Gives you an opportunity to come here and just kind of decompress for a moment. Little social experiment. 00:02:34

I'm going to talk just a little bit about music and how important it is for us as a society and and for myself personally. 00:02:42
Music is a magical language that everyone can understand, no matter where they come from or what time they live. 00:02:51
What time they leave? 00:02:58
Or they live. It's been part of our lives for a long time and it's super important to us. 00:02:59
It makes us feel all sorts of emotion, helps us remember where we come from, and brings us close to each other, whether it's a 00:03:06
song that makes us feel happy. 00:03:10
Or a tune that helps us relax. 00:03:15
Music is like a special friend that always is there for us, making life brighter and more fun. 00:03:17
It's like emotional language. It helps us express how we're feeling inside. It has this amazing power to affect our mood. 00:03:24
Not only this, but music has a special way of triggering memories. When we hear a song from the past, it's like we're transported 00:03:31
back in time. 00:03:35
Music isn't just for fun either. It can also help us feel better when we're not doing so great. 00:03:41
I've had to use music a lot this year. 00:03:46
We can use music as a healing potion for our souls. 00:03:49
Whether we're feeling sad or stressed out, music has this magical ability to soothe us and make us feel understood. 00:03:53
It can even help us relax and sleep better at night, so next time you're feeling down. 00:04:00
Just turn on some tunes and let the music work work its magic. 00:04:05
Music Culture. 00:04:12
Is super important because it shows who we are and where we come from. Every culture has its special music. 00:04:13
That's been around for a long time, whether it's the lively beats. 00:04:19
Of drums in Africa, the peaceful sounds of. 00:04:23
Flutes from Native American tribes or the beautiful tunes of classical music in India. Each type of music tells a story about the 00:04:26
people who make it. 00:04:30
I wanted to umm. My selection of music tonight was in honor of Black Heritage Month. 00:04:37
I but I really just thought I wanted to do something tonight that was going to. 00:04:44
Take us a little way away from politics and. 00:04:49
The chaos on the outside world, something that would bring us together. And I thought, music. 00:04:53
Is something that we can all relate to. 00:04:58
I think I've shared musical experiences with each one of the council members here we've. 00:05:02
Danced we've I've listened to. 00:05:07
Our mayor sing and acquire. I think all of us have a deep appreciation for music. It's something we all share. 00:05:10
Together. 00:05:17
So during these moments of enjoying music, we can forget about our differences. Enjoy. 00:05:20
Music has as friends. 00:05:24
And comrades. 00:05:28
And music is where for me, we can find. 00:05:30
Commonality and community. 00:05:33
So that is my inspiration tonight. I don't know if I'll set a precedent here where we have music before the City Council meetings 00:05:35
every month, but I'm going to give it a try. We'll see what happens after this. 00:05:41

And we have the speech exposition and the winner of that each year. 00:12:55

It is conveyed through spoken, written and visual means, reflecting the cultural richness and diversity of the human experience. 00:15:55
And whereas language vary across the globe. 00:16:02
By country, region and culture. 00:16:06
And one's native language, often referred to as a mother language or mother tongue, is the foundation of cultural identity and 00:16:08
heritage. 00:16:12
And whereas certain languages and dialects. 00:16:16
Are fading or disappearing. 00:16:20
Resulting in the loss of unique customs, shared memories and cultural knowledge. 00:16:21
Nearly half of the world's eight. 00:16:26
1300 plus languages are endangered. 00:16:28
With roughly one language vanishing every two weeks. 00:16:31
And WHEREAS, February 21st has been recognized as International Mother Language Day to promote the preservation and protection of 00:16:35
all languages, fostering linguistic and cultural diversity. 00:16:41
The 25th anniversary of this observance marks 1/4 century of dedicated efforts to safeguard linguistic heritage. 00:16:47
Emphasizing the critical role of language in protecting culture identity, advancing education, and cultivating more peaceful 00:16:54

Good evening everyone. I'm here tonight to present to you your newest. 00:20:12
Port waiting me police dispatcher. 00:20:16
Nikki Scottie. 00:20:19

So Nikki was born and raised in San Pedro, CA. 00:20:26
And as the youngest of six children. 00:20:29
She became a mother to her two sons, Christian, Andrew, very young. 00:20:31
In her life. 00:20:35
But she always knew they were the biggest blessings she would ever receive. 00:20:36
She still calls them her son and Moon. 00:20:40
As they are essential to her world. 00:20:43
That you began a career in hospitality management as soon as she realized how much she loved customer service. 00:20:46
In fact, creating extraordinary experiences and helping others see just like that just turn to say bless you because that she does 00:20:52
creates extraordinary experience. It's all about. 00:20:57
Customer service, in fact, creating extraordinary experiences and helping others and is a passion of hers. 00:21:02
When COVID struck, she redirected her focus. Focus. She decided she wanted to focus her efforts on helping people in a different 00:21:08
way. 00:21:12
And wanted to work in public safety. 00:21:16
It's a calling for many. 00:21:19
Got that Calling. 00:21:21
She moved to Rio Rancho, NM with her family and it was there where she applied to be an emergency dispatcher. 00:21:23
She completed her Academy, receiving her Public Safety 901 dispatcher certification as well as Emergency Medical Dispatcher 00:21:33
certification. 00:21:36
And began dispatching for the city of Rio Rancho and Sandoval counties. 00:21:41
Police, fire and EMS. 00:21:46
Her heart for helping those around her was not going unnoticed, as she soon was assigned as the very first mentor to the new 00:21:48
mentorship program. 00:21:53
At that agency. 00:21:57
With this role, she was now assisting and supporting new recruits as well as completing training. 00:22:00
And serving as an active member of that agency's peer support team. 00:22:06
With her boys now grown, Nikki returned to school to complete something she started so long ago. She attended college around her 00:22:12
work hours and obtained her associate's degree in criminology. 00:22:17
As well as an Associates of applied science. 00:22:23
And integrated studies. 00:22:25
A sociology degree and a general studies certification. 00:22:27
Nikki told me. 00:22:32
When she moved back to California in September of 2024. 00:22:34
She knew she wanted to continue dispatching. 00:22:37
What was determined to find an agency that. 00:22:40
Would be a perfect fit for her. 00:22:44
She was absolutely thrilled when the Portland Police Department extended a job offer to her. 00:22:47
She was confident. 00:22:51
This is where she wanted to stay. 00:22:53
Nikki feels honored to work alongside such amazing, skilled and passionate professionals. 00:22:56
Who share the same vision for their community that she does. 00:23:01
She's excited to be a part of a team. 00:23:04
And where's the name? City of Port Oneimi proudly. 00:23:06
I have to tell you, just like police officers. 00:23:09
Agencies are in demand for. 00:23:12
For dispatchers and police officers, so. 00:23:14
When people choose to come here and they get their choice of cities to work for. 00:23:19

But her personality too is winning over the crew, as you can tell just from her background so. 00:23:42

You guys are amazing. You don't get enough credit for what you do. You don't get enough appreciation and mention in the things 00:24:20
that you do. You are also first responders so and we appreciate everything that you do without you and your ability to do your job 00:24:25
appropriately. 00:24:29
Our officers can't get what they need in order to do their job, so we thank you for choosing Winimi and we we appreciate your 00:24:34
service and we appreciate your family's service as well. 00:24:39

We'd had several discussions about some measures we were implementing about traffic and pedestrian safety and we had said. 00:27:51
We come back and do some periodic status updates on. 00:27:57
How those were working and so we wanted to do one of those today. 00:28:02
Talking about some of the recent improvements, but also some of the things that we have in progress. So with that, I'll turn it 00:28:07

Limited oversized vehicles so they would not park there. 00:40:20

Currently, the city's municipal code, specifically its leash law, does not allow for dogs to be off leash in city parks. 00:57:37
Therefore, in order to allow this facility to operate as it's intended, we need to. 00:57:45
Consider an amendment to the code to allow for dogs to be off leash within this area. 00:57:50
So the ordinance that's presented this evening seeks to amend 2 sections of the municipal code. 00:57:58
The first is Article 3 of Chapter 1, Section 3007. 00:58:03

The proposal is to amend that. 00:58:11
Section to allow for off leash activity at Bubbling Springs Park in the designated area. 00:58:13

And allow for the city manager to further develop administrative rules and regulations governing the use of the area. 00:58:30

So, by way of review, the city's master fee schedule establishes costs to be charged in exchange for materials or services. 01:02:58

The fee schedule covers a wide variety of fees. 01:03:09
Ranging from building and safety fees. 01:03:12
To fees related to police services. 01:03:14

Those fees are commonly influenced by rates charged for comparable amenities in nearby agencies. 01:03:24

So for anybody not familiar, a short term rental is a rental of a. 01:11:14
Home, apartment or room that is for less than 30 consecutive days. 01:11:21

That definition is pretty. 01:11:29

I think a lot of people. 01:11:34
Will get confused over time where people will say well I have like. 01:11:36
You know, somebody staying for 27 days, is that, you know, does that count? Well, it's a 30 day cutoff, so. 01:11:39
A rental of 29 days is a short term rental. A rental of one day is a short term rental, and then a rental of 30 days or longer 01:11:45
than that is not a short term rental. So. 01:11:50
So when we're talking about short term rentals, we're talking about those types of stays for less than 30 consecutive days. 01:11:54
And most frequently, people are familiar with Airbnb or VRBO as the two most frequent booking platforms. 01:12:03
But and those are the easiest to regulate because. 01:12:11
Were able to see those and and have access to that, but obviously somebody could be. 01:12:14
Renting a short term rental by word of mouth or. 01:12:20
Or, you know, it used to be Craigslist. Or, you know, whatever the new version of that is. 01:12:24

It's not only Airbnb and VRBO that are. 01:12:32

So that's what we are talking about when we talk about a short term rental. 01:12:43
A lot of cities around us are starting to regulate short term rentals. 01:12:47
The City of Port Hueneme currently does not have any regulations restricting short term rentals. 01:12:52
Which essentially means that. 01:12:57
People can legally. 01:12:59
Rent out their properties for less than 30 days. 01:13:01
Under our current. 01:13:04
Code and rules. 01:13:06
And. 01:13:07
We are aware of 14 that actually. 01:13:08
Have registered with the city and pay transient occupancy tax. 01:13:13
Those 14 total about 24 to $29,000 in taxes paid each year. So 14 total not. 01:13:18
It's not. 01:13:27
That amount for each one, it's 14 short term rentals. 01:13:28
Totaling 24 to $29,000. 01:13:32
But when we just were doing research for this, we looked and found that. 01:13:36
There's closer to 50. 01:13:41
Short term rentals advertised on either Airbnb or VRBO. So what that means it could be one of two things, probably a combination 01:13:43
of both. 01:13:48

Either some people are renting out units that aren't reporting that to the city and aren't paying TOT. 01:13:53
And probably a combination of both that some people probably. 01:14:00

One interesting thing for us in Port Hueneme is that. 01:14:48
Almost all of the listings are within the coastal zone. 01:14:51
And so makes sense, you know, people are listing them with the idea that somebody wants to come to I need me and stay for a week 01:14:55
and go to the beach, so. 01:14:59
We're almost all of ours on the map show within the coastal zone. 01:15:04
So. 01:15:11
We'll talk a little bit about why that's important because of the California Coastal Commission. 01:15:13
Makes it a little bit more complicated. 01:15:19
But at a high level. 01:15:23
We looked at neighboring cities, neighboring agencies. 01:15:25
There's really these five key areas that. 01:15:28
Most regulations. 01:15:32
Even though the specific standard might be a little different, there's five key areas that they address and it's. 01:15:34
Requiring permitting and licensing. 01:15:41
Requiring the payment of transient occupancy tax. 01:15:43
Identifying operational standards. 01:15:47
Setting health and safety requirements and then. 01:15:50
Identifying enforcement and penalties for. 01:15:53
For umm. 01:15:56
People that violate rules. 01:15:57
So within those. 01:15:59
Permitting and licensing obviously requiring a. 01:16:01
Short term rental permit, a business license, those types of things. Usually the ordinances will. 01:16:04
Specify which of those are required and what the fees are for those. 01:16:10

Transient occupancy tax. 01:16:17
Essentially. 01:16:19
A lot of. 01:16:20
Places used to call it hotel tax. It's the same same tax. 01:16:21
So they the ordinances will establish a. 01:16:25
Usually will state that short term rentals will pay the hotel tax and then. 01:16:29

State how that's done. 01:16:35
The operational standards. 01:16:37
Is probably the key area that I think most of the complaints that we have gotten so far relate to you. 01:16:39
Which is. 01:16:45
Setting things like maximum numbers of units that can be rented, maximum numbers of nights that a unit can be rented. 01:16:46
Parking requirements. Noise requirements, Trash protocols. 01:16:53
And. 01:16:58
The signage, identifying rules and contact information if somebody's breaking the rules. 01:16:59
And then? 01:17:06
Health requirements or things like fire safety standards and compliance with building codes. 01:17:07
And then as I said earlier, the usually the ordinance will establish fines. 01:17:13
And penalties for violation of any of those rules. 01:17:18
Those are those are the key areas that short term rental regulations focus on. 01:17:22
We will show our foremost neighboring agencies who have adopted regulations will show. 01:17:28
A couple slides that show what they have set for each of those and you'll see that. 01:17:35
They vary depending on. 01:17:38
What the concern was. 01:17:41
So we mentioned that almost all of the units are within the coastal zone. 01:17:43

And most of the short term rental issues and units that we see are within that zone. 01:18:00

That's important because the Coastal Commission. 01:18:08
Has a mandate to protect and enhance public access to the coast. 01:18:11

Generally have said that they do not support an outright ban on short term rentals. 01:18:17
They the Coastal Commission views short term rentals is another tool to help people. 01:18:22
Get to the beach. 01:18:28
It's you know, if you as a. 01:18:29
Renter of these units. 01:18:32
If this is the way that you can spend your vacation at the beach, then the Coastal Commission supports that is providing equal 01:18:34
access to the beach. 01:18:38
But so they don't allow an outright ban, but they do allow. 01:18:44
Reasonable regulation. 01:18:48
They say that the regulations must. 01:18:51
Preserve visitor access and address community concerns. 01:18:53
And they typically require a local Coastal Program amendment to be approved by the Commission. 01:18:57
And some of the cities around us are actually working through that process now. So we'll be able to see pretty soon if. 01:19:03
For example Ventur. 01:19:10
Ordinances go under review by the Commission. 01:19:11
And we'll be able to see. 01:19:14
If it gets approved by the Commission or if they have concerns with some of the rules that Ventura is implementing. 01:19:15
And so. 01:19:24
Some of the one of the attachments was a chart showing. 01:19:25
All the different short term rental. 01:19:29

We saw some of the measures that Coastal Commission typically allows and supports. 01:19:38
And those are things like limiting the total amount of rentals by a neighborhood, so. 01:19:43

Only 10% of the units within the coastal zone can be rented as short term rentals or only. 01:19:52
You know, either by kind of a ratio or even like a number like 50. 01:19:58
50 units within the. 01:20:03

They the Coastal Commission also. 01:20:09
Allowed for rules for cities to adopt rules saying that 80 use or affordable. 01:20:12
Housing could not be used as short term rentals. 01:20:19
We haven't heard this so much in our complaints, but it is a. 01:20:24
Common concern. 01:20:27
When short term rentals are discussed is that there is an argument that they increase the price of housing because it's. 01:20:30
Essentially another path for people to turn a housing unit into an investment and. 01:20:36
Purchase a property with the intent of renting it out, whereas previously that would have been a unit that somebody could have 01:20:41
actually purchased and lived in. 01:20:45
So there is. 01:20:49
Concerns related to them impacting housing stock available and affordable housing in particular. 01:20:50
So the Coastal Commission has allowed some restrictions. 01:20:57
Where Adu's or affordable units can't be used as short term rentals. 01:21:01
If cities say that the intent of those is to allow for affordable housing. 01:21:06

So we started with knowing that most of our units are in the coastal zone. We're starting by saying here's what the Coastal 01:24:04

It just doesn't really make sense for us as a city because we don't really. From what we found, there aren't really many outside 01:24:18

Not been able to get the approval from the coastal zones or have been told that they're unlikely to get approval for the coastal 01:27:07
zone, so that's why they've come to the city asking for the city to adopt something. 01:27:13

Have most cities don't have code enforcement staff working? 01:35:15

And so if they aren't working 24/7, if they aren't working evening or weekends. 01:35:28
Then there isn't somebody to respond to those issues right away. 01:35:33

One way to solve that would be having the property owner responsible for. 01:35:41
For being the point of contact to address issues. 01:35:46
So we'll talk about that. 01:35:50
Also, just with limited staff and then budget limitations. 01:35:52
Typically even just things like monitoring for short term rentals cities now are contracting with. 01:35:58
Service provider who actually monitors and searches out the short term rentals. So those are things that require some resources. 01:36:04

Business licensing, all of those things. 01:36:19
Require staff time to process. 01:36:22
Those require resources as well. 01:36:25
We mentioned identification issues, that's. 01:36:30
Probably the biggest challenge is once you start enforcing. 01:36:33

People get very crafty and. 01:36:39
I've gone through this where. 01:36:42
What we started to see after we started enforcing was. 01:36:44
People would literally take one picture inside their house with all their windows closed just to show the inside of the room. 01:36:49
And then? 01:36:55
Essentially do that so that. 01:36:57
We, as the staff cannot figure out where the unit is. 01:36:59
Because if they're only advertising on Airbnb with one picture inside the house, you don't have any way to identify the unit. 01:37:03
So online listings can be very difficult to actually. 01:37:10
Find the exact unit. 01:37:15
There are a couple of tricks to it and a couple of contractors. 01:37:18
Who are able to get like identifying information from? 01:37:23
Even things like IP addresses and stuff like that. So. So there are some ways to work with that, but that goes back to resources. 01:37:28
So and so and then. 01:37:34
What my experience was even. 01:37:39
Dropping the number of units that were advertised online. 01:37:41
From hundreds down to just a couple. 01:37:45
There was still a concern from. 01:37:48
A prior community that. 01:37:51
That there was still word of mouth rentals going on. There were still just people who had friends who every year would come rent 01:37:54
their. 01:37:57
Condo and have a party or whatever it was. 01:38:01
And so obviously those are even harder to catch because you just. 01:38:04
You you usually only hear about those. 01:38:09
When the, you know, you get the call at 2:00 AM because they're having the party and they want somebody to enforce, but there was 01:38:12
no other way to. 01:38:15
To identify it ahead of time. 01:38:18
So. So those are some of the issues. 01:38:22
We talked about the effective enforcement tactics like requiring the 24/7. 01:38:26
Property owner Property manager Contact information. 01:38:31
Having a complete hotline for neighbors and residents online. Moderate monitoring tools to track rentals. 01:38:34
And progressive penalty structures up to the revocation of the permit, those are typically the things that most of the regulations 01:38:40
have that actually work. 01:38:44
And so I won't go into these in detail, but. 01:38:50
Those earlier slides where we said. 01:38:52
Each of the cities around us. 01:38:55
Kind of have these key. 01:38:57

And then you can see some examples there like with Oxnard, it's 10% of the beach zone is. 01:39:49
Is eligible for short term rentals so they have a cap on it. 01:39:55
They have a minimum three night stay. 01:39:58
And a maximum of 100 nights per year at each of the houses. 01:40:01

Sounds great and I think that. 01:40:08
Probably addresses some of the concerns, but it's also very difficult to actually enforce. 01:40:10
Like who's actually going to track whether somebody's at 99 nights or. 01:40:15

So some of these rules are more difficult than others to enforce. 01:40:20
And then things like good neighbor rules, quiet hours. 01:40:25
Parking requirements that they that people leave a certain amount of spaces available. 01:40:32
In their garage or driveway, things like that. 01:40:38

We also looked at Carpinteria. Similar, just. 01:40:46
They'd be a lot of the a lot of similar requirements, but with slight differences. 01:40:49

We mentioned city of Ventura and then county of Ventura and you could see again similarly that. 01:40:55
City of Ventura has a very low fee and then County of Ventura has a higher fee that compares to Oxnard. 01:41:01
Probably for that very reason mentioned is that. 01:41:07
Oxnard and then Silver Strand. 01:41:11
A lot of people don't really know the difference and so. 01:41:14
If one is vastly different than the other, it's it would probably cause a problem, so. 01:41:17
They have more similarities. 01:41:23
And I think for that. 01:41:26

Similarly for Port Hueneme, with us being sort of the next beach after that. 01:41:28

It's something to keep in mind the. 01:41:36
One of the challenges is going to be with if we only have, let's say 30 or 40. 01:41:39

Person worth of staff time. 01:41:52

Are the costs of that person should be borne by the people that are? 01:41:57

Taxpayers, it should be the people that are. 01:42:05
Receiving that benefit of being able to have a short term rental. 01:42:07
So the costs would not be insignificant. I'd imagine that it would be a couple $1000 per. 01:42:11

draft another set of rules. Yeah. So I think that's what we need to understand is what? 01:43:58
People what concerns people want us to address? 01:44:03
So does this Do we even? I know this is just the conversation, but are we gonna discuss like? 01:44:07

Property owner who's renting the units to really manage. 01:45:44

With the city overseeing that. 01:45:49
Partially that's because we can do that with. 01:45:52
Less resources. If we have to actually be the enforcement arm, that's going to require additional resources. 01:45:55
And then the third option would be the comprehensive regulation, which can be, as you know, things like. 01:46:01
Putting the caps on how many and what neighborhoods, having a zoning overlay or a district limitation really getting into like. 01:46:06
Pinpointing where we want short term rentals and where we don't want short term rentals. 01:46:14
With stronger requirements, stronger enforcement penalties. 01:46:19
And things like that. 01:46:23
So those are really the three options, but. 01:46:25
I said before there was 4 because we recommend the fourth. 01:46:28

Regardless of those other options, I think having more. 01:46:34

You know, not having short term rentals in this neighborhood, but that's not the concern. The concern is is. 01:46:51
You know this other neighborhood, then it doesn't really accomplish anything so. 01:46:57

Owners who do short term rentals have monetized our community. 01:56:26

And their guests can extract a huge toll on our communities. 01:56:33
There is an Airbnb below me, 80% of the time there is no problem, but without a city ordinance we have no recourse when there is a 01:56:37

One time 8 college students rented A2 bedroom unit below me. They took turns locking each other out with resulted which resulted 01:56:46
in a lot of yelling and banging on doors. 01:56:50
Then at 2:00 in the morning when the bars closed, more yelling and banging. 01:56:55
Another time, someone rented a unit and then invited 30 people to party at our clubhouse. 01:56:59
Children with huge squirt guns were left unattended in the pool and drenched our pool table. 01:57:05
The STR owners made money and the other residents had to put up with the sleepless nights and destruction of communal property. 01:57:10
But I find the dread I feel every time someone arrives to be the worst. 01:57:17
I have no way to solve the problem. 01:57:21
Call the police, some have a device. I was told the police do not respond to noise complaints on private property. 01:57:24
As a taxpayer, I wouldn't want the police to spend time talking to drunk 20 somethings at 2:00 in the morning. 01:57:30

The ordinance is passed by other coastal communities solve this problem by requiring that owners register with the city and post 01:57:38
the 24/7 number to call if there is a problem. 01:57:43
Also, neighbors can file a complaint with the city, and the city can issue a citation with far less bureaucracy than HOA's. 01:57:48
If an owner tries to do short term rentals without registering with the city, I would not have problem reporting them to city 01:57:55

And the second was to allow the council to consider reaches proposed utility box beautification project. 02:17:16
