Provide a little education about the history of Cinco de Mayo. 00:03:38
So bear with me, it's only a page long. 00:03:43
Once Upon a time, in the heart of Mexico, there was a small town called Puebla. 00:03:46
It was the year 1862 and the country was in turmoil. 00:03:50
Mexico was facing a formidable challenge foreign invasion led by the French Empire, which sought to expand its influence. 00:03:54
And control over the nation. 00:04:01
The Mexican people were wary. 00:04:03
From years of conflict and economic hardship, but they were determined to defend their homeland. 00:04:06
In Puebla, a young general named Ignacio Zaragoza rallied his troops. He was not a man of great stature, but he possessed an 00:04:11
indomitable spirit in a fierce love for his country. 00:04:17
Zaragoza knew that the odds were stacked against them. The French army was well equipped and experienced, while his own soldiers 00:04:23
were often poorly armed. 00:04:28
And outnumbered. 00:04:33
Yet he believed in the heart and resilience of his people. 00:04:34
On May. 00:04:38
5th 1862 The two armies clashed in a fierce battle. 00:04:39
The French forces, confident in their superiority, expected an easy victory. 00:04:44
But Zaragoza and his men fought with unparalleled courage. They were fueled not just by the desire to win, but by a deep sense of 00:04:49
pride and unity. 00:04:54
As the sun rose over the battlefield, the sounds of cannon fire and the cries of soldiers filled the air. 00:04:59
Against all odds, the Mexican army emerged victorious that day. 00:05:06
The Battle of Puebla became a symbol of resistance and hope, demonstrating that even the most powerful adversaries could be 00:05:10
challenged by the spirit of a united people. 00:05:16
The victory was celebrated not just in Puebla, but throughout Mexico and beyond. 00:05:21
It ignited a sense of nationalism and pride that resonated with people far and wide. 00:05:26
Has the years passed, Cinco de Mayo transformed from a local celebration into a national holiday. It became a day to honor the 00:05:33
bravery of those who fought for freedom and to celebrate Mexican culture and heritage. 00:05:39
Communities across Mexico and in the United States began to commemorate this day with parades, music. 00:05:46
And traditional foods showcasing the rich tapestry of Mexican traditions. 00:05:53
Today, Cinco de Mayo is not just a celebration of a historic battle. 00:05:58
It is a reminder of the strength that comes from unity and resilience. 00:06:02

And whereas suicide is the 10th leading cause of death in the United States and 2nd leading cause of death among people ages 10 to 00:12:06

And 90% of people who die by suicide have an underlying mental illness. 00:12:15
And whereas only one out of two people. 00:12:20
With a serious form of mental illness, seeks treatment. 00:12:23
For his or her mental illness. 00:12:26
And whereas good mental health is critical to the well-being of our families, communities, schools and businesses. 00:12:28
Whereas public education and civic activities can encourage mental health and help improve. 00:12:35
The lives of individuals and families affected by mental illness. 00:12:42
Whereas people with mental illness recover if given the necessary services and support in their communities. 00:12:46
And whereas every citizen and community can make a difference in helping in the silence and stigma. 00:12:52
That far too long have surrounded mental illness and discourage people from getting help. 00:12:58

There are lots of regulations and government codes that you have to know, the Brown Egg Political Reform Act, Public Records Act, 00:18:53
and Evelyn is familiarizing herself with them and she's working her way through that. 00:18:58
Umm, it's an honor to serve in this role. It's often behind the scenes, but we take a light or a lot of pride in making sure it 00:19:04

And as part of that public hearing, staff is recommending that council adopt A resolution or I'm sorry that the Housing Authority 00:24:22

Plan and a capital fund five year action plan. 00:24:37
One of the main changes this year. 00:24:42

We did new things and revenues might have gone up a lot and then years where that went away and so. 00:31:36
We wanted to really start by just talking about what what is a normal budget for the city. 00:31:42
And how do we avoid sort of cycles of spending and then cycles of reduction? 00:31:47

And how do we just have a sustainable, consistent budget? 00:31:53
So I mentioned earlier that we're here at the start of a second phase, I think. 00:31:58
It's since the day I started. 00:32:02
We really were looking to try to get ahead of the cannabis. 00:32:06

Revenue reductions. 00:32:11
We we knew that that that the reductions were coming. We tried to. 00:32:13
Adjust our. 00:32:17
Spending to be sort of back to the pre cannabis levels. 00:32:19
And I think that we're at a point here today where. 00:32:23
We essentially had gotten there. 00:32:28
And we expected that. 00:32:31
To sort of be a place where we could. 00:32:33
Stop and maybe take a. 00:32:35

The the new word of the day that we've heard really consistently, we're hearing it from other cities, other agencies. 00:32:53
I think it's the it's going to be what we hear for the next few months at least, is the phrase economic uncertainty. 00:33:01

Consultants who work for the city, who advise on things like sales tax and. 00:33:10
Things like that. Call us and say due to economic uncertainty we are revising your revenue projections down. 00:33:15
Due to economic uncertainty, we are expecting that these things will cost more. 00:33:21

The keyword we want to focus on cuz. 00:33:27
I think over the last couple weeks we really sort of had to stop and go, OK, we've we've gotten to a more balanced sustainable 00:33:30
level. We still have. 00:33:34
Some small things we're trying to work through, but we've gotten to a more sustainable position. 00:33:38
But now we're hearing this uncertainty word and how? 00:33:42
Much do we react? 00:33:46
To that and and what would be overreacting to that and we want to be careful not to do that so. 00:33:47
So and and the the keyword being uncertain is important because. 00:33:53
I think what we are going to see this year is that every few months I think we'll have a clearer picture of. 00:33:59
What's going to happen? And we'll be making more adjustments during the year. 00:34:06
Versus right now trying to guess at. 00:34:11

So we note that at the end of the slide saying expect to have budget adjustments. 00:34:19

Which also I think one of the key points we wanted to highlight there is that the cannabis revenues have. 00:34:38
Multiple impacts because they also impact sales tax and measure you. 00:34:44

As when we spoke in September of 2023 and we had identified that as a major concern. 00:34:56
At that time, it doesn't sound that long ago, but at that time, Oxnard and Ventura still hadn't issued permits to any dispensaries 00:35:02
within their cities. 00:35:06
And so we had talked about at that time. 00:35:10
Let's try to get ahead of it. Let's try to start paring down that spending. 00:35:12
And I think what happened, what we saw is that they did finally get open, if everybody remembers. 00:35:16
Oscar and Ventura both had challenges where they had to restart their permitting processes and so. 00:35:22
So at that time, it was sort of like unclear how long that would take, but they did get their dispensaries open. 00:35:28
They opened up. 00:35:34
Many, uh. 00:35:35
I know that there's a couple still in progress and everything, but I know. 00:35:37
I had heard at least a dozen. 00:35:40
And so. 00:35:43
Um, that impact that we were trying to get in front of happened. 00:35:45
Quickly. 00:35:49
And so the hope was that we were going to be proactive, get in front of it. 00:35:50
And have some time where we. 00:35:54
Kind of got ready for it, but I. 00:35:57
It was good that we were proactive, but it ended up happening, you know, right, right, right away, basically. 00:36:00

The fact that when cannabis sales drop, it also impacts sales tax. 00:36:15

I think one of the key points I want to highlight is when we look at expenditures in a couple of minutes. 00:36:56
We have been trying to reduce them. 00:37:01
But that drop was so. 00:37:03
Kind of quick and steep that it's a struggle to kind of. 00:37:05
Even being proactive to really match that level of decline, so. 00:37:10
So as. 00:37:19
As discussed, the city took efforts immediately to try to correct. 00:37:21
And prepare for for that decline. 00:37:27
If you remember in September of 2023. 00:37:30
City Council prudently approved postponing. 00:37:34
Millions of dollars of capital improvement projects that would have. 00:37:37
Essentially, utilize the city's reserves. 00:37:41
We took some of those dollars from some of those projects and we put those towards completing Bubbling Springs Park. 00:37:45
To ensure that we didn't run out of funding for Bubbling Springs Park. 00:37:51
And then some of those dollars just got programmed into future. 00:37:54
CIP projects but. 00:37:58
That was a key thing to avoid. 00:38:00
Sort of draining the reserves. 00:38:03
All at once when? When those revenues were at a peak. 00:38:05
And then there was direction for staff to continue working towards balancing the budget. 00:38:09
We have have continued to work towards doing that, reducing costs sort of across the board. 00:38:14
Including just at the last council meeting, we reduced the cost of the broadband master plan by about $5 million. 00:38:19
And so we've just consistently been looking at everything we do and how we can do it more efficiently. 00:38:25
Or, umm. 00:38:31
You know, identify maybe portions of plans and projects that are not priorities at this time. 00:38:34
So we've consistently worked towards that. 00:38:40
And then as you can see there, we we show the full time employee count. 00:38:42
Which shows that. 00:38:48
Again, when we look at, you know, sort of what was normal. 00:38:50
Was 22, you know, fiscal year 2223 normal or was? 00:38:53

Personnel costs are about 70% of our general fund budget. 00:41:43
Personnel costs, which include salaries, benefits are about $20 million of our $27 million budget. 00:41:48

Why is that important? Because it sort of speaks to the challenge that. 00:43:02
You know, I've heard some people say, well. 00:43:07
Like we could wait and we can just make severe reductions in the future. 00:43:09
And but if our personnel costs are $20 million? 00:43:13

Reduce that far down South. 00:43:18
So it's sort of important to just know that that. 00:43:21
That is that cost and. 00:43:25
And it makes it difficult. There's not a whole lot of wiggle room. 00:43:27
So, So what we have been doing though is that as we've had positions become vacant. 00:43:30
We've looked at reorganizing, restructuring. 00:43:37
Combining positions. 00:43:40
Like we, we started off looking at that full time employee count and. 00:43:43
You can see that just. 00:43:48
You know, 5-6 years ago we had significantly fewer employees. 00:43:49
So a lot of it is sort of pairing back to. 00:43:52

That's not necessarily easy. It's not necessarily what we want to do. 00:43:59
But it's what we can afford, so we're we're. 00:44:05
Continuing to do that. 00:44:08
We've asked our employees to do more. 00:44:10

I'm proud to say that I think we have done more with less resources over the last couple years. 00:44:16
But it's also important to note that at some point you can't keep doing more with with less resources, so. 00:44:21

We struggle right now to kind of make to put together a balanced budget. That's one of the challenges we're running into. 00:44:28
So we have successfully been able to keep. 00:44:35
To reduce operating expenses. 00:44:38
Them at a lower level, they're starting to get pushed back up because of the significant on. 00:44:40
Cost increases across the board. 00:44:47
I know I mentioned this at the last council meeting, but just one example that. 00:44:50
That people wouldn't think of. 00:44:54
On top of the 20 million in personnel costs, we also just have some hard costs like the cost of the city to have insurance. 00:44:56
And our insurance. 00:45:02
In the last couple weeks, was increased from. 00:45:04
We pay about $1.8 million for insurance and it went up. 00:45:07
I think it ends up being like 12% to about $2,000,000. 00:45:11
So when we're. 00:45:15
You know, we're looking at trying to. 00:45:16
Keep increases from going up more than a couple percent, but if you get a couple of bills like that, it kind of throws off your 00:45:19

Your whole plan. 00:45:26
So we wanted to show this just to show that we have been really trying to hold the operating budgets. 00:45:30
Tight and we have really increased it, I think you could see. 00:45:35

Things I'll point out, but looking first at expenses. 00:45:44
So when we made those adjustments in September of 2023, we were able to reduce our expenditures down to about 27.15 million. 00:45:48

Went up to about 28.7 million. 00:46:00
And you'll notice that that's a trend that essentially when we set our budget the second year. 00:46:03
Increases about $1,000,000 because. 00:46:09

Negotiated increases. 00:46:16
And so then. 00:46:18
This year we're looking to try to reduce it back down. 00:46:19
From that high of 28.75. 00:46:24
And we're still working on it. But when we put this report together, we were down to 28.17 million. 00:46:27
Which is actually significantly lower than where we started. 00:46:33
If you remember in February, we got a presentation from the finance director that there was about a. 00:46:37
$2.4 million gap at that time and. 00:46:41
You can see here that when we put this together, we were. 00:46:44
Down to maybe 4 or $500,000 gap. 00:46:47
So we're working on it. We're still working on trying to get balanced, but. 00:46:51
But you can see we. 00:46:55
Worked on it. We reduced it down because it would have trended up to about 29 and a half million. 00:46:57
So we reduced it down to about 28.17. 00:47:02
But then right away you see that the second year because of. 00:47:05
You know, colas and merit increases and things. 00:47:09
It already would go back up. 00:47:12
Like another $1,000,000 again. So. 00:47:14
That's a battle we're facing because when you look at the revenues. 00:47:16
The revenues aren't really going up. 00:47:21
Are not anywhere near as fast as the expenditures are. 00:47:23
The revenues as you can see here, 27.2 million to 27.5, about a $300,000 increase. 00:47:26
And then we're looking at 27.7. 00:47:33
Our 27.8 however year round. 00:47:36
Next year, so maybe a $300,000 increase and then? 00:47:39
We did get an update from our sales tax consultants who look at sales tax and measure you and they're saying. 00:47:44

Due to economic uncertainty, which will be the word of the day. 00:47:52
That they're actually suggesting we revise that even down a little bit more now, so. 00:47:55
So flat revenues and expenditures going up because everything's getting more expensive. 00:48:00
Just big picture, it means it's going to be tough to stay balanced. You know, each year it's going to be an ongoing battle. 00:48:06
And that's where we're looking at some things right now to sort of try to figure out how to. 00:48:12
Structurally changed. 00:48:17
To not. 00:48:19
To become more sustainably budgeted. 00:48:23
So I mentioned earlier. 00:48:26
Phase one has been working to try to get ahead of that cannabis reduction. 00:48:29
I think we're about there and we're where the goal was when we started. 00:48:33
It's just unfortunately we're looking at phase two economic uncertainty. 00:48:38
Again, keyword is uncertain because. 00:48:43
It's everybody's basically saying to be conservative because we don't know what's going to happen over the next six months to it. 00:48:46

Like I mentioned a few. 00:48:55
Of our consultants and things have called us and said be conservative, adjust down. 00:48:57

No one's really sure if it's really. 00:49:02

The goal will be have a good plan. 00:49:12
And then as things change, be prepared to adjust as we need to so. 00:49:15

We sort of know what direction we're going on unless council. 00:50:41
Says to go in a different direction. 00:50:44
So I'll just note that what we have done already is that top list we. 00:50:46
Met with each department and we went through 5% reduction exercise. 00:50:53
I will say that each department. 00:50:58
We really appreciate that each department took it seriously in each department made reductions. 00:51:01

I will say on behalf of myself and our finance team. 00:51:07
We've looked at the departments. 00:51:11
They're pretty cut to the bone. 00:51:13

So we appreciate that everybody did it. I think it's a step we needed to take. But again, it's. 00:51:41

List there there's some things we have to look at doing differently in the future so that we. 00:51:50
Because that won't be an option moving forward. 00:51:56

That we have put in place as a temporary external hiring freeze. 00:52:02

There may be opportunities to sort of reorganize, reorg or restructure and kind of move people into roles that are needed. 00:52:17

Funding to keep bringing more people on board so. 00:52:32

And it's definitely a challenge. 00:52:46

The City Council took several steps to sort of. 00:52:55
Get prepared and one of them was creating a CIP reserve fund. 00:52:58
Because there had never been. 00:53:02
CIP funding source. So the CIP. 00:53:04

Basically added to the deficit every year. 00:53:08
And so. 00:53:11
That has been created. It was funded for two years and so we do have some funding. 00:53:12
In that CIP reserve and using that like starting to use that now. 00:53:17
You know, we essentially created it for a rainy day. 00:53:22
And it looks like it might be a rainy day this year. 00:53:24
So we're proposing starting to use that to. 00:53:27
Pay for the CIP, which would then would not. 00:53:30
Which would help balance the budget. 00:53:34
The key there that we would just highlight is that. 00:53:36
You know the goal was. 00:53:39
To try to create that and get a couple years of funding built up to pay for a project. 00:53:40
We we really only were able to create it and have it in place for a pretty minimal period of time. So it'll help us for a couple 00:53:45
of years, but it's not the long term solution. 00:53:50
And then? 00:53:56
As we've said a few times with that keyword, economic uncertainty. 00:53:58
The last recommendation would be. 00:54:01
Just be prepared to make adjustments throughout the year. 00:54:05
And I will just note there, I did reach out to other cities and some other agencies. 00:54:08
And everybody's starting to realize. 00:54:13
That point, at this point, it's. 00:54:16
We aren't going to be the only ones who sort of. 00:54:18
Kind of adopt A conservative budget. 00:54:23
And just know that. 00:54:25
There's probably going to be changes during the year one one way or the other, so. 00:54:27
So that's what we put in place that we've worked on over the last couple of weeks even as this agenda has come out. 00:54:33
Where we've really been able to sort of fine tune the budget and and keep working to balance it and making progress. 00:54:40
At that time we had said, you know, kind of next options if we couldn't get balance would be. 00:54:47
The four options noted. 00:54:52
Which are. 00:54:54
Additional reductions of. 00:54:55
Annual or ongoing expenses. 00:54:58

A simple way to. 00:55:07
Kind of what we've already done, which is going through the departments and identifying whatever reductions we can that don't 00:55:09

Bigger, I'd probably be asking, OK, what service levels are we willing to impact? 00:55:18
But I think we're. 00:55:24
When we bring the full list of reductions at the next meeting, we'll talk about, you know, some of them will inevitably have 00:55:26

But we haven't had to actually eliminate any. 00:55:32
Like full programs or anything at this point? 00:55:36

And I think the staff report noted when we wrote it that if we couldn't get balanced. 00:55:41

And I'll use this as an example just. 00:56:25
Of for the purposes of. 00:56:28
Illustrating that point. 00:56:30
Would be, you know, we do a lifeguard program every summer. 00:56:31
And the lifeguard program, it costs the city about $250,000. 00:56:34
And if. 00:56:39
You know, if it were as simple as well, like maybe we take one year off where we don't have that program. 00:56:40
That might be something we'd consider. 00:56:46
But the reality is right now, if you were to cancel something like that. 00:56:49
Every other agency is desperate for lifeguards. They would take all your lifeguards. You'd lose all your certifications. You 00:56:55
you'd, you know, lose your whole structure. 00:57:00
It would really have to be just known like that would. That wouldn't be a short term. 00:57:05
Solution. 00:57:10
And so for that reason, we're doing our best and, and I think we're we're on the path to not. 00:57:11
Have to have those kinds of conversations right now. 00:57:18

You know the couple months ago where we saw a two and a half million dollar gap to now I think we. 00:57:25
We're on the path towards avoiding. 00:57:30

Reducing travel budgets, training budgets, you know those types of things. 00:57:43

But we've tried to avoid. 00:57:50
For that reason, we've really tried to avoid any impacts to any. 00:57:52
Like real programs. 00:57:55
That would be longer term impacts. 00:57:57

And I actually would highlight with what we've heard from a lot of dispensaries is. 01:25:25
Oxnard's actually charging them a lot more because they had to. 01:25:30
I don't remember if they officially put out the number, but the number we're hearing from people is that they essentially have to 01:25:35
pay 250 grand for the permit to get started. 01:25:39
And even with that. 01:25:44
They know they want that location right off the freeway. 01:25:45
They could stay in Winimi and not have to pay that, but it's. 01:25:48
You know it's worth that trade off for them so. 01:25:52
So we've heard that from some of our dispense, well several of our dispensaries, you know that. 01:25:55

They're still moving forward with opening those locations, so. 01:26:05
So I just think that the biggest competitive advantage they have is location. 01:26:09

The city has serious issues with accountability, transparency and basic responsiveness that get ignored. 01:28:57

And is the exact opposite of what this community needs right now. 01:29:07
Everyone loves dogs but long term getting another canine which requires a handler. 01:29:11
Officer, a working vehicle, additional and ongoing officer training, and a host of other equipment is not a cost effective 01:29:16
solution to a problem that cannot be solved by ignoring the real problems and allowing the department to crowd fund. 01:29:22
To obtain a drug dog. 01:29:29
We should ask ourselves if the canine the Police Department already has is actually working for the community. 01:29:31

I love dogs as much as the next person, but another canine for the Police Department is not the answer. 01:29:39

While some are being told to tighten belts, council events embrace for more cuts. 01:29:47
Somehow there's still room in the budget for a canine program that doesn't address our actual public safety concerns. 01:29:52
And puts our community at more risk. 01:29:58
Taking officers off the streets to even think of this as a slap in the face to residents who are already frustrated. 01:30:00

We need more officers actually patrolling our streets and officers who genuinely engage with the community. 01:30:08

Back in June of last year, the City Council. 01:37:34
Approved a series of. 01:37:38
Amendments to our existing 18 development agreements with our cannabis businesses. 01:37:40
And this is the first of the annual reviews since that June meeting. 01:37:46
But. 01:37:53
Further back, we've been discussing cannabis quite a bit in the last item. 01:37:54
And back in 2016, the City Council, because they were facing a budget crisis at the time. 01:37:59
Opted to allow cannabis businesses to operate in the city as a source of revenue. 01:38:06
And since the city does not have a cannabis tax in place. 01:38:11
The development agreement was the tool that the. 01:38:15
Council at the time. 01:38:18
Established to ensure that the various cannabis businesses here in the city. 01:38:21
Would pay their required obligated payments towards the City General Fund or the contractual payment as it's called. 01:38:26
The development agreements also include remedies that should the applicant default. 01:38:34
And such a default would be for instance. 01:38:39
If the annual amount of the contractual payment dropped by 50% or more of a three-year average. 01:38:42
If any conditions of the related conditional use permits for the operation of each business were violated. 01:38:49
Or if there was a continuing or repetitive breach of the city's ordinances. 01:38:56
And as a result of the default, the city could terminate the development agreement, modify it, or exercise a similar remedy. 01:39:01
And as stated in each staff report that was presented to the City Council for consideration of a cannabis a new cannabis 01:39:10
businesses application. 01:39:14
The respective development agreements specifically required applicants to agree to the following. 01:39:20
Pay that contractual payment of 5% for dispensaries in this case of their annual gross revenues on a regular basis and this is 01:39:25
less taxes paid such as? 01:39:30
Sales tax or now excise taxes as we discussed back in June of last year. 01:39:36
That they would maintain all books and records accurately and pay for annual audits. 01:39:41
And it's down from 2 audits down to 1 audit annually. And this was the cost savings, a measure to help our businesses out. 01:39:46
And this was per our June. 01:39:53
24 amendments to the development agreements. 01:39:55
And that they'd obtain a certificate of occupancy to. 01:39:59
Open their businesses with one year of effective date of the agreement being put into place. 01:40:02
And in exchange for these provisions, the city would agree that through the development agreements. 01:40:08
That the development rights in place at the time that the agreements were approved would be vested with the exception of any non 01:40:14
conflicting laws or regulations. 01:40:18
And so again, the public benefits summary, the reason why the city was allowing these businesses to operate in here in the 1st 01:40:23
place would be again to open the business with one year. 01:40:30
Of the effective date of the agreement. 01:40:37
Provide the long term source of employment opportunities and assisting the revitalization of the economic development base of this 01:40:40
Community. 01:40:44
Provide the city directly with additional revenue in the form of an increase in certain taxes, such as sales taxes and whatnot. 01:40:49
Provide additional monies for the general funding of this that 5% payment. 01:40:56
And provide certain community benefits, which are generally 1% of the annual gross revenues that are put towards. 01:41:01
Organizations and events and whatnot here in the community. 01:41:09
So with regard to Emerald Perspective, it is the dispensary. It's located at 100 W Pleasant Valley Rd. They've been in business 01:41:14
since April of 2019 and while they have been in compliance with past development agreement reviews. 01:41:21
The city is currently out of compliance with their development agreement for the following. 01:41:28
First of all, the lack of payment of 5% in gross revenues for the city's general fund, and this was for the months of November and 01:41:33
December 2023, as well as from April 24. 01:41:38
To present. 01:41:43
Terms and condition #12 of their development agreement states that the City requires this payment. 01:41:45
On a city on a regular basis. 01:41:52
And again, the primary purpose for the city to require this payment is for allowing the cannabis businesses to operate. 01:41:55
Basically, is a source of revenue for the general fund. 01:42:03
And the lack of this payment to the city basically has a negative impact on our finances, as we've just discussed. 01:42:05
And the ability to provide, all right, excuse me, provide services to ensure the health and safety of the public. 01:42:12
Since December 23, staff has made over two dozen attempts to reach out to Emerald Prospective with regard to the amount owed to 01:42:19
the city. 01:42:24
Some of these the finance department was successful in at least talking to somebody, but we're told that. 01:42:30
The business either claimed that they owed that they were owed money. 01:42:37
To the city. 01:42:41
And or they were being overcharged. 01:42:42
Or they ignored Staffs outreach altogether. 01:42:45
What documentation was provided to the city by the business was unsubstantiated, and requests from staff for the developer to 01:42:48
provide proper documentation and backup data will also ignore it. 01:42:54
Second, due to the lack of the regular payments and the affiliated paperwork. 01:43:01
To prove otherwise. 01:43:07
Staff cannot determine whether or not the developer has been providing the city directly with additional revenue from increased 01:43:08
taxes, and further, the developer has not paid for this year's annual business license tax. 01:43:13
I say this year's, I mean 2024 and now we're coming up with 2025 shortly. 01:43:19
Terms and conditions #8 of the Development Agreement. 01:43:24
Requires compliance with all existing development regulations in place at the time the agreement becomes effective. 01:43:27
Our Municipal code sections 5003C and 5016 require that all businesses operating in the city pay their business license tax and 01:43:34
have a business license in place. 01:43:39
Again, this business is not at this time. 01:43:45
Where there cannot be determined if the revenue is being generated in the form of additional taxes that is required by the 01:43:48
agreement. 01:43:51
Public benefits summary are occurring at this time. 01:43:55
Three, the developer is out of compliance with several of the conditional use permits. Conditions of approval. The conditional Use 01:44:01
permit, PHCU 844 was approved by the City Council to allow the operation of the dispensary back in April of 2018. 01:44:08
Specifically, conditions 1431 and 40 require the developer to comply with their project application and what was contained within 01:44:16
it. 01:44:20
As well as the plans. 01:44:24
That they would comply with their certificate of approval as well as the development agreement that employees where visible 01:44:27
identification cards. 01:44:31
And that the developer will agree to the annual business reviews by city staff and outside consultant HDL, respectively. 01:44:35
HDL performs annual inspections of all of our businesses, generally in October that occurred with this year in October with 01:44:43
Emerald Perspective and HDL when they were there. 01:44:48
Found several violations of either. 01:44:54
City or and or state law. 01:44:57
Such as the business not having the required plans and documents on hand for the inspector to review. 01:45:00
And the employees were not wearing proper identification. 01:45:06
Staff follows up with the letters to the businesses, whether to let them know that they are in compliance or if there are 01:45:10
corrections that are needed. 01:45:14
When staff reached out with the letter to the developer, we asked that the items all be corrected by November 30th. 01:45:19
To date, the developer has not responded to the letter nor verified that any of these corrections have been made. So again, the 01:45:27
business is in violation of their CP. 01:45:32
And Terms and conditions #17 of the Development Agreement notes that this is. 01:45:37
Consideration of default with their development agreement. 01:45:43
And finally, as I mentioned earlier. 01:45:48
In addition to not paying for the. 01:45:50
The contractual payment, business license tax. The developer is also not paid for the past audit or inspection. 01:45:54
And again, terms and condition #17 notes the developer shall be in default if not in compliance with the CP with regard to. 01:46:00
Condition #40 specifically. 01:46:09
And this chart basically shows a breakdown of what is currently owed to the city by Emerald Perspective. 01:46:12
The required 5% payment to the General fund, along with interest, totals $76,217.00, roughly. 01:46:20
The remaining balance from the previous audit, not to mention the one current coming up soon, but the previous one is over $7000. 01:46:29
The 2024 compliance inspection, which we just discussed has not been paid for and that's $12150. 01:46:37
Balance of penalties for late payments from October to December 2022 / 3000 dollars. 01:46:45
The past due business license tax is $16142 roughly. 01:46:52
For a total of $89,154.69. 01:46:56
And as of today, with this development agreement review, there's another $16180 for that fee. 01:47:01
Which brings the total ode to the city of $90,834.69. And this is all general fund revenue. 01:47:09
Or potential general fund revenue, I should say. 01:47:16
So consequently, per the terms and conditions #11 of the development agreement, the City Council may opt to. 01:47:19
One of several alternatives, the first one here. 01:47:26
Would be to demand full payment of all monies owed to the city. 01:47:30
By a certain date, IE 30 days from today. 01:47:33
And if not paid in full within this period, revoke the development the Developers Development Agreement, subject to the procedures 01:47:37
set forth in the Development Agreement and the City's adopted requirements and procedures. 01:47:42
And should the City Council so choose this option, this would also begin the process of revoking the business's conditional use 01:47:48
permit. 01:47:51
I'll keep in mind they don't have a business license on file right now, so that would not be subject to revocation because of Bebo 01:47:55
point. 01:47:59
Alternatively, the City Council may allow a one time payment plan with fixed terms and conditions. 01:48:05
Requiring a payment of not less than $12,000 immediately. 01:48:11
That would be to cover all of the outstanding annual audit and inspection development, review and review. 01:48:15
Bees as well as the business tax. 01:48:21
Within 30 days of this hearing, with the remainder of the payments to be completed within no greater than six months. 01:48:24
The agreement for the payment plan must then be entered into within 30 days of this hearing. 01:48:30
And the payment plan would be based on the unaudited gross receipts, so basically what we know of today. 01:48:35
Upon completion of the financial audit that will be coming up within the next few months here. 01:48:41
And that will be for all of our cities here. 01:48:46
All of our businesses in the city, I should say. 01:48:48
A true up adjustment will be calculated based on the audit results. If there are additional revenues out of the city, the amount 01:48:52
of additional revenues will then be due within 30 days of a completion. 01:48:57

And these mounts will not be included in the payment plan. 01:49:03
The business would also be able to continue to operate. 01:49:06
Subject to complying with all terms and conditions of that payment plan. 01:49:09

Since, the developer has repeatedly ignored staff's request to produce the information. 01:49:20
Necessary to validate their claims of how much is owed to the city. 01:49:25
Ignored Staffs outreach all together with regard to paying for all of the fees that I've discussed previously. 01:49:29
Since the city has not, excuse me, since the developer also has not paid the required annual business license tax. 01:49:37
Is also operating in violation of the conditional use permit. 01:49:44
Which is a violation of the development agreement. At this time, it is recommended that you, the City Council, find the Emerald 01:49:47
Perspective is in violation of their development agreement and exercise option one. 01:49:53
Which is to demand a full payment within 30 days. 01:49:58
Or move forward with. 01:50:02
Starting revocation of the development agreement and conditional use permit. 01:50:05
