and. 01:58:09
In law enforcement, I want to thank them because. 01:58:11
They taught me what it's like to be a. 01:58:14
A very good officer. 01:58:16
So I want to thank them personally. Thank you guys. 01:58:17
Thank you. 01:58:22
We're going to have some comments, but I've been waiting this whole time for the connection of the football team, so thank you for 01:58:29
making the connection. 01:58:34
So the one thing. 01:58:44
Just remember about you and every time I see you is that. 01:58:46
Bright smile. 01:58:49
You are always smiling. You have so much joy that comes from you and I remember seeing you because my daughter is an explorer, so 01:58:51
I remember seeing you at all the events and you just. 01:58:55
Your life is on your face and you just enjoy whatever it is you're doing and I want to thank you. 01:59:00
For choosing Winimi, because you could have went anywhere. You could have went to Oxnard. 01:59:05
Could went to the bigger agencies. 01:59:09
So you chose Winimi So. 01:59:10
I appreciate you for that because we always need great cops and. 01:59:12
Being trained by our finest. 01:59:16
So thank you and I want to wish you well. 01:59:18
And be safe out there. 01:59:21
It's not easy being an officer. 01:59:22
And you're starting here, you're going to learn from. 01:59:24
The best that we have. 01:59:27
Before you make that change into a full time officer. 01:59:28
You're gonna learn everything you need to know. 01:59:31
And then you're going to be the greatest once you start. 01:59:33
So I wish you well. 01:59:36
So thank you. 01:59:37
Thank you. 01:59:38
Congratulations, Angel. It's so I. 01:59:45
I looked at yourself. 01:59:48
That guy used to be the explorer. Yeah, thank you so much for. 01:59:49
Choosing port wine Amy to be. 01:59:53
Place where you're gonna. 01:59:56
Move up, I think that's the only place for you to go is up through the ranks. So you know from reserve to reserve to. 01:59:57
Full time officer. 02:00:03
Umm, congratulations and keep up the Google work. 02:00:06
Thank you. 02:00:09
Congratulations. 02:00:17
I mean seven years as an explorer. 02:00:18
Now as a reserve police officer. 02:00:21
It talks your perseverance. 02:00:24
You know, sticking it through. 02:00:26
Seen seeing the course. 02:00:27
And uh. 02:00:30
That's you. 02:00:32
Right. And I could see why you have a big support system in the back and. 02:00:33
People love you. 02:00:38
So keep up the good work. 02:00:39
And keep our city safe. 02:00:41
And keep yourself safe as well, OK? We look forward to seeing you around the city. 02:00:43
Thank you. 02:00:47
Yeah. And I'll just say I'm so glad having you. 02:00:56
For you to pick us, I think that's great and I just look forward to seeing how you're going to progress. 02:00:58
In the Police Department and I hope it continues to be the Port Hueneme Police Department. So looking forward to seeing you on the 02:01:03
street. 02:01:07
All right, great. Thank you. You want let's get a photo. 02:01:10
Yeah. 02:01:21
Family, come on up. 02:01:22
123. 02:01:52
And can we just take? 02:01:56
Just one more if we can have the kids come up. 02:01:57
Yeah. 02:02:03
Come on over here. Come on that side. Yeah, yeah. 02:02:18
Yeah. 02:02:21
Oh. 02:02:26
OK. Thank you. 02:02:49
Let's bring them all up to City Hall. 02:02:55
Great. Now we're going to move to our third presentation, which is the Wine Amy Beach Festival recap. 02:03:08
And presentation of poster award winners can we get? 02:03:14
Here he comes. 02:03:17
Police support Service manager Frank Montalongo. 02:03:19
Good evening, Madam Mayor, Mayor Pro Tempest Council members. 02:03:23
So I'm going to give you a. 02:03:25
Quick brief update from this year's Beach Festival and the presentation for our poster contest winners. 02:03:27
So I just included some. 02:03:35
OK, perfect. So I included just some general photographs of the event from this year where this will be the second year. 02:04:09
City staff and the Police Explorers have taken over the festival and we're building up on it from last year. 02:04:14
So on the first slide, you'll see we have photos of Band 11 and OSA that performed on Sunday. 02:04:19
You have the photo on the lower. 02:04:24
Corner left hand corner. 02:04:26
With the red hot cholo Peppers, which is a big hit with the community I believe, and then just a general banner for the festival. 02:04:28
On top, you'll see an aerial photo of the layout of the festival area. 02:04:35
Where we again like last year instead of having. 02:04:39
Canopies in closing the festival. 02:04:42
Changes more to an open field concept for the festival. 02:04:44
With the umbrellas opening up the grass, you know area as well for the patrons. 02:04:47
I'm on the bottom with just another aerial photo of when. 02:04:51
The community was doing the lane dancing. 02:04:54
When the band was. 02:04:56
Playing and then there's another photo of another musician. 02:04:57
One of the big things we wanted for the festival was include the community or community programs. So on top you have the Danza 02:05:01
from Mary, Star of the Sea. They came out and performed Saturday morning. 02:05:06
On the bottom right hand corner, we had Winnie Me High School. Originally we had three high schools that were going to come, but 02:05:10
because it was summertime and. 02:05:13
Conflicts with their instructors when Amy was the only one that they would have come out. 02:05:16
To make it out to the festival and then we have a photo of the presentation I believe on. 02:05:20
To the region, I think of Anabola when we presented the Hero Award. 02:05:24
To her. 02:05:28
One of the other things we weren't incorporated, we did this year first was incorporating the Copacabana. 02:05:29
Which was a huge success in collaboration with our festival. So here you have photographs of the youth playing on the beach. Fun 02:05:34
fact, Lower Hand Corner is actually my son and his team playing there that weekend. So they were out there, they enjoyed it. 02:05:40
A lot of the participants from there, once the festival opened, came over, had lunch. 02:05:48
Gotta buy GE, listen to the music and then we're going back to the tournament cuz it ended until 5:00 in the afternoon and 02:05:53
feedback and talking to the coordinator from Copacabana. 02:05:57
They were really happy they didn't hear any complaints. One of the bigger concerns with the parking situation because of the 02:06:01
festival and the. 02:06:04
Soccer tournament. 02:06:08
But. 02:06:09
He had no complaints. We had the port parking at the port provided as well with the shuttling and it worked out for for both them 02:06:09
for both events. 02:06:13
Going back to the summary and the CAC feedback from last year. So we again building off of it. 02:06:18
One of the things that they wanted the engagement of nonprofit the Community group. So this year we came back. 02:06:23
Again, the high school band we included A5 additional nonprofit. 02:06:28
Informational. 02:06:31
Increased use of the beach. Again, we did the Copacabana soccer. 02:06:33
We wanted to do the beach wrestling, but like we mentioned, it got put on hold. 02:06:36
Because we had the youth wrestlers wrestling at the national championship and Fargo, so they weren't able to make out the event 02:06:40
this year. 02:06:43
The CSE wanted us to avoid conflicts with their pride events, VC fair, other VC activities so. 02:06:46
Again this year we moved it to July 12 and 13th was seen to workout. 02:06:52
Goes right before the Wine Amy Beach Festival and right after the Camarillo day, I mean. 02:06:55
Those before the Ventura County Fair. 02:07:00
And right after the Camarillo day, so. 02:07:02
We're like the largest regional event in that area during the festival. 02:07:04
Youth involvement, community focus and sports activities. Again Copacabana. 02:07:08
High school marching bands, All the police Explorers were there. 02:07:12
Our police explorers were there. Oxnard Police Department and the Santa Paula Police Force came on and hopped out for this event. 02:07:14
This year we also had the Danza from Mary Star the Sea. 02:07:19
Our regional draw to maximize attendance. So this year again, we won't the local radio stations, Spanish and English on stations. 02:07:24
We did mailers into all the water bills for the entire city of Waeneme this year. And then something that we tried was with the 02:07:30
help of our public works department, we incorporated a citywide banners. So we're hoping to build off of that next year with more 02:07:36
signage, getting it out sooner. So just to get the traffic we have people coming through the city. 02:07:42
For the event. 02:07:48
They wanted us to include. 02:07:50
Resources serving the community such as Interior County Agency. So again this year we had the Ventura County children and family. 02:07:52
Services were out here Ventura County health cannabis education. 02:07:58
We had the Ventura County Mobile Library. 02:08:01
Surfrider Foundation, the Clean Power Alliance, and the Liberty. 02:08:03
Military Housing Authority was out here as well to engage our community, our military families in our city. 02:08:07
And then? 02:08:12
Increase of event sponsorships. 02:08:13
We actually this year due to the economic climate, we actually had a loss in sponsorships. We had about $50,000 and loss of 02:08:16
sponsors that I'm didn't return because of what was going on with the economy. So. 02:08:21
But we continued on. 02:08:28
And so just a. 02:08:29
Brief overview of the finances SO. 02:08:31
Total expenses. And when I say total expenses, this is talking about the cost of the stage, the musicians, the restrooms, the. 02:08:33
How permits? 02:08:41
The rentals of the tables and chairs. 02:08:42
With the band so total came out to $104,220.08. The city contributed $35,000 and sponsors. We ended up with a 40,915. Some of that 02:08:44
didn't directly come to the city. For example Viper Security and Skunk Masters class repairing company. 02:08:53
They went ahead and made some commands for me the donation and paid the twenty $20,000 directly to Viper Security for the event 02:09:01
this year. 02:09:05
Then event carnival. 02:09:09
Donation The revenue from the carnival that was given to the city. 02:09:11
Was $14,000. Vendor fees collected was another 18, so surplus deficit based off of those fees. We ended up with the surplus this 02:09:14
year of $3798 given the fact that we lost so much in on sponsorships from last year. 02:09:21
That's just a quick overview of the finances. Now, one thing we still have left to do from the Beach Festival was the winner of 02:09:28
our poster contest. So. 02:09:32
Lujan Transportation once again was a sponsor for this event. 02:09:35
All the posters here of all the submittals are here in the Council chambers. 02:09:39
They'll stay on here for the next couple months. 02:09:42
So our first winner was elementary school winner for 4th grade from Sunkist Elementary, and I don't believe he's here. Just 02:09:44
correct. Joe Jones not in the audience, correct. 02:09:49
So Joe was unable to make it on today, but we will get in contact with him and get him a. 02:09:53
His his prize which Lujan Transport donated $350.00 to each of the winners to use for school supplies or whatever they need for 02:09:58
the school year. So this is Jill's poster which is actually behind you guys as well. 02:10:03
Our second elementary school winner was 1/4 grader as well from our Vista. 02:10:10
And that is going to be Juan Manuel Diaz if he is here, if he could come up. 02:10:14
And we actually have his photo here framed but. 02:10:23
Also to mention, our junior high winner is actually his sister from Ocean View Junior High and that is. 02:10:27
Aurelia Diaz, please come up. 02:10:34
So we actually have siblings who won this year. 02:10:36
So again, if these will be their. 02:10:42
And then we have one check for both you guys can give it to you. 02:10:58
So these were our winners for the two and then they call up. 02:11:01
And then our high school winner and she here in the audience. 02:11:08
Stephanie. 02:11:12
Come on up. So here we have Stephanie for one evening. High school 12th grader with our winner for the high school. 02:11:14
'Cause I learned if we want to get a photo with him really quick before perfect. 02:11:28
123. 02:12:23
So once again, thank you to everybody that participated in the. 02:12:36
Poster contest. 02:12:38
Can I say something? I want to give one more thank you to our sponsor for this series event against Skunk Masters, Clean Power 02:12:40
Alliance, Kona Big Wave Viper. 02:12:45
The Port 180 Poe actually sponsored the Danza and the high school marching band. 02:12:49
Lujan Transportation. Darwin Productions. 02:12:53
High Vacation Club until the brothers. All the sponsors on here will be on our website. 02:12:56
Up until next year's Umm Winnie Beach Festival when we replace them with the new sponsors. 02:13:00
So the one thing we do have for the recommendations for next year going forward, and we'll be coming back, is staff is 02:13:05
recommending that we have the festival again next year. 02:13:09
In July, I know we've had it in August, September and July. 02:13:14
From what we've seen is we think July works best because it's before the. 02:13:17
The Ventura County Fair so the dates would be the 11th and 12th and one of the big things too is it works out with the carnival 02:13:22
rights as well because they had to have their pre booking so it falls online and availability of what they have. 02:13:27
For the festival. 02:13:32
Any questions? 02:13:36
Can we can we do this really quick? 02:13:39
Any comments to the winners? 02:13:41
Congratulations. I can't believe you're so young. You have such great talent. 02:13:43
Keep it up. 02:13:47
I hope you go into art. 02:13:48
Yes, thank you very, very much for the great art that you submitted. I wanted to. 02:13:52
Ask Rich Rollins, who's our president of reach, to note that. 02:13:56
These are potential. 02:14:01
Designs for our utility boxes that we might be able to use them again. 02:14:03
All right, great minds think alike. 02:14:12
Yeah. Thank you so much. Congratulations. 02:14:14
Yeah, congratulations. 02:14:19
I actually saw. 02:14:21
The artwork on the banners. 02:14:22
And it was just. 02:14:24
Really good work. 02:14:26
And. 02:14:27
Brother and sister combo and then. 02:14:28
The high school. 02:14:31
Those are awesome. So really appreciate your guys's efforts on. 02:14:32
On this and. 02:14:37
Congratulations. I could see why you guys won. 02:14:38
Thanks. 02:14:40
Yes, I could say it, but I'd say the same thing. Great job. We had the. 02:14:42
Were these always right here, these pictures, Did they get moved after they won? No, they've been there since these have been here 02:14:47
and these are those have been the ones that we have looked at. 02:14:51
And we were talking about how wonderful that they were. 02:14:57
And so. 02:15:00
So yeah, so they're all right here together. 02:15:01
So thank you so much. The art is beautiful and so I'm glad that you all took the time to participate. 02:15:03
In the contest. 02:15:11
So that we have the. 02:15:14
Ability to sit in a room like we are today and we have been for over a month. 02:15:15
Looking at this beautiful art, so thank you so much. 02:15:20
Back up, back over to you. Something else? 02:15:25
Which is if you had any questions, reference the festival. 02:15:28
I don't have any questions. I just want to thank you for all the work that you've put in. I know over the last, this is the second 02:15:31
year, right, Second year that you know, the festival has been brought back in house and have been. 02:15:37
Hopefully something that you will continue with. 02:15:44
You've just done a great job, you've done a great job, and so just appreciate your work and your commitment. 02:15:47
To the city. 02:15:54
1st right to the city to actually take it on for us. 02:15:55
And then your commitment for the second year, you've just done a great job. So thank you for that. 02:15:59
And your team, yes. And your team without the help of our committee, which is Henry, want the longo, Veronica, want the longo, 02:16:03
Michelle Gutierrez. 02:16:07
Who am I missing? 02:16:12
Jose Coyote and IE Carter. 02:16:14
So and public where all the departments. It was a city collaboration as a whole, so we could have done it without everybody from 02:16:17
all city staff. 02:16:20
Great. Thank you. Appreciate that. 02:16:22
I do have a comment and a question. My first question is, I know it's been really difficult over the years and they've tried to do 02:16:24
it, gauge how many people actually attend. Were you able to get an idea? So we didn't with something mean the same as we're 02:16:30
discussing a party. We had to look at staffing, getting somebody to sit there to accurately count every day. 02:16:36
Two items where you could guess you could save. 02:16:42
Where you can maybe get account of weather like. 02:16:45
If there's an increase of attendances. 02:16:47
We had two revenue sources. 02:16:51
Carnival rides and beer sales. 02:16:52
So in Carnival rise in comparison from last year to this year, we were up 40%. 02:16:54
Pre sales were last year only about. 02:16:59
$3000 this year we had close to $9000 in pre sales to the carnival rights, so it being 40% increase. 02:17:01
It would lead to believe that we had more attendance or more activity in the carnival right area. 02:17:08
As far the beer sales, we had a 30% increase from last year. So with last year was about $30,000 in beer sales, this year was 02:17:12
around $43,000. So that as well was an increase. So those are the two items that we really have where we could measure of whether 02:17:18
we had more tents or people were spending more, but in talking to our vendors as well because most of them were all returning from 02:17:23
last year. 02:17:28
They said they did a lot better this year, that they were a lot busier, especially on the Saturday when we had Copacabana. 02:17:34
That there was a busier thing and they sold out of food because they had to get replenishments for the following day. 02:17:39
For it, OK. 02:17:45
Well, that's good. Good to know. My comment is thank you. I knew when this started and when this was in concept. 02:17:45
This was a huge undertaking that you weren't even sure if it was something you were. 02:17:52
Going to be able to do it was short notice, but you pulled it off and you guys do such a great job and so thank you for 02:17:56
undertaking this and like. 02:18:00
Mayor says we appreciate everything that you do. 02:18:04
Thank you. 02:18:07
Yeah, I want to echo that too. Thank you for juggling everything that you have to do outside of. 02:18:09
Preparing the Wine Amy Beach Festival. I know that there's you work really hard over there in the department and you have a lot of 02:18:14
other responsibilities. So thank you for the good work, you and your team. 02:18:19
And I had one question, Is this the first year that we've had? 02:18:25
Drone shots. 02:18:29
Of the festival knows now we've actually had a believe prior reach might have had drone shots in the past, so this was actually 02:18:30
taken by our. 02:18:34
By our drone unit with our Matrice drone. 02:18:39
Off to the side, which has a really high zoom capacity. 02:18:42
Yeah, it's great. Those are great shots. Thank you so much. 02:18:44
Mayor, can I say one thing? So for the audience, just to note. 02:18:47
Mr. Montalongo is also. 02:18:51
A full time employee at the Police Department. He handles our evidence and now he is now the supervisor for the non sworn. 02:18:54
Correct. And he also supervises our explorers and runs that program as well. So he has a lot of things he does. So he did a great 02:19:01
job with this in addition to everything else he does. 02:19:05
Thank you. 02:19:11
Well coordinated. 02:19:18
You can tell a lot of people are having fun. 02:19:20
The venues were good. 02:19:22
Red Hot solo Peppers. 02:19:25
We're a hit. 02:19:27
You know. 02:19:30
Sunday the Vonda probably 1 of. 02:19:31
Went well under. 02:19:34
Circumstance, you know, circumstances were in, but it was well attended. 02:19:35
Overall. 02:19:41
Super impressed. 02:19:43
My only my only question is like. 02:19:44
When in the planning stage do we give the port? 02:19:47
An opportunity to. 02:19:51
You know, maybe. 02:19:53
Put more effort. 02:19:56
In collaborating. 02:19:58
Empathy. Or I can. 02:20:01
Speak to that, I think. 02:20:03
I know you and I had talked about maybe like a. 02:20:05
Like some opportunities for the port to maybe sponsor like specific items. So that's something that we can go back and. 02:20:08
Talk to the port about this year and see if there's that interest in partnering. 02:20:16
If there's any interest, yeah. 02:20:21
Correct. Yeah. For example, last year the port actually sponsored the. 02:20:23
The banners that replace the side of the festival. 02:20:27
The poor sponsor those and the actually sponsored the wrestling tournament. They've made the purchase for all the medals. 02:20:29
For the for the tournament and we actually have enough. 02:20:34
For a couple years of medals going forward that the ports purchased. 02:20:37
And then lastly, the heroes. 02:20:41
I guess my only comment is during the hero's presentation. 02:20:43
You know, doing it so early in the morning. 02:20:47
There's not a lot of attendance, maybe kind of moving that. 02:20:49
Little little out of poker, essentially moving it to the afternoon for it. 02:20:52
Other than that. 02:20:58
It was fun. 02:20:59
I think the our residents had a good time, so thank you for. 02:21:01
Your your staff for everything you guys did, so I appreciate that. 02:21:04
Thank you. 02:21:08
All right. Nope. That's it. Thank you. All right, thank you so much. 02:21:11
OK, we're going to move on to the consent calendar. 02:21:19
And which will be enacted in one motion unless a council member has a request to remove an item for discussion. 02:21:23
I'm before you all jump in, I do have a couple of items I'd like to pull. 02:21:32
I'd like to pull item number 7. 02:21:37
And item number 14. I just have a question, unless you want me to just ask the question. 02:21:39
Yeah, let's go ahead and pull them. 02:21:46
We'll pull number 7 and #14. 02:21:48
Anyone else have anything to pull? 02:21:51
I had 14 as well. 14 OK anybody else? 02:21:53
OK. Anyone else? OK, is there a motion and a second to approve the other items? So move to approve all items aside from number 7 02:21:56
and 14? 02:22:00
Is there a second? 02:22:04
Great. Thank you, Madam Clerk. 02:22:05
All in favor. 02:22:07
Aye, all opposed. 02:22:08
Hearing none, motion passes unanimously. 02:22:09
OK. 02:22:12
Item number seven, I just had one question. 02:22:14
So in our report. 02:22:18
Court and in. 02:22:20
The. 02:22:23
Resolution it speaks of. 02:22:25
Just speaks of. 02:22:28
Items that are sold in. 02:22:30
The smoke shops. 02:22:33
The question is. 02:22:35
Do we know if they're being sold anywhere else? 02:22:36
That's a good question. 02:22:41
I don't have that information, but perhaps officer from hash that in. Come on out. 02:22:44
Hello. Hello. 02:22:50
The question whether it's being sold? 02:22:53
Yeah. So there's a reference in our reports to smoke shops and in of the actual resolution. But the question is? 02:22:56
Are they being sold anywhere else? 02:23:03
Not that I'm aware of. I know it's sold. 02:23:05
Potentially in small quantities in like Ralph's for legitimate purposes, OK, In regards to whipped cream chargers and things like 02:23:07
that, OK. 02:23:11
Starbucks hasn't for legitimate purposes, but not for sales to the community. Got it, Got it. And the question was only because if 02:23:15
we do a resolution. 02:23:19
Based on just the smoke shops and we find out there's somewhere else, then we have to come back. 02:23:24
Do it again So. 02:23:29
Got it. Got. 02:23:30
OK. So that's the only question I have. If there are no other questions, is there a motion and a second to approve item number 7? 02:23:31
So move. 02:23:38
2nd. 02:23:39
Madam Clerk, all in favor. 02:23:42
Aye, all opposed. 02:23:43
Hearing none, motion passes unanimously. 02:23:45
Great. We'll move to item number 14. 02:23:47
And that is thank you so much. We'll move to item 14 and that's the authorization of pre purchase of the 7000 gallon fiberglass 02:23:50
double walled and dual. 02:23:55
Compartment fuel tank. 02:24:00
And fixtures, accessories. 02:24:03
Did you, what's your question? You have questions? I did. 02:24:06
So this is just the cost of the tank. 02:24:09
But what's the real cost of the dig out? 02:24:12
To put back. 02:24:16
The total replacement. 02:24:17
We're currently in the process of. 02:24:19
Getting the RFP together to go that we're working with the consultant now that is in charge of helping us get. 02:24:21
All the permitting that's necessary prior. 02:24:27
To doing that, so then we'll be going out to bid. 02:24:30
For the removal. 02:24:32
And then? 02:24:33
To help with that. 02:24:35
Process speeding up because there's. 02:24:37
Long lead time in the ordering of the tank. 02:24:39
That's why we're coming to council to get authorization to do that first. 02:24:42
Because we're trying to minimize the downtime from removal of tank. 02:24:46
To receiving of the new one. 02:24:50
Because during that time, we're going to have to buy fuel off site. 02:24:52
Which will increase our. 02:24:56
Costs for having our fleet field. 02:24:59
So we're also working in conjunction with County RMA right now. 02:25:02
So. 02:25:06
They're seeing if we may have the ability to. 02:25:07
Also. 02:25:10
Leave the tank. 02:25:12
Out of service, drained, empty. 02:25:13
Disconnected. 02:25:16
But leave it in the ground, otherwise we may have to dig it out, remove it. 02:25:17
Burying it back all up again, then read it a hole that we just. 02:25:21
Did a few months beforehand so. 02:25:25
I'm waiting for word back. 02:25:27
From the RMA. 02:25:28
So do you have a like just the best? 02:25:30
Guess estimate on what it's going to cost. 02:25:32
We have no idea right now. We do know that a lot of agencies are in the same predicament of having to get. 02:25:34
Single walled tanks out of the ground. 02:25:41
Sometimes the. 02:25:46
Demand. 02:25:47
Might drive that price too so. 02:25:48
We have I believe $455,000 budgeted for this, so. 02:25:52
Speaking with our consultant, we're fairly confident that we're going to be able to get this all done. 02:25:58
With that amount of money that's already been budgeted. 02:26:03
My only. 02:26:06
I had spoke to the city manager. I did have concerns with, you know. 02:26:08
Whenever we. 02:26:11
We got to bury a tank. 02:26:12
Eventually has to come up. 02:26:14
And it's it's always easier. 02:26:15
For leakage purposes to. 02:26:18
Do you have an above ground tank? 02:26:21
One you can constantly keep your eye on. 02:26:23
You know the condition of. 02:26:26
The tank. 02:26:28
And there is no. 02:26:30
Burial of. 02:26:31
Of the tank and eventually it's going to have to come out. 02:26:33
This this fiberglass tank. 02:26:36
Is has a shelf life. 02:26:37
It does, and it's going to have to come back out at another. 02:26:39
Big cost. 02:26:43
So I was just. 02:26:45
Was did you look? Did you? 02:26:48
I know. 02:26:51
I know storage space. 02:26:52
Is you got to have space for it. 02:26:53
But was it thought of? 02:26:58
And was it considered rather than just? 02:27:00
Going with the status quo of. 02:27:02
Is called the tank. 02:27:04
That's going to be buried. 02:27:06
Obviously we have the ability to go with an ASD above ground storage tank. 02:27:07
Some of the obviously the our biggest concern is space. 02:27:12
If we went with a tank, that. 02:27:16
The size that we're. 02:27:18
Presuming to put underground. 02:27:20
Above ground. 02:27:21
We would. 02:27:22
Our current footprint is 5 feet wide by 20 feet long. 02:27:23
If we went with an above ground tank. 02:27:27
It would. 02:27:31
Increase to the width of it by three to four feet. 02:27:32
Long or wider, and about four to five feet longer. 02:27:36
And that's just for the tank itself. 02:27:40
Than the standards for putting in a. 02:27:42
Also has to involve. 02:27:46
Above ground secondary containment. 02:27:47
And then it has to be protected all the way around. 02:27:49
With bollard so nobody hits it. 02:27:52
Damages the tanks. 02:27:55
So we would lose even more space. 02:27:56
Looking at where our layout is, if. 02:27:58
Accounting for all of that. 02:28:01
We probably would have lost the ability to park right in front of our building. 02:28:03
So besides. 02:28:08
I've also checked with our designated operator who's the person that comes and does our monthly inspections and does our annual 02:28:10
inspections. 02:28:14
When the county is present. 02:28:18
I asked for. 02:28:20
His advice on what he felt about using an above ground storage tank and he said. 02:28:22
There are some advantages to it, but. 02:28:27
What you don't have is space, and that's what you need. 02:28:29
He said it'll be. 02:28:32
You'll be doing yourself a disservice if you try and do that. 02:28:34
Additionally, he let me know that. 02:28:39
We'd be going through a different permitting process. 02:28:42
With this we have the permit. 02:28:44
In place already, it will be new equipment, but it won't be a whole new. 02:28:46
Application process, so we'll have to go through. 02:28:49
And some additional plans if we went above ground that we'd have to do that we don't currently do because it's run through a 02:28:52
different agency. 02:28:55
Not the RMA if we go above ground. 02:28:59
And then? 02:29:02
He said that. 02:29:03
Because of our location, we probably have to get a special. 02:29:05
Anchoring system to account for if we ever had. 02:29:09
Flood or. 02:29:12
Tsunami stuff and. 02:29:14
Be something that would be required to be put in there so. 02:29:16
If we had an event like that, it wouldn't. 02:29:19
Float. 02:29:21
So we did look at it. 02:29:23
And then we also. 02:29:25
One other additional thing he did say. 02:29:26
An above ground tank would require a cover over the. 02:29:28
Whereas the underground tank doesn't and. 02:29:32
A structural cover over that is going to. 02:29:34
Be rather expensive as well, so. 02:29:38
We considered it. 02:29:40
But replacing what we have. 02:29:42
Especially with our space. 02:29:44
Lack of space. 02:29:46
We felt this was the best way to go. 02:29:48
Got it. Thanks. 02:29:50
Great. Thank you. And that was my question additional cost, so you answer that. 02:29:52
What is the life? 02:29:56
Of the tank. 02:29:58
They say anywhere from. 02:29:59
35 to 40 years in the fiberglass tank. 02:30:01
OK, great. Thank you. 02:30:04
Those are all my questions. There is no other question. Is there a motion in a second for #14? 02:30:06
Move to approve second. 02:30:11
All in favor. 02:30:15
Aye, all opposed. 02:30:16
Hearing none, motion passes unanimously. 02:30:18
Great. Thank you. 02:30:20
OK. We're going to move on to item number 16. 02:30:23
The introduction of an ordinance to amend Chapter 7 of Article 3 of the Port Winding Municipal Code for the purpose of adding 02:30:29
smoke restrictions, including a smoking. 02:30:34
Prohibition. 02:30:39
Within multi unit residential properties, Madam Clerk, do you have a proof of publication as required by law and a complete files? 02:30:40
Of reports and exhibits. 02:30:47
Yes, Madam Mayor. 02:30:49
Great. Will staff please present the report? 02:30:50
Good evening, Mayor, City Council. 02:30:56
Members of the public. 02:30:58
As you indicated in the introduction. 02:31:00
Item 17 is a public hearing to introduce an ordinance to amend Chapter 7 of Article 3 of the Port Hueneme Municipal Code. 02:31:02
The amendment would amend the city's existing smoking ordinance, most notably by adding. 02:31:09
A smoking prohibition within multi unit residences. 02:31:13
At the November 20th 2023 meeting, Council heard numerous public. 02:31:19
Speakers who articulated concerns. 02:31:24
About the negative impacts of secondhand smoke. 02:31:26
And specifically addressed concerns. 02:31:29
About the impacts. 02:31:31
To those living in multi unit housing. 02:31:32
These speakers requested the Council consider taking action to create a multi unit. 02:31:35
Smoking policy. 02:31:39
Council requested the item. 02:31:42
Be agendized for discussion at a future meeting. 02:31:43
And staff subsequently. 02:31:46
Returned with information about the city's smoking ordinance. 02:31:48
And a summary of more parks. 02:31:51
Municipal More parks multi unit housing smoking ordinance. 02:31:53
Staff also provided information about potential outreach efforts to gauge community feedback. 02:31:57
Pursuant to council direction, property owners and managers. 02:32:03
Were surveyed and the results were presented to the City Council in July of last year. 02:32:06
Council requested some additional research and at a subsequent meeting staff returned with additional information. 02:32:11
And a list of potential changes to the city smoking ordinance. 02:32:16
Council voted unanimously to direct. 02:32:20
Staff to prepare an ordinance that would prohibit smoking. 02:32:22
In multi unit. 02:32:25
Residential properties. 02:32:26
At its meeting on. 02:32:30
October 21st, 2024. 02:32:31
It gave that direction. 02:32:34
And included the directive to consider and incorporate questions and comments that were posed by the City Council at that time. 02:32:36
Those include. 02:32:42
The city's approach? 02:32:44
To the enforcement of the ordinance. 02:32:45
And with regard to that, consistent with the approach. 02:32:48
Of the other cities that were researched, the city's role with regard to enforcement is proposed to be limited. 02:32:51
In terms of. 02:32:56
Education. 02:32:57
If the city receives A complaint related to smoking and multi unit residences, information about the potential violation would be 02:32:59
forwarded to the alleged violator and the person legally responsible. 02:33:04
For the unit. 02:33:08
Property managers and owners will be responsible for taking action to investigate. 02:33:10
And enforce the ordinance. 02:33:14
The next item that was discussed was the cities obligation to enforce the ordinance. 02:33:17
And during that October meeting, the city attorney noted that the city has multiple government immunities. 02:33:22
And the lack of enforcement. 02:33:27
Would not likely generate liability for the city. 02:33:29
We also discussed ventilation systems. 02:33:34
Specific to units. 02:33:36
And then follow up to that discussion. 02:33:38
About the effectiveness of such units staff. 02:33:40
Communicated with the Public Health Law Center. 02:33:42
Which is an organization devoted to developing and defending laws that promote health and well-being. 02:33:45
The Center determined that such systems do not effectively prevent the dangers. 02:33:50
Of secondhand smoke. 02:33:54
And noted that research from the CDC. 02:33:55
And non-smokers Rights Foundation support that finding. 02:33:57
As such, the proposed ordinance does not. 02:34:01
Suggest. 02:34:03
A exemption for. 02:34:04
Such units. 02:34:06
There was also discussion about the application of the ordinance. 02:34:09
To rent it and owner occupied units. 02:34:12
So council discussion included an inquiry about whether or not the ordinance would apply. 02:34:16
In one or both of those situations. 02:34:20
Staff indicated that it was proposed. 02:34:23
That it would apply to all units regardless of rented or owned status. 02:34:25
Which is the case with many other municipal ordinances. 02:34:30
The ordinance definition as proposed. 02:34:33
Includes language makes it clear. 02:34:35
That it includes both owner occupied and rented units. 02:34:37
And then lastly there was a discussion about the definition of multi unit residences. 02:34:41
And during that discussion there was a question about its. 02:34:46
Applicability to townhomes. 02:34:49
And as such the definition. 02:34:51
That is proposed tonight. 02:34:53
Includes the word townhome to clarify that such residences. 02:34:54
Are included. 02:34:58
So to ensure public awareness and provide a timeline for landlords and property managers to take action. 02:35:03
That is required by the ordinance. 02:35:08
It is recommended that the prohibition have an effective date of October 1st, 2026. 02:35:10
In addition to using city social media channels and the newsletter. 02:35:15
Outreach efforts would include direct communications to the cities homeowners associations. 02:35:19
Ventura County Coastal Association of Realtors. 02:35:23
And registered owners of multi unit residential buildings in Port Hueneme. 02:35:26
The primary purpose of the proposed amendment to the city smoking ordinances is to prohibit smoking within. 02:35:34
Multi unit housing. 02:35:39
Including both individual units and common areas in order to. 02:35:40
Better protect residents. 02:35:43
From health risks of secondhand smoke. 02:35:45
However, the proposed amendment also includes updates that create a more comprehensive and modern smoking ordinance. 02:35:47
Collectively, the proposed changes are expected to improve the grade currently assigned to the City of Port Hueneme by the 02:35:53
American Lung Association in its State of Tobacco Control report. 02:35:58
The proposed ordinance amendment. 02:36:07
Adds and modifies various definitions and creates new regulations within multi unit residences. 02:36:09
I wanted to highlight two of the definitions, the first being the multi unit residence definition. 02:36:16
It's defined as a residential property containing 2 or more units, whether owner, occupied or rented. 02:36:21
Including but not limited to apartment buildings, condominium complexes, townhomes. 02:36:26
Senior and assisted living facilities. 02:36:31
Group homes and long term care facilities. 02:36:33
The following types of housing are specifically excluded from the definition. 02:36:36
Single family homes. 02:36:40
Detached or attached. 02:36:41
Dwelling units on property zoned for single family use. 02:36:43
And hotels and motels. 02:36:46
And the second definition that I wanted to highlight. 02:36:55
Is the term unit? 02:36:58
Which is defined as any personal dwelling space. 02:36:59
In a multi unit residence. 02:37:02
And shall include. 02:37:04
Associated exclusive use areas including but not limited to private balconies. 02:37:06
Porches or patios? 02:37:11
If adopted, the city's smoking ordinance would prohibit smoking in all units. 02:37:14
As well as common areas. 02:37:19
Of properties within multi unit residents. 02:37:20
It would, however, allow for the designation of smoking areas. 02:37:23
Subject to specific conditions. 02:37:26
Regulations would require that property owners and managers install signs. 02:37:29
Remove smoking amenities. 02:37:32
Investigate reported violations. 02:37:34
Issue notices of the ordinance. 02:37:37
And incorporate language into leases and sales. 02:37:39
Contracts. 02:37:42
The recommendation for the council is to open the public hearing and take testimonial documentary evidence. 02:37:46
Close the public hearing and consider the evidence. 02:37:51
Introduced for first reading by title only, waving further reading of the. 02:37:53
Ordinance. Uh. 02:37:57
Entitled An Ordinance of the City Council of the City of Port Hueneme, CA. 02:37:57
Amending Chapter 7 of Article 3, the Port Winnie Municipal Code for the purpose of adding smoking restrictions, including a 02:38:02
smoking prohibition within multi unit properties. 02:38:06
And take such additional related action as may be desirable. 02:38:11
Thank you, Mr. Perez, for your presentation. And I guess this was. 02:38:22
A long time coming since we started discussing this back in. 02:38:27
2023. 02:38:31
Umm, I was. 02:38:35
Curious is to know whether it included cannabis and I see here it does include cannabis. 02:38:36
And while I do a. 02:38:42
Not like smoke. 02:38:44
Nicotine, smoke and. 02:38:45
Around me and I have. 02:38:48
Problems sometimes with where I live with. 02:38:49
Cigar smoke. 02:38:53
Coming through my windows. 02:38:54
And nicotine smoke. Umm. 02:38:56
I don't have any issues with cannabis smoke. 02:38:58
Doesn't seem to be a problem. 02:39:01
But I'm just wondering if we're shooting ourselves in the foot. 02:39:02
Not allowing cannabis. 02:39:07
Because of what? 02:39:09
We've been, we've seen a decline in revenue. 02:39:11
Among our cannabis businesses. 02:39:13
And it just seems. 02:39:16
It just seems kind of hypocritical. 02:39:20
That we would. 02:39:23
Allow cannabis in our cities, but we don't allow cannabis to be used in private residences so. 02:39:24
That's just my general feeling. 02:39:30
My other question is, sorry, I didn't mean to make a comment there. 02:39:33
How much? 02:39:38
Outreach did we do to HOA's? 02:39:39
And to cannabis businesses. 02:39:43
Before. 02:39:46
Putting this report forward. 02:39:48
Did we alert them that this was going to be on tonight's agenda? 02:39:51
Did we alert? 02:39:54
Hoas and cannabis businesses that this is going to be discussed tonight. 02:39:55
I did send a notification earlier today. It was only maybe a couple hours before the meeting, but I did send a notification to. 02:40:02
HOA representatives that we have on file that it's on tonight. 02:40:11
We did not notify. 02:40:14
Cannabis businesses that it's on tonight. 02:40:16
So that's something that can be done. 02:40:20
And either. 02:40:23
I'm sorry, either in the future. 02:40:25
If this item is. 02:40:27
Comes back or it still needs to be. 02:40:29
Have a second reading as well, so there's options to do that. 02:40:32
All right. Thank you. 02:40:34
Is this time for comments or? 02:40:36
Questions. 02:40:37
OK. 02:40:38
You have a question. I do have a couple of questions, so. 02:40:40
I think this is one of the questions that I asked last time around. 02:40:45
I know we used Carpinteria. 02:40:48
Oh, high. 02:40:51
For the three cities, when we look at the geographical areas. 02:40:53
Are they, are we compared? You know, is there a comparison between us being that we? 02:40:57
Do they have the HOA, the number of HOA's and townhouses and apartments that we have here, are they more spread out? Is it apples 02:41:02
and apples? Are we looking at apples and oranges as it relates to the three cities that we looked at? 02:41:09
Yeah. I can tell you specifically with More Park, they were dissimilar in that they had I think a total of seven apartment 02:41:18
complexes. So their situation was a little bit different in terms of the number of. 02:41:24
Multi unit residential buildings. 02:41:31
I'm sure James can fill us in on the comparability with Ohio. Yeah, well, I would say more parking Carpenteria I. 02:41:35
Well, Moorpark doesn't have cannabis and Carpinteria I don't believe has cannabis, last I had heard. So there's another 02:41:42
distinction between but. 02:41:46
I would just note. 02:41:50
And just as a reminder on. 02:41:51
How we got here? 02:41:54
We didn't bring this forward. 02:41:55
Because we looked at Ohio, more parking, carpentry, yeah, I think was the future leaders of America brought it forward and said. 02:41:57
These three cities have done it so. 02:42:03
Port Hueneme should do it. 02:42:05
But umm. 02:42:07
You know, I will always be the first to say just because every city around us doesn't do something means doesn't mean it's a great 02:42:08
idea or the right idea for us so. 02:42:12
So we didn't propose that we were similar to those it was. 02:42:16
Those were the three that were given to us as samples. Yeah. So I'm just going to say. 02:42:21
No, that's a comment. I'll save my comment. Any other questions? 02:42:27
Any other questions? 02:42:30
OK. 02:42:32
Any public comments? 02:42:34
Yes, first will be Luis Mendez, followed by Stephen Claire. 02:42:35
Hello Council members again. 02:42:45
City Manager Res. 02:42:46
I'm here because I spoke on this the last time it was brought up. 02:42:49
I kind of feel like this is being. 02:42:52
Put up as a resolution to be passed like the. 02:42:54
Free Energy Alliance was before you guys went out to the public and figured out what was going on, so I feel like. 02:42:57
You guys are doing things backwards. 02:43:01
One this was brought up by a group Florida, who I was a member of back. 02:43:03
In 92 when I was in high school. So there's nothing against them, but I've always been a proponent. 02:43:07
A proponent of government telling. 02:43:11
Homeowners what they can and cannot do. 02:43:12
I'm a resident here but I live in the single family residence so I'm not affected by this. 02:43:15
But at the same time, like Laura said. 02:43:19
We sell cannabis. 02:43:21
In the city we sell tobacco. 02:43:23
In the city. 02:43:25
How are you gonna tell people that they cannot smoke? 02:43:25
Either one. 02:43:28
In their own home. 02:43:29
That's kind of ridiculous. 02:43:30
I think umm uh. 02:43:31
Also, you know what are the potential effects when it comes to selling or the sale or resale of homes? 02:43:33
You know, because I think you mentioned there's got to be restrictions, you know, in leases. Does that go along with home sales as 02:43:38
well? 02:43:41
You know, those are big things. 02:43:44
That sales taxes, you guys get sales revenue. 02:43:47
As the city as part of the budget. 02:43:49
I think. 02:43:50
Once again, I'm opposed to this resolution. I don't think adults or the government should be telling people what they should do or 02:43:52
can or cannot do. 02:43:54
In their own home when they sell it around the corner. 02:43:57
Or they approve the sale of it. 02:44:00
So that's my opinion. Thank you. 02:44:01
Thank you. 02:44:03
Mayor, Mayor Pro Tem, City Council. 02:44:11
I appreciate and I'm glad that this ordinance has come before you for a first reading. 02:44:13
It's really gonna help. 02:44:19
The city of Port Hueneme catch up with its neighbors. 02:44:20
I do think the question of cannabis use should be looked at further between now and the second reading. 02:44:24
Well, I believe over 40% of the residents in Ventura County, excuse me, in Port Hueneme. 02:44:30
Reside in a dwelling that would be covered by this ordinance. 02:44:35
Many of those individuals or our working class. 02:44:39
Our retirees. 02:44:42
Those on the lower end of our income brackets, middle and middle income families. 02:44:44
We're kind of unique in Ventura County and just the sheer amount. 02:44:50
Of multi dwelling. 02:44:53
Multi unit unit. 02:44:54
Households, excuse me, residences that are covered by this ordinance covering the income bracket. 02:44:55
I'm concerned that this includes cannabis. 02:45:01
Usage without. 02:45:05
Really a larger conversation around that because. 02:45:06
Unlike smoking that you can do in public. 02:45:09
Cannabis is literally only permitted. 02:45:11
Really to be consumed. 02:45:13
And non public Prairie places. So essentially 40% of the population will not have a location where they can lead legally consume 02:45:15
cannabis. 02:45:19
I'm concerned that that's going to disproportionately impact our renters and disproportionately impact. 02:45:24
Those lower in the income. 02:45:29
Bracket and communities of color, possibly putting them at risk. 02:45:32
With their property management companies to impose fines or whatever their remediations that are included in the ordinance. 02:45:36
So that's an unintentional consequence and something that is. 02:45:44
Distinctive between cannabis usage and tobacco usage. 02:45:47
I urge you to look at that between now and the second reading. 02:45:51
And figure out. 02:45:55
Are we going to create no space for this 40%? 02:45:55
Of the population to participate. 02:45:59
And an industry that has been a benefit to this city. 02:46:02
And have them risk. 02:46:06
Being penalized under the ordinance because of it. 02:46:07
When I believe the the core mission is really to reduce harm, and that harm largely comes. 02:46:10
Primarily from tobacco use. 02:46:15
As well. 02:46:17
And cannabis maybe can be subsidized. Maybe you do tobacco use. 02:46:18
And have an education campaign around the impact of cannabis smoke exposure as well. 02:46:21
Some kind of balance there. Thank you, counsel. Thank you. 02:46:27
We have 1 written public comment. 02:46:31
Dear City Council members, I am the owner of 936 Lighthouse Way in the Surfside Three complex. I'm highly opposed to the pending 02:46:33
ordinance that says I cannot do as I wish within the walls of my home. 02:46:39
Or to tell my renter what they can or cannot do within. 02:46:46
The walls of their home. 02:46:50
This ordinance is a direct attack on my our civil liberties. 02:46:51
I commend the City of Port Hueneme for being a front runner in the support of the cannabis industry. 02:46:56
And yet the city is going to tell me I can't sit and watch TV in my home and smoke a joint. 02:47:01
How does that make sense? 02:47:06
Also, the Surfside Three HOA already has designated smoking areas around the complex. 02:47:08
There are already stricter rules on where smoking is allowed. 02:47:14
The occupants cannot smoke anywhere outside or close to the individual units as is. 02:47:17
Now the city wants to tell me what I can or cannot do inside my home. 02:47:23
This is just too much oversight on the city's part. 02:47:27
I love where I live. I pay my taxes without complaint. I support local businesses. Please do not invade my private space, Bill 02:47:30
Brayton. 02:47:34
And that concludes public comment. 02:47:38
Great. Thank you. And I failed to say open public hearing. So we've just had our public comment. So I'll now close the public 02:47:40
hearing. 02:47:44
And so I'll go back to Council. 02:47:49
Any comments? 02:47:53
Yes, so I am. 02:47:54
Off ways for less government intrusion into people's rights. 02:47:56
But I wish we would have thought about this because this was unanimously voted on. 02:48:00
Umm, even though the marijuana thing was brought up so before staff. 02:48:06
Jumped into this and did all the work on it. 02:48:09
I wish we would have had this conversation then so they would not have put the effort. 02:48:11
Into doing all the work. 02:48:15
You know, us having to backtrack. 02:48:17
Because I think I don't how is this going to look? We've we've banning smoke in one area and allowing for smoke in another. 02:48:20
I mean, can we really do that without causing another issue? 02:48:26
It's going to be brought up. 02:48:28
So. 02:48:30
I was hoping that this would be an informational. 02:48:32
Thing coming back to us, taking a look at what we can do, what options are out there. 02:48:34
Since the last time we did this, we didn't really have a lot to go on as to what the other cities were doing. 02:48:39
I wished staff would not have put a lot of work into it. I hate when they waste their time and. 02:48:46
And and. 02:48:50
Put effort into something that we're going to backtrack on and possibly. 02:48:52
Go a different way. So I appreciate the work that staff put into this, but. 02:48:56
Yeah. Thank you. We're going to help with that as we move forward. But I agree, I think our. 02:49:00
We ask that it be put on the agenda without. 02:49:06
Really identifying what we expected of that. But what I will say is yes, I think the IT received a unanimous vote. I also will say 02:49:10
I believe that was for we wanted to know more not we were in favor or not. 02:49:16
So any other comments? Do you have any comments? Yeah, I just, I just wanted to add to my comments that I made earlier. 02:49:24
I just had my best friend. 02:49:31
Move in with me about a month ago and he was, he moved in with me because he was living out of the country and he was diagnosed 02:49:33
with multiple myeloma. 02:49:38
Which is others no cure. 02:49:43
Marijuana is one of the things that helps with nausea when you go through chemotherapy. 02:49:48
It's it's recommended that. 02:49:55
Patients use marijuana whether they smoke it or. 02:49:58
Ingest it through tinctures or. 02:50:02
Or gummies or whatever. 02:50:06
It's there to help them relieve them of the nausea that they that they. 02:50:08
That results from their chemotherapy and so. 02:50:13
This is this is near and dear to my heart and I just wonder, you know, if. 02:50:15
I don't even know if I can, if I want to say, you know, let's eliminate. 02:50:21
Cannabis from this. 02:50:24
Ordinance and leave cigarette smoke there because there's still the issue of. 02:50:26
Of civil rights and privacy so. 02:50:31
I just wanted to make that comment that. 02:50:33
Those are my concerns. 02:50:35
You have any comments? 02:50:37
Yeah. 02:50:39
I remember sitting out. 02:50:40
There on the in the council chambers as a. 02:50:42
Resident listening to this ordinance. 02:50:46
You know the. 02:50:50
First public hearing. 02:50:50
And. 02:50:53
I had a kind of hard time. 02:50:54
Grasping this but. 02:50:56
You know, thinking about. 02:50:58
Where the support is coming from? 02:51:00
You know. 02:51:03
Property owners. 02:51:04
Of these apartment buildings or multi. 02:51:06
You they actually want this? 02:51:08
And so. 02:51:12
It helps them. 02:51:13
You know, you know, cleaning up their residents. When, when? 02:51:17
When someone vacates and. 02:51:20
You know, having to take all the. 02:51:22
The smell out of the apartment buildings. 02:51:24
But on the other hand too. 02:51:27
At what point are we taking? 02:51:30
You know, civil rights. 02:51:32
Away from people. 02:51:34
And the comments are right on. 02:51:36
Cannabis is supposed to be consumed at home. 02:51:40
There's really no other place for it. 02:51:42
So you know. 02:51:45
We're going to have to kind of. 02:51:46
We're going to have to maneuver that. 02:51:48
A little bit. 02:51:51
Is my thought. 02:51:52
And I want to know what the public thinks. 02:51:53
What? Uh. 02:51:56
Do we really want to just ban tobacco use from. 02:51:57
From multi. 02:52:01
Multi unit residential areas and and. 02:52:03
Just skip cannabis but. 02:52:06
Again. 02:52:08
We're showing preference. 02:52:09
This one's going to be kind of. 02:52:14
It's kind of hard to maneuver on this. 02:52:16
And I want, I want the public to weigh in. 02:52:18
On our next reading. 02:52:21
Thank you. 02:52:23
Yeah. So thank you for what you all have said so. 02:52:25
I'm having flashbacks at the last conversation and going back to. 02:52:29
What I just asked about. 02:52:33
Percentage of multi use. 02:52:36
A multi family. 02:52:38
Properties versus single family homes. 02:52:40
And I did an exercise today. 02:52:43
I don't smoke, so it's not about it's not about me having my liberty to do so in my home. 02:52:46
But I didn't exercise today so I thought about my community. So I said OK if I walk out of my front door. 02:52:54
About 15 feet out is the halfway point to my neighbors. 02:53:00
Residents. 02:53:05
So I can't go to my front yard. 02:53:06
The back where? 02:53:09
Most people enter their homes is at the garage. 02:53:11
We have a pathway. 02:53:13
Between houses so I can't go out there. 02:53:15
My garage is about. 02:53:18
Maybe 10 or 12 feet. 02:53:22
And my neighbor is on the other side so I can't go to my alleyway. 02:53:23
I can't go out. 02:53:28
By my jacuzzi, because that's common. 02:53:29
And I can't go. 02:53:32
Out to where I go park my car. 02:53:33
So literally I would have to walk down the street. 02:53:36
Wheelhouse or go on seaside. 02:53:39
The outer edges. 02:53:42
My complex. 02:53:44
And so I just, I have, I struggle and and I would imagine that maybe other places too in the city. 02:53:46
And so. 02:53:53
I can't imagine telling and I hear you about the. 02:53:54
I think your comment about. 02:53:58
Folks cleaning up houses and people moving in, I think that's the renter side. 02:54:00
Right, I'm talking about owner. 02:54:04
When you're the owners actually live in the house, right? 02:54:06
And uh. 02:54:09
And they have to. 02:54:10
Leave their neighborhoods or their residential area. 02:54:12
To have a cigarette. 02:54:15
That's that's hard for me to. 02:54:17
To. 02:54:19
To say yes. 02:54:22
And so. 02:54:23
It's just hard for me to say yes to. 02:54:26
And. 02:54:28
And I know people around here pay a lot of money. 02:54:31
To live in city of Port Hueneme. 02:54:33
By the beach or anywhere else? 02:54:35
I don't want to tell you how much house is causing my area. 02:54:37
But I don't know if I can tell someone that just paid. 02:54:40
6 seven $800,000 that now you can't smoke in your house, you have to go to some other neighborhood. That's just hard for me to. 02:54:44
To just to think about. 02:54:50
So that's where I that's kind of my thought. 02:54:53
So I have no other comments. Anyone else have any comments? 02:54:55
You know air filters, HEPA filters are. 02:54:59
You know, an option. 02:55:02
Yeah. And that's what we have throughout. 02:55:04
You know our place right now. 02:55:06
Just to keep the air clean. 02:55:08
For medical purposes. 02:55:10
I, you know, it's hard, it's really hard. Any other comments? 02:55:14
OK, so this is the first reading by title only, waving further readings of the ordinance entitled and Ordinance of the City 02:55:20
Council of the City of Port Hueneme, CA amending Chapter 7 of Article 3 of Port Winding Municipal Code for the purpose of adding 02:55:26
smoking restrictions. 02:55:32
Including a smoking prohibition. 02:55:38
With multi unit properties and take such actions related. 02:55:41
Additional related actions that may be. 02:55:47
Desirable. 02:55:50
Anyone have any any? 02:55:52
Any desirable? 02:55:54
City Manager. 02:55:56
Yeah, I was just going to note. 02:55:57
Of course. 02:56:00
Council doesn't have to introduce the ordinance if not desired at this time if there's additional. 02:56:02
Information requested. 02:56:08
An action can just be asking for additional information and returning to council with that. 02:56:11
Yes. Well, I'd like to recommend that we do further outreach. 02:56:15
More outreach to our. 02:56:20
HOA's and to the cannabis businesses to. 02:56:23
To the public in general. 02:56:26
Umm, so that they can. 02:56:29
So they have an opportunity to weigh in. 02:56:30
I think we need more public input. 02:56:33
OK. Can I ask a question? Have we done that? 02:56:35
City Manager. 02:56:39
And I'm gonna ask Charles to correct me if I'm right. I think in 2023 we did a survey of property owners and property managers 02:56:41
early 2024. And that survey included outreach to the HOA's. 02:56:48
Early 2024. Early 2024. 02:56:55
And the results of that? 02:56:58
The results of that were presented to Council, I believe, in July of 2024. 02:57:00
Which is where he's, which is where he's getting his info that property managers were for it. 02:57:04
OK. Yeah. At that time we had received, I think, all but one. OK. OK. All right. Yeah, yeah. And I remember that now and I 02:57:09
remember asking the question. 02:57:14
When you say property managers responded. 02:57:19
How many property managers or how many residents are we talking about? 02:57:22
We contacted all property managers and owners that are registered with our Community Development department. 02:57:29
I don't remember how many that was in total response was. 02:57:37
As is usually, the response of the survey was significantly less than the total number of people that we contacted. 02:57:41
I think we had about 9 or 10 responses and all but. 02:57:47
One were supportive of the ordinance, OK. 02:57:50
That doesn't sound like enough to me. 02:57:53
You're talking about individual people. 02:57:56
Individual people representing. 02:57:59
Either associations or multi unit buildings, yes. OK, so I would even go further than that. 02:58:01
What was the authority of those 9 or 10 people? 02:58:07
Did they have an action to go and reach out and touch? 02:58:10
So many and they responded with the numbers that they collected from their. 02:58:14
HOA. 02:58:19
Are you talking about? 02:58:20
The HR HOA representative there were 9. 02:58:22
Or ten of them that said. 02:58:26
Yeah, we, yeah. 02:58:27
We agree. 02:58:29
The latter, yeah, the representative spoke. We did not prescribe. 02:58:30
The outreach that they needed to do, we just asked based on their understanding of the. 02:58:34
Tenants or residents? 02:58:39
Whether they already had existing regulations or what their response was about a proposed prohibition. 02:58:41
OK, I guess the question I'm trying to get to is. 02:58:48
Was there? 02:58:52
Was there something that? 02:58:53
I did that HOA. 02:58:56
Point of contact a representative? Did they do a survey of their HOA members? 02:58:59
And they responded based on. 02:59:07
Some survey numbers that they received or. 02:59:09
We don't know that, we just know that 9 or 10 people said. 02:59:12
Yeah, we want it. 02:59:16
Correct the latter. 02:59:17
So I don't think that's good enough. 02:59:18
For us to make a decision at this level. 02:59:20
OK, great. In any other comments? 02:59:23
And what is the? 02:59:26
Go ahead. I would just say that. 02:59:27
I probably have a good understanding of what property managers and HOA's are going to say. 02:59:29
Because most of them are probably going to want no smoking in their. 02:59:34
Property in their homes. 02:59:37
Because. 02:59:39
The wear and tear that smoking puts on. 02:59:40
Walls and such. 02:59:42
Have a good understanding of that. 02:59:44
I think it's more of individuals that own their own house. 02:59:45
Yeah, are the most important part of this. 02:59:50
So yeah, how do we reach those people? 02:59:52
Most of them are going to say. 02:59:55
Though don't tell me what I can do in my property. 02:59:57
Right. OK. So is there any other action that we would like? 03:00:00
The staff to move forward with any specific. 03:00:05
Actions. 03:00:09
That we think that we need to know before we. 03:00:10
Want to? 03:00:14
Take a motion and vote on this item. 03:00:16
Be specific though. 03:00:19
I think we need. 03:00:21
A good understanding of. 03:00:23
Of our multi. 03:00:26
Multi unit. 03:00:30
Residents what what their feelings are. 03:00:32
Because it's almost like they're work. 03:00:36
We're not asking them. We're asking the owners of these complex or the HOA or the HOA. 03:00:39
So it would be good to. 03:00:45
To get a survey. 03:00:47
From from our community. 03:00:49
OK. That are that are affected. 03:00:54
I had another question. Do we know what? 03:00:56
Hoas currently. 03:00:59
Umm have in place. 03:01:02
Do we know that from the surveys? What Hoas have smoking or smoking? 03:01:05
Regulations already in place. 03:01:10
Those that responded, we do have that information. That was one of the questions asked on the survey. 03:01:12
And I understand we currently have a smoking ordinance. 03:01:19
Do we? The city currently has a smoking ordinance does not. 03:01:24
Prohibit smoking. 03:01:27
In units and multi unit housing. 03:01:28
So. 03:01:36
Do we want another survey? 03:01:37
Do we want a more in depth survey? 03:01:41
Do we want more public outreach? 03:01:44
Yeah. So I think one of the things that we know for sure. 03:01:47
That most people. 03:01:52
Don't come in this room and hear us talking about this topic. 03:01:54
And you know, we hear those that speak the loudest. 03:01:58
Get mostly get what they want because if they don't speak then we just don't do anything right? 03:02:02
And so I think that I'm with. 03:02:07
Mayor Pro Tem is that we have to hear from the people. 03:02:10
And even if we don't hear from the people. 03:02:13
We have to hear, even if we hear through the. 03:02:16
The HOA needs to. 03:02:18
Give U.S. data based on the people. 03:02:20
Right. And so I don't think we can. I don't think we can decide. 03:02:23
And you know what? Does anybody know you may know? 03:02:27
What is? 03:02:30
What is? 03:02:31
And I kind of asked this before. 03:02:32
The population of the residents. 03:02:35
The properties that we have here. 03:02:38
Do we know what the I think? 03:02:40
City manager may have. 03:02:43
Said something I may have just thought I heard it. 03:02:44
What is the percentage single family homes versus multi? 03:02:47
Family. 03:02:52
I do not have that information. 03:02:56
I think we did. 03:02:58
Report on that at some point. 03:02:59
Recently with another item and it's it's significant we have a larger. 03:03:01
A share of multi unit housing than probably most of our neighboring cities, yeah. 03:03:05
And so the decision we make is going to impact most of our most of our community. So we have to be really sure. I was looking at 03:03:10
a. 03:03:14
A housing type. 03:03:18
Survey results that had Port Hueneme and SCAG on it. 03:03:21
And on this is from 2023 though, so I'm sure we haven't had that much growth. 03:03:26
And as far as buildings built just ad use, pretty much yes. Single family detached homes. 03:03:30
32.4%. 03:03:36
32.4%. 03:03:38
Single family attached. 03:03:40
Is 28.6. 03:03:43
Multifamily. 03:03:45
2 to 4 units. 03:03:47
11.6. 03:03:48
Multifamily 5 plus units. 03:03:50
27.2%. 03:03:53
And a list of motor homes at. 03:03:56
.1%. 03:03:59
But that's a that's a huge part. 03:04:00
That's over. 03:04:03
That's over 60%. 03:04:05
That's either attached homes 2 to 4 units, 5 plus units. 03:04:08
And so that's a large, I think, I think we have to. 03:04:14
Get some more data. 03:04:19
Before we can. 03:04:20
Make decisions that impact 60% or around there. 03:04:22
Of our community. 03:04:24
Yeah. And I think the last time around the idea was to. 03:04:27
Focus it on. 03:04:31
Those that would be. 03:04:32
Potentially enforcing. 03:04:34
The requirements, I think that was the. 03:04:36
The target before SO. 03:04:38
So we can essentially reuse that survey and just target it towards. 03:04:41
The individuals would be impacted and get their. 03:04:46
Their feedback? It might be a different opinion. 03:04:49
Yeah. OK, so I hear we want to. 03:04:51
Gather more data in some type of survey. 03:04:54
Staff, can you help us to understand what something like that would look like? 03:04:57
And then? 03:05:02
We can go forward. 03:05:03
Based on what? 03:05:05
What options that we have? 03:05:07
Yeah, I think it would be similar to. 03:05:10
What we've done. 03:05:12
Just focusing it on. 03:05:13
The user and or the resident end rather than the property manager. And so you know, we have a survey we've already prepared, we 03:05:16
can utilize that. 03:05:20
The other thing I would say is since 2023, we've really. 03:05:24
Built up our. 03:05:28
Social media and our ways of getting that information out where I think in prior surveys. 03:05:30
In 2023, when we first started doing surveys, we'd get maybe a dozen responses or a couple dozen responses and. 03:05:36
As we'll hear on the one of the next couple of items, the survey we just did more recently had over 200 responses, so. 03:05:43
The reach is is greater than it used to be as well. 03:05:49
Yeah. So that can be done relatively and I'm just talking so you all, you all could absolutely jump in. The other thing would be. 03:05:53
How many? How many survey? I mean, how many? 03:05:59
How many respondents? 03:06:04
Do we need to hear from to say? 03:06:05
This is a good population of people to be able to make a decision. I don't know what that number is. 03:06:07
Yeah. So do we need to take a vote or anything about the survey or we need to give direction? Yeah, I would say. 03:06:13
If the motion would be to. 03:06:22
Proceed with the survey focused on. 03:06:25
The residents. 03:06:29
And those impacted? 03:06:30
And I think I also heard and you know, in addition to everybody else, but make sure we're hearing from that voice. 03:06:32
Then that would be an appropriate motion rather than introducing the ordinance. 03:06:39
Great. 03:06:44
Thank you. 03:06:44
I think we need to. 03:06:45
In that survey. 03:06:47
Also. 03:06:49
Talk about cannabis. 03:06:50
Yeah. 03:06:52
Yeah. So I was just looking at the, if I may. 03:06:54
Mayor looking at our. 03:06:57
General plan. The housing element. 03:07:00
And we have. 03:07:02
Broken down. 03:07:03
Multifamily units 2 to 4 units, multifamily units 5 plus units and then single family attached. 03:07:04
And if you add those up. 03:07:11
That's almost 70%. 03:07:12
Of our. 03:07:14
Of our housing units. 03:07:17
In Port Hueneme. 03:07:18
So yeah. 03:07:20
You're right about. 03:07:21
Yeah, OK. 03:07:22
You were really close. 03:07:23
Move to approve staff. 03:07:26
To introduce a survey. 03:07:28
Specifically to. 03:07:30
Homeowners. 03:07:32
Of multi units. 03:07:33
And residents. 03:07:36
And include cannabis cannabis. 03:07:39
Is there a second? 03:07:43
A second. 03:07:44
Madam Clerk. 03:07:45
World. 03:07:47
Councilmember Hernandez. 03:07:48
Yes, Councilmember Perez. Yes, Mayor Pro Tem Lopez. Yes, Mayor McQueen Le Jean. 03:07:50
Yes. Motion passes unanimously with Councilmember Gama absent. 03:07:54
Great. Can we? Is everybody OK with taking a 5 minute restroom? 03:07:58
Great. Thank you. 03:08:03
We'll be back in 5 minutes. 03:08:05
Got it on video. 03:17:31
OK. We're going to move on to number item number 17. 03:17:44
Short term rental. 03:17:48
Community engagement. 03:17:49
Findings and potential regulatory framework. 03:17:51
Will staff please present the report? 03:17:54
Yes, thank you. 03:18:02
We are looking for the clicker. 03:18:04
OK, so we are presenting this item related to short term rental. 03:18:11
Community engagement findings and potential regulatory framework. 03:18:17
The City Council had. 03:18:21
Considered. 03:18:23
Developing some short term rental regulations earlier this year. 03:18:24
And similar to the. 03:18:28
The last item the City Council had requested that we do community feedback. 03:18:29
And a survey. 03:18:33
And. 03:18:35
A community forum at City Hall. 03:18:37
So we have now done. 03:18:40
Those I. 03:18:42
The survey and the community forum. 03:18:43
We had as I mentioned earlier. 03:18:46
I think we've grown our. 03:18:48
Reach with our social media and our surveys to get much more. 03:18:50
Responses than than we had used to receive and so we received over 200 responses. 03:18:55
To our survey. 03:19:01
And also at the. 03:19:03
Community forum. We had many attendees and so. 03:19:05
We'll talk a little bit about. 03:19:08
What came out of those meetings, but as a starting point, just as a reminder. 03:19:11
When we say the word short term rental, we're talking about a property rented out for less than 30 consecutive days. It can be a 03:19:16
home rented out, an apartment, or an individual room. 03:19:21
A lot of people, sort of. 03:19:27
Think of Airbnb and VRBO. 03:19:30
Almost, uh. 03:19:34
Example examples of short term rentals but it actually. 03:19:36
Can be those or it could be. 03:19:40
Booked. 03:19:42
Other umm. 03:19:45
Means as well, so it's. 03:19:46
Specifically, a property that's rented out for less than 30 days, whether it is on Airbnb and VRBO or not. 03:19:49
The City of Port Hueneme does not currently have regulations restricting short term rentals. 03:19:58
We. As part of the research on this, we. 03:20:03
Looked into how many short term rentals exist and we confirm that there are 1414 short term rentals in the city. 03:20:07
That are are actually paying TOT. 03:20:13
Transient occupancy tax or otherwise known as the hotel tax. 03:20:16
Those 14 generate. 03:20:20
Hotel tax revenue of about 24 to $29,000 annually. 03:20:22
But looking at. 03:20:27
Those websites that advertise it, we can. 03:20:29
Estimate that there are many additional short term rentals. We estimate between 40 and 55 active short term rentals within city 03:20:32
limits. 03:20:36
The majority of those short term rentals are within the California coastal zone. 03:20:41
And we'll talk in a minute about why that's important. 03:20:44
We. 03:20:50
As a starting point, we when we had asked, when we had done some feedback, we tried to. 03:20:51
Talk about. 03:20:56
Some of the things that cities. 03:20:57
Have done or can do some of the potential regulatory options. 03:20:59
We the. 03:21:03
Can require permitting and licensing for short term rentals. 03:21:04
The cities can limit the amount of short term rentals based on a percentage or number. 03:21:08
And the city can impose application requirements. 03:21:13
Such as? 03:21:17
One of the things that came up a lot in our conversations were local contact information. 03:21:18
So that the property owners. 03:21:23
Would be responsible for responding to. 03:21:25
Needs that arise in short term rentals. 03:21:28
Cities can also establish fees to cover the administrative and enforcement related costs of short term rental programs. 03:21:31
Additionally, the cities can. 03:21:39
Mandate that short term rental operators collect and remit. 03:21:41
The tot technically, even though we don't have. 03:21:45
Rules right now about short term rentals. Technically if somebody's operating one they should be collecting and remitting tax for 03:21:48
it. 03:21:52
And so that's something that that can be done. 03:21:56
Without even. 03:22:01
An additional ordinance. 03:22:02
So some of the key areas that were discussed. 03:22:06
As part of these. 03:22:10
Conversations. Community conversations. 03:22:11
Were needs for operational standards, such as limiting the maximum number of nights rented per year. 03:22:14
Imposing parking requirements or no noise and or quiet hour rules. 03:22:20
Requiring trash management protocols and mandating signage such as the. 03:22:25
Posting rules for short term rentals and local contact info information in case there are issues related to short term rentals. 03:22:30
Additionally, there is a. 03:22:38
The ability to require. 03:22:39
Health and safety requirements such as fire safety, smoke detectors, fire extinguisher requirements. 03:22:41
And require compliance with building and housing codes. 03:22:47
And then finally, the city can establish. 03:22:51
Fines for violations such as unauthorized rentals or exceeding occupancy limits as part of a short term rental. 03:22:55
Compliance program. 03:23:01
And then ultimately, if there are continued fines, we can establish a process where the permits would be revoked if if a property 03:23:04
owner continues to violate. 03:23:08
These requirements. 03:23:13
So those are just generally. 03:23:14
Kind of the framework of what can be done about short term rentals. 03:23:16
With in Port Hueneme there's a big asterisk and the asterisks is. 03:23:20
In the California coastal zone. 03:23:25
The California Coastal Commission. 03:23:28
Does have. 03:23:31
Has to review and approve. 03:23:34
The requirements that we put in place for short term rentals. 03:23:37
So. 03:23:40
Generally. 03:23:44
Really make whatever regulations they would want to about short term rentals. 03:23:46
But because. 03:23:50
A major portion of our city and including the area where there are short term rental. 03:23:51
Issues and complaints right now are within the California coastal zone. 03:23:56
We have to have. 03:24:00
Our permit our our regulations approved by the coastal zone. 03:24:01
Which means. 03:24:05
They they have some oversight over what those. 03:24:06
Conditions can be, yeah. 03:24:09
And so this slide shows how many communities we have within the coastal zone. It's several. 03:24:11
Of our, of our communities and. 03:24:16
Also generally where most short term rentals occur. 03:24:19
As a lot of short term rentals are. 03:24:22
To come to the beach. 03:24:24
So. 03:24:25
So California Coastal Commission. 03:24:29
They have a mandate that is to protect and enhance public access to the coast. 03:24:32
And so. 03:24:36
Essentially, they make sure that all regulations from cities. 03:24:37
Ensure that the public has access to the coast. 03:24:41
Which is why they do not want cities to just say no short term rentals near the beach and so. 03:24:44
They if we were to. 03:24:50
Adopt short term rental rules. We would then have to submit them to coastal zone as part of a coastal development permit. 03:24:53
And. 03:25:00
Generally we have an idea of what they've approved in other areas and what they have viewed as too strict and so. 03:25:02
And then finally, I think this was one of the reasons why this topic came to the City Council. 03:25:10
Early on is that? 03:25:15
Some of the homeowners associations in our community discovered that. 03:25:16
Per The Coastal. 03:25:20
Commission that. 03:25:22
They cannot. 03:25:24
Now adopt. 03:25:25
Short term rental. 03:25:27
Regulations without going through. 03:25:28
A coastal zone coastal development permit process Which. 03:25:31
Which some of our homeowners association set was. 03:25:35
Likely going to be too complicated or too difficult for them to
