| Celebrating our cultural heritage on this day. | 00:03:28 | |
| Among other things, but I wanted to just read the story to you and. | 00:03:33 | |
| Provide a little education about the history of Cinco de Mayo. | 00:03:38 | |
| So bear with me, it's only a page long. | 00:03:43 | |
| Once Upon a time, in the heart of Mexico, there was a small town called Puebla. | 00:03:46 | |
| It was the year 1862 and the country was in turmoil. | 00:03:50 | |
| Mexico was facing a formidable challenge foreign invasion led by the French Empire, which sought to expand its influence. | 00:03:54 | |
| And control over the nation. | 00:04:01 | |
| The Mexican people were wary. | 00:04:03 | |
| From years of conflict and economic hardship, but they were determined to defend their homeland. | 00:04:06 | |
| In Puebla, a young general named Ignacio Zaragoza rallied his troops. He was not a man of great stature, but he possessed an | 00:04:11 | |
| indomitable spirit in a fierce love for his country. | 00:04:17 | |
| Zaragoza knew that the odds were stacked against them. The French army was well equipped and experienced, while his own soldiers | 00:04:23 | |
| were often poorly armed. | 00:04:28 | |
| And outnumbered. | 00:04:33 | |
| Yet he believed in the heart and resilience of his people. | 00:04:34 | |
| On May. | 00:04:38 | |
| 5th 1862 The two armies clashed in a fierce battle. | 00:04:39 | |
| The French forces, confident in their superiority, expected an easy victory. | 00:04:44 | |
| But Zaragoza and his men fought with unparalleled courage. They were fueled not just by the desire to win, but by a deep sense of | 00:04:49 | |
| pride and unity. | 00:04:54 | |
| As the sun rose over the battlefield, the sounds of cannon fire and the cries of soldiers filled the air. | 00:04:59 | |
| Against all odds, the Mexican army emerged victorious that day. | 00:05:06 | |
| The Battle of Puebla became a symbol of resistance and hope, demonstrating that even the most powerful adversaries could be | 00:05:10 | |
| challenged by the spirit of a united people. | 00:05:16 | |
| The victory was celebrated not just in Puebla, but throughout Mexico and beyond. | 00:05:21 | |
| It ignited a sense of nationalism and pride that resonated with people far and wide. | 00:05:26 | |
| Has the years passed, Cinco de Mayo transformed from a local celebration into a national holiday. It became a day to honor the | 00:05:33 | |
| bravery of those who fought for freedom and to celebrate Mexican culture and heritage. | 00:05:39 | |
| Communities across Mexico and in the United States began to commemorate this day with parades, music. | 00:05:46 | |
| And traditional foods showcasing the rich tapestry of Mexican traditions. | 00:05:53 | |
| Today, Cinco de Mayo is not just a celebration of a historic battle. | 00:05:58 | |
| It is a reminder of the strength that comes from unity and resilience. | 00:06:02 | |
| It teaches us that no matter how daunting, the challenges we face. | 00:06:06 | |
| We can overcome them when we stand together. | 00:06:10 | |
| The spirit of Zaragoza and the brave soldiers of Puebla live. | 00:06:13 | |
| Inspiring generations to fight for their dreams and to celebrate their identities. | 00:06:17 | |
| So, as we gather to celebrate Cinco de Mayo, let us remember the lessons of history. Let us honor the courage of those who came | 00:06:22 | |
| before us, and embrace the diversity that enriches our lives. | 00:06:28 | |
| In every dance, every song, and every shared meal, we find a connection to our past and a promise. | 00:06:34 | |
| For our future, together we can create a world. | 00:06:40 | |
| Where hope and unity prevail, just as they did on that fateful day in Puebla. | 00:06:43 | |
| Thank you. | 00:06:48 | |
| Thank you. | 00:06:49 | |

| Unless an authority member would like to pull an item. | 00:23:08 | |
| Move approval. | 00:23:13 | |
| 2nd. | 00:23:14 | |
| Great roll call please. All in favor, aye? | 00:23:15 | |
| All opposed. | 00:23:19 | |
| Hearing none, motion passes unanimously. | 00:23:20 | |
| OK, we will now. | 00:23:23 | |
| OK, we'll now move to the Housing Authority policy. | 00:23:28 | |
| Public hearing. | 00:23:30 | |
| The 202520295 year public housing agency. | 00:23:32 | |
| Plan and capital fund five year plan. | 00:23:36 | |
| Madam Clerk, do you have proof of publication as required by law? | 00:23:39 | |
| And a complete file of reports and exhibits. Yes, Madam Mayor. | 00:23:43 | |
| Great. Thank you. | 00:23:47 | |
| Will staff please present the report? | 00:23:49 | |
| Yes, Thank you, Mayor. | 00:23:53 | |
| All public housing authorities, ourselves included, are required to review, update and amend. | 00:23:57 | |
| Our housing agency plan every five years. | 00:24:03 | |
| This update would be the 2025 to 2029 five Year Public Housing Agency plan. | 00:24:06 | |
| We are required to hold a public hearing after a 45 day comment period has elapsed. | 00:24:15 | |
| We are here today to hold that public hearing. | 00:24:20 | |
| And as part of that public hearing, staff is recommending that council adopt A resolution or I'm sorry that the Housing Authority | 00:24:22 | |
| board adopt A resolution. | 00:24:27 | |
| Approving the five year plan. The Housing Authority five year. | 00:24:31 | |
| Public agency. | 00:24:35 | |
| Plan and a capital fund five year action plan. | 00:24:37 | |
| One of the main changes this year. | 00:24:42 | |
| Is umm. | 00:24:45 | |
| To the. | 00:24:46 | |
| Housing Authority admission and continued occupancy policy or a cop? | 00:24:49 | |
| And the Housing Choice Voucher administrative plan. | 00:24:54 | |
| And so. | 00:24:58 | |
| We have to implement those items by July 1st 2025. | 00:24:59 | |
| That is reflected in the plan. | 00:25:03 | |
| And uh. | 00:25:05 | |
| We noted in our staff report that the agency is. | 00:25:06 | |
| Currently waiting on the the Hud's software vendor to update the system so that the city can or the Public housing agency can | 00:25:11 | |
| transition to the new regulations. | 00:25:16 | |
| So that's one of the main items addressed in the plan. | 00:25:21 | |
| Other than that, it was fairly consistent with the with the prior plan so staff is recommending. | 00:25:25 | |
| That the Housing Authority board adopt A resolution approving. | 00:25:31 | |
| The five year plan and the capital Fund plan at this time. | 00:25:35 | |
| Great. Does any board members have any questions? | 00:25:41 | |
| I got one question. | 00:25:47 | |
| So I know they've been putting off. | 00:25:50 | |
| Fix finish in fixing up inside the. | 00:25:54 | |
| The building. | 00:25:59 | |
| Marvelous to hear. | 00:26:01 | |
| You know, the carpets are so old. | 00:26:04 | |
| And they were. | 00:26:09 | |
| They've been telling us they're going to replace them. I don't know. | 00:26:12 | |
| That they have the funding. | 00:26:16 | |
| Or they're just waiting for something, you know, but. | 00:26:18 | |
| I was just hoping that they would do that pretty soon. | 00:26:23 | |
| And what I will say related to this plan is that as part of this. | 00:26:29 | |
| The five year capital program plan includes. | 00:26:34 | |
| $227,000 of capital. | 00:26:38 | |
| Program projects for each year of those five years. | 00:26:42 | |
| Which? | 00:26:46 | |
| Ends up totaling over $1,000,000 so. | 00:26:47 | |
| There is work. | 00:26:49 | |
| Intended. | 00:26:51 | |
| Are included with the Five year plan. | 00:26:53 | |
| Thank you. Thank you. | 00:26:55 | |
| Great. Any other questions? | 00:26:59 | |
| OK. | 00:27:01 | |
| We will now open the public hearing and take public comments. | 00:27:03 | |
| The time is now 655. Are there any public comments regarding this item? | 00:27:08 | |
| No public comments. | 00:27:13 | |
| We will then now close or conclude the public comments portion. I will now close it and the time is now 655. | 00:27:16 | |
| We have before us the recommendation to adopt the resolution approving the housing authorities 2025 through 2029 five year plan | 00:27:24 | |
| and it's. | 00:27:29 | |
| Capital fund, five year action plan and budget. | 00:27:34 | |
| May I have a motion? | 00:27:37 | |
| And a second. | 00:27:39 | |
| Move to approve. | 00:27:40 | |
| 2nd. | 00:27:42 | |
| Great. Is there any discussion? | 00:27:43 | |
| There's no discussion. Madam Clerk, please take role. | 00:27:48 | |
| Member Brown. | 00:27:52 | |
| Yes or yes? | 00:27:55 | |
| Member comma. | 00:27:56 | |
| Yes, member Perez. | 00:27:58 | |
| Yes. Member Hernandez, Yes. Vice Chair Lopez, Yes. And Chair McQueen, Legend, Yes. Motion passes with Blackwell absent. | 00:28:00 | |
| Thank you. We'll now move to the authority members reports. | 00:28:08 | |
| Any reports? | 00:28:12 | |
| Any comments? | 00:28:15 | |
| Move on to any future. | 00:28:19 | |
| Agenda items. | 00:28:21 | |
| Great. If there are nothing, if there's nothing else, we'll go ahead and adjourn this meeting. The time is now 656. | 00:28:26 | |
| And the next regular scheduled meeting is June 2nd, 2025 at 6:30 PM. | 00:28:34 | |
| The time is now. | 00:28:42 | |
| Again 656. | 00:28:43 | |
| OK, now we're going to call to order the special joint meeting of the City Council. | 00:28:46 | |
| Housing Authority and surplus property authority Commission. | 00:28:53 | |
| Madam Clerk, please take a roll call. | 00:28:58 | |
| Member Brown. | 00:29:01 | |
| Here Council member, Member, Commissioner Gama. | 00:29:02 | |
| I am here. | 00:29:08 | |
| Councilmember, Member Commissioner Hernandez here. | 00:29:10 | |
| Councilmember Member Commissioner Perez here. | 00:29:14 | |
| And Mayor Pro Tem Vice Chair, Vice President Lopez. | 00:29:17 | |
| Here and Mayor, Chair and President McQueen Legend here. | 00:29:22 | |
| Member Blackwell is absent. | 00:29:27 | |
| Great. Thank you. | 00:29:29 | |
| We're going to move to public hearing item number 7, the Biennial. | 00:29:30 | |
| Budget Fiscal year 20/25/2020 through 2026 and. | 00:29:35 | |
| 2026 through 2027 Budget Workshop. | 00:29:40 | |
| Madam Clerk, do you have proof of publication as required by law? | 00:29:44 | |
| And the complete file of reports and exhibits. | 00:29:48 | |
| Yes, Madam Mayor. | 00:29:51 | |
| Thank you. Will staff please present the report. | 00:29:53 | |
| Yes, thank you. | 00:29:56 | |
| So today's Budget workshop #1 for this year's two year budget process for fiscal years 2526 and 2627. | 00:29:57 | |
| We expect to have a second budget workshop in two weeks, followed by proposing adoption of the budget. | 00:30:08 | |
| Two weeks from that point in early June. | 00:30:15 | |
| And so. | 00:30:18 | |
| We really wanted to start today with really very high level big picture. | 00:30:19 | |
| Conversation. | 00:30:24 | |
| I think. | 00:30:26 | |
| As we go through the budget. | 00:30:28 | |
| It'll be clear. | 00:30:30 | |
| Why we're sort of starting big picture this year, I think we're sort of in the midst of. | 00:30:31 | |
| A couple of changes and we sort of want to. | 00:30:36 | |
| Kind of make sure we take the time and. | 00:30:40 | |
| Identify that. | 00:30:42 | |
| That everybody sort of sees the direction where we are going and then we'll be asking the council for. | 00:30:44 | |
| To provide direction from there. | 00:30:51 | |
| But we wanted to start. | 00:30:53 | |
| Here before we really. | 00:30:55 | |
| Dig into the details of the proposed budget at the second workshop. | 00:30:57 | |
| And so. | 00:31:02 | |
| We wanted to focus on the big picture. | 00:31:04 | |
| We wanted to talk about. | 00:31:07 | |
| Sort of entering a new phase with our budget. | 00:31:10 | |
| As. | 00:31:13 | |
| We look at the next two years and understanding of what would be a sustainable budget for the city. | 00:31:16 | |
| And what we expect to be. | 00:31:23 | |
| Sustainable for the next couple of years. | 00:31:25 | |
| And we've had a lot in our city of. | 00:31:29 | |
| Sort of peaks and valleys in our history where we've had years where. | 00:31:32 | |
| We did new things and revenues might have gone up a lot and then years where that went away and so. | 00:31:36 | |
| We wanted to really start by just talking about what what is a normal budget for the city. | 00:31:42 | |
| And how do we avoid sort of cycles of spending and then cycles of reduction? | 00:31:47 | |
| Moving forward. | 00:31:52 | |
| And how do we just have a sustainable, consistent budget? | 00:31:53 | |
| So I mentioned earlier that we're here at the start of a second phase, I think. | 00:31:58 | |
| It's since the day I started. | 00:32:02 | |
| We really were looking to try to get ahead of the cannabis. | 00:32:06 | |
| Business. | 00:32:10 | |
| Revenue reductions. | 00:32:11 | |
| We we knew that that that the reductions were coming. We tried to. | 00:32:13 | |
| Adjust our. | 00:32:17 | |
| Spending to be sort of back to the pre cannabis levels. | 00:32:19 | |
| And I think that we're at a point here today where. | 00:32:23 | |
| We essentially had gotten there. | 00:32:28 | |
| And we expected that. | 00:32:31 | |
| To sort of be a place where we could. | 00:32:33 | |
| Stop and maybe take a. | 00:32:35 | |
| A breath. | 00:32:38 | |
| Kind of prepare for the next challenge. | 00:32:41 | |
| I think what we've seen over the last couple of weeks, I know I've sent some updates on some things, but is that the next | 00:32:43 | |
| challenge? | 00:32:47 | |
| Appears to be here. | 00:32:51 | |
| The the new word of the day that we've heard really consistently, we're hearing it from other cities, other agencies. | 00:32:53 | |
| I think it's the it's going to be what we hear for the next few months at least, is the phrase economic uncertainty. | 00:33:01 | |
| We've had. | 00:33:09 | |
| Consultants who work for the city, who advise on things like sales tax and. | 00:33:10 | |
| Things like that. Call us and say due to economic uncertainty we are revising your revenue projections down. | 00:33:15 | |
| Due to economic uncertainty, we are expecting that these things will cost more. | 00:33:21 | |
| So, umm. | 00:33:25 | |
| The keyword we want to focus on cuz. | 00:33:27 | |
| I think over the last couple weeks we really sort of had to stop and go, OK, we've we've gotten to a more balanced sustainable | 00:33:30 | |
| level. We still have. | 00:33:34 | |
| Some small things we're trying to work through, but we've gotten to a more sustainable position. | 00:33:38 | |
| But now we're hearing this uncertainty word and how? | 00:33:42 | |
| Much do we react? | 00:33:46 | |
| To that and and what would be overreacting to that and we want to be careful not to do that so. | 00:33:47 | |
| So and and the the keyword being uncertain is important because. | 00:33:53 | |
| I think what we are going to see this year is that every few months I think we'll have a clearer picture of. | 00:33:59 | |
| What's going to happen? And we'll be making more adjustments during the year. | 00:34:06 | |
| Versus right now trying to guess at. | 00:34:11 | |
| You know, will next year be. | 00:34:14 | |
| Positive or negative so? | 00:34:16 | |
| So we note that at the end of the slide saying expect to have budget adjustments. | 00:34:19 | |
| Throughout the year. | 00:34:24 | |
| So sort of going back to that phase one, Phase 2. | 00:34:27 | |
| The last two years were focused on trying to. | 00:34:31 | |
| Make sure we weren't being too reliant on cannabis revenues. | 00:34:35 | |
| Which also I think one of the key points we wanted to highlight there is that the cannabis revenues have. | 00:34:38 | |
| Multiple impacts because they also impact sales tax and measure you. | 00:34:44 | |
| So losing cannabis revenue? | 00:34:48 | |
| Actually impacts. | 00:34:51 | |
| Three key revenues. | 00:34:53 | |
| And so. | 00:34:54 | |
| As when we spoke in September of 2023 and we had identified that as a major concern. | 00:34:56 | |
| At that time, it doesn't sound that long ago, but at that time, Oxnard and Ventura still hadn't issued permits to any dispensaries | 00:35:02 | |
| within their cities. | 00:35:06 | |
| And so we had talked about at that time. | 00:35:10 | |
| Let's try to get ahead of it. Let's try to start paring down that spending. | 00:35:12 | |
| And I think what happened, what we saw is that they did finally get open, if everybody remembers. | 00:35:16 | |
| Oscar and Ventura both had challenges where they had to restart their permitting processes and so. | 00:35:22 | |
| So at that time, it was sort of like unclear how long that would take, but they did get their dispensaries open. | 00:35:28 | |
| They opened up. | 00:35:34 | |
| Many, uh. | 00:35:35 | |
| I know that there's a couple still in progress and everything, but I know. | 00:35:37 | |
| I had heard at least a dozen. | 00:35:40 | |
| And so. | 00:35:43 | |
| Um, that impact that we were trying to get in front of happened. | 00:35:45 | |
| Quickly. | 00:35:49 | |
| And so the hope was that we were going to be proactive, get in front of it. | 00:35:50 | |
| And have some time where we. | 00:35:54 | |
| Kind of got ready for it, but I. | 00:35:57 | |
| It was good that we were proactive, but it ended up happening, you know, right, right, right away, basically. | 00:36:00 | |
| So this chart shows. | 00:36:07 | |
| Like we talked about. | 00:36:10 | |
| Sort of that double effective sales tax and cannabis. | 00:36:11 | |
| The fact that when cannabis sales drop, it also impacts sales tax. | 00:36:15 | |
| Again, we sat here in September of 2023, which would be. | 00:36:19 | |
| Would have been about where that peak was. | 00:36:23 | |
| And we said we thought there was a drop coming and so. | 00:36:27 | |
| You can see that it did, in fact. | 00:36:30 | |
| Occur and it dropped pretty significantly. | 00:36:33 | |
| I think at the time we spoke there was maybe some. | 00:36:35 | |
| Thought that well it might drop it. It won't drop back to the level that it. | 00:36:38 | |
| You know that historically had been because it should be something but. | 00:36:42 | |
| You can see from the. | 00:36:46 | |
| From the chart that it. | 00:36:48 | |
| Really has dropped back to sort of the historic level. | 00:36:49 | |
| So, umm. | 00:36:52 | |
| Again. | 00:36:55 | |
| I think one of the key points I want to highlight is when we look at expenditures in a couple of minutes. | 00:36:56 | |
| We have been trying to reduce them. | 00:37:01 | |
| But that drop was so. | 00:37:03 | |
| Kind of quick and steep that it's a struggle to kind of. | 00:37:05 | |
| Even being proactive to really match that level of decline, so. | 00:37:10 | |
| So as. | 00:37:19 | |
| As discussed, the city took efforts immediately to try to correct. | 00:37:21 | |
| And prepare for for that decline. | 00:37:27 | |
| If you remember in September of 2023. | 00:37:30 | |
| City Council prudently approved postponing. | 00:37:34 | |
| Millions of dollars of capital improvement projects that would have. | 00:37:37 | |
| Essentially, utilize the city's reserves. | 00:37:41 | |
| We took some of those dollars from some of those projects and we put those towards completing Bubbling Springs Park. | 00:37:45 | |
| To ensure that we didn't run out of funding for Bubbling Springs Park. | 00:37:51 | |
| And then some of those dollars just got programmed into future. | 00:37:54 | |
| CIP projects but. | 00:37:58 | |
| That was a key thing to avoid. | 00:38:00 | |
| Sort of draining the reserves. | 00:38:03 | |
| All at once when? When those revenues were at a peak. | 00:38:05 | |
| And then there was direction for staff to continue working towards balancing the budget. | 00:38:09 | |
| We have have continued to work towards doing that, reducing costs sort of across the board. | 00:38:14 | |
| Including just at the last council meeting, we reduced the cost of the broadband master plan by about $5 million. | 00:38:19 | |
| And so we've just consistently been looking at everything we do and how we can do it more efficiently. | 00:38:25 | |
| Or, umm. | 00:38:31 | |
| You know, identify maybe portions of plans and projects that are not priorities at this time. | 00:38:34 | |
| So we've consistently worked towards that. | 00:38:40 | |
| And then as you can see there, we we show the full time employee count. | 00:38:42 | |
| Which shows that. | 00:38:48 | |
| Again, when we look at, you know, sort of what was normal. | 00:38:50 | |
| Was 22, you know, fiscal year 2223 normal or was? | 00:38:53 | |
| You know was normal before that. | 00:38:58 | |
| And you can see that that year and going back quickly. | 00:39:00 | |
| The years where the cannabis revenue spiked. | 00:39:05 | |
| That employees. | 00:39:08 | |
| Employee counts also spiked. | 00:39:10 | |
| And. | 00:39:12 | |
| That's a challenge. | 00:39:13 | |
| We'll talk more about. | 00:39:15 | |
| Personnel costs in the future, but. | 00:39:16 | |
| Once you add an employee, it's an ongoing cost and it's very difficult to then. | 00:39:19 | |
| When you see revenues drop. | 00:39:26 | |
| Also, drop your expenditures. It's just. | 00:39:28 | |
| It's an ongoing cost that doesn't allow you to do that. | 00:39:31 | |
| So this chart shows the sales tax in cannabis revenues again. | 00:39:36 | |
| Overlaid over it and orange. | 00:39:40 | |
| Is actually our full time employee count. | 00:39:43 | |
| And so you can see. | 00:39:45 | |
| Sort of how it spiked with the cannabis revenue coming in. | 00:39:47 | |
| And that from before the cannabis revenue started to decline, we were trying to already start. | 00:39:51 | |
| Identify some savings by attrition. | 00:39:56 | |
| But. | 00:39:58 | |
| It hasn't. | 00:40:00 | |
| Declined to the. | 00:40:02 | |
| Same degree or with that same. | 00:40:05 | |
| Kind of steep decline that the revenue has because ongoing costs are more difficult to. | 00:40:09 | |
| To reduce. | 00:40:14 | |
| And so that then reflects in this general fund expenditures chart. | 00:40:17 | |
| Where you can see sort of similarly there was that spike just like we showed on those other slides in about fiscal year 2223. | 00:40:21 | |
| And then? | 00:40:28 | |
| As we have been starting to try to taper down, you can see how costs started to come down a little bit. | 00:40:30 | |
| But then you can see it's starting to go back up. | 00:40:35 | |
| And that reflects the challenge that we have that everything we do is getting more expensive. | 00:40:37 | |
| So even cutting. | 00:40:43 | |
| Or if we went back to that FTE count, even having fewer employees. | 00:40:45 | |
| This year than last. | 00:40:49 | |
| Costs still go up. | 00:40:51 | |
| Because each one is more expensive. | 00:40:53 | |
| So it's. | 00:40:55 | |
| Sort of just reflects that challenge of. | 00:40:58 | |
| Managing our expenditures, I think. | 00:41:02 | |
| A lot of cities are. | 00:41:04 | |
| Seeing it right now of like costs have really increased and. | 00:41:06 | |
| It's creating this. | 00:41:09 | |
| This challenge. | 00:41:11 | |
| We've been proactive to sort of try to address it, but you can still see how it's it's it's going to be an ongoing challenge. | 00:41:13 | |
| Every year when you look ahead, every year. | 00:41:19 | |
| That that. | 00:41:22 | |
| Move forward, there's going to be a constant like expenditures rising and we'll have to try to keep them. | 00:41:25 | |
| Within revenues? | 00:41:32 | |
| And so this is I mentioned personnel earlier. | 00:41:35 | |
| For us. | 00:41:39 | |
| Just kind of seeing the big picture. | 00:41:41 | |
| Personnel costs are about 70% of our general fund budget. | 00:41:43 | |
| Personnel costs, which include salaries, benefits are about $20 million of our $27 million budget. | 00:41:48 | |
| And so. | 00:41:55 | |
| Sort of across like right off the top. | 00:41:56 | |
| If you cut everything else and we don't have computers or you know. | 00:41:59 | |
| Printers. Or you know anything to work with? Any tools? | 00:42:04 | |
| Our costs would be $20 million. So it's there's your kind of hard floor, you know. | 00:42:07 | |
| So, umm. | 00:42:13 | |
| So if that's the case. | 00:42:15 | |
| You don't have much wiggle room when revenues start to drop. | 00:42:18 | |
| I would. | 00:42:23 | |
| Say that there's some agencies around us who have a very different. | 00:42:25 | |
| Personnel cost. | 00:42:29 | |
| We'll compare that when we come back for our workshop. We'll compare it to some other cities and. | 00:42:33 | |
| And kind of spell that out, but. | 00:42:37 | |
| There are other agencies near us that. | 00:42:40 | |
| Use a lower percentage of their annual. | 00:42:43 | |
| Budget for personnel costs and that so. | 00:42:46 | |
| So it's just important to know that because even if you tried to cut everything else, you can't. | 00:42:49 | |
| We can't really cut that unless you're looking at. | 00:42:53 | |
| Reducing personnel, essentially. | 00:42:56 | |
| So so. | 00:42:59 | |
| Why is that important? Because it sort of speaks to the challenge that. | 00:43:02 | |
| You know, I've heard some people say, well. | 00:43:07 | |
| Like we could wait and we can just make severe reductions in the future. | 00:43:09 | |
| And but if our personnel costs are $20 million? | 00:43:13 | |
| You really can't. | 00:43:17 | |
| Reduce that far down South. | 00:43:18 | |
| So it's sort of important to just know that that. | 00:43:21 | |
| That is that cost and. | 00:43:25 | |
| And it makes it difficult. There's not a whole lot of wiggle room. | 00:43:27 | |
| So, So what we have been doing though is that as we've had positions become vacant. | 00:43:30 | |
| We've looked at reorganizing, restructuring. | 00:43:37 | |
| Combining positions. | 00:43:40 | |
| Like we, we started off looking at that full time employee count and. | 00:43:43 | |
| You can see that just. | 00:43:48 | |
| You know, 5-6 years ago we had significantly fewer employees. | 00:43:49 | |
| So a lot of it is sort of pairing back to. | 00:43:52 | |
| What we used to do. | 00:43:56 | |
| And. | 00:43:57 | |
| That's not necessarily easy. It's not necessarily what we want to do. | 00:43:59 | |
| But it's what we can afford, so we're we're. | 00:44:05 | |
| Continuing to do that. | 00:44:08 | |
| We've asked our employees to do more. | 00:44:10 | |
| Do more with less resources. | 00:44:13 | |
| I think. | 00:44:16 | |
| I'm proud to say that I think we have done more with less resources over the last couple years. | 00:44:16 | |
| But it's also important to note that at some point you can't keep doing more with with less resources, so. | 00:44:21 | |
| I think. | 00:44:27 | |
| We struggle right now to kind of make to put together a balanced budget. That's one of the challenges we're running into. | 00:44:28 | |
| So we have successfully been able to keep. | 00:44:35 | |
| To reduce operating expenses. | 00:44:38 | |
| Them at a lower level, they're starting to get pushed back up because of the significant on. | 00:44:40 | |
| Cost increases across the board. | 00:44:47 | |
| I know I mentioned this at the last council meeting, but just one example that. | 00:44:50 | |
| That people wouldn't think of. | 00:44:54 | |
| On top of the 20 million in personnel costs, we also just have some hard costs like the cost of the city to have insurance. | 00:44:56 | |
| And our insurance. | 00:45:02 | |
| In the last couple weeks, was increased from. | 00:45:04 | |
| We pay about $1.8 million for insurance and it went up. | 00:45:07 | |
| I think it ends up being like 12% to about $2,000,000. | 00:45:11 | |
| So when we're. | 00:45:15 | |
| You know, we're looking at trying to. | 00:45:16 | |
| Keep increases from going up more than a couple percent, but if you get a couple of bills like that, it kind of throws off your | 00:45:19 | |
| whole. | 00:45:22 | |
| Your whole plan. | 00:45:26 | |
| So we wanted to show this just to show that we have been really trying to hold the operating budgets. | 00:45:30 | |
| Tight and we have really increased it, I think you could see. | 00:45:35 | |
| Here and you can see here that. | 00:45:40 | |
| There's a few. | 00:45:43 | |
| Things I'll point out, but looking first at expenses. | 00:45:44 | |
| So when we made those adjustments in September of 2023, we were able to reduce our expenditures down to about 27.15 million. | 00:45:48 | |
| In 20/24/25. | 00:45:56 | |
| Our operating budget. | 00:45:59 | |
| Went up to about 28.7 million. | 00:46:00 | |
| And you'll notice that that's a trend that essentially when we set our budget the second year. | 00:46:03 | |
| Increases about $1,000,000 because. | 00:46:09 | |
| Because of. | 00:46:12 | |
| Colas. | 00:46:13 | |
| Negotiated increases. | 00:46:16 | |
| And so then. | 00:46:18 | |
| This year we're looking to try to reduce it back down. | 00:46:19 | |
| From that high of 28.75. | 00:46:24 | |
| And we're still working on it. But when we put this report together, we were down to 28.17 million. | 00:46:27 | |
| Which is actually significantly lower than where we started. | 00:46:33 | |
| If you remember in February, we got a presentation from the finance director that there was about a. | 00:46:37 | |
| $2.4 million gap at that time and. | 00:46:41 | |
| You can see here that when we put this together, we were. | 00:46:44 | |
| Down to maybe 4 or $500,000 gap. | 00:46:47 | |
| So we're working on it. We're still working on trying to get balanced, but. | 00:46:51 | |
| But you can see we. | 00:46:55 | |
| Worked on it. We reduced it down because it would have trended up to about 29 and a half million. | 00:46:57 | |
| So we reduced it down to about 28.17. | 00:47:02 | |
| But then right away you see that the second year because of. | 00:47:05 | |
| You know, colas and merit increases and things. | 00:47:09 | |
| It already would go back up. | 00:47:12 | |
| Like another $1,000,000 again. So. | 00:47:14 | |
| That's a battle we're facing because when you look at the revenues. | 00:47:16 | |
| The revenues aren't really going up. | 00:47:21 | |
| Are not anywhere near as fast as the expenditures are. | 00:47:23 | |
| The revenues as you can see here, 27.2 million to 27.5, about a $300,000 increase. | 00:47:26 | |
| And then we're looking at 27.7. | 00:47:33 | |
| Our 27.8 however year round. | 00:47:36 | |
| Next year, so maybe a $300,000 increase and then? | 00:47:39 | |
| We did get an update from our sales tax consultants who look at sales tax and measure you and they're saying. | 00:47:44 | |
| That. | 00:47:50 | |
| Due to economic uncertainty, which will be the word of the day. | 00:47:52 | |
| That they're actually suggesting we revise that even down a little bit more now, so. | 00:47:55 | |
| So flat revenues and expenditures going up because everything's getting more expensive. | 00:48:00 | |
| Just big picture, it means it's going to be tough to stay balanced. You know, each year it's going to be an ongoing battle. | 00:48:06 | |
| And that's where we're looking at some things right now to sort of try to figure out how to. | 00:48:12 | |
| Structurally changed. | 00:48:17 | |
| To not. | 00:48:19 | |
| To become more sustainably budgeted. | 00:48:23 | |
| So I mentioned earlier. | 00:48:26 | |
| Phase one has been working to try to get ahead of that cannabis reduction. | 00:48:29 | |
| I think we're about there and we're where the goal was when we started. | 00:48:33 | |
| It's just unfortunately we're looking at phase two economic uncertainty. | 00:48:38 | |
| Again, keyword is uncertain because. | 00:48:43 | |
| It's everybody's basically saying to be conservative because we don't know what's going to happen over the next six months to it. | 00:48:46 | |
| To a year. | 00:48:51 | |
| And so. | 00:48:53 | |
| Like I mentioned a few. | 00:48:55 | |
| Of our consultants and things have called us and said be conservative, adjust down. | 00:48:57 | |
| But. | 00:49:01 | |
| No one's really sure if it's really. | 00:49:02 | |
| Gonna be there or not so it. | 00:49:05 | |
| I think we're just. | 00:49:07 | |
| Sort of getting to the point of realizing that. | 00:49:09 | |
| The goal will be have a good plan. | 00:49:12 | |
| And then as things change, be prepared to adjust as we need to so. | 00:49:15 | |
| So, umm. | 00:49:20 | |
| So one of the points of today's item was. | 00:49:27 | |
| Initially, uh. | 00:49:30 | |
| We did have a bigger. | 00:49:31 | |
| Gap we were working on. | 00:49:33 | |
| And so we were going to come and explain the adjustments we were making to try to get balanced and then. | 00:49:34 | |
| We had identified some options that we wanted some Council direction on. | 00:49:40 | |
| We have gotten closer to being balanced. I think that. | 00:49:45 | |
| The. | 00:49:52 | |
| We we're, we're getting close to being able to bring a budget forward for. | 00:49:54 | |
| At the next workshop. | 00:50:00 | |
| That is better balanced. I think the big challenge that we'll see again is that second year. | 00:50:02 | |
| Because if we're balanced the first year, but then we have. | 00:50:06 | |
| $1,000,000 in increases the second year, that's going to be the real challenge. | 00:50:09 | |
| So we have a proposal and a sort of a plan of how we're going. | 00:50:14 | |
| Going to address that. | 00:50:18 | |
| But the item. | 00:50:19 | |
| Was on the agenda to allow the Council to give. | 00:50:21 | |
| Direction. | 00:50:24 | |
| At first the. | 00:50:26 | |
| Gap was expected when we put this out a week ago, the gap was bigger than it is now because we've been, we continue to work on it. | 00:50:28 | |
| So we're still looking for direction, but I think at this point it's. | 00:50:35 | |
| We sort of know what direction we're going on unless council. | 00:50:41 | |
| Says to go in a different direction. | 00:50:44 | |
| So I'll just note that what we have done already is that top list we. | 00:50:46 | |
| Met with each department and we went through 5% reduction exercise. | 00:50:53 | |
| I will say that each department. | 00:50:58 | |
| We really appreciate that each department took it seriously in each department made reductions. | 00:51:01 | |
| And uh. | 00:51:05 | |
| I will say on behalf of myself and our finance team. | 00:51:07 | |
| We've looked at the departments. | 00:51:11 | |
| They're pretty cut to the bone. | 00:51:13 | |
| There's not a whole lot left. | 00:51:16 | |
| And so. | 00:51:18 | |
| That's just important to keep in mind because. | 00:51:20 | |
| Next year or the year after? | 00:51:23 | |
| The conversation. | 00:51:25 | |
| Really won't be, you know, can we do 5% reductions again, there's just. | 00:51:27 | |
| There it's we're essentially on year two or three. | 00:51:31 | |
| In a row of doing that, and there's really not much. | 00:51:34 | |
| Left to cut that doesn't impact service levels so. | 00:51:37 | |
| So we appreciate that everybody did it. I think it's a step we needed to take. But again, it's. | 00:51:41 | |
| When we get to that second. | 00:51:48 | |
| List there there's some things we have to look at doing differently in the future so that we. | 00:51:50 | |
| Because that won't be an option moving forward. | 00:51:56 | |
| One of the things. | 00:52:00 | |
| That we have put in place as a temporary external hiring freeze. | 00:52:02 | |
| And I think at this point. | 00:52:08 | |
| The. | 00:52:13 | |
| Calling it an external hiring freeze because. | 00:52:14 | |
| There may be opportunities to sort of reorganize, reorg or restructure and kind of move people into roles that are needed. | 00:52:17 | |
| But umm. | 00:52:25 | |
| Again, just looking at the. | 00:52:26 | |
| How much money we bring in and how much money we spend, there's not really. | 00:52:28 | |
| Funding to keep bringing more people on board so. | 00:52:32 | |
| So it'll be sort of that. | 00:52:36 | |
| Almost puzzle of trying to. | 00:52:39 | |
| You know, fit people in the right places to be able to maintain service levels. | 00:52:41 | |
| And it's definitely a challenge. | 00:52:46 | |
| The we also. | 00:52:50 | |
| On September of 2023. | 00:52:53 | |
| The City Council took several steps to sort of. | 00:52:55 | |
| Get prepared and one of them was creating a CIP reserve fund. | 00:52:58 | |
| Because there had never been. | 00:53:02 | |
| CIP funding source. So the CIP. | 00:53:04 | |
| Projects just. | 00:53:07 | |
| Basically added to the deficit every year. | 00:53:08 | |
| And so. | 00:53:11 | |
| That has been created. It was funded for two years and so we do have some funding. | 00:53:12 | |
| In that CIP reserve and using that like starting to use that now. | 00:53:17 | |
| You know, we essentially created it for a rainy day. | 00:53:22 | |
| And it looks like it might be a rainy day this year. | 00:53:24 | |
| So we're proposing starting to use that to. | 00:53:27 | |
| Pay for the CIP, which would then would not. | 00:53:30 | |
| Which would help balance the budget. | 00:53:34 | |
| The key there that we would just highlight is that. | 00:53:36 | |
| You know the goal was. | 00:53:39 | |
| To try to create that and get a couple years of funding built up to pay for a project. | 00:53:40 | |
| We we really only were able to create it and have it in place for a pretty minimal period of time. So it'll help us for a couple | 00:53:45 | |
| of years, but it's not the long term solution. | 00:53:50 | |
| And then? | 00:53:56 | |
| As we've said a few times with that keyword, economic uncertainty. | 00:53:58 | |
| The last recommendation would be. | 00:54:01 | |
| Just be prepared to make adjustments throughout the year. | 00:54:05 | |
| And I will just note there, I did reach out to other cities and some other agencies. | 00:54:08 | |
| And everybody's starting to realize. | 00:54:13 | |
| That point, at this point, it's. | 00:54:16 | |
| We aren't going to be the only ones who sort of. | 00:54:18 | |
| Kind of adopt A conservative budget. | 00:54:23 | |
| And just know that. | 00:54:25 | |
| There's probably going to be changes during the year one one way or the other, so. | 00:54:27 | |
| So that's what we put in place that we've worked on over the last couple of weeks even as this agenda has come out. | 00:54:33 | |
| Where we've really been able to sort of fine tune the budget and and keep working to balance it and making progress. | 00:54:40 | |
| At that time we had said, you know, kind of next options if we couldn't get balance would be. | 00:54:47 | |
| The four options noted. | 00:54:52 | |
| Which are. | 00:54:54 | |
| Additional reductions of. | 00:54:55 | |
| Annual or ongoing expenses. | 00:54:58 | |
| I think. | 00:55:02 | |
| You know that's. | 00:55:04 | |
| A simple way to. | 00:55:07 | |
| Kind of what we've already done, which is going through the departments and identifying whatever reductions we can that don't | 00:55:09 | |
| impact service levels. | 00:55:13 | |
| If the gap was. | 00:55:17 | |
| Bigger, I'd probably be asking, OK, what service levels are we willing to impact? | 00:55:18 | |
| But I think we're. | 00:55:24 | |
| When we bring the full list of reductions at the next meeting, we'll talk about, you know, some of them will inevitably have | 00:55:26 | |
| impacts. | 00:55:29 | |
| But we haven't had to actually eliminate any. | 00:55:32 | |
| Like full programs or anything at this point? | 00:55:36 | |
| We had a. | 00:55:40 | |
| And I think the staff report noted when we wrote it that if we couldn't get balanced. | 00:55:41 | |
| You know, we might have to talk about programs, for example. | 00:55:45 | |
| I will. | 00:55:49 | |
| Uses only as an example of. | 00:55:50 | |
| Why we want to avoid this if we can? | 00:55:54 | |
| And I think we can at this point this year. | 00:55:57 | |
| But eliminating a program? | 00:56:01 | |
| Is actually. | 00:56:04 | |
| A lot more impactful than maybe it would seem, because. | 00:56:06 | |
| As a small city and and essentially with very bare bones. | 00:56:09 | |
| Resources over the next couple years once we eliminate a program. | 00:56:15 | |
| There's not going to be a plan to get it back anytime soon. | 00:56:19 | |
| So we really want to avoid that and. | 00:56:23 | |
| And I'll use this as an example just. | 00:56:25 | |
| Of for the purposes of. | 00:56:28 | |
| Illustrating that point. | 00:56:30 | |
| Would be, you know, we do a lifeguard program every summer. | 00:56:31 | |
| And the lifeguard program, it costs the city about $250,000. | 00:56:34 | |
| And if. | 00:56:39 | |
| You know, if it were as simple as well, like maybe we take one year off where we don't have that program. | 00:56:40 | |
| That might be something we'd consider. | 00:56:46 | |
| But the reality is right now, if you were to cancel something like that. | 00:56:49 | |
| Every other agency is desperate for lifeguards. They would take all your lifeguards. You'd lose all your certifications. You | 00:56:55 | |
| you'd, you know, lose your whole structure. | 00:57:00 | |
| It would really have to be just known like that would. That wouldn't be a short term. | 00:57:05 | |
| Solution. | 00:57:10 | |
| And so for that reason, we're doing our best and, and I think we're we're on the path to not. | 00:57:11 | |
| Have to have those kinds of conversations right now. | 00:57:18 | |
| Again, just from. | 00:57:23 | |
| You know the couple months ago where we saw a two and a half million dollar gap to now I think we. | 00:57:25 | |
| We're on the path towards avoiding. | 00:57:30 | |
| Those types of things, but we what we have done though. | 00:57:33 | |
| Is look at things like. | 00:57:36 | |
| Keeping vacant positions unfilled instead. And umm. | 00:57:38 | |
| Reducing travel budgets, training budgets, you know those types of things. | 00:57:43 | |
| So still impactful, but. | 00:57:47 | |
| But we've tried to avoid. | 00:57:50 | |
| For that reason, we've really tried to avoid any impacts to any. | 00:57:52 | |
| Like real programs. | 00:57:55 | |
| That would be longer term impacts. | 00:57:57 | |
| So. | 00:58:00 | |
| So we'll keep working on those. The other was. | 00:58:02 | |
| We were going to note that. | 00:58:05 | |
| You know, one of the goals a couple years ago was we said. | 00:58:08 | |
| That when revenues were high because of cannabis, we did not want to adopt A plan that used our reserves. | 00:58:11 | |
| You know that the reserves are there for years that are tough where we don't have the revenues. | 00:58:18 | |
| And so again a couple weeks ago when we were writing these reports. | 00:58:23 | |
| We were looking and saying, well, maybe this is the year that we have to use some of those reserves to get by. | 00:58:28 | |
| I think that the plan that we'll be bringing forward in a couple weeks, I don't think we'll be doing that for Year 1. | 00:58:34 | |
| But uh. | 00:58:40 | |
| That may be a conversation for Year 2. | 00:58:41 | |
| And I think. | 00:58:45 | |
| The real sort of. | 00:58:46 | |
| Conversation for your two will be. | 00:58:48 | |
| You know, can we continue to identify savings? Can we continue to have some attrition? | 00:58:50 | |
| To get balanced or. | 00:58:54 | |
| Do we need to use? | 00:58:57 | |
| The reserves we have. | 00:58:58 | |
| You know if that doesn't happen, so. | 00:59:00 | |
| The other option, the third, which we are working on and Council has approved us to work on already. | 00:59:03 | |
| Is revenue increases. | 00:59:09 | |
| The key there is you know. | 00:59:13 | |
| We're not looking at increasing revenues. | 00:59:14 | |
| And this I think was the key is. | 00:59:17 | |
| We're not increasing revenues because we were overspending. We've reduced the spending and we're we're spending. | 00:59:19 | |
| Pretty minimally. | 00:59:26 | |
| But we're looking at increasing revenues because the costs of providing services has gone up and we haven't increased. | 00:59:28 | |
| Those costs are those those fees. | 00:59:34 | |
| And we had talked recently about. | 00:59:37 | |
| Some of the utility funds. | 00:59:40 | |
| Having. | 00:59:42 | |
| Not been increased for 12 hours. Utility rates not being increased for. | 00:59:43 | |
| A decade plus. | 00:59:47 | |
| And so just like everything in this presentation is the cost of everything has gone up including those and so. | 00:59:49 | |
| That's something we need to look at. | 00:59:55 | |
| So the council had approved that we look at those. We're also looking at our master fee schedule in some other areas. | 00:59:57 | |
| And so. | 01:00:02 | |
| When we looked at our revenues and they were flat, I think. | 01:00:04 | |
| Looking at. | 01:00:08 | |
| The things that we haven't increased for many years is one way to sort of. | 01:00:09 | |
| Stay balanced moving into the future. | 01:00:13 | |
| And then the last. | 01:00:16 | |
| Which? | 01:00:18 | |
| We're going to explore and we're going to bring some items to the council on this, but it's really not an ongoing solution. | 01:00:19 | |
| It's a one time solution is exploring options with surplus city property. | 01:00:26 | |
| And we actually do have. | 01:00:32 | |
| One that we're working on that I think would be. | 01:00:34 | |
| A positive all the way around, but it would particularly would be a positive right now if we could. | 01:00:39 | |
| Kind of include that as another. | 01:00:45 | |
| Way to balance that. | 01:00:48 | |
| What we hope is a more temporary gap. | 01:00:50 | |
| On that second year of the budget, so. | 01:00:53 | |
| So we're looking at all of those things. | 01:00:56 | |
| Like I said when we wrote this report. | 01:00:58 | |
| We were still. | 01:01:01 | |
| Had a significant gap where we were going to really try to talk through some ideas to close it. | 01:01:02 | |
| We've made good progress on that. | 01:01:08 | |
| I'll leave it with. We're going to be looking at each of these and we have implemented the four up top. We're looking at the four. | 01:01:11 | |
| On bottom, it's probably going to be a combination of those four things to get. | 01:01:19 | |
| Balanced over the next two years. | 01:01:23 | |
| And try to sort of. | 01:01:26 | |
| Truly get balanced versus just trying to keep making 5% reductions every year and trying to catch up so. | 01:01:31 | |
| So. | 01:01:38 | |
| That is where we're at. | 01:01:40 | |
| And we will be bringing the second workshop in two weeks where we will go through significant detail. | 01:01:43 | |
| Of what's proposed to be. | 01:01:51 | |
| Reduced. | 01:01:53 | |
| And where that leaves us so? | 01:01:55 | |
| But again, the key thing today was we just wanted everybody to really understand that big picture. | 01:01:58 | |
| I, you know, it's not unusual when we're having a cut year or reduction year. | 01:02:05 | |
| That, umm. | 01:02:09 | |
| You know. | 01:02:10 | |
| Position that you have to hold vacant or each. | 01:02:13 | |
| Cut you make, somebody will say, but that's the one that's really important to me. | 01:02:16 | |
| And uh. | 01:02:20 | |
| We really wanted to have the conversation big picture because. | 01:02:21 | |
| We want everybody to see it. It's not about. | 01:02:25 | |
| You know. | 01:02:28 | |
| One or two. | 01:02:30 | |
| Things where it's not about. | 01:02:32 | |
| You know, can we? | 01:02:35 | |
| Afford maybe or you know, maybe, you know, twelve $10,000 here isn't a big deal or you know, those kinds of conversations. | 01:02:36 | |
| Where we really wanted to show everybody. It's really about structurally changing how we look at the budget. | 01:02:43 | |
| And sort of knowing what is a realistic spending level and continually trying to. | 01:02:49 | |
| Get us to that point. | 01:02:54 | |
| So. | 01:02:56 | |
| That is. | 01:02:58 | |
| Our workshop for today and we'll have more information in two weeks and we're happy to answer any questions. | 01:02:59 | |
| Great. Thank you. | 01:03:07 | |
| Are there any questions? We'll just take questions at this time. We'll come back around for comments and discussion. Yes, | 01:03:08 | |
| Councilmember Press. | 01:03:11 | |
| Mr. City Manager. | 01:03:15 | |
| You inherited this problem. When you got here, you came into a situation. | 01:03:17 | |
| Where we were having issues and you knew of the issues before when our last budget meeting, before we even started. | 01:03:23 | |
| You were concerned about some of the stuff that you were hearing. | 01:03:30 | |
| And with the new finance director and everything happening, what things have been done in the finance department? | 01:03:34 | |
| Where you have confidence in what is being done and what is you're hearing from them, the numbers that you're hearing. | 01:03:41 | |
| To make sure that we don't repeat the mistakes of the past. | 01:03:48 | |
| I think that's where. | 01:03:51 | |
| We were trying to highlight. | 01:03:53 | |
| There's a few charts but. | 01:03:56 | |
| This is this is a good one that. | 01:03:58 | |
| You know, it's really trying to understand. | 01:04:00 | |
| What? | 01:04:03 | |
| Normal is and trying to make sure we're staying within that. | 01:04:04 | |
| I think. | 01:04:07 | |
| One thing I heard from a lot of our employees was that. | 01:04:09 | |
| People have sort of seen this cycle of, you know, something good happens and then revenues go up. | 01:04:14 | |
| And then they drop. | 01:04:20 | |
| And then once you. | 01:04:22 | |
| If you add ongoing expenses. | 01:04:24 | |
| To a temporary one time revenue. | 01:04:27 | |
| You'll be in trouble the next year, you know. | 01:04:30 | |
| And. | 01:04:32 | |
| So I think that's really the key thing is trying to. | 01:04:33 | |
| Really figure out what should we be, what is our spending level, what is our revenue level and trying to stay there. And the | 01:04:37 | |
| challenge for us right now is getting balanced and then the next challenge after that will be when revenues increase not. | 01:04:44 | |
| Doing the same thing all over again, you know, And not not. | 01:04:50 | |
| Not kind of falling back into that cycle. | 01:04:54 | |
| So for us, it's really been the key was. | 01:04:57 | |
| Really trying to figure out what is that normal level you know because you see the chart go like. | 01:05:00 | |
| This and go up and down, but it's like, what's that line where? | 01:05:05 | |
| You know it's. | 01:05:10 | |
| That we should be aiming for every year. | 01:05:12 | |
| To follow that up. | 01:05:15 | |
| When you first started, the first thing you tackled was our budget. We had a deficit. | 01:05:16 | |
| You worked hard, you got rid of it, and then everything you did was pretty much undone. | 01:05:20 | |
| Are you confident in the staff and the finance department? Are you confident in everyone being able to do what they need to do to | 01:05:26 | |
| make sure that we. | 01:05:30 | |
| Keep on balance our budget in the next few years. | 01:05:35 | |
| And. | 01:05:37 | |
| Cannot meet the same mistakes. | 01:05:38 | |
| Yeah, I think. | 01:05:40 | |
| I think. | 01:05:43 | |
| The challenge the last couple years was every time we would make reductions. | 01:05:44 | |
| The. | 01:05:48 | |
| Of what was left would go back up. | 01:05:49 | |
| And so it wasn't. | 01:05:52 | |
| So much. | 01:05:55 | |
| You know that. | 01:05:56 | |
| It wasn't things being added back into the budget, but it was that you know when you go. | 01:05:59 | |
| When this department has this position and that position is this many dollars and then the next and we got it down to the, you | 01:06:04 | |
| know, the dollars that we have. | 01:06:09 | |
| And then the next year it goes up 7% because of a, you know, a. | 01:06:14 | |
| Negotiated. | 01:06:21 | |
| Cost of living increase. | 01:06:22 | |
| And so that's been the thing we've been fighting. I think it's the thing we're going to. | 01:06:24 | |
| Keep fighting. | 01:06:28 | |
| You know, one thing we have to keep in mind is this year. | 01:06:30 | |
| Contract negotiations are scheduled, so it's something that. | 01:06:34 | |
| All of us are going to have to sort of keep in mind. | 01:06:38 | |
| Again, this chart is key to me because it just. | 01:06:41 | |
| Looking at the revenue revenues, that's really the key point everybody is the revenues are flat. | 01:06:45 | |
| You know, in the past. | 01:06:49 | |
| Like we talked about a minute ago. | 01:06:51 | |
| You know when there are these spikes and everything? | 01:06:53 | |
| Sometimes people go, well, this is the new normal. | 01:06:57 | |
| You know, but yeah. | 01:06:59 | |
| This is the normal and they really. | 01:07:00 | |
| Haven't been increasing. | 01:07:03 | |
| With because of economic uncertainty, we don't expect them to increase. | 01:07:05 | |
| If something you know happens unexpected and they do increase, great, but then that's where the key point would be. But we should | 01:07:09 | |
| still try to stay within what normal levels are if there's this one time change, so. | 01:07:14 | |
| So I think. | 01:07:20 | |
| I think we. | 01:07:23 | |
| Understand that. | 01:07:25 | |
| From your question was you know. | 01:07:26 | |
| Are we ready to? | 01:07:29 | |
| And able to sort of. | 01:07:31 | |
| You know, keep that. | 01:07:33 | |
| In place and and really. | 01:07:35 | |
| Not make that mistake. | 01:07:37 | |
| And I think we understand that and we're going to keep working towards it. | 01:07:39 | |
| It's just for all the reasons mentioned and this charts the perfect example of just. | 01:07:43 | |
| Even if we make no additions next year, the costs go up. | 01:07:47 | |
| It's going to be an ongoing challenge. | 01:07:51 | |
| Thank you. | 01:07:54 | |
| Thank you. | 01:07:57 | |
| So going back 25 years. | 01:07:59 | |
| Macro view. It seems like every time the city ran into the situation. | 01:08:02 | |
| They would sell out a piece of property. | 01:08:08 | |
| Build it up. | 01:08:10 | |
| Whether it's the hideaway. | 01:08:11 | |
| Right across over here, Harbor Walk. | 01:08:15 | |
| Ocean Walk. | 01:08:17 | |
| I forget all the names but. | 01:08:19 | |
| So here we are again. | 01:08:21 | |
| We're in the same situation. | 01:08:23 | |
| If we were to sell off. | 01:08:27 | |
| The nine properties at the hideaway and I've always been uncomfortable with the fact that the city owns 9 units in the hideaway. | 01:08:29 | |
| My fear is that yes, we would solve our problem like we've always done in the past. | 01:08:38 | |
| But is that something? | 01:08:43 | |
| That you would consider. | 01:08:46 | |
| And I think. | 01:08:50 | |
| I think it would solve our problems just like the city had solved their problems throughout the. | 01:08:51 | |
| You know, every, every time they ran into the situation, they do a new development. | 01:08:56 | |
| So here we are. | 01:08:59 | |
| In this situation again. | 01:09:00 | |
| And and if we were to sell, say those nine properties at. | 01:09:02 | |
| The Hideaway. | 01:09:07 | |
| What changes would we make? | 01:09:09 | |
| Structurally. | 01:09:12 | |
| We would not. | 01:09:14 | |
| Because we're running out of. | 01:09:15 | |
| Properties. | 01:09:17 | |
| To sell. | 01:09:18 | |
| And I could go all the way back to the sale to the port. | 01:09:19 | |
| The big area out in front of a. | 01:09:23 | |
| Anacapa View Homes. | 01:09:27 | |
| You know, right over here there used to be a hospital, whatever, I mean all these developments. So we seem to. So anyways, do you | 01:09:30 | |
| feel that if we were to sell. | 01:09:34 | |
| Say those 9 units solve our problem today. | 01:09:39 | |
| Would we be able to make the necessary changes to? | 01:09:42 | |
| Whether these storms, these revenue storms? | 01:09:46 | |
| OK, Yeah, the the key, the interesting thing there is actually the thing you said at the end, which is. | 01:09:49 | |
| I was gonna say. | 01:09:54 | |
| And I said it earlier that. | 01:09:55 | |
| Selling property is not a ongoing solution. It's a one time solution to an ongoing. | 01:09:57 | |
| Problem. So we have to structurally keep working on. | 01:10:03 | |
| Just structurally getting balanced and sustainable. | 01:10:07 | |
| If we were to sell a property, it would be essentially. | 01:10:11 | |
| Which you ended on there. It would be a way to try to. | 01:10:15 | |
| Stay balanced for another year to buy us time to do that, you know which is. | 01:10:19 | |
| That's been part of the strategy the last couple years and into the next two years is. | 01:10:24 | |
| Trying to. | 01:10:29 | |
| Basically. | 01:10:32 | |
| Make sure we are limiting what we can. | 01:10:33 | |
| To have the time to make structural changes without them being painful. | 01:10:37 | |
| And if you look at that chart that showed the FTE count, the full time employee accounts. | 01:10:42 | |
| The number of employees have dropped over the last couple of years, but it hasn't. | 01:10:47 | |
| Been painful, so to speak. We haven't had to have, you know. | 01:10:52 | |
| We haven't had to impact any existing employees. It was vacant positions. | 01:10:56 | |
| That's. | 01:11:01 | |
| The thought process is. | 01:11:03 | |
| You know, instead of having to have. | 01:11:05 | |
| And if we hadn't made the reductions we had, we would have been in a spot where we would be having a much more difficult | 01:11:08 | |
| conversation, right, because we made those reductions. | 01:11:12 | |
| We're able to say now we have the time to make a couple years worth of reduction, you know, changes. | 01:11:16 | |
| And we didn't. | 01:11:22 | |
| We don't have to overreact because we haven't drained our reserves. | 01:11:23 | |
| To go back to your question about. | 01:11:27 | |
| The proper. | 01:11:30 | |
| What we're one thing is. | 01:11:31 | |
| Is you don't. We don't want to be in a spot where we're selling a property because we have to. | 01:11:33 | |
| You know, and so that's not what we're looking for at this point. | 01:11:37 | |
| What the the the item I mentioned and we're still working on it, but it would actually be something that I think the city. | 01:11:41 | |
| Would want to do. It's something the city has chosen to do in the past. | 01:11:48 | |
| We're partnering with another agency on on a property that leads to affordable housing essentially. | 01:11:52 | |
| So it's not something that we are saying. | 01:11:59 | |
| Explore it, because we need the money, you know. | 01:12:02 | |
| But the timing right now is helpful where? | 01:12:05 | |
| If it's something we want to explore and. | 01:12:09 | |
| Right now we could use the money, you know, so. | 01:12:13 | |
| But I think to your point. | 01:12:16 | |
| You know, we don't want to get to a spot where we're selling the properties that we have. | 01:12:18 | |
| Because. | 01:12:22 | |
| We need a Band-Aid to survive another year. | 01:12:25 | |
| And so we aren't, we aren't at that point. | 01:12:27 | |
| The goal would be over the next two years to keep working to. | 01:12:31 | |
| Make sure we're still not at that point. | 01:12:34 | |
| But umm. | 01:12:36 | |
| But the. | 01:12:39 | |
| In the mean time though, I think there's a couple of opportunities that we want to explore and bring to the Council. | 01:12:40 | |
| That are actually positive win win opportunities. | 01:12:46 | |
| So I got one more question just for perspective. | 01:12:49 | |
| And I know when you came here, Council Member Perez. | 01:12:53 | |
| Reminded me that. | 01:12:58 | |
| You know at. | 01:12:59 | |
| Prior to you coming in, we're like. | 01:13:01 | |
| We're gonna have a skate park, we're gonna have a destination playground. We're gonna do Bubbling Springs. We're gonna do this. | 01:13:03 | |
| We're gonna do that. And remember when you came in and said I don't think you guys get afford all this? | 01:13:07 | |
| And, umm. | 01:13:12 | |
| I remember you saying I'm not even sure if we could. | 01:13:15 | |
| Afford bubbling springs. | 01:13:18 | |
| Because yes, it's an $8 million grant. | 01:13:19 | |
| But we know we're going to come over, and we have. | 01:13:22 | |
| Cash flow that we have to dedicate and I think so my question is. | 01:13:25 | |
| If we didn't do bubbling springs, we'd still have the same problem, it would just be a little further out because I think what we. | 01:13:29 | |
| Dipped in our $4 million. | 01:13:37 | |
| For that project. | 01:13:40 | |
| Yes, out of the general fund. | 01:13:41 | |
| So. | 01:13:43 | |
| Yeah. So like, I guess my question is like. | 01:13:46 | |
| You know, how do we? | 01:13:49 | |
| How do we better prepare? | 01:13:50 | |
| For the inevitable. | 01:13:52 | |
| Yeah, I think to reiterate. | 01:13:54 | |
| The point you made because I do think. | 01:13:56 | |
| Some people have the perception like are we in a problem because of bubbling springs And that's not the case. | 01:13:58 | |
| The the way we. | 01:14:05 | |
| Addressed bubbling springs and the issues there, and there's a couple key points as one is. | 01:14:07 | |
| Remember, we had significant grant funding for the project. | 01:14:12 | |
| And then yes. | 01:14:16 | |
| When one of my first meetings we talked about. | 01:14:18 | |
| Postponing other projects. | 01:14:22 | |
| Including our ARPA funded projects and taking that funding and putting it towards bubbling spring. | 01:14:25 | |
| Bubbling Springs. | 01:14:30 | |
| So I think we ended up with something like 8 or $9 million of the project paid for by these other sources. | 01:14:32 | |
| And then we talked about, you know. | 01:14:39 | |
| Knowing that. | 01:14:42 | |
| The the bulk of it is paid for by these. Are we willing to? | 01:14:44 | |
| Essentially, you know, fill the gap of $4 million. | 01:14:48 | |
| But to your point. | 01:14:51 | |
| There were other projects already planned that would have utilized that funding. | 01:14:54 | |
| So, umm. | 01:14:58 | |
| The conversation. | 01:15:00 | |
| Really was Are we willing to postpone? | 01:15:03 | |
| All these projects and instead focus on one important one. | 01:15:06 | |
| Because if we don't. | 01:15:10 | |
| And I think it. | 01:15:12 | |
| I think it is true now. | 01:15:13 | |
| Two years later. | 01:15:16 | |
| Both in dollars and in staff time, we wouldn't have gotten Bubbling Springs done. We would have jeopardized grant funding, | 01:15:17 | |
| Millions of dollars of grant funding. | 01:15:21 | |
| We would have. | 01:15:25 | |
| Probably dipped into our reserves for multiple projects that would have added up to a lot more so. | 01:15:27 | |
| So those reductions that. | 01:15:33 | |
| Are those that conversation we had, I think. | 01:15:35 | |
| Put us in the position now where we got that project done. We didn't drain the reserves. | 01:15:38 | |
| And it's counterintuitive because I've heard a few people say, well, if we hadn't done bubbling springs, maybe we'd be fine. | 01:15:43 | |
| If we had stuck with sort of plan A we, I think we would have been a much worse position and. | 01:15:48 | |
| Having lost grant funding and having. | 01:15:53 | |
| Spent more money on design for projects that we can't afford to complete so. | 01:15:56 | |
| So, uh. | 01:16:01 | |
| That was a good outcome. We're sitting here today that projects done. It's the biggest project that the city has accomplished in | 01:16:02 | |
| many, many years. | 01:16:05 | |
| And I think it brings value to the community, so. | 01:16:09 | |
| So that's all positive, but. | 01:16:12 | |
| The the big challenge is moving forward. | 01:16:14 | |
| Like I said, we've identified we're able to grab about two years of CIP funding for the next couple years, which? | 01:16:18 | |
| Is actually the most CIP funding we've had. | 01:16:25 | |
| By creating that CIP reserve in September as well. | 01:16:27 | |
| September 2023. | 01:16:31 | |
| But there's a list of. | 01:16:33 | |
| Millions of dollars of projects or deferred maintenance or things like that, so. | 01:16:35 | |
| It's something we still have to keep an eye on. | 01:16:40 | |
| This year when we bring the budget forward. | 01:16:44 | |
| There's going to be. | 01:16:47 | |
| You know, that's one of the issues we will raise is. | 01:16:49 | |
| One of the ways we're going to stay balanced is by deferring things and like. | 01:16:51 | |
| That gets us by for a year, but deferred maintenance becomes a problem on its own right, and projects in and of themselves bring. | 01:16:56 | |
| Ftes whether partial or full fully, but when you have. | 01:17:04 | |
| Big projects that are coming along that and then you are putting more pressure on the system because you have to maintain it and | 01:17:09 | |
| add personnel. | 01:17:12 | |
| Yep, thank you. Let's go ahead and move on to Councilmember Hernandez. Thank you. Thank you Mr. City Manager and finance staff for | 01:17:16 | |
| the good work and. | 01:17:20 | |
| It's kind of. | 01:17:24 | |
| Encouraging even though the. | 01:17:25 | |
| Not, you know, we are concerned here. | 01:17:28 | |
| That you're already making closing that gap between the time the staff report went out till now, and I imagine you'll get closer | 01:17:30 | |
| to it by the 17th when we do the workshop. We're making good progress. Yeah, that's great. | 01:17:36 | |
| I did send you a list of questions I. | 01:17:43 | |
| I think you answered some of them and I do anticipate that the others will probably get answered at the at the workshop because | 01:17:46 | |
| they were kind of. | 01:17:50 | |
| Digging into some of the details here, but I do have a question about. | 01:17:54 | |
| Just I'm assuming that the revenues that we're looking at here for the general fund, those include property taxes. | 01:17:59 | |
| So these, yes, these include all general fund revenues. | 01:18:07 | |
| And our property tax. | 01:18:11 | |
| Revenue is just as flat. | 01:18:13 | |
| I would call it flat. I think it increases a couple 100. And so when you see here that the revenues increase a couple 100,000 a | 01:18:16 | |
| year, I think most of that is the property tax. | 01:18:22 | |
| Everything else is. | 01:18:28 | |
| Very flat. The property tax, That's still fairly flat. | 01:18:30 | |
| But. | 01:18:33 | |
| But that accounts for the whatever little increase there is. OK. | 01:18:34 | |
| I would like to hear you talk about more about what we. | 01:18:40 | |
| Will be doing during the workshop but before. | 01:18:43 | |
| Before we do that. | 01:18:47 | |
| Can you tell me will you have? | 01:18:49 | |
| Are you making any plans to implement the? | 01:18:51 | |
| Economic development plan. | 01:18:53 | |
| We can start looking at. | 01:18:55 | |
| Long term. | 01:18:57 | |
| Maybe short term, long term strategies, Yeah, yeah. So we are working on a couple elements. One of the challenges that we'll talk | 01:18:58 | |
| about in the second workshop is. | 01:19:03 | |
| With that plan and some other plans. | 01:19:08 | |
| It's one of those things where you know you have to spend money to make money and you have to have money to spend money. | 01:19:11 | |
| So, umm. | 01:19:17 | |
| I think what we're looking at so far right now is we're trying to find the low cost. | 01:19:18 | |
| Items that we can implement. | 01:19:23 | |
| And kind of get the best bang for our buck. | 01:19:25 | |
| But there are some. | 01:19:29 | |
| There's some projects in there that. | 01:19:31 | |
| You know, when we have the discussion, we're gonna have to look at which ones we can afford to do now and which ones are gonna | 01:19:33 | |
| have to wait. | 01:19:36 | |
| A little bit, umm. | 01:19:40 | |
| So. | 01:19:41 | |
| Yeah, I was about to get into detail, but I'll save the detail for the next. | 01:19:44 | |
| Meeting but. | 01:19:48 | |
| We are working on. | 01:19:49 | |
| Some low cost items on that plan. | 01:19:51 | |
| Thank you. | 01:19:54 | |
| Great. Thank you, Mayor Pro Tem. | 01:19:55 | |
| Yes, so. | 01:19:56 | |
| 70% of our. | 01:19:58 | |
| Expenses derived from manpower. | 01:19:59 | |
| And then you, you stated that the 30% remainder which is $7,000,000 looks like? | 01:20:02 | |
| We really can't. | 01:20:07 | |
| You're down to the bare minimum. | 01:20:08 | |
| It's not gonna. | 01:20:11 | |
| We can't cut our way out of this. | 01:20:12 | |
| So from 2017 to. | 01:20:14 | |
| 2024-2025. | 01:20:18 | |
| We went from 112 employees, spiked at 143 down to 132. | 01:20:21 | |
| So it looks like we've gained 20 employees since then. | 01:20:27 | |
| That that's currently so. | 01:20:31 | |
| What departments grew and what services didn't increase? | 01:20:34 | |
| I think you could pretty much look across the board and see where. | 01:20:38 | |
| Sort of across departments there was growth. | 01:20:44 | |
| I don't think it was. | 01:20:47 | |
| You know, kind of isolated to one location. I think that there was, it really was sort of across the board. | 01:20:49 | |
| I think umm uh. | 01:20:56 | |
| To sort of go to your. | 01:20:58 | |
| Question there is going back to the FTE charts. | 01:21:00 | |
| Did I pass it already? | 01:21:06 | |
| OK, good. Thank you. | 01:21:11 | |
| So going back to your FTE chart, so one of the things we're looking at doing. | 01:21:12 | |
| One of the questions for us. | 01:21:16 | |
| Is uh. | 01:21:18 | |
| Sort of what's implied in your question is, is 130 now is that, is that the minimum? | 01:21:20 | |
| You know, staffing level that we would have and we know we've had a lower number than that in the past. | 01:21:26 | |
| I do think that the true. | 01:21:34 | |
| Number is somewhere in between and. | 01:21:37 | |
| The reason I would say that is because. | 01:21:39 | |
| The city did pass Measure U in that period. | 01:21:42 | |
| 2 So Measure U is intended to sort of help. | 01:21:46 | |
| You know, maintain service levels. | 01:21:50 | |
| And so I think that the numbers in between and that's that is why. | 01:21:52 | |
| That approach we've talked about of. | 01:21:56 | |
| Sort of attrition. | 01:21:58 | |
| Managing vacancies, which is what we've used the last couple years to start. | 01:22:01 | |
| Bringing that number back down. | 01:22:05 | |
| Is part of the plan moving into the future? Because I do think. | 01:22:08 | |
| That. | 01:22:13 | |
| Quite simply, can we afford? | 01:22:16 | |
| Two years from now to still have. | 01:22:19 | |
| You know, 131 1/2. | 01:22:20 | |
| Employees. | 01:22:22 | |
| It looks. | 01:22:24 | |
| Difficult to do that so. | 01:22:26 | |
| Part of the workshop can we get? | 01:22:27 | |
| The breakdown between. | 01:22:30 | |
| In 2017 to 20/24/25. | 01:22:32 | |
| By department so we can see where the manpower grew. | 01:22:37 | |
| Just so because it seems like. | 01:22:40 | |
| It seems. | 01:22:41 | |
| I can provide that to the. | 01:22:44 | |
| Council, I think we could provide that. I only hesitated because sometimes personnel stuff we can't provide, but I think we could | 01:22:46 | |
| at least provide count by department. | 01:22:50 | |
| But I think that's. | 01:22:55 | |
| Sort of part of the answer. | 01:22:56 | |
| Moving forward and I think. | 01:22:59 | |
| To go back. | 01:23:01 | |
| Though the positive thing is by. | 01:23:02 | |
| Being proactive by already managing some of these costs and already starting to taper down. | 01:23:05 | |
| We have. | 01:23:09 | |
| The time and the reserves to kind of keep doing it in that. | 01:23:10 | |
| Less painful way of attrition and not having to have other discussions so. | 01:23:14 | |
| So that's that's why we said that's part of our plan is that, you know, managing vacancies. | 01:23:19 | |
| But we can provide. I'll make a note. | 01:23:24 | |
| To provide a position count by department. | 01:23:27 | |
| OK. So my next question is since cannabis is declining. | 01:23:30 | |
| With. | 01:23:35 | |
| Oxnard Ventura I know we have a cannabis. | 01:23:37 | |
| In our next. | 01:23:41 | |
| Go around but. | 01:23:43 | |
| This is pertains to. | 01:23:44 | |
| The declining sales. | 01:23:46 | |
| With no. | 01:23:48 | |
| What are our neighboring cities doing successfully? | 01:23:49 | |
| That they're growing and we're. | 01:23:53 | |
| We're declining. | 01:23:56 | |
| Or since they're opening, what? | 01:23:57 | |
| I mean they can't, I can't assume they took all ourselves. I know competition is probably. | 01:24:00 | |
| Is being very competitive? Are they driving our? | 01:24:07 | |
| Our cannabis stores out of business. | 01:24:11 | |
| Like, you know, survival of the fittest. | 01:24:14 | |
| All right. So do we have a good snapshot? Are we competitive with our neighboring cities? I think the biggest reason we're not | 01:24:16 | |
| competitive is unfortunately something we can't change. It's they're right off the freeway. | 01:24:22 | |
| And we're not. | 01:24:28 | |
| And I think. | 01:24:29 | |
| All else being equal. | 01:24:31 | |
| You know, I've talked to some people about this, but. | 01:24:33 | |
| If you come from the north and you get off the freeway to to go to a dispensary, you're gonna pass one right off the freeway. And | 01:24:36 | |
| are you gonna come like, are you gonna drive past that and, you know, come the extra 15 minutes to Port Hueneme? | 01:24:42 | |
| And same thing coming from the other direction. When you get off the freeway, there's another one right there and. | 01:24:49 | |
| And, you know, they're right there off the freeway. | 01:24:54 | |
| And. | 01:24:58 | |
| The one in Oxnard, I'll try not to use names, but the one in Oxnard closest to Camarillo, that anybody from coming from Camarillo | 01:25:00 | |
| would get off and pass right by. | 01:25:05 | |
| They have a Winnie Me location but. | 01:25:10 | |
| They're right off the freeway now, and I think you're starting to see that, you know, shift. | 01:25:13 | |
| So I think all else being equal, if we did everything else the same. | 01:25:18 | |
| I think they still have that advantage. | 01:25:23 | |
| And I actually would highlight with what we've heard from a lot of dispensaries is. | 01:25:25 | |
| Oxnard's actually charging them a lot more because they had to. | 01:25:30 | |
| I don't remember if they officially put out the number, but the number we're hearing from people is that they essentially have to | 01:25:35 | |
| pay 250 grand for the permit to get started. | 01:25:39 | |
| And even with that. | 01:25:44 | |
| They know they want that location right off the freeway. | 01:25:45 | |
| They could stay in Winimi and not have to pay that, but it's. | 01:25:48 | |
| You know it's worth that trade off for them so. | 01:25:52 | |
| So we've heard that from some of our dispense, well several of our dispensaries, you know that. | 01:25:55 | |
| That was. | 01:26:01 | |
| Even with that. | 01:26:02 | |
| Fee that we don't have. | 01:26:03 | |
| They're still moving forward with opening those locations, so. | 01:26:05 | |
| So I just think that the biggest competitive advantage they have is location. | 01:26:09 | |
| And. | 01:26:13 | |
| Unfortunately, that's the one thing we can't change. | 01:26:15 | |
| We do actually though, and I know you and I. | 01:26:18 | |
| Went back and forth on this. | 01:26:21 | |
| Earlier today, but. | 01:26:23 | |
| We do charge a lower. | 01:26:24 | |
| Rate, uh. | 01:26:26 | |
| Than Oxnard. | 01:26:27 | |
| And Ventura do. | 01:26:28 | |
| On dispensaries. | 01:26:31 | |
| Which is most of our businesses, so. | 01:26:34 | |
| So we are still trying to be competitive. We focused on it. | 01:26:37 | |
| And then a couple months ago. | 01:26:41 | |
| There was an article in the paper about a lot of. | 01:26:43 | |
| Dispensaries lowering their their fees. | 01:26:46 | |
| But they were at. | 01:26:49 | |
| 9 or 10% and so they were lowering to 5 or 6% and we've been at 5%. | 01:26:51 | |
| Amongst the lower ones since we started. | 01:26:56 | |
| So I think. | 01:26:59 | |
| In dispensaries at least you know, maybe some of the other fees, maybe if we had adjusted earlier, maybe we would have gotten some | 01:27:02 | |
| of those businesses in, but. | 01:27:05 | |
| I don't think so because even other cities have really struggled to get those businesses in, like the cultivation. | 01:27:09 | |
| That is just very difficult in. | 01:27:15 | |
| Southern California manufacturing and cultivation is just very difficult because of the costs. | 01:27:18 | |
| But for us, that's the challenge. And so just round numbers, so everybody knows. So our cannabis revenue went from about 3 million | 01:27:23 | |
| at its peak. | 01:27:28 | |
| In a year. | 01:27:32 | |
| Three years ago. | 01:27:34 | |
| And has come all the way down to about 1,000,000 so. | 01:27:35 | |
| I think even. | 01:27:39 | |
| Projections. | 01:27:40 | |
| From the sales tax consultants. | 01:27:41 | |
| Two years ago was that it would settle at like 1.6 million like they thought maybe cut in half. | 01:27:43 | |
| But it's really been cut into a third. | 01:27:49 | |
| So. | 01:27:51 | |
| Yeah, that one. | 01:27:54 | |
| Yeah. And so this graph. | 01:27:56 | |
| Shows sales tax and cannabis. | 01:27:59 | |
| And so. | 01:28:02 | |
| That's why it doesn't just say 3 million to 1,000,000, but if it was just cannabis it would show 3 million to 1,000,000. | 01:28:04 | |
| OK, great. Thank you. | 01:28:12 | |
| Any other? | 01:28:14 | |
| Questions before we move on. | 01:28:15 | |
| OK, great. So we'll now open the public hearing. It's open and it is now 756. | 01:28:16 | |
| Madam Clerk, are there any public comments? | 01:28:24 | |
| We have to written public comment. | 01:28:27 | |
| The first one is from Jessica Balka. | 01:28:31 | |
| Good evening council members, community members and city staff. I am a port winning me resident who genuinely loves this | 01:28:34 | |
| community. | 01:28:37 | |
| I've I've seen this city come together through hard times. I want to thank staff for working hard to try to stabilize the budget | 01:28:41 | |
| and protect the services residents depend on. | 01:28:46 | |
| I would like to bring up honest concerns about something that's not working. | 01:28:52 | |
| The Police Department. | 01:28:55 | |
| The city has serious issues with accountability, transparency and basic responsiveness that get ignored. | 01:28:57 | |
| Adding a new police dog would require taking an officer off the streets. | 01:29:03 | |
| And is the exact opposite of what this community needs right now. | 01:29:07 | |
| Everyone loves dogs but long term getting another canine which requires a handler. | 01:29:11 | |
| Officer, a working vehicle, additional and ongoing officer training, and a host of other equipment is not a cost effective | 01:29:16 | |
| solution to a problem that cannot be solved by ignoring the real problems and allowing the department to crowd fund. | 01:29:22 | |
| To obtain a drug dog. | 01:29:29 | |
| We should ask ourselves if the canine the Police Department already has is actually working for the community. | 01:29:31 | |
| I would say it is not. | 01:29:37 | |
| I love dogs as much as the next person, but another canine for the Police Department is not the answer. | 01:29:39 | |
| It will not help the budget issues the city has. | 01:29:44 | |
| While some are being told to tighten belts, council events embrace for more cuts. | 01:29:47 | |
| Somehow there's still room in the budget for a canine program that doesn't address our actual public safety concerns. | 01:29:52 | |
| And puts our community at more risk. | 01:29:58 | |
| Taking officers off the streets to even think of this as a slap in the face to residents who are already frustrated. | 01:30:00 | |
| With how this department operates. | 01:30:06 | |
| We need more officers actually patrolling our streets and officers who genuinely engage with the community. | 01:30:08 | |
| Not performative programs that drain resources and remove personnel from patrol. | 01:30:14 | |
| It is already bad enough. | 01:30:19 | |
| I urge you, don't approve a police dog at the cost of real public safety. Focus on restoring trust, not appearances. | 01:30:21 | |
| Thank you, Jessica Baca. | 01:30:27 | |
| The next one is from Abraham Baca. | 01:30:30 | |
| Good evening, City Council members, community members and city staff. I want to acknowledge the city's proactive efforts to | 01:30:33 | |
| stabilize our budget amid declining revenues and growing economic uncertainty. | 01:30:38 | |
| The actions taken have hopefully helped preserve service levels and avoid more painful cuts. | 01:30:44 | |
| As we look to the 20/25/26 and 20/26/27 budgets. | 01:30:50 | |
| I support the continued focus on sustainability, protecting the general fund, and minimizing impacts to core services our | 01:30:56 | |
| residents rely on. | 01:31:00 | |
| However, I must express concern about one specific proposal. | 01:31:04 | |
| The addition of a new police dog. | 01:31:07 | |
| Which would require removing a sworn officer from patrol. | 01:31:09 | |
| At a time when we are facing projected deficits, increased service demands and staffing constraints, we cannot afford to shift | 01:31:13 | |
| critical frontline resources. | 01:31:17 | |
| Public safety is a top priority, but it must be approached strategically. | 01:31:22 | |
| Removing an officer from our streets to fund a canine program does not align with our fiscal reality or the broader community | 01:31:26 | |
| safety needs. | 01:31:30 | |
| I urge council to direct staff to prioritize efficient, people focused investments and to reconsider any additions to the Police | 01:31:34 | |
| Department that reduce boots on the ground. | 01:31:39 | |
| Let's ensure every dollar serves the highest needs, especially during this critical planning period. | 01:31:44 | |
| Thank you. | 01:31:48 | |
| And that concludes public comment. | 01:31:50 | |
| Mayor, if I could just. | 01:31:51 | |
| Provide some information to the Council and. | 01:31:53 | |
| To the public comments so. | 01:31:57 | |
| I know we didn't get into detail, so I didn't. | 01:32:00 | |
| Speak to what? | 01:32:03 | |
| The detailed items that are in the budget, but I just did just want to note that. | 01:32:04 | |
| There isn't a second canine. | 01:32:10 | |
| Officer included in the. | 01:32:13 | |
| Budget that we're bringing forward in two weeks. | 01:32:15 | |
| There is not. I don't know if that was clear when I said it. | 01:32:18 | |
| There is not that. | 01:32:21 | |
| 2nd canine unit. | 01:32:23 | |
| I understand the perspective I think. | 01:32:26 | |
| We have a similar perspective that. | 01:32:30 | |
| We need to. | 01:32:32 | |
| Sort of make sure that our budget is sustainable and that we're taking care of priorities before we talk about any additions, you | 01:32:34 | |
| know, across the board. | 01:32:37 | |
| So we'll bring that budget forward and we'll explain that, but it's not in the budget that's being proposed. | 01:32:41 | |
| And. | 01:32:48 | |
| We'll have more information on that. | 01:32:50 | |
| The detailed meeting in two weeks. | 01:32:52 | |
| Great. Thank you. | 01:32:55 | |
| So I will now close the public. | 01:32:56 | |
| Sorry, comment section of the hearing. | 01:33:01 | |
| It is now 801. | 01:33:04 | |
| We have before us a recommendation to direct staff to incorporate any direction and return with the second budget workshop. | 01:33:07 | |
| On May 19, 2025. | 01:33:15 | |
| Is there anything that you all want to add? | 01:33:18 | |
| Any direction? | 01:33:22 | |
| It's just going to be during the meeting. We'll get to that. | 01:33:27 | |
| At the end of today, when we talk about the next agenda, we're going to keep that agenda light so we can have like a. | 01:33:31 | |
| Workshop within the regular time 6:30. | 01:33:36 | |
| Great. Thank you, Mike. Mike and my comment was about is there any other direction that the Council would like to give the staff | 01:33:39 | |
| in preparation for? | 01:33:42 | |
| The next workshop. | 01:33:46 | |
| If not, if their motion is there, can I get a motion in a second? Sorry. | 01:33:49 | |
| I move to approve the recommendations of stated in the staff report. | 01:33:55 | |
| 2nd. | 01:34:00 | |
| Thank you. | 01:34:02 | |
| Any discussion, Councilmember Gama? | 01:34:03 | |
| So this is complicated stuff and as we digest it our. | 01:34:06 | |
| Can we? | 01:34:10 | |
| Send questions to City Manager to be addressed at the May 19th Budget Workshop. | 01:34:11 | |
| Yes. Umm. | 01:34:17 | |
| We are planning to go pretty in depth. There was a question earlier. | 01:34:19 | |
| I think somebody had asked about. | 01:34:22 | |
| You know what will be presented at that meeting. | 01:34:24 | |
| We were planning. | 01:34:26 | |
| It is very difficult to really show everything, but what we're planning to do is bring sort of what was reduced from the budget | 01:34:28 | |
| so. | 01:34:32 | |
| You know, in a Goodyear, you start with your budget, you talk about what's being added. | 01:34:36 | |
| Think of not that it's a bad year, we're just trying to. | 01:34:40 | |
| You know, look ahead and be careful. So we're going to bring. | 01:34:43 | |
| We're going to start with. | 01:34:46 | |
| These things are being reduced from the budget. | 01:34:48 | |
| And then have that conversation with Council of. | 01:34:50 | |
| You know, umm. | 01:34:53 | |
| Whether to make any changes or not. | 01:34:55 | |
| So, so if there's questions about those, then we can make sure that we're. | 01:34:58 | |
| We plan to explain all those, but we you can send them and we'll make sure we. | 01:35:02 | |
| Are prepared for that so. | 01:35:06 | |
| Thank you. If there's nothing else, no comments discussion, Madam Clerk, please take roll call. | 01:35:09 | |
| Member Brown. | 01:35:14 | |
| Do you approve the recommendation? | 01:35:19 | |
| OK. | 01:35:22 | |
| Councilmember, Member. Commissioner Gama. | 01:35:24 | |
| Yes. | 01:35:28 | |
| Councilmember, Member. Commissioner Hernandez. | 01:35:29 | |
| Council member, member Commissioner Perez, Mayor Pro Tem. Vice Chair Vice President Lopez and Mayor Chair President McLean. | 01:35:32 | |
| Yes. Motion passes unanimously with Member Blackwell absent. | 01:35:41 | |
| Great. Thank you. This brings us to the end of the special joint meeting. We will now reconvene to the City Council regular | 01:35:46 | |
| meeting. | 01:35:50 | |
| The time is now 8. | 01:35:53 | |
| 04. | 01:35:55 | |
| Mr. Brown. | 01:35:56 | |
| Thank you. | 01:36:01 | |
| OK. All right. So we'll now move to the consent calendar. | 01:36:05 | |
| For the City Council meeting. | 01:36:11 | |
| The consent calendar have been acted in one motion unless a council member would like to request. | 01:36:14 | |
| Item be pulled. | 01:36:20 | |
| Any items to be pulled? | 01:36:22 | |
| If not, can I get a motion and a second move to approve the consent agenda? | 01:36:24 | |
| 2nd. | 01:36:28 | |
| All in favor. | 01:36:31 | |
| Aye, all opposed. | 01:36:32 | |
| Hearing none, motion passes unanimously. | 01:36:35 | |
| Great. We'll move on to item number 12A, public hearing. This is the annual development agreement compliance review for Emeril. | 01:36:38 | |
| Perspective Cooperative. | 01:36:47 | |
| Incorporated and finding. | 01:36:51 | |
| Of exemption from sequa. | 01:36:53 | |
| Madam Clerk, do you have proof of publication as required by law and a complete file of reports and exhibits? Yes, Madam Mayor. | 01:36:56 | |
| Thank you. Will staff please present. | 01:37:04 | |
| The report. | 01:37:07 | |
| Yes, and. | 01:37:10 | |
| Community and Economic Development Director Tony Stewart will. | 01:37:11 | |
| Take us through a presentation. | 01:37:14 | |
| Hey, thank you and good evening, Mayor. Mayor Pro Tem. | 01:37:19 | |
| Council staff and audience. | 01:37:23 | |
| This is. | 01:37:25 | |
| Development agreement Annual review for Emerald perspective is. | 01:37:27 | |
| You just mentioned. | 01:37:32 | |
| Back in June of last year, the City Council. | 01:37:34 | |
| Approved a series of. | 01:37:38 | |
| Amendments to our existing 18 development agreements with our cannabis businesses. | 01:37:40 | |
| And this is the first of the annual reviews since that June meeting. | 01:37:46 | |
| But. | 01:37:53 | |
| Further back, we've been discussing cannabis quite a bit in the last item. | 01:37:54 | |
| And back in 2016, the City Council, because they were facing a budget crisis at the time. | 01:37:59 | |
| Opted to allow cannabis businesses to operate in the city as a source of revenue. | 01:38:06 | |
| And since the city does not have a cannabis tax in place. | 01:38:11 | |
| The development agreement was the tool that the. | 01:38:15 | |
| Council at the time. | 01:38:18 | |
| Established to ensure that the various cannabis businesses here in the city. | 01:38:21 | |
| Would pay their required obligated payments towards the City General Fund or the contractual payment as it's called. | 01:38:26 | |
| The development agreements also include remedies that should the applicant default. | 01:38:34 | |
| And such a default would be for instance. | 01:38:39 | |
| If the annual amount of the contractual payment dropped by 50% or more of a three-year average. | 01:38:42 | |
| If any conditions of the related conditional use permits for the operation of each business were violated. | 01:38:49 | |
| Or if there was a continuing or repetitive breach of the city's ordinances. | 01:38:56 | |
| And as a result of the default, the city could terminate the development agreement, modify it, or exercise a similar remedy. | 01:39:01 | |
| And as stated in each staff report that was presented to the City Council for consideration of a cannabis a new cannabis | 01:39:10 | |
| businesses application. | 01:39:14 | |
| The respective development agreements specifically required applicants to agree to the following. | 01:39:20 | |
| Pay that contractual payment of 5% for dispensaries in this case of their annual gross revenues on a regular basis and this is | 01:39:25 | |
| less taxes paid such as? | 01:39:30 | |
| Sales tax or now excise taxes as we discussed back in June of last year. | 01:39:36 | |
| That they would maintain all books and records accurately and pay for annual audits. | 01:39:41 | |
| And it's down from 2 audits down to 1 audit annually. And this was the cost savings, a measure to help our businesses out. | 01:39:46 | |
| And this was per our June. | 01:39:53 | |
| 24 amendments to the development agreements. | 01:39:55 | |
| And that they'd obtain a certificate of occupancy to. | 01:39:59 | |
| Open their businesses with one year of effective date of the agreement being put into place. | 01:40:02 | |
| And in exchange for these provisions, the city would agree that through the development agreements. | 01:40:08 | |
| That the development rights in place at the time that the agreements were approved would be vested with the exception of any non | 01:40:14 | |
| conflicting laws or regulations. | 01:40:18 | |
| And so again, the public benefits summary, the reason why the city was allowing these businesses to operate in here in the 1st | 01:40:23 | |
| place would be again to open the business with one year. | 01:40:30 | |
| Of the effective date of the agreement. | 01:40:37 | |
| Provide the long term source of employment opportunities and assisting the revitalization of the economic development base of this | 01:40:40 | |
| Community. | 01:40:44 | |
| Provide the city directly with additional revenue in the form of an increase in certain taxes, such as sales taxes and whatnot. | 01:40:49 | |
| Provide additional monies for the general funding of this that 5% payment. | 01:40:56 | |
| And provide certain community benefits, which are generally 1% of the annual gross revenues that are put towards. | 01:41:01 | |
| Organizations and events and whatnot here in the community. | 01:41:09 | |
| So with regard to Emerald Perspective, it is the dispensary. It's located at 100 W Pleasant Valley Rd. They've been in business | 01:41:14 | |
| since April of 2019 and while they have been in compliance with past development agreement reviews. | 01:41:21 | |
| The city is currently out of compliance with their development agreement for the following. | 01:41:28 | |
| First of all, the lack of payment of 5% in gross revenues for the city's general fund, and this was for the months of November and | 01:41:33 | |
| December 2023, as well as from April 24. | 01:41:38 | |
| To present. | 01:41:43 | |
| Terms and condition #12 of their development agreement states that the City requires this payment. | 01:41:45 | |
| On a city on a regular basis. | 01:41:52 | |
| And again, the primary purpose for the city to require this payment is for allowing the cannabis businesses to operate. | 01:41:55 | |
| Basically, is a source of revenue for the general fund. | 01:42:03 | |
| And the lack of this payment to the city basically has a negative impact on our finances, as we've just discussed. | 01:42:05 | |
| And the ability to provide, all right, excuse me, provide services to ensure the health and safety of the public. | 01:42:12 | |
| Since December 23, staff has made over two dozen attempts to reach out to Emerald Prospective with regard to the amount owed to | 01:42:19 | |
| the city. | 01:42:24 | |
| Some of these the finance department was successful in at least talking to somebody, but we're told that. | 01:42:30 | |
| The business either claimed that they owed that they were owed money. | 01:42:37 | |
| To the city. | 01:42:41 | |
| And or they were being overcharged. | 01:42:42 | |
| Or they ignored Staffs outreach altogether. | 01:42:45 | |
| What documentation was provided to the city by the business was unsubstantiated, and requests from staff for the developer to | 01:42:48 | |
| provide proper documentation and backup data will also ignore it. | 01:42:54 | |
| Second, due to the lack of the regular payments and the affiliated paperwork. | 01:43:01 | |
| To prove otherwise. | 01:43:07 | |
| Staff cannot determine whether or not the developer has been providing the city directly with additional revenue from increased | 01:43:08 | |
| taxes, and further, the developer has not paid for this year's annual business license tax. | 01:43:13 | |
| I say this year's, I mean 2024 and now we're coming up with 2025 shortly. | 01:43:19 | |
| Terms and conditions #8 of the Development Agreement. | 01:43:24 | |
| Requires compliance with all existing development regulations in place at the time the agreement becomes effective. | 01:43:27 | |
| Our Municipal code sections 5003C and 5016 require that all businesses operating in the city pay their business license tax and | 01:43:34 | |
| have a business license in place. | 01:43:39 | |
| Again, this business is not at this time. | 01:43:45 | |
| Where there cannot be determined if the revenue is being generated in the form of additional taxes that is required by the | 01:43:48 | |
| agreement. | 01:43:51 | |
| Public benefits summary are occurring at this time. | 01:43:55 | |
| Three, the developer is out of compliance with several of the conditional use permits. Conditions of approval. The conditional Use | 01:44:01 | |
| permit, PHCU 844 was approved by the City Council to allow the operation of the dispensary back in April of 2018. | 01:44:08 | |
| Specifically, conditions 1431 and 40 require the developer to comply with their project application and what was contained within | 01:44:16 | |
| it. | 01:44:20 | |
| As well as the plans. | 01:44:24 | |
| That they would comply with their certificate of approval as well as the development agreement that employees where visible | 01:44:27 | |
| identification cards. | 01:44:31 | |
| And that the developer will agree to the annual business reviews by city staff and outside consultant HDL, respectively. | 01:44:35 | |
| HDL performs annual inspections of all of our businesses, generally in October that occurred with this year in October with | 01:44:43 | |
| Emerald Perspective and HDL when they were there. | 01:44:48 | |
| Found several violations of either. | 01:44:54 | |
| City or and or state law. | 01:44:57 | |
| Such as the business not having the required plans and documents on hand for the inspector to review. | 01:45:00 | |
| And the employees were not wearing proper identification. | 01:45:06 | |
| Staff follows up with the letters to the businesses, whether to let them know that they are in compliance or if there are | 01:45:10 | |
| corrections that are needed. | 01:45:14 | |
| When staff reached out with the letter to the developer, we asked that the items all be corrected by November 30th. | 01:45:19 | |
| To date, the developer has not responded to the letter nor verified that any of these corrections have been made. So again, the | 01:45:27 | |
| business is in violation of their CP. | 01:45:32 | |
| And Terms and conditions #17 of the Development Agreement notes that this is. | 01:45:37 | |
| Consideration of default with their development agreement. | 01:45:43 | |
| And finally, as I mentioned earlier. | 01:45:48 | |
| In addition to not paying for the. | 01:45:50 | |
| The contractual payment, business license tax. The developer is also not paid for the past audit or inspection. | 01:45:54 | |
| And again, terms and condition #17 notes the developer shall be in default if not in compliance with the CP with regard to. | 01:46:00 | |
| Condition #40 specifically. | 01:46:09 | |
| And this chart basically shows a breakdown of what is currently owed to the city by Emerald Perspective. | 01:46:12 | |
| The required 5% payment to the General fund, along with interest, totals $76,217.00, roughly. | 01:46:20 | |
| The remaining balance from the previous audit, not to mention the one current coming up soon, but the previous one is over $7000. | 01:46:29 | |
| The 2024 compliance inspection, which we just discussed has not been paid for and that's $12150. | 01:46:37 | |
| Balance of penalties for late payments from October to December 2022 / 3000 dollars. | 01:46:45 | |
| The past due business license tax is $16142 roughly. | 01:46:52 | |
| For a total of $89,154.69. | 01:46:56 | |
| And as of today, with this development agreement review, there's another $16180 for that fee. | 01:47:01 | |
| Which brings the total ode to the city of $90,834.69. And this is all general fund revenue. | 01:47:09 | |
| Or potential general fund revenue, I should say. | 01:47:16 | |
| So consequently, per the terms and conditions #11 of the development agreement, the City Council may opt to. | 01:47:19 | |
| One of several alternatives, the first one here. | 01:47:26 | |
| Would be to demand full payment of all monies owed to the city. | 01:47:30 | |
| By a certain date, IE 30 days from today. | 01:47:33 | |
| And if not paid in full within this period, revoke the development the Developers Development Agreement, subject to the procedures | 01:47:37 | |
| set forth in the Development Agreement and the City's adopted requirements and procedures. | 01:47:42 | |
| And should the City Council so choose this option, this would also begin the process of revoking the business's conditional use | 01:47:48 | |
| permit. | 01:47:51 | |
| I'll keep in mind they don't have a business license on file right now, so that would not be subject to revocation because of Bebo | 01:47:55 | |
| point. | 01:47:59 | |
| Alternatively, the City Council may allow a one time payment plan with fixed terms and conditions. | 01:48:05 | |
| Requiring a payment of not less than $12,000 immediately. | 01:48:11 | |
| That would be to cover all of the outstanding annual audit and inspection development, review and review. | 01:48:15 | |
| Bees as well as the business tax. | 01:48:21 | |
| Within 30 days of this hearing, with the remainder of the payments to be completed within no greater than six months. | 01:48:24 | |
| The agreement for the payment plan must then be entered into within 30 days of this hearing. | 01:48:30 | |
| And the payment plan would be based on the unaudited gross receipts, so basically what we know of today. | 01:48:35 | |
| Upon completion of the financial audit that will be coming up within the next few months here. | 01:48:41 | |
| And that will be for all of our cities here. | 01:48:46 | |
| All of our businesses in the city, I should say. | 01:48:48 | |
| A true up adjustment will be calculated based on the audit results. If there are additional revenues out of the city, the amount | 01:48:52 | |
| of additional revenues will then be due within 30 days of a completion. | 01:48:57 | |
| Of the audit. | 01:49:02 | |
| And these mounts will not be included in the payment plan. | 01:49:03 | |
| The business would also be able to continue to operate. | 01:49:06 | |
| Subject to complying with all terms and conditions of that payment plan. | 01:49:09 | |
| Or the City Council may take other additional action as we desired. | 01:49:13 | |
| Since, the developer has repeatedly ignored staff's request to produce the information. | 01:49:20 | |
| Necessary to validate their claims of how much is owed to the city. | 01:49:25 | |
| Ignored Staffs outreach all together with regard to paying for all of the fees that I've discussed previously. | 01:49:29 | |
| Since the city has not, excuse me, since the developer also has not paid the required annual business license tax. | 01:49:37 | |
| Is also operating in violation of the conditional use permit. | 01:49:44 | |
| Which is a violation of the development agreement. At this time, it is recommended that you, the City Council, find the Emerald | 01:49:47 | |
| Perspective is in violation of their development agreement and exercise option one. | 01:49:53 | |
| Which is to demand a full payment within 30 days. | 01:49:58 | |
| Or move forward with. | 01:50:02 | |
| Starting revocation of the development agreement and conditional use permit. | 01:50:05 | |
| That concludes my presentation. | 01:50:08 | |
| With regard to other than to mention that of course the project is exempt from SQL, we have to mention that. | 01:50:11 | |
| Fiscal impact again is over $90,800 due to the city's general fund at this time. | 01:50:19 | |
| And the. | 01:50:26 | |
| Recommendation then would be to open the public hearing and take testimony and documentary evidence. | 01:50:29 | |
| Close the hearing and consider this evidence. | 01:50:36 | |
| Adopt A resolution determining that Emerald Prospective Cooperative Incorporated is out of compliance with their development | 01:50:38 | |
| agreement. | 01:50:41 | |
| And make a determination the project is exempt from SQL. | 01:50:45 | |
| And takes such additional related action that may be desirable, including determination of which course of action to take | 01:50:48 | |
| regarding to the subject businesses default of the development agreement for the options noted in our staff report. | 01:50:54 | |
| And I'm happy to answer any questions you may have. | 01:51:01 | |
| Yes. | 01:51:06 | |
| Is anyone from Emeril perspective here? | 01:51:08 | |
| I believe so, according to Georgiana. I have not met anybody in person. | 01:51:12 | |
| So. | 01:51:18 | |
| We'd like to hear from Emerald perspective. I'd like to ask some questions to them. | 01:51:19 | |
| Can we? | 01:51:24 | |
| Ask questions Do you have any questions? | 01:51:25 | |
| Well, not really, because. | 01:51:33 | |
| They gave all the information that I have and and we need additional information from the actual business owner. | 01:51:37 | |
| OK. So we're in a hearing, so we'll follow the process. | 01:51:42 | |
| Go through public comments and. | 01:51:45 | |
| Discussion and comments will. | 01:51:47 | |
| Got it. | 01:51:50 | |
| Councilmember Gamma. | 01:51:51 | |
| Thank you. | 01:51:53 | |
| Are we? | 01:51:56 | |
| Only able to talk to. | 01:51:57 | |
| The recognized. | 01:51:59 | |
| Owner. | 01:52:01 | |
| Mead Whipple junior. | 01:52:03 | |
| In other words, is anyone authorized to speak on behalf of the? | 01:52:05 | |
| Organization. | 01:52:08 | |
| There's nothing that says that they that they can't. We don't have to hear it from necessarily a business owner. | 01:52:11 | |
| Specifically, OK. | 01:52:16 | |
| Yes, Thank you, Mr. Stewart for the. | 01:52:21 | |
| Presentation and all your efforts to. | 01:52:23 | |
| Collect this revenue. Can I see the option one again please? | 01:52:26 | |
| And I just, I wanted to know. | 01:52:31 | |
| Does that preclude us from? | 01:52:33 | |
| Collecting on the entire amount. | 01:52:36 | |
| OK, so we go with option one. Do we eventually? | 01:52:43 | |
| Can we eventually? | 01:52:47 | |
| Go after the full amount. Is that the intent? | 01:52:48 | |
| That is the intent. Option one would be to collect the entire amount within 30 days. | 01:52:51 | |
| I do. | 01:52:58 | |
| So. | 01:52:59 | |
| It shows November and December 2020. | 01:53:01 | |
| Three, there was. | 01:53:04 | |
| There was money owed. | 01:53:05 | |
| What? What was that exact dollar amount? | 01:53:07 | |
| I would have to defer to our finance department. I'm not sure exactly what those two particular months are, what I gave you were. | 01:53:12 | |
| Yeah. | 01:53:20 | |
| The amount in the slide was not just those two months, but everything owed for the 5% because it was those two months as well as | 01:53:21 | |
| from April 24 on to present. | 01:53:26 | |
| And that total amount with interest is $76,216.87. | 01:53:32 | |
| So what was the average monthly? | 01:53:38 | |
| Money that. | 01:53:42 | |
| What we would normally get. | 01:53:43 | |
| Do you know? | 01:53:46 | |
| Well, it's I sort of do, but we don't usually disclose the details on those for the security and safety of each business, so. | 01:53:47 | |
| They're in violation of not having a business license tax. | 01:53:58 | |
| Right, currently that is correct. | 01:54:02 | |
| And then something that was so simple as. | 01:54:05 | |
| The IDs. | 01:54:07 | |
| They never responded to our request. | 01:54:10 | |
| That is correct. | 01:54:13 | |
| Great. I'd like to just pose a question to. | 01:54:19 | |
| Are a city attorney. | 01:54:23 | |
| Can we take questions from the organization now and then go to public comments, or should we go to public comments first? | 01:54:25 | |
| Public comment first what I thought. Thank you. | 01:54:31 | |
| Any other question? | 01:54:34 | |
| Great. Thank you. I will now open the public hearing and take public comments. | 01:54:35 | |
| The time is now 822. | 01:54:41 | |
| Madam Clerk, are there any public comments? | 01:54:44 | |
| Yes, we have one from Emeralds perspective, Walter Gauss. | 01:54:47 | |
| High Council. | 01:54:58 | |
| My name is Walter Gaz. I'm an assistant manager at Animal Perspective. | 01:55:00 | |
| I'm here to ask for a 60 day. | 01:55:05 | |
| Extension for me and my Co workers. | 01:55:08 | |
| As we have not been notified until recently. | 01:55:11 | |
| Meet with OH the owner has been dealing with his wife's cancer and needed a full time job. | 01:55:15 | |
| So his full attention has not been at the shop and he has not been in. | 01:55:20 | |
| As much as he has used to be into her shop. | 01:55:25 | |
| He has notified us that his lawyer, Matthew Schriller, has contacted the City of Port Hueneme regarding this matter. | 01:55:31 | |
| Again, we are just asking for a 60 day extension for us. | 01:55:39 | |
| As employees so we could figure out how we could get the. | 01:55:43 | |
| Though needed funds for the city to continue operating. | 01:55:46 | |
| Thank you. Thank you. | 01:55:50 | |
| Are there any other public comments? | 01:55:52 | |
| No more public comments. | 01:55:55 | |
| Do you want the applicant to stay up here while they do the questions? | 01:55:57 | |
| Sir, are you prepared to answer some questions that the Council may have? | 01:56:04 | |
| Yeah, I can to the extent you can. | 01:56:08 | |
| Terrific. Thank you. Should the public comments. | 01:56:11 | |
| Should the hearing stay open? | 01:56:15 | |
| The hearing should stay up Great. Thank you. | 01:56:17 | |
| I just would like to ask one question if I may. | 01:56:19 | |
| So are all of you employees? | 01:56:22 | |
| So no, no one with the decision making authority is here. | 01:56:25 | |
| And making all the decision makings for the last. | 01:56:30 | |
| Pretty much year and a half. OK and what? | 01:56:32 | |
| Advice to. | 01:56:34 | |
| I basically just been keeping. | 01:56:37 | |
| OK, so and what is your role? | 01:56:39 | |
| What is your? Could you identify yourself please? | 01:56:43 | |
| And then can can you guys speak in the mic please? | 01:56:46 | |
| Andrea Reyes. | 01:56:49 | |
| And the general manager? General manager. OK, thank you. | 01:56:50 | |
| OK. Any questions? | 01:56:53 | |
| Councilmember Perez Well, I'm reluctant. Is there anyone really here with any authority to answer the questions that we have like | 01:56:56 | |
| we'd want to know? | 01:57:00 | |
| What happened, what got off track? What you know, you they built up so much past due why wasn't any payment made? You know, are is | 01:57:05 | |
| anybody available to even answer those questions? Yeah. | 01:57:10 | |
| Need pretty much left us to come here because he's. | 01:57:16 | |
| Just dealing with. | 01:57:19 | |
| Life things and. | 01:57:21 | |
| Basically he told us that. | 01:57:23 | |
| There is some discrepancy against. | 01:57:26 | |
| Something about. | 01:57:28 | |
| Payment that's owed. | 01:57:29 | |
| Whatnot that I'm not too sure about what it is. He's supposed to be giving me more paperwork from his attorney to show me | 01:57:31 | |
| everything. | 01:57:34 | |
| But he said to ask for like a 60 day extension because. | 01:57:38 | |
| We are trying to come up with something like. | 01:57:41 | |
| To give you guys an upfront payment. | 01:57:44 | |
| So we could. | 01:57:46 | |
| Start a payment plan to get back into compliance just to keep her shop open. | 01:57:47 | |
| Why? Because I understand that he thinks that we owe them money, but still, I mean the contract states that. | 01:57:50 | |
| You pay a certain amount. | 01:57:56 | |
| There's, you know, there's a. | 01:57:58 | |
| He went into the agreement understanding all the things that he had to do and doesn't sound like he's done any of them so. | 01:58:00 | |
| Not sure how much we can get out of this without really having the person here to answer those questions. | 01:58:07 | |
| If I can interject just one comment, I did speak with a Mr. Schiller. | 01:58:13 | |
| Late last week he contacted me. | 01:58:17 | |
| Either Thursday or Friday. He did not identify himself as an attorney. | 01:58:20 | |
| My understanding was that he was an accountant. | 01:58:26 | |
| And I essentially informed him the amount that was owed. | 01:58:29 | |
| By the dispensary. | 01:58:34 | |
| And then there was some issue about a $9000 credit. | 01:58:36 | |
| That was potentially owed from the city. | 01:58:39 | |
| To the dispensary. | 01:58:42 | |
| And I informed Mr. Schiller that that credit. | 01:58:45 | |
| It cannot be confirmed until it has been confirmed by our outside auditors. | 01:58:48 | |
| And that my understanding and information was that the dispensary was not responding to any of the. | 01:58:55 | |
| Outreach. | 01:59:05 | |
| From the outside auditors. So the outside auditors weren't able to confirm. | 01:59:06 | |
| The amount of the credit. | 01:59:11 | |
| The credit was 9000, but what was owed? | 01:59:12 | |
| To the city is 90,800. What I'm saying difference, Yeah, OK. | 01:59:15 | |
| So I have nothing. | 01:59:20 | |
| OK, Councillor McConnell. | 01:59:22 | |
| Yes. I would ask that you extend our condolences to Mr. Meade and his wife, and going through cancer, we understand, is very | 01:59:24 | |
| difficult. | 01:59:28 | |
| However. | 01:59:32 | |
| As you understand. | 01:59:33 | |
| We have a budget, we have a city to run and we need to. | 01:59:35 | |
| Have a. | 01:59:39 | |
| Payment and we need to have cooperation so. | 01:59:40 | |
| We are in a very difficult situation here, as you. | 01:59:44 | |
| Learned. | 01:59:48 | |
| That that's why we're here, because we're trying to come up with some kind of agreement where we can give you guys some kind of | 01:59:49 | |
| payment. | 01:59:51 | |
| Well, the thing that. | 01:59:54 | |
| We need is a massive payment. | 01:59:57 | |
| I mean, I would say if you could. | 02:00:00 | |
| If somebody was able to. | 02:00:03 | |
| Yeah, well. | 02:00:05 | |
| But clearly you haven't. | 02:00:08 | |
| There's an amount owed. | 02:00:09 | |
| And and are you? | 02:00:12 | |
| Can you? | 02:00:14 | |
| Vouch to say that. | 02:00:16 | |
| Do you have resources to pay us or? | 02:00:19 | |
| What? Well, not the full 90 grand, but like if we could come to some kind of payment agreement where we can make payments every | 02:00:21 | |
| month. I'm sure we give you a good chunk, like at least 10 to 12,000. | 02:00:26 | |
| Just to get it going. | 02:00:31 | |
| That's that's what we're here trying to do. | 02:00:36 | |
| Are you, are you authorized to make an? | 02:00:40 | |
| Offer. | 02:00:45 | |
| On this outstanding debt. | 02:00:46 | |
| Yes. | 02:00:47 | |
| And your offer is? | 02:00:48 | |
| Maybe you could come up with some kind of agreement within the next 30 days to make you guys some sort of payment to get on a | 02:00:50 | |
| payment plan. | 02:00:52 | |
| OK, Mayor Pro Tem. | 02:01:01 | |
| Yes, so. | 02:01:02 | |
| Does he wants it? Does Does. | 02:01:03 | |
| Does your owner want to stay open? | 02:01:06 | |
| He basically he says yes, that we're just trying, but. | 02:01:08 | |
| We are going through like financial difficulties with the economy and everything so. | 02:01:12 | |
| Right now, like our overhead has been very good. | 02:01:16 | |
| Basically where you have enough to pay rent. | 02:01:19 | |
| Have to pay our employees. | 02:01:21 | |
| Have to pay our bills? | 02:01:23 | |
| And I mean, we're struggling. | 02:01:24 | |
| All the straps are struggling. | 02:01:27 | |
| OK, so as general manager, who pays? | 02:01:29 | |
| Who pays the sale tax? | 02:01:32 | |
| Well, that that was needs doing. | 02:01:34 | |
| But umm. | 02:01:37 | |
| He's gonna start giving me authority to like, get in contact with you guys because he said a lot of this is because he was not in | 02:01:38 | |
| contact with people. | 02:01:41 | |
| So now he told me to come up to the meeting and basically. | 02:01:45 | |
| Talk and he would give me authority to be able. | 02:01:49 | |
| To be the contact point for you guys. So if you guys needed somebody to contact, you could contact me and I could give you | 02:01:52 | |
| answers. | 02:01:54 | |
| To what's going on? | 02:01:57 | |
| Rather than being ignored. | 02:01:59 | |
| So were you aware of? | 02:02:00 | |
| The violations. | 02:02:02 | |
| Not of this, no. | 02:02:03 | |
| I barely found this out like within the last two weeks. | 02:02:05 | |
| OK, so. | 02:02:08 | |
| You guys are out of compliance with your business sales tax. | 02:02:09 | |
| And just your audit? | 02:02:13 | |
| Yeah. So you were not aware as a general manager aware of any of this? I was not aware of being like? | 02:02:15 | |
| The cities being out of compliance I was aware of like the. | 02:02:22 | |
| The employees when they didn't have their badges that one day, what it was was we had hired 2 new employees during that time and | 02:02:26 | |
| their badges just hadn't come in yet. | 02:02:30 | |
| But all that had been corrected. | 02:02:34 | |
| But why didn't you guys notify the city that I thought we did? | 02:02:37 | |
| Because he was the one that was handling things like that at that time. At that time, I was just the buyer. | 02:02:41 | |
| Like I basically I was just. | 02:02:45 | |
| So as a general manager though, you. | 02:02:47 | |
| The sales tax. | 02:02:48 | |
| Like the business license should be posted right? | 02:02:52 | |
| Yeah. Well the business license, I from what I understand it was paid last Friday. | 02:02:55 | |
| Is that true? | 02:02:59 | |
| I have not been told that yet. I don't know if our finance department knows that they take that normally, but if it was just this | 02:03:02 | |
| past Friday, no, I wouldn't have known that yet. | 02:03:08 | |
| OK, so it just seems like. | 02:03:14 | |
| Seems like the owner is really not. | 02:03:16 | |
| Being faithful to the business and he's he's been letting you guys run with this and. | 02:03:21 | |
| It's unfortunate because you you guys are not in compliance. | 02:03:27 | |
| That's what it basically boils down to. You guys are not following the rules. | 02:03:32 | |
| Well, we're trying to figure out what we need to do to. | 02:03:36 | |
| Be back in compliance. | 02:03:38 | |
| Because this the city stuff I was not aware of at all. | 02:03:40 | |
| OK, that's fine. | 02:03:44 | |
| Any other questions? | 02:03:48 | |
| I just wanted. | 02:03:50 | |
| So the owner. | 02:03:52 | |
| Is he local? | 02:03:55 | |
| He's in Thousand Oaks, 1000 Rio area. Yeah, OK. | 02:03:57 | |
| Thank you. | 02:04:03 | |
| Any other questions? | 02:04:05 | |
| Any other questions? | 02:04:09 | |
| OK. | 02:04:10 | |
| So we will now close the public comment period. I will now. | 02:04:11 | |
| It is now 832. | 02:04:17 | |
| We have before us our recommendations. Can we go back to the recommendation page so I don't have to? | 02:04:20 | |
| We have our recommendations. | 02:04:25 | |
| You want the options or just the actual recommendations? | 02:04:31 | |
| Let's go. Let's go to the options. | 02:04:34 | |
| OK, so that we're on the 2 pages, this was the first option again, option one, which was the one time payment within 30 days. | 02:04:39 | |
| And have not paid then the City Council would move forward with. | 02:04:46 | |
| The procedures to revoke the development agreement and conditional use permit. | 02:04:51 | |
| Then option 2 would be the payment plan with the down payment of $12,000 minimum. | 02:04:56 | |
| And then have that agreed to within 30 days of this evening. | 02:05:02 | |
| And then to have that all paid in full within six months and this again would be based on the unaudited gross receipts and if the | 02:05:06 | |
| audit the true up. | 02:05:11 | |
| Calculated more than those payments would be due. | 02:05:17 | |
| Within 30 days of the audit and they would not be part of the payment plan. | 02:05:20 | |
| And then third would be any other option that you may want to exercise this evening. | 02:05:23 | |
| OK, so we have the recommendations and we have the options before us. | 02:05:31 | |
| May I get a first and a second? | 02:05:39 | |
| A motion. | 02:05:41 | |
| Could I ask a question about one of them? Sure. | 02:05:43 | |
| So if we were to agree to the second one. | 02:05:46 | |
| With putting terms that. | 02:05:49 | |
| Once you said it has to be paid within 30 days, what was the 30 days? The first payment? | 02:05:52 | |
| And they have to. You have to make a plan, correct? | 02:05:58 | |
| And then? | 02:06:00 | |
| The full payment has to be made within six months. What was the rest of it? | 02:06:01 | |
| That the gist of it. That would be the gist of it, correct? | 02:06:05 | |
| And we add something if we wanted to do 2. | 02:06:08 | |
| Give them an option and add something in there that as soon as they were. | 02:06:11 | |
| Already out of compliance with that first portion of it, then we could. | 02:06:15 | |
| Another decision. Can I just ask a question really quick if you don't mind? | 02:06:22 | |
| Can we come up with a #3 or #4? | 02:06:26 | |
| Yes, you do whatever you want come up. OK. So, so we don't have to adjust two or one, we can just if there's something else. | 02:06:29 | |
| That you want to at least put out there. | 02:06:37 | |
| Do that I'd like. | 02:06:40 | |
| Suggest or make a motion. | 02:06:43 | |
| That we. | 02:06:45 | |
| We umm. | 02:06:49 | |
| Asked for 30% of the total due within 30 days. | 02:06:51 | |
| And then a. | 02:06:57 | |
| Aggressive payment plan thereafter. | 02:06:59 | |
| However. | 02:07:05 | |
| I mean that that. | 02:07:06 | |
| I by motion is to. | 02:07:08 | |
| Show good faith that you're going to make. | 02:07:12 | |
| A significant reduction in the debt. | 02:07:15 | |
| And then aggressive repayment plan. | 02:07:18 | |
| If there's no second, is there? | 02:07:25 | |
| Another motion. | 02:07:29 | |
| Because I didn't, I didn't hear a second on that. | 02:07:30 | |
| Is there another motion? | 02:07:32 | |
| Anyone. | 02:07:34 | |
| If not, I have one. | 02:07:36 | |
| I would like to hear yours, Mayor. | 02:07:37 | |
| Yeah. And so I have heard the general manager talk about 60 days. | 02:07:39 | |
| And so I would like to. | 02:07:46 | |
| Umm, request the 12,000 immediately. | 02:07:49 | |
| And then allow the 60 days to pay the balance. | 02:07:57 | |
| Of what's due. | 02:08:02 | |
| Since since it sounds like they asked for 60 days. | 02:08:06 | |
| If there's no second, is there another motion? | 02:08:13 | |
| I I wanted to ask. | 02:08:17 | |
| Staff if that was something they had. | 02:08:20 | |
| Considered and if they think that's a bad. | 02:08:22 | |
| Feasible option. | 02:08:25 | |
| And what about the balance? | 02:08:32 | |
| OK, I'm just not confident. | 02:08:38 | |
| I'm not. I'm not confident. | 02:08:42 | |
| At a payment. | 02:08:44 | |
| Arrangement. So that's where I stand personally. | 02:08:45 | |
| Can we discuss? | 02:08:47 | |
| Can I come up with? | 02:08:50 | |
| Can I make a motion? | 02:08:53 | |
| You can because they both have failed so. | 02:08:54 | |
| So I would like to. | 02:08:57 | |
| Make a motion that. | 02:08:59 | |
| A. They get in compliance. | 02:09:02 | |
| 1st. | 02:09:04 | |
| Have a one time payment of 12/12 K immediately. | 02:09:07 | |
| And. | 02:09:11 | |
| Three payments. | 02:09:14 | |
| In the next 6 months. | 02:09:15 | |
| That covers the remaining amount. | 02:09:17 | |
| Can I get a second? | 02:09:21 | |
| I'll second that. | 02:09:23 | |
| Are there any discussion any any further question, comments, discussion? | 02:09:27 | |
| So. | 02:09:32 | |
| What do we mean by compliance? What does that actually mean? What will they have to do to be? | 02:09:33 | |
| Well, they had. | 02:09:38 | |
| So they don't have a business. | 02:09:41 | |
| License A. | 02:09:44 | |
| That we know of since the staff report. | 02:09:46 | |
| They were out of compliance with. | 02:09:50 | |
| The. | 02:09:52 | |
| And it sounds like they made those corrections but didn't notify the city. | 02:09:54 | |
| And Mr. Stewart, did I miss anything else? | 02:09:58 | |
| The badges, right, You just mentioned the badges. So it would be basically compliance with the conditional use permit conditions | 02:10:03 | |
| of approval. That's what you're asking for them to be in compliance with. That includes the business license, the badging | 02:10:07 | |
| documentations. | 02:10:11 | |
| And whatnot. | 02:10:16 | |
| Yeah. | 02:10:17 | |
| Thank you. | 02:10:20 | |
| Yeah, discussion, so. | 02:10:20 | |
| I just want I can just. | 02:10:22 | |
| Will you just summarize again? | 02:10:24 | |
| What? | 02:10:26 | |
| You just commented to our mayor Pro Tem. | 02:10:27 | |
| She talked about being in compliance. | 02:10:31 | |
| With. | 02:10:35 | |
| And I just want everybody to hear that. | 02:10:36 | |
| Right. What does that mean? | 02:10:38 | |
| So they would be. | 02:10:40 | |
| What compliance would how it would be defined would be that they would. | 02:10:41 | |
| Have a business license. | 02:10:46 | |
| In effect, they basically pay for their current one. | 02:10:47 | |
| And then? | 02:10:52 | |
| Because we're coming up close to our new they would get a new one. | 02:10:53 | |
| They would also verify that all of the deficiencies found during the inspections, such as the the lack of the paperwork and plans. | 02:10:58 | |
| As well as the identification were corrected. | 02:11:07 | |
| And so basically those conditions of approval. | 02:11:13 | |
| Would be complied with. | 02:11:17 | |
| And let me ask you based on, based on timelines, how long it takes for those items to get done? | 02:11:18 | |
| How long should it take? | 02:11:25 | |
| For them for the organization to be. | 02:11:27 | |
| Compliant with those things. | 02:11:30 | |
| I would say that within 30 days we just heard that they may already be, but if not, then there's no reason why they can't be | 02:11:33 | |
| completely compliant within 30 days. These are not big asks. | 02:11:38 | |
| And also at that point then we've got the $12,000 that we had also mentioned that could also that were requested with option one. | 02:11:44 | |
| To be going also paid within 30 days, that would be great. | 02:11:53 | |
| And I think that I have amended motion. Just want to add one thing. So exactly what our mayor pro temp said. | 02:11:56 | |
| But after the six month period. | 02:12:03 | |
| It's not done to move to the revoking. | 02:12:05 | |
| Yeah. | 02:12:10 | |
| Is there can I get a second on that? | 02:12:11 | |
| Did you have something? | 02:12:15 | |
| Yeah, we're on this motion. Can we take the motion? | 02:12:17 | |
| This is, I'm sorry, this is discussion time. Go ahead. | 02:12:20 | |
| I just want to be brutally honest. | 02:12:25 | |
| Sales are down. We just heard that. | 02:12:27 | |
| I don't know. I just don't see the business surviving in the current environment and. | 02:12:31 | |
| You know $90,000 is a lot of money. | 02:12:37 | |
| That's owed to the city and we have a fiduciary responsibility to. | 02:12:40 | |
| To our end. | 02:12:45 | |
| And you know, nothing personal. I mean, I want you to have your jobs, but. | 02:12:47 | |
| I don't have any confidence that we're going to be. | 02:12:52 | |
| Paid the way we should be paid. | 02:12:55 | |
| And so. | 02:12:57 | |
| I I just, I can't vote for a payment plan that drags us out for six more months. I'm sorry, but. | 02:13:01 | |
| OK, so I have a comment to that. Either way either they're they're able to make the payment. | 02:13:07 | |
| We'll get our 12,000. | 02:13:12 | |
| Either way, I mean, they're going to owe the money, so. | 02:13:14 | |
| Either able to do it or they're not. | 02:13:17 | |
| It's not going to really affect us any more than what it already is. But my question is. | 02:13:19 | |
| To the. | 02:13:24 | |
| Business, do you have another Emerald perspective? You have another business that you're operating in like Oxnard or Ventura? | 02:13:26 | |
| It's port oriented me the only location. | 02:13:31 | |
| So just to be clear. | 02:13:36 | |
| When I said. | 02:13:39 | |
| Six months, So that would be 3 payments within six months. | 02:13:40 | |
| So. | 02:13:45 | |
| So every two months. | 02:13:49 | |
| They're gonna make a payment. | 02:13:51 | |
| But I heard the. | 02:13:54 | |
| Right. Yes. | 02:13:58 | |
| Then we immediately we moved to come back to the council. | 02:14:00 | |
| OK. Is that clear or do we need to put that on the record again? | 02:14:04 | |
| I think that's clear. | 02:14:08 | |
| It's clear, OK, I did. So we're not taking mayor's amended motion. It just. | 02:14:09 | |
| Well. | 02:14:15 | |
| I think I was in crystal clear on my so so so that is. | 02:14:17 | |
| Clear on the record. | 02:14:22 | |
| Can you please state your motion again? | 02:14:23 | |
| The six month that the comment that I made, but make sure you're clear about paying. | 02:14:27 | |
| I'm going to let you. | 02:14:33 | |
| I'm gonna let you make the motion. OK, I'll make the motion and so. | 02:14:35 | |
| I move that we. | 02:14:40 | |
| Allow umm. | 02:14:42 | |
| Emerald to come into compliance in the 30 days. | 02:14:43 | |
| Make the immediate $12,000 payment. | 02:14:48 | |
| And between the 30 days and the next five months, they should make 3 payments. | 02:14:52 | |
| That at the end of the six month period. | 02:14:59 | |
| We would have received. | 02:15:02 | |
| All the due funds. | 02:15:04 | |
| Is that correct? | 02:15:07 | |
| And if not at any point any stage, so we can get this, I guess we have to get it written for at any stage of the non compliance. | 02:15:08 | |
| To our decision, we should move to revocation. | 02:15:19 | |
| Do you need a second for that or is she just clear? | 02:15:23 | |
| Clarifying the original. | 02:15:25 | |
| And I just want to also clarify that includes adopting the resolution and making the determination that it's exempt from SEQUA. | 02:15:29 | |
| Yes. | 02:15:36 | |
| OK, I'll second that. | 02:15:37 | |
| Thank you. | 02:15:38 | |
| Any other discussion? | 02:15:39 | |
| Can I make one? Yeah. Can I make one suggestion? | 02:15:42 | |
| I'll just say I feel terrible for. | 02:15:48 | |
| You all here that you have to deal with this because I don't think it's your guys''s fault and I think the council probably feels | 02:15:52 | |
| the same way and I don't think it's the situation any of us want. | 02:15:57 | |
| But the biggest concern I have is that the property owner is not here. Property owner hasn't told us anything. A business owner. | 02:16:03 | |
| Confirmed he's willing to do anything. | 02:16:10 | |
| I think my suggestion would be as part of that motion. | 02:16:14 | |
| That the public hearing be continued for 30 days. | 02:16:17 | |
| And if. | 02:16:20 | |
| The business owner. | 02:16:22 | |
| Takes the steps needed and signs the compliance agreement then. | 02:16:24 | |
| When we we can report back in 30 days. | 02:16:29 | |
| That they're in compliance. | 02:16:32 | |
| But if they're not. | 02:16:34 | |
| Because I haven't heard from the business owner yet and I don't really have a lot of faith right now. So that's a new motion that, | 02:16:35 | |
| well, it's not, it's the mechanics of this motion is that. | 02:16:40 | |
| At 30 days, if we don't have an agreement, we continue this public hearing so it comes back to council will report if. | 02:16:45 | |
| They've taken care of things or if not, and then there could be a decision made at that day. | 02:16:52 | |
| So after 30 days we should expect. | 02:16:57 | |
| How much? | 02:17:01 | |
| It would be the $12,000 and. | 02:17:03 | |
| And significant progress on getting into compliance with all of the requirements. | 02:17:05 | |
| And so then at that point Council could say OK, you know you made progress and we'll give you the six months to make payments or | 02:17:11 | |
| you haven't made progress. | 02:17:15 | |
| We have to act and I will just note just there that. | 02:17:19 | |
| Just as. | 02:17:22 | |
| We do have almost all of our businesses are in compliance. So I just want to reflect that. | 02:17:24 | |
| You know, umm. | 02:17:30 | |
| This is a. | 02:17:31 | |
| One thing that gets lost sometimes it is a fairness to all businesses. | 02:17:32 | |
| Conversation where? | 02:17:36 | |
| Other businesses are following the rules and are making the payments, and so it's unfair to let one business not do those things. | 02:17:38 | |
| So I just want to make that point. | 02:17:44 | |
| Because it's not something that anybody likes to do. | 02:17:46 | |
| But it's something. | 02:17:49 | |
| That we have to do to be fair to everyone. | 02:17:51 | |
| So giving that 30 day period. | 02:17:53 | |
| Continuing the public hearing. | 02:17:55 | |
| If they've done. | 02:17:57 | |
| Mr. Whipple has done what? | 02:17:58 | |
| They said he would do then then. | 02:18:00 | |
| We'll be able to. | 02:18:02 | |
| Approved the agreement and move on. | 02:18:03 | |
| I could support that. | 02:18:09 | |
| Great, Madam Clerk. | 02:18:10 | |
| Can we have a vote please? | 02:18:12 | |
| Yes. | 02:18:13 | |
| Councilmember Goma. | 02:18:14 | |
| Yes, Councilmember Hernandez. Yes. | 02:18:18 | |
| Mayor Pro Tem Lopez. | 02:18:21 | |
| Sorry, Councilmember Perez, you were looking right at me too. | 02:18:23 | |
| Yes, and Mary Queen legend. | 02:18:28 | |
| Motion passes unanimously. | 02:18:30 | |
| Question. | 02:18:34 | |
| So let's see our city attorney and city manager discuss it. So and what we were discussing is the the council meeting is on June | 02:18:35 | |
| 2nd. | 02:18:39 | |
| That's the one a month from now. | 02:18:43 | |
| It's technically less than 30 days. So I was asking do we need to have the motion say come back on June 2nd? | 02:18:45 | |
| Yeah. | 02:18:53 | |
| OK. So I want to amend the motion. | 02:18:54 | |
| To return to continue the public hearing till June 2nd. | 02:18:57 | |
| OK, return the public hearing June 2nd, 2025. | 02:19:00 | |
| 2nd, 2nd. | 02:19:04 | |
| Great. Can we take a roll call please? | 02:19:06 | |
| Councilmember Gama Yes Councilmember Hernandez, Councilmember Perez, Yes Mayor Pro Tem Lopez and Mayor McQueen Lejeune. Motion | 02:19:09 | |
| passes unanimously. | 02:19:14 | |
| Council, I'd like to take a point. | 02:19:20 | |
| I need to step up. | 02:19:26 | |
| Step up. | 02:19:27 | |
| Are we taking that 5 minutes? | 02:19:29 | |
| 5 minute. | 02:19:34 | |
| I know. | 02:23:55 | |
| All right, welcome back. We'll reconvene to the City Council meeting and we'll move to item business, item number 13. | 02:24:08 | |
| Electric motorized vehicles on Waeneme Beach Pier. | 02:24:17 | |
| Will staff please present the report? | 02:24:22 | |
| Yes, and our Deputy City manager, Charles Parrots will be. | 02:24:25 | |
| Presenting this report. | 02:24:29 | |
| Good evening Mayor and council members, member of the public and staff. | 02:24:33 | |
| So item 13. | 02:24:38 | |
| Agenda. | 02:24:40 | |
| Pertains to a discussion about electronic and motorized vehicles at the pier. | 02:24:42 | |
| The April 7th City Council meeting included a public comment. | 02:24:47 | |
| Pertaining to the operation of motorized electric. | 02:24:51 | |
| Bikes on the pier. | 02:24:55 | |
| And this agenda is presented in response to Council's request for a future agenda item. | 02:24:57 | |
| To discuss such activity and consider options to address the concerns that were expressed. | 02:25:03 | |
| The purpose of the presentation is to provide information about existing signage. | 02:25:08 | |
| Relevant municipal codes. | 02:25:13 | |
| And ultimately to provide Council the opportunity to provide direction. | 02:25:15 | |
| Last year in response to community members concerns about a wide variety of activities at the beach. | 02:25:21 | |
| The city installed new rule signs. | 02:25:27 | |
| The new signs which are pictured here. | 02:25:30 | |
| Include an extensive listing of activities that are prohibited at Winemi Beach. | 02:25:33 | |
| As noted in the staff report. | 02:25:38 | |
| Consolidated rule signs allow for consistency in messaging. Decreased sign clutter. | 02:25:40 | |
| Reduced costs. | 02:25:45 | |
| And they provide centralized locations where. | 02:25:47 | |
| Members of the public. | 02:25:49 | |
| Can find information about various rules. | 02:25:51 | |
| O In a review of the municipal code, there are no specific code sections that address motorized vehicle activity on the pier, | 02:25:58 | |
| however. | 02:26:03 | |
| There are two code sections that relate to the issue of wheeled vehicles at the beach and the pier. | 02:26:08 | |
| The first is section 4301. | 02:26:15 | |
| And that prohibits. | 02:26:18 | |
| Riding, pushing or pulling wheeled vehicles on. | 02:26:19 | |
| The Pier. | 02:26:22 | |
| The other section 4212. | 02:26:24 | |
| Is uh. | 02:26:26 | |
| Which is which references. | 02:26:28 | |
| Which is referenced. I'm sorry, which is referenced on the sign. | 02:26:30 | |
| Prohibits riding, pushing, and pulling wheeled vehicles for human conveyance. | 02:26:34 | |
| On unpaved areas at the beach park. | 02:26:39 | |
| While these two reference wheeled vehicles. | 02:26:43 | |
| Neither define the term wheeled vehicle. | 02:26:46 | |
| In summary. | 02:26:53 | |
| Of this issue last year. | 02:26:55 | |
| The city installed new beach signs that address a multitude. | 02:26:57 | |
| Of prohibited activities in the beach in the pier area. | 02:27:01 | |
| The code includes prohibitions related to wheeled vehicles, but does not define that term. | 02:27:05 | |
| And staff doesn't think that the intention was for the city to prohibit. | 02:27:11 | |
| Wheeled vehicles such as strollers. | 02:27:14 | |
| And wagons. | 02:27:16 | |
| Yeah, there there is a provision in the municipal code that allows for wheeled vehicles that are used to transport disabled | 02:27:19 | |
| persons. | 02:27:23 | |
| Staff is recommending that the city produce. | 02:27:27 | |
| A flyer. | 02:27:30 | |
| Prohibiting electronic and motorized vehicles. | 02:27:31 | |
| From the pier. | 02:27:35 | |
| And place it in the kiosk that lies adjacent to the pier. | 02:27:36 | |
| And additionally as staff does. | 02:27:40 | |
| Periodically. Umm. | 02:27:43 | |
| The suggestion is that staff would take an inventory of the signs at the beach. | 02:27:44 | |
| Identify any areas where signage is deficient and add. | 02:27:48 | |
| The rule signs that have already been installed as necessary. | 02:27:52 | |
| That provides an overview of the issue. | 02:27:58 | |
| And we are available for. | 02:28:00 | |
| Questions that the Council may have. | 02:28:02 | |
| Are there any questions? | 02:28:04 | |
| Go ahead. | 02:28:10 | |
| So is a. | 02:28:12 | |
| California Legislature. Are they beginning to? | 02:28:13 | |
| Recognize. | 02:28:17 | |
| I think the motorized. | 02:28:19 | |
| Bikes that we're talking about are basically motorcycles. | 02:28:21 | |
| And are they going to, is there any pending legislation that's going to? | 02:28:25 | |
| Make it necessary to register said vehicles because. | 02:28:32 | |
| I think there's a MPH. | 02:28:36 | |
| Ceiling but. | 02:28:40 | |
| Because we're kind of getting this area. | 02:28:43 | |
| And we need help from the state. | 02:28:45 | |
| So my question is, is the state doing anything to address these? | 02:28:49 | |
| Electric. | 02:28:53 | |
| Bikes which go very fast and we see them all over the roads. We see them in in the. | 02:28:54 | |
| Intersections at the stoplights and so forth. | 02:29:00 | |
| I can't speak to specific legislation, but I can tell you. | 02:29:05 | |
| What has been discussed and what is proposed is not. | 02:29:09 | |
| Ebike specific. | 02:29:13 | |
| It's it's actually differentiated in the the power of the wattage of the bikes. | 02:29:14 | |
| So bikes that are able to travel at certain speeds and have certain wattages and powers. | 02:29:19 | |
| Are designated more as motor vehicles. | 02:29:24 | |
| And and motorized. | 02:29:27 | |
| Bikes that have less wattage and has have lesser speed capabilities. | 02:29:29 | |
| Are not. So you get to a point where it does have to be registered with the Department of Motor Vehicles and is appropriate for | 02:29:33 | |
| streets. | 02:29:37 | |
| But there are many E bikes. | 02:29:40 | |
| That are not in that category, that would not be subject to registration with the Department of Motor Vehicles. | 02:29:42 | |
| So you referenced motorcycles before? | 02:29:49 | |
| And that would be something that would rise to the level of more of a motor. | 02:29:51 | |
| Vehicle. | 02:29:55 | |
| Rather than an E bike, you know. But I see these two kids that come to Miranda Park on some. | 02:29:56 | |
| I mean these electric. | 02:30:02 | |
| Bikes look like motorcycles. | 02:30:05 | |
| And they literally could burnout and send dirt and grass a fly in. | 02:30:08 | |
| And they jump and they do all these crazy things. So I'm wondering like. | 02:30:13 | |
| Because they're clearly. | 02:30:18 | |
| Vehicles or. | 02:30:20 | |
| Bicycles or. | 02:30:22 | |
| Could go very very fast, so. | 02:30:23 | |
| I think what you're saying is that. | 02:30:26 | |
| They're not recognized as a. | 02:30:29 | |
| I mean, I mean, how do we? | 02:30:31 | |
| Because I think what the complaint was. | 02:30:33 | |
| Correct me if I'm wrong. | 02:30:36 | |
| Was that? | 02:30:38 | |
| Some of these bikes were zipping down the pier. | 02:30:39 | |
| Fast, fast. | 02:30:45 | |
| Yeah, so. | 02:30:46 | |
| Yeah, if I could add to that, then I think. | 02:30:47 | |
| I think it was last year. I know it's. | 02:30:52 | |
| I know they've tried. | 02:30:54 | |
| But the state has a couple of times. | 02:30:56 | |
| Talked about legislation. | 02:30:58 | |
| I think they sort of differentiated it as like the what do they call the Class 2 bicycles? So the. | 02:31:00 | |
| Class one goes up to 20 miles an hour and then class 2IN excess of that I think. | 02:31:06 | |
| And so the state has talked a couple times about. | 02:31:11 | |
| Requiring things like insurance and registration, but it hasn't. | 02:31:16 | |
| Gone. It hasn't been approved at this point and I think it's failed a couple of times. | 02:31:20 | |
| So. | 02:31:25 | |
| And then what about enforcement? I mean, are we? | 02:31:27 | |
| Yeah. What are we doing? How are we going to enforce? | 02:31:31 | |
| Are we imposing a fine? | 02:31:35 | |
| Such as? | 02:31:37 | |
| For violation. | 02:31:38 | |
| Do we have any type of anything that will stick? | 02:31:39 | |
| I think. | 02:31:42 | |
| The challenge for us kind of goes back to the budget discussion right now of. | 02:31:43 | |
| You know, essentially we have four officers. | 02:31:49 | |
| On duty at anyone time and so do we want to use that resource at the pier? | 02:31:52 | |
| You know and. | 02:31:57 | |
| Or do you know, do we respond when called when there's, you know, problematic behavior, but we don't have somebody stationed at | 02:31:58 | |
| the pier? | 02:32:02 | |
| Right. No, I wouldn't want that. But if they see it and it happens and there's somebody, you know. | 02:32:07 | |
| Yeah. And I think that's the big thing is if people see it, call us. | 02:32:12 | |
| You know, I think this is accurate. I know we were checking, but I don't believe we've gotten a call on this in the last year, for | 02:32:15 | |
| example. | 02:32:19 | |
| So, umm. | 02:32:22 | |
| So just as a reminder, there is if people are seeing it. | 02:32:24 | |
| You know, call us and call the police. But. | 02:32:27 | |
| So far, when that request came forward, the request was, you know, brought to the Council meeting. | 02:32:33 | |
| And so sort of big picture wise, we're saying, well, let's make sure we put some signage specific to this, but. | 02:32:40 | |
| If we get the calls and we're able to respond to those calls then. | 02:32:49 | |
| That's something that can be enforced. | 02:32:53 | |
| But. | 02:32:56 | |
| We don't have. | 02:32:57 | |
| Any plan right now to have? | 02:32:59 | |
| Like resources stationed there to, you know, to just be looking for this issue so. | 02:33:00 | |
| I understood and I agree with that. | 02:33:05 | |
| Portion of it, but just in case there is. | 02:33:07 | |
| An officer there because they do make calls out to the pier. Is there a fine related to getting a citation for writing a | 02:33:10 | |
| motorized? | 02:33:14 | |
| Vehicle on the pier. | 02:33:19 | |
| I'll let Charles answer that. | 02:33:20 | |
| Yes. I can't tell you what the amount is, but it would be a violation of the municipal code and subject to an administrative | 02:33:22 | |
| infraction. | 02:33:25 | |
| Thank you. | 02:33:29 | |
| That was the code section that. | 02:33:32 | |
| We went through a moment ago is that. | 02:33:34 | |
| Vehicle. Wheeled vehicle other than a wheelchair, right? | 02:33:37 | |
| Is technically, yeah, I believe it says a wheelchair or other device used to transport a disabled person. | 02:33:41 | |
| And like we said, we wouldn't, we wouldn't plan to enforce that because we don't think it was the intent when it was passed. We | 02:33:48 | |
| don't plan to enforce it. I get somebody pushing a stroller. | 02:33:51 | |
| But if somebody's out there. | 02:33:55 | |
| You know, terrorizing people and somebody calls us that we have the tools so that the police could respond to that. | 02:33:57 | |
| Yeah. I just want to make sure what we're doing here is we're not really amending the the. | 02:34:08 | |
| City ordinance at all? We're just calling out this? | 02:34:13 | |
| They don't ride your wheel vehicle on the pier. | 02:34:17 | |
| That's correct. | 02:34:21 | |
| This is an opportunity to provide education and information to the public about existing violations. | 02:34:22 | |
| Yeah, so do we make? | 02:34:32 | |
| Yes. | 02:34:35 | |
| So we have the ability. | 02:34:36 | |
| Oh, so so we created the sign that was illustrated. But we do. | 02:34:40 | |
| We have somebody make the sign. The city pays for the signs to be made. | 02:34:46 | |
| OK, so. | 02:34:50 | |
| My question is. | 02:34:53 | |
| You know the little soccer carts that people push? | 02:34:55 | |
| And you know they're loading up all their fishing gear. | 02:34:58 | |
| So you're telling me that's not allowed on the pier? | 02:35:01 | |
| Because you're pushing it. So that's the conversation we're having. Technically, it can be interpreted that would be a violation | 02:35:04 | |
| of this code section. | 02:35:07 | |
| And unless the Council directs us otherwise, it would not be our intent. | 02:35:10 | |
| To enforce that as a violation of the code. | 02:35:14 | |
| But it would be our intent to use this section to prohibit. | 02:35:17 | |
| Electronic, uh. | 02:35:20 | |
| Electric motorized vehicles. | 02:35:21 | |
| And so can I ride my beach cruiser on the pier? | 02:35:23 | |
| Technically, it's a violation of the code. | 02:35:29 | |
| And so. | 02:35:33 | |
| That goes back to if you're doing it and you're not bothering anyone and nobody calls us, then you're not. | 02:35:35 | |
| You know, there's there's no one to respond to it, but technically it's a violation of the code. | 02:35:40 | |
| So. | 02:35:44 | |
| Couple things I would. | 02:35:46 | |
| The recommendation of of. | 02:35:49 | |
| Signage specifically for this I would agree with. | 02:35:52 | |
| What? | 02:35:58 | |
| What I. | 02:36:02 | |
| Yeah, I just lost my friend without. | 02:36:05 | |
| The electric motorized vehicles. | 02:36:08 | |
| So your recommendation is to have specific signage for this? | 02:36:13 | |
| Because it's it's very hard to see that little. | 02:36:19 | |
| One thing like. | 02:36:23 | |
| I don't think we're using our social media arm. | 02:36:24 | |
| To actually. | 02:36:30 | |
| To distribute what can be. | 02:36:32 | |
| What's a lot on that pier? What's allowed on the beach? | 02:36:34 | |
| Like we should, we should have a reoccurring. | 02:36:37 | |
| Post that. | 02:36:42 | |
| Gives the regulations on on this so that we. | 02:36:44 | |
| Or at least being proactive, not reactive like we're acting right now. | 02:36:47 | |
| That's all I have. | 02:36:52 | |
| Yeah. Thank you for that. | 02:36:53 | |
| And so I guess I'll follow up and say. | 02:36:55 | |
| Yeah. This is kind of the thing that, you know, I've been talking about about ordinances, right? | 02:36:58 | |
| So one day you'll have one person that is. | 02:37:04 | |
| Purposefully. | 02:37:07 | |
| Calling the police because the ordinances. | 02:37:09 | |
| Ordinance is not being followed. | 02:37:13 | |
| Right. And so based on what our city manager just said. | 02:37:14 | |
| Someone can actually do that. | 02:37:18 | |
| Police will need to come and then provide them a. | 02:37:20 | |
| Ticket I imagine. | 02:37:23 | |
| If it's the ordinance. | 02:37:24 | |
| So do we need to do something with the ordinance? | 02:37:28 | |
| So that it's more clear because I was reading and I thought, you know, I see people come out for the movie. | 02:37:31 | |
| And they have their cards with the now beach wheels that they haven't already had. So technology has changed. | 02:37:36 | |
| Right to take their stuff on the beach, but really based on the ordinance. | 02:37:43 | |
| That's against the ordinance. | 02:37:48 | |
| And so. | 02:37:51 | |
| It's just it's really confusing for me. | 02:37:52 | |
| And it says no, you know, no wheeled vehicles. And I actually went out and looked and said, OK, what really is a vehicle? | 02:37:55 | |
| And it, I mean really, I went to look for today and said, OK, what's a vehicle and. | 02:38:02 | |
| Yeah, anything that carries something, really. | 02:38:09 | |
| People. Umm. | 02:38:12 | |
| Ice chests, yeah. | 02:38:13 | |
| Real guppy supplies. | 02:38:15 | |
| You know, so I just think we. | 02:38:19 | |
| We can do. | 02:38:21 | |
| We can do better. | 02:38:22 | |
| You know when I was a mayor a because I don't want to get a ticket and then you don't get a ticket. | 02:38:26 | |
| And you went later the same day, but the people didn't call the police on you, right? So like when I was married. | 02:38:31 | |
| A kid got. | 02:38:38 | |
| By a dog that was running around on the beach and got. | 02:38:39 | |
| Facial stitches. | 02:38:42 | |
| So. | 02:38:44 | |
| We're being made aware that no dogs on the beach. Well, everybody has a dog on the beach. Well, no ordinance and so. | 02:38:46 | |
| You know, I don't know. | 02:38:54 | |
| Where we go from here? But. | 02:38:56 | |
| And I know that our city manager have heard him say this. | 02:38:58 | |
| Don't want? | 02:39:01 | |
| Things that we don't plan on enforcing. | 02:39:02 | |
| But at the same time, clearly when? | 02:39:05 | |
| An injury. | 02:39:07 | |
| It all you know. | 02:39:08 | |
| Fun and games until somebody gets hurt. | 02:39:10 | |
| And so. | 02:39:13 | |
| I think that bigger conversation is where we have to go is like, you know. | 02:39:14 | |
| If someone gets hurt. | 02:39:18 | |
| Suddenly we're saying, well, you're weren't supposed to be there and you're going to get a ticket. | 02:39:20 | |
| OK. Any other any other questions? | 02:39:26 | |
| If I could just add. | 02:39:29 | |
| To that that. | 02:39:31 | |
| The last paragraph of the staff report we did sort of speak to if that's a concern. | 02:39:33 | |
| That. | 02:39:39 | |
| One approach could be. | 02:39:41 | |
| That Council. | 02:39:44 | |
| Send that. | 02:39:46 | |
| Issue to the Citizens Advisory Commission to to. | 02:39:47 | |
| Review, but also do it in a public meeting where there can be public input because I do think that there are a lot of opinions. | 02:39:51 | |
| On this topic, on, you know, even just one portion. | 02:39:58 | |
| You know of it should. | 02:40:03 | |
| You know, umm. | 02:40:05 | |
| The probably the biggest question that I get most frequently is do we allow dogs on the beach? Should we allow dogs on the beach? | 02:40:07 | |
| Should we allow them on this side? Should we allow them on that side? Should we allow them, you know, all that stuff. | 02:40:12 | |
| And. | 02:40:17 | |
| So. | 02:40:19 | |
| I think sending it to the Citizens Advisory Commission and asking them to review the sections and have that public conversation | 02:40:21 | |
| and then. | 02:40:25 | |
| Sort of create recommendations of what? | 02:40:29 | |
| The updates could be. | 02:40:31 | |
| Because I think. | 02:40:32 | |
| Maybe to answer your question is like for us. | 02:40:34 | |
| We don't. | 02:40:36 | |
| We assume that. | 02:40:38 | |
| The Council, when this ordinance was adopted, didn't want us to issue citations to a mother with the stroller. | 02:40:39 | |
| But. | 02:40:47 | |
| You know, I don't know what the story was. I don't know if, you know, a mother with a stroller had run somebody over or, you know. | 02:40:48 | |
| But I think it's safe to say that probably didn't happen. We don't think that was the case, but we don't know why. | 02:40:55 | |
| The rule was specifically formulated. | 02:41:00 | |
| What it was intended to address. | 02:41:02 | |
| We just know that it was written very broad and now applies to a lot. | 02:41:04 | |
| And so. | 02:41:08 | |
| You know, I don't ever like having our staff have to kind of make the judgment call out there and say, well, it's against the | 02:41:10 | |
| rules, but. | 02:41:13 | |
| You know, umm. | 02:41:17 | |
| But I don't think it's meant to be against the rules, so clarity is better. | 02:41:18 | |
| I think I also kind of weigh that with. | 02:41:23 | |
| You know, it's like at this point we have essentially 1 complaint and so it's like. | 02:41:26 | |
| You know, how much of an effort do we go through to address 1 complaint? | 02:41:30 | |
| But if that beach. | 02:41:34 | |
| Conversation continues to come up and there's always sort of like. | 02:41:36 | |
| You know, disagreement about what's allowed, what's not, what should be. | 02:41:41 | |
| That could be an item that's sent to the Citizens Advisory Commission for them to make recommendations. Mayor, I have a further | 02:41:45 | |
| comment on that line of thinking, though. | 02:41:49 | |
| We're not looking at the other side of this where we start getting into the conversation of enforcement. | 02:41:54 | |
| Do we really want to start creating negative? | 02:41:59 | |
| Police interactions with people with dogs. | 02:42:03 | |
| Where the police's requirement is, you assure a citation. | 02:42:06 | |
| You have to sign that citation. | 02:42:10 | |
| Their rule is, and it's the law for police officers, they don't sign the citation. They have to arrest you. | 02:42:11 | |
| So are we really going to have? | 02:42:17 | |
| That interaction happening with somebody violating, not signing a citation over a dog and now we have a negative interaction with | 02:42:18 | |
| a police officer that could lead to. | 02:42:23 | |
| Other things, somebody not wanting to be arrested. | 02:42:27 | |
| So we have to think about all the things that we're creating out of this conversation. | 02:42:30 | |
| That we could be going down that dark hole. | 02:42:34 | |
| Yeah, I'm going down this list of rules and regulations and all these things are happening. | 02:42:40 | |
| They're not and they're not being enforced. I mean, it's really there comes a point where people have to self police. | 02:42:45 | |
| On these rules, because this is I think it's ridiculous for us to expect that. | 02:42:52 | |
| Police are really going to enforce this and. | 02:42:56 | |
| I don't think it's a good use of their time. People just have to understand the rules and follow them. | 02:42:59 | |
| Are these genuine rules of the road for the beach? Or is it could we just do the old? | 02:43:03 | |
| Pirates of the Caribbean guidelines. | 02:43:10 | |
| Type. They're all part of the ordinance. | 02:43:12 | |
| I mean, maybe that's something we could wrestle was like. | 02:43:16 | |
| You know we're not going to. | 02:43:18 | |
| We're not going to the dog thing though. | 02:43:21 | |
| Again, because that's kind of like the extreme. | 02:43:25 | |
| Somebody has a dog and dogs running around and. | 02:43:28 | |
| Bites a kid in the face. I mean, that's. | 02:43:30 | |
| That's not good. | 02:43:33 | |
| Right. But then again. | 02:43:35 | |
| We all agree that we don't have the resources to be policing the beach. | 02:43:37 | |
| And we don't want to be. And we don't want to be. | 02:43:43 | |
| Correct. So maybe. | 02:43:46 | |
| Guidelines. I don't know. Guidelines, ordinances. I just don't understand why we. | 02:43:48 | |
| Have mosquitoes flying around at night but anyways. | 02:43:55 | |
| I'm done, mayor Pro Tem. | 02:44:00 | |
| So I think. | 02:44:02 | |
| Motorized. | 02:44:04 | |
| Vehicles are important too on the pier. | 02:44:06 | |
| And require the same emphasis. | 02:44:09 | |
| So I. | 02:44:13 | |
| I think this is this is valid. | 02:44:14 | |
| And I do like the recommendation that we kick this down to the Citizens Advisory Commission. | 02:44:16 | |
| Is there a way also when we're actually doing lifeguards? | 02:44:23 | |
| To have some not an enforcement. | 02:44:27 | |
| Policy, but a general information policy where they can go. | 02:44:31 | |
| Instruct citizens. | 02:44:35 | |
| On the do's and don'ts of the beach. | 02:44:38 | |
| Yeah, we last year we did a couple of things. | 02:44:39 | |
| It's actually in line with what you you said before is. | 02:44:43 | |
| Basically right when before the summer, when we were kind of, we knew everybody was starting to think about going to the beach. | 02:44:47 | |
| We did a social media campaign on. | 02:44:54 | |
| Sort of the rules. And then there was a big focus because at that time we had a. | 02:44:57 | |
| A group of residents asking us to help educate, including surf riders. | 02:45:01 | |
| They help ask us to help educate about the dogs on leash issue. | 02:45:07 | |
| So we actually did get Surfrider gave both our police officers and our lifeguards their brochure on. | 02:45:10 | |
| About why dogs shouldn't. | 02:45:18 | |
| You know why they can't be at the beach? | 02:45:19 | |
| And then the lifeguards. | 02:45:21 | |
| Officers, when they did beach patrol and the lifeguards when they're out there were part of the educational process and, you know, | 02:45:24 | |
| actually would tell people. Here's some information. | 02:45:28 | |
| So I think that was a good approach. | 02:45:33 | |
| That was actually pretty simple because Surf Riders already has the brochures and they brought them to us and we just like kind of | 02:45:36 | |
| helped get them out. | 02:45:39 | |
| But. | 02:45:44 | |
| So we don't quite have that for. | 02:45:46 | |
| The E bike issue, so that would be something. | 02:45:48 | |
| We could definitely do messaging on it. | 02:45:51 | |
| We don't have like a ready made brochure for it. | 02:45:54 | |
| So I have a motion. | 02:45:56 | |
| I want to make a motion that this. | 02:46:03 | |
| That we direct this to the Citizens Advisory Commission to review for. | 02:46:05 | |
| To come up with recommendations on. | 02:46:11 | |
| On, you know, the signage enforcement and. | 02:46:16 | |
| And everything to do with. | 02:46:19 | |
| Public safety on the beach. | 02:46:21 | |
| Electric motor vehicles, Yeah, and do the sign stating electric motorized vehicles. | 02:46:25 | |
| 'Cause everything's a broad term. | 02:46:31 | |
| Yeah, everything's everything. Does anybody have a motion? | 02:46:34 | |
| The attorney is there. | 02:46:39 | |
| Is there a way to? | 02:46:41 | |
| Move these rules. | 02:46:44 | |
| To just suggestions as opposed to. | 02:46:46 | |
| Codified in a. | 02:46:49 | |
| Ordinance. | 02:46:50 | |
| Because we, we do put ourselves in this position like, well, why did you pass the ordinance if you're not going to enforce the | 02:46:55 | |
| rule? | 02:46:58 | |
| Well, you could. | 02:47:03 | |
| Direct that staff come back with an amended ordinance. | 02:47:04 | |
| And the ordinances as it is, I don't know. I wasn't around when that particular ordinance was drafted. | 02:47:11 | |
| You could direct that we amend the ordinance. | 02:47:18 | |
| To address. | 02:47:22 | |
| Some of these other issues that we've been discussing tonight. | 02:47:24 | |
| Or we can do perhaps do that. | 02:47:28 | |
| Upon recommendations from the Citizens Advisory. | 02:47:31 | |
| Commission, Umm. | 02:47:36 | |
| We could do that now or do it after they've come back with their proposals or recommendations. | 02:47:40 | |
| Yeah, I think. | 02:47:47 | |
| If I can add to that. | 02:47:49 | |
| Just to answer your. | 02:47:52 | |
| To kind of get back to the. | 02:47:53 | |
| Basic of your question is. | 02:47:55 | |
| I think what you're saying is something similar to what we do in some other parks is we have like administrative. | 02:47:57 | |
| Guidelines and administrative policies. | 02:48:03 | |
| And so like. | 02:48:07 | |
| I'll say how you could do it, but I'll also say. | 02:48:12 | |
| I think I would tell you we probably shouldn't do it, but I'll, I'll say how you do it is. | 02:48:15 | |
| What you could do is you could revoke that ordinance and then basically say that. | 02:48:19 | |
| You know the city manager can create administrative policies. | 02:48:24 | |
| That say you know you should not do these things, but the problem and the reason why I wouldn't suggest that. | 02:48:27 | |
| Is because then if you do have somebody that goes out and just. | 02:48:33 | |
| You know, purposely. | 02:48:36 | |
| Rides a motorcycle up and down the pier. | 02:48:38 | |
| We can't write them a ticket. | 02:48:41 | |
| And so that's really the. | 02:48:43 | |
| Challenge here. I think that's why this happens the way it does is that. | 02:48:45 | |
| Code is written for the one person who just goes way over the top. | 02:48:50 | |
| And when we catch them, we can write them a ticket. | 02:48:53 | |
| But it's not meant and I think this is where. | 02:48:56 | |
| The conversation with the resident who brought this forward is it's not meant for us to go out and write tickets to everybody who, | 02:48:59 | |
| you know, the wheel of their stroller touches the pier. That's not what the intent is. | 02:49:04 | |
| But the mayors point. | 02:49:09 | |
| Doesn't say that in the code. So that's sort of where you know that challenge is so. | 02:49:12 | |
| So. | 02:49:18 | |
| I think maybe that answers the question of that's, that's that's why at the end of the day, there's an ordinance on it and why | 02:49:19 | |
| just guidelines. | 02:49:23 | |
| The risk with guidelines is you can't actually do something about. | 02:49:27 | |
| The. | 02:49:32 | |
| But in the case of a catastrophic injury or. | 02:49:32 | |
| Then you know these things will work against us. | 02:49:36 | |
| These facts. | 02:49:40 | |
| I mean like if if. | 02:49:43 | |
| Like having having an ordinance and not enforcing it, correct? | 02:49:44 | |
| Correct, correct. | 02:49:48 | |
| It would be on the individual who broke. | 02:49:50 | |
| Who broke the law? | 02:49:52 | |
| And injured someone else he had. | 02:49:53 | |
| Deep pockets. | 02:49:55 | |
| Yeah, it won't stop somebody from suing the city, but. | 02:49:57 | |
| And Joan could speak better to this, but when you have a law and somebody breaks it and somebody's injured. | 02:50:00 | |
| They are per se. | 02:50:05 | |
| Right. Negligence per se responsible for it. | 02:50:07 | |
| There's no obligation on the part of the municipality to really enforce any of its rules. | 02:50:12 | |
| Because there are all sorts of statutory immunities. | 02:50:18 | |
| That protect. | 02:50:22 | |
| The municipality. | 02:50:24 | |
| Municipality. | 02:50:25 | |
| Just for this, what we're talking about here. So are we opening up a? | 02:50:27 | |
| Can of worms per SE by sending it over to the CAC. | 02:50:31 | |
| Maybe. Are we bringing attention? | 02:50:35 | |
| Should be doing I think is that's probably the better question. That's a question for council. It's not opening a can of Worm | 02:50:39 | |
| well. | 02:50:42 | |
| It's not legally opening. I can't wear it. Might be politically open. I can't work. It's passing the book. Yeah, but it's not | 02:50:45 | |
| legally opening. And I think you might have some city. | 02:50:50 | |
| Commissioners. | 02:50:55 | |
| Who would need to recuse themselves because they live? | 02:50:57 | |
| Close to the beach. | 02:51:00 | |
| So that could be problematic. | 02:51:01 | |
| You only have to recuse yourself whether there's a conflict there or not. | 02:51:03 | |
| Yeah. But I do have a comment to hopefully help us move along because we've talked about definitions about what's a wheeled | 02:51:08 | |
| vehicle and I'm looking at the list of definitions I would like to. | 02:51:13 | |
| Whatever motion we decide on to include that staff, go back. | 02:51:20 | |
| And. | 02:51:24 | |
| Define wheeled vehicles. | 02:51:25 | |
| And maybe there's a difference between wheeled vehicles and motorized vehicles, but. | 02:51:29 | |
| The list of definitions needs to be. | 02:51:34 | |
| Updated. Modified. | 02:51:37 | |
| Could help. Is that a motion? | 02:51:40 | |
| Yeah, that's a motion. | 02:51:43 | |
| In in addition to the recommendations. | 02:51:45 | |
| That are here on the staff. | 02:51:49 | |
| Did you make a motion that we did? | 02:51:52 | |
| I'm going to withdraw my motion, OK. | 02:51:54 | |
| OK. OK. So I'll second. | 02:51:56 | |
| Councilmember Hernandez Motion. | 02:51:58 | |
| Great. So the recommendation and the staff report was the sign. | 02:52:00 | |
| Right, yes, OK, the sign and then ask staff to. | 02:52:04 | |
| Update these. | 02:52:08 | |
| Yeah, staff to update definition of will vehicle, so those two. | 02:52:10 | |
| So I don't see a need to go. | 02:52:15 | |
| Back to the citizens Advisory. | 02:52:17 | |
| No, OK. | 02:52:19 | |
| And we make sure we include #1. | 02:52:22 | |
| So our. | 02:52:24 | |
| Madam Chair. | 02:52:26 | |
| Doesn't have to tell me to come. | 02:52:28 | |
| Read it over. | 02:52:29 | |
| The first one was receive information regarding status of Electro motorized vehicles. | 02:52:30 | |
| And then the other one that. | 02:52:35 | |
| Direct staff to create science starts. | 02:52:37 | |
| Yeah, Elect. | 02:52:40 | |
| Motorized vehicles are not allowed. | 02:52:41 | |
| And then make sure that. | 02:52:44 | |
| Electric motorized vehicles are in the. | 02:52:46 | |
| Hard to find in the ordinance as well as wheeled vehicles. | 02:52:48 | |
| I second. | 02:52:54 | |
| Any other discussion? | 02:52:57 | |
| Madam Clerk, can we get the roll call, please? | 02:52:59 | |
| OK, all in favor. | 02:53:01 | |
| Aye, all opposed. | 02:53:02 | |
| Hearing none, motion passes unanimously. | 02:53:04 | |
| Great. Thank you. We will now move to the City Manager comments and reports. | 02:53:07 | |
| And thank you. | 02:53:13 | |
| Assistant City Manager. | 02:53:14 | |
| OK, so we have a couple of. | 02:53:22 | |
| Items we wanted to. | 02:53:24 | |
| Provide updates or reports on. | 02:53:26 | |
| And I think first was highlighting. | 02:53:28 | |
| Saturday's events. | 02:53:32 | |
| So I know we actually had a good turn out, especially for the tour. I wasn't sure. | 02:53:33 | |
| How many people would? | 02:53:39 | |
| How many people would turn out? But we actually had pretty 2 pretty big tour groups so. | 02:53:40 | |
| We had our official ribbon cutting of the playground at Bubbling Springs Park. | 02:53:45 | |
| All of the park amenities are open at this time. | 02:53:51 | |
| The. | 02:53:56 | |
| Soccer fields are opening for. | 02:53:57 | |
| Like general public use and what we're working towards getting some processes in place for. | 02:53:59 | |
| For that to sort of ex. | 02:54:04 | |
| Expand to some of the filled rental. | 02:54:06 | |
| Type options, but for now we have that open for public use. | 02:54:09 | |
| And so people can come check out. | 02:54:12 | |
| Basically everything that the park has to offer. | 02:54:15 | |
| I will just note that I went by the playground today. | 02:54:18 | |
| And there is a good probably 30 to 40 people out there. | 02:54:22 | |
| I think the timing was right. I ended up going by like 3:30 or so, but it was. | 02:54:26 | |
| Packed. Probably the busiest I've ever seen. | 02:54:31 | |
| The play like a play. | 02:54:35 | |
| A playground at Bubbling Springs, if you count the old one too, is the busiest I'd ever seen it so. | 02:54:36 | |
| People are getting out and exploring it and discovering so. | 02:54:42 | |
| The Shortly after that we celebrated with our. | 02:54:50 | |
| County Library team. | 02:54:54 | |
| For the Radi Pruder grand reopening and mural unveiling. | 02:54:56 | |
| And, umm. | 02:55:00 | |
| We have. | 02:55:01 | |
| Some photos here of the. | 02:55:02 | |
| Interior of the library, I think all of us. | 02:55:04 | |
| Agreed at the event that they did a great job with with that library and it looks like a new building on the inside. It's really. | 02:55:07 | |
| Nice and so. | 02:55:14 | |
| Nice, open and. | 02:55:16 | |
| Fresh, I think they talked a little bit about the HVAC improvements that now make that a clean air certified building. | 02:55:22 | |
| And uh. | 02:55:29 | |
| It's just a lot of good improvements there, so. | 02:55:31 | |
| And then the. | 02:55:35 | |
| We unveiled the officially unveiled the mural. | 02:55:38 | |
| The first city public art project. | 02:55:42 | |
| And so that is now open and available to see and. | 02:55:44 | |
| This handy guide that the library has, they actually have these inside at their counter, shows all the elements of that mural so. | 02:55:50 | |
| It's very cool. | 02:55:57 | |
| So that was a good day a lot of and and you know, I think people are excited about those two being open and back for the long | 02:56:00 | |
| term, so. | 02:56:04 | |
| Many good days of that. | 02:56:08 | |
| And so. | 02:56:10 | |
| Looking forward, we have a couple of things going on we have launched. | 02:56:12 | |
| Sort of the call for applications of the Veterans Advisory Ad Hoc Committee. | 02:56:16 | |
| And so. | 02:56:21 | |
| We have the QR code here. | 02:56:22 | |
| And the note that people can come to the City Clerk's office to get the application to apply to be. | 02:56:25 | |
| A representative and then those applications. | 02:56:30 | |
| Are due by June 2nd, about a month from now. | 02:56:33 | |
| And then? | 02:56:36 | |
| We'll be bringing those applications back to the Council shortly thereafter. | 02:56:37 | |
| Also, currently we have the nomination period for the 2025 Winimi Hero Award. | 02:56:42 | |
| Shown here. | 02:56:49 | |
| The 2024 winners Kevin Brandon from Real Guppy and George from the Ocean View Pavilion. | 02:56:51 | |
| And so we're looking for. | 02:56:56 | |
| 2025 S Honorees. | 02:56:58 | |
| And and there's also a QR code. | 02:57:00 | |
| To submit the nomination for Hero. | 02:57:03 | |
| And then we have two upcoming. | 02:57:07 | |
| Events or. | 02:57:09 | |
| Deadlines and the first is on. | 02:57:11 | |
| I'll start with the soonest first, the community poster contest. | 02:57:15 | |
| Is currently open. It's open until May 15th. We actually extended it a couple of weeks because the school district had said that | 02:57:20 | |
| they needed. | 02:57:23 | |
| That they're planning to participate, but they asked us for a couple weeks more to. | 02:57:28 | |
| To have all their students participate. | 02:57:32 | |
| So the deadline has been extended to May 15th and. | 02:57:34 | |
| We're just reminding people to get their posters in for the Beach Fest poster contest. | 02:57:38 | |
| And then a reminder that on May 26, we are planning our. | 02:57:43 | |
| Memorial Day ceremony at 8:30 AM at Winnie Me Pier. | 02:57:48 | |
| For two weeks from now. | 02:57:54 | |
| We have. | 02:57:57 | |
| Two presentations, scheduled Public Works Week proclamation and their annual project update. | 02:57:59 | |
| Along with our. | 02:58:05 | |
| Arthritis Awareness Month proclamation That was the item that one of our local high school students had were. | 02:58:07 | |
| Requested and the council agreed to. | 02:58:13 | |
| Honor that this year, so that'll be coming forward as well. | 02:58:15 | |
| For the budget. | 02:58:19 | |
| I'm sorry for the agenda. | 02:58:20 | |
| Where we plan to have the in-depth. | 02:58:22 | |
| Workshop. | 02:58:24 | |
| With more detail in it. | 02:58:26 | |
| Now that we have the the big picture view, we're going to get more into the details. | 02:58:29 | |
| So that'll probably be the main event, so to speak, for that. May 19th. | 02:58:34 | |
| Agenda. | 02:58:39 | |
| We also council had requested an item to talk about goals and objectives for Beacon, so we'll be bringing that back as well. | 02:58:41 | |
| And then? | 02:58:49 | |
| We're working on an item. | 02:58:50 | |
| To get approval for procurement for a backup generator. | 02:58:53 | |
| At the Public Works Department. | 02:58:56 | |
| We are currently working with BCA PCD on that, so we'll be bringing it as long as we get. | 02:58:59 | |
| Everything taken care of through vcapcd. | 02:59:05 | |
| By then. | 02:59:09 | |
| So those are the items scheduled for May 19th. | 02:59:10 | |
| Mayor, I have a question about this. | 02:59:13 | |
| Something on this item? | 02:59:15 | |
| Mr. City Manager, has anyone got in touch with the student who requested that? | 02:59:16 | |
| A proclamation to see if she would come and accept it. | 02:59:20 | |
| Yes, I believe she is coming to that meeting. | 02:59:23 | |
| Our our clerk who? | 02:59:27 | |
| Was honored today. | 02:59:30 | |
| Reached out and coordinated that already always on it. Thank you. | 02:59:31 | |
| Showing off a little bit now, but. | 02:59:36 | |
| So that's the plan for May 19th and that is everything I have. | 02:59:39 | |
| All right. Any questions specifically? | 02:59:43 | |
| All right, we'll move on to council member reports and comments. | 02:59:45 | |
| I have nothing at this time. | 02:59:51 | |
| I participated in Take Five. I think a lot of us did. | 02:59:55 | |
| Oh man, that is the. | 02:59:59 | |
| That is a thing. It really is a thing. | 03:00:02 | |
| There's other opportunities to read to school children, but. | 03:00:05 | |
| Yeah, if you. | 03:00:11 | |
| Get a chance, I would strongly recommend doing it. I got to go on base. | 03:00:13 | |
| Naval Base Port Hueneme. | 03:00:19 | |
| Here uh. | 03:00:21 | |
| To the. | 03:00:22 | |
| To the preschool. | 03:00:24 | |
| These little kids. | 03:00:26 | |
| And I was exhausted after 45 minutes and I'm like. | 03:00:27 | |
| You know I have a. | 03:00:32 | |
| Such a high regard for preschool teachers. I mean, it's, it's a, it's a handful. | 03:00:34 | |
| So I got to read the book. Maria had a little llama. | 03:00:39 | |
| Yes. | 03:00:43 | |
| Yeah, I got to read if I cancel member gamma, yeah. | 03:00:46 | |
| So anyways I. | 03:00:49 | |
| Last Friday I had an hour and 20 minute conversation with Jason Hodge. | 03:00:53 | |
| From the port commissioners, I thought. | 03:00:58 | |
| I thought, you know, we need more of this and I hope that. | 03:01:00 | |
| Hope that we could find a way to. | 03:01:04 | |
| To bring individual council members with commissioners and have conversations that matter so that we could. | 03:01:05 | |
| I keep pursuing. | 03:01:13 | |
| Conversing with each other, working together. | 03:01:15 | |
| Working closely together. And I really was. | 03:01:18 | |
| Surprised. | 03:01:21 | |
| See how much Jason and I? | 03:01:22 | |
| Agree on. | 03:01:25 | |
| He lives over at Silverstrand Beach and. | 03:01:27 | |
| So it was a really good conversation, so I hope that. | 03:01:30 | |
| And I did mention to Kristen during our walk the other day that. | 03:01:33 | |
| Maybe we could. | 03:01:37 | |
| Come up with a way to to pair up and and start continuing to have conversations that matter for us. | 03:01:39 | |
| Beacon Sand Summit was completed. | 03:01:47 | |
| And and I'm really glad to see that agenda item like what what do we want out of Beacon? You know, we. | 03:01:51 | |
| We're we're looking. | 03:01:58 | |
| Forward to. | 03:02:00 | |
| To hopefully hearing from the Army Corps engineers, because we do. | 03:02:01 | |
| Have a. | 03:02:06 | |
| Significant problem and. | 03:02:08 | |
| Being able to look ahead is really important in this life that we live. | 03:02:11 | |
| And we know that if we don't get the Army Corps back here. | 03:02:16 | |
| In October, we're going to have a real problem, and it's. | 03:02:21 | |
| It's really interesting to watch and learn. | 03:02:24 | |
| But watch the sand as it's disappearing because it is really moving fast and so just. | 03:02:29 | |
| Look forward to that coming up. | 03:02:35 | |
| So the sand Summit. | 03:02:36 | |
| Basically. | 03:02:38 | |
| Now this was the 4th Sand Summit that Beacon has sponsored. | 03:02:39 | |
| Um, and the way. | 03:02:44 | |
| Doctor patch Doctor Kiki patch describes it is that. | 03:02:46 | |
| You know, the goal of the Sand Summit is to bring all the electeds and board members and. | 03:02:51 | |
| Regionally connected by a coastline. | 03:02:56 | |
| But to also learn and understand that we're. | 03:02:59 | |
| Each part of the coast that we operate is very different than the other one and it's all connected, but it's different. | 03:03:03 | |
| And so. | 03:03:09 | |
| She she does a wonderful job of bringing the group up and so. | 03:03:10 | |
| We're at the master level, oceanography. | 03:03:15 | |
| Point now where? Where? | 03:03:19 | |
| Now that conversations that. | 03:03:21 | |
| People associated with Beacon. | 03:03:24 | |
| Have are at a higher level of understanding. | 03:03:26 | |
| And the trick is is to make sure that. | 03:03:29 | |
| We're all not going to be here forever. We're going to move on. We're going to do this. We're going to pass on. | 03:03:35 | |
| But umm. | 03:03:40 | |
| You know, what do we pass on to the future leaders of our city? | 03:03:41 | |
| Hopefully we'll. | 03:03:45 | |
| Pass on a. | 03:03:47 | |
| A great understanding of how. | 03:03:49 | |
| How important it is to get that dredge operation up and running and get the sand that we need so. | 03:03:51 | |
| And. | 03:03:59 | |
| Of course, this weekend was wonderful. | 03:04:00 | |
| I am the library is just. | 03:04:03 | |
| Exceeded expectations beyond. | 03:04:07 | |
| Any reasonable amount? I mean it's just. | 03:04:09 | |
| So open and beautiful and I'm just so excited. | 03:04:12 | |
| 50 years from now, it's gonna. | 03:04:17 | |
| It'll still be there doing its thing, so. | 03:04:20 | |
| Really appreciate all the work that staff did to bring us all together this weekend. | 03:04:22 | |
| Really enjoyed walking with the community. I mean it's just such a wonderful thing. | 03:04:26 | |
| I don't know how many people have. | 03:04:31 | |
| Hundreds, right? | 03:04:33 | |
| So thank you. | 03:04:34 | |
| Thank you, staff. Congratulations, Georgiana. | 03:04:35 | |
| Evelyn Umm. | 03:04:38 | |
| Look forward to. | 03:04:40 | |
| Continued success in keeping us organized and productive. | 03:04:41 | |
| Thank you Mayor. Last week I attended 2 conferences. I was at the. | 03:04:48 | |
| Clean Power Alliance conference on Monday and Tuesday and then Wednesday, Thursday, Friday. | 03:04:52 | |
| I was with Skag regional policy gathering. | 03:04:58 | |
| In Palm Palm Desert and both were really good conferences. Got little. | 03:05:02 | |
| Bits of information. | 03:05:08 | |
| On what both organizations are doing and. | 03:05:10 | |
| Hope to pass those on to our staff at some point. | 03:05:14 | |
| Next tomorrow I'm I'll be in Sacramento again with Skag to do some advocacy. | 03:05:18 | |
| Other than that, thank everybody for coming out to. | 03:05:24 | |
| The library opening and the mural. | 03:05:28 | |
| So-called unveiling. It was just a really nice event and thank you staff and everybody for. | 03:05:31 | |
| For contributing to the organization of that, I thought it was a really well. | 03:05:36 | |
| Attended event. | 03:05:42 | |
| And I just want to I looked at the newsletter for the. | 03:05:43 | |
| That was issued last week. | 03:05:47 | |
| Came out last week and I was just. | 03:05:49 | |
| I was so happy to see all the things that we're doing in there. And James, you're doing a great job with that newsletter. It just | 03:05:51 | |
| really captures. | 03:05:55 | |
| Everything the city is doing, so it just made me very proud and very happy. | 03:05:58 | |
| That we can. | 03:06:04 | |
| And the fact that you recap the council meetings is really helpful too, so I can carry that around and people want to know what's | 03:06:05 | |
| going on. | 03:06:08 | |
| It's a good refresher, so thank you for that. | 03:06:11 | |
| That's it. Thank you. | 03:06:14 | |
| Yes, I got to tour the United Water District watershed, Santa Clara River bottom. | 03:06:18 | |
| And it was actually very. | 03:06:24 | |
| Educational. Didn't know how. | 03:06:28 | |
| They we filled our water tables. | 03:06:30 | |
| Here in Ventura County and how we reclaim. | 03:06:32 | |
| The water runoff from the Santa Clara River bottom. So that was. | 03:06:35 | |
| That was an eye opener and I really. | 03:06:39 | |
| Really enjoyed that tour so you guys have. | 03:06:41 | |
| Not done it. I'd recommend it. | 03:06:43 | |
| I did get to golf with Commissioner Marianne Rooney in support of Veterans Gold Coast. | 03:06:46 | |
| And like Councilmember Gama said, you know, just good conversation. | 03:06:53 | |
| And and for a good cause, so that that was good to do. | 03:06:59 | |
| Saturday and Sunday I actually walked. | 03:07:06 | |
| Bubbling Richard Richard Bar, Bubbling Springs Park and to see everybody using the park. | 03:07:08 | |
| Was amazing. | 03:07:15 | |
| The covered patio was was being used. | 03:07:18 | |
| The soccer park. | 03:07:22 | |
| The baseball park. | 03:07:24 | |
| The playground. | 03:07:26 | |
| The dog park. | 03:07:28 | |
| All of it. | 03:07:29 | |
| I mean, there was probably. | 03:07:30 | |
| 150 people at the park. | 03:07:33 | |
| And so it was exciting for the community to see that. So good job staff. | 03:07:36 | |
| City Manager. | 03:07:40 | |
| And council. | 03:07:41 | |
| That's all I got. | 03:07:43 | |
| Great. Thank you. And I'll just say Ditto. I really enjoyed this weekend and it was really. | 03:07:45 | |
| Nice seeing the residents come out and people from the community and people from outside the community. | 03:07:50 | |
| And so folks are going to be using the park that are from. | 03:07:56 | |
| The county, right. | 03:07:59 | |
| I agree with Mayor Pro Tem, it was just really nice to see the people out enjoying it. | 03:08:02 | |
| And see how excited that they are. | 03:08:06 | |
| To have. | 03:08:09 | |
| Public Springs Park. | 03:08:11 | |
| Renovated and the new library, it's just, it's been wonderful. It's just been wonderful. | 03:08:12 | |
| May I do have a comment before you move on? | 03:08:16 | |
| I did want to say something. OK, so I did attend the Sand Summit. So thank you both for giving me information. | 03:08:19 | |
| To be able to dial in and the information about the meeting. So I did participate in that. | 03:08:26 | |
| Learned second year. I participate, learn a lot each time I go. | 03:08:30 | |
| I did participate in the Moorpark City Hall grant opening. | 03:08:35 | |
| It's so nice if you have an opportunity. | 03:08:39 | |
| I think I'm saying it's so nice because I heard the horrors about the old one, which makes it, I'm sure, very nice. | 03:08:43 | |
| I will be on vacation starting Thursday. I'll be in Texas, my nieces graduating from college and I'll be back on. | 03:08:51 | |
| Early Monday morning. | 03:08:59 | |
| Finally. | 03:09:01 | |
| I wanted to share this. I don't know. I left before I was able to talk to council. | 03:09:03 | |
| Member Perez. | 03:09:07 | |
| I remember when you walked in the library on Saturday. | 03:09:09 | |
| Saturday, you said? I'm so glad they came. | 03:09:12 | |
| Kept the mosaic. | 03:09:15 | |
| Stream there. | 03:09:18 | |
| And so did everyone get a chance to meet. | 03:09:19 | |
| The artist who did that back in 1989, it was so funny because I got in line for Mr. Softee. | 03:09:23 | |
| And I needed to run in my car, so I just. | 03:09:30 | |
| Said to the lady. I said hey, can you hold my space? I'll be right back. | 03:09:33 | |
| And I came back and. | 03:09:37 | |
| The lady behind me said, oh, she said if someone comes back and says that. | 03:09:41 | |
| That I'm holding the line. | 03:09:45 | |
| She's not telling the truth. | 03:09:47 | |
| And I was like, and then we started talking and so I asked her, oh, So what do you do? Are you from? | 03:09:49 | |
| From Port Hueneme and she said, oh, I did the mosaic. | 03:09:53 | |
| And I was like, what? | 03:09:58 | |
| Wow, in 1989? | 03:09:59 | |
| And so I went back to Steve. I said, do you know this lady? I went back to Anna and Taylor and said, do you know this lady? | 03:10:03 | |
| But it was so just so nice. | 03:10:10 | |
| The whole thing. | 03:10:12 | |
| To kind of. | 03:10:14 | |
| Put it, put a hat on it, say and and she's here. | 03:10:15 | |
| She did that in 1989 and it's as beautiful today, I'm sure, as it was back then. So yeah, it was great. | 03:10:18 | |
| Being able to meet her so I got her card and so hope to be able to talk to her. | 03:10:24 | |
| About just. | 03:10:29 | |
| Art. All right. | 03:10:31 | |
| So that's all that I have. | 03:10:33 | |
| Councilmember Perez, I did. I just wanted to make to follow up that comment. The librarian was telling me that they did everything | 03:10:35 | |
| they could. | 03:10:39 | |
| To protect that, to make sure that that was salvage, it took a lot of work, but they 100% wanted that to be. | 03:10:43 | |
| Salvage and I just remember thinking when the flood came and the damage that was done, that's the first thought that came to my | 03:10:49 | |
| mind was Oh no, the. | 03:10:53 | |
| The mosaic because I remember seeing that, how beautiful it was when you cut. | 03:10:56 | |
| Come into the library and I'm just so happy that they did that. | 03:11:00 | |
| To talk about. | 03:11:03 | |
| What we do, the park and our staff and how. | 03:11:05 | |
| We do such a great job with community events. | 03:11:08 | |
| I see all over social media actually, people actually talk about us in our events and our park. | 03:11:11 | |
| And the things that we do and. | 03:11:17 | |
| Is in a negative way, but we're saying look what why Nimi's doing, why can't Oxnard or what can't other cities do this? So it is | 03:11:19 | |
| really nice. | 03:11:22 | |
| To see that the community outside of us actually pays attention to what we're doing, they're taking notice. | 03:11:25 | |
| And they're talking about it in their own communities, about how great we do for our own community. | 03:11:31 | |
| So thank you, Steph. | 03:11:36 | |
| So I took my wife today. You got to see the library. She's, you know, school teacher. | 03:11:37 | |
| Was a school teacher and. | 03:11:42 | |
| We went in today and. | 03:11:45 | |
| Every little corner there's somebody doing homework, a lady reading to her child. It was just just amazing. It's just so open and | 03:11:47 | |
| so. | 03:11:51 | |
| Just like what we all seen, like the park is busy, but you go inside the library and it's like it's. | 03:11:56 | |
| Exactly what you wish to see and it's something that we've been missing, so. | 03:12:02 | |
| I'm really excited. | 03:12:08 | |
| Just really nice. | 03:12:10 | |
| Great. Thank you. | 03:12:12 | |
| We're going to move on to future agenda items. | 03:12:13 | |
| Nothing. Councilmember Hernandez. | 03:12:19 | |
| I don't have an agenda item, but I would like to ask if we could endure in honor of the missing and murdered indigenous women. | 03:12:21 | |
| Everywhere that today is the National. | 03:12:28 | |
| Murdered Missing Indigenous Women's Day. | 03:12:33 | |
| And. | 03:12:36 | |
| Just like to. | 03:12:37 | |
| Acknowledge and remember those women who. | 03:12:39 | |
| Never returned home. | 03:12:42 | |
| Indigenous women. | 03:12:44 | |
| Do you have anything for tomorrow? | 03:12:47 | |
| OK, great. Thank you. | 03:12:49 | |
| If there's nothing else, we'll adjourn tonight's meeting. Umm. | 03:12:51 | |
| In the memory of those. | 03:12:55 | |
| MMIWMMIW. | 03:12:58 | |
| Women everywhere. | 03:13:01 | |
| And so we'll now adjourn the meeting at. | 03:13:03 | |
| The 9:41. | 03:13:07 | |
| Next scheduled meeting is May 19th at 6:30. | 03:13:09 |
