On City Council, my first inspiration was a video and then eventually I think I found a new passion on writing poems. And so this 00:03:02
is my last inspiration on my first on my term here as a City Council member in the city of Wanami. And it was meant to be read on 00:03:09
my last day. But I have to stay for one more meeting. But I'm excited to be here. 00:03:15
So, umm. 00:03:23
The poem is. 00:03:25
Tonight I stand before you, bittersweet and proud. The friendly city by the sea has never felt so loud. 00:03:27
Not in noise, but in spirit, in the heart of us all and every event, every festival, every triumph, big or small. 00:03:35
At 31, I stepped into this hall, the youngest to answer poor wine Amy's call. 00:03:45
Now, at 35, I pause, reflect and see the growth, the strength, the best of me. 00:03:51
Together we've celebrated 75 years strong, building bridges, creating bonds that will last long. 00:03:58
From the beach to the base to the city next door, we've built relationships that will open more doors. 00:04:06
I've seen the city grow, flourish, and thrive. I've seen the spark that keeps it alive. From the beach festival to a team built 00:04:14
with care, I know the future holds promise far beyond compare. But while this chapter now comes to a close, it's not an end. As 00:04:22
everyone knows. I step back to focus on family and life, to nurture new beginnings with love and delight. 00:04:30
Yet I leave this, I leave with this message for those who remain our city's brightest days are yet to attain. 00:04:39
Difficult choices may lie ahead, but with unity and vision, success will spread. 00:04:47
Port Hueneme, my heart is still with you, and every wave, every breeze, every ocean view. And though this marks my final full 00:04:53
stay, I hope you'll wait for my return someday. 00:04:59
Because deep down, as we've all come to see, the city and I share destiny. 00:05:05

And even though there were people that didn't win the last election, I hope they run again because there was really, really great 00:05:58

Good evening Mayor Perez, council members, staff and community members here. Anybody's watching? I don't know. My name is Julie to 00:06:37
my at Stensley. 00:06:41
I'm coming from Ohio, but it is my time here just to come back to you about your last council meeting. 00:06:46
And clearing making some clarifications and some comments about the receiving of the proclamation for Native American Heritage 00:06:55
much month. Excuse me, that I was not able to attend. I apologize for that. My schedule keeps me Oh, I need a secretary, I think. 00:07:05
So I sent my my cousin Casey Rodriguez to accept that we have been. 00:07:16
Pretty constant here these last few years attending festivals and doing many, many things in this beautiful, beautiful town. And 00:07:22
we continue to do that all throughout. I am getting close to 40 years of being engaged within my culture and part of that 00:07:29
engagement is with all walks of life and many, many passions. So 20 years ago I started the Baranio Ventura Band of Mission 00:07:37
Indians for the purpose of. 00:07:44
A consultation. Appropriate consultations through Sequa. 00:07:52
And while I was on the Commission, the Native American Heritage Commission, I did for 15 years part of that bill, AB 52, SB 18, 00:07:57
which you can look up. I can't go through them with this amount of time left, but they're the ones that that are consultation for 00:08:04
building protection of our cultural resources. So as a tribal chair for the 20 years that I was before prior just teaching in 00:08:12
classrooms going everywhere, but the the importance of. 00:08:19
Tribal group is for that major consultation of the protection of cultural resources. 00:08:27
And end consultation that unpermitted projects. So coming in and wanting to just say that our participation in this city goes a 00:08:33
long way. And I really don't feel that there was anything wrong or any mistakes made by who received the proclamation. In fact, 00:08:40
what I think it did is just opened it up to more inclusion because there's many families that are not part of the barbarian event 00:08:48
that Daniel Ban. There's many Chumash families that live here. Actually, my cousins live here Vernon. 00:08:55
To Mama, it's family, my uncle, his family is here. So you know, a lot of people aren't part of the group. They're not members. So 00:09:03
you actually reach are reaching out to many more community members here. And so we hope and and really will be more active in our 00:09:10
participation with the city. We have lots of opportunities that we can move forward with the education. I've talked to Bobby with 00:09:16
this or excuse me, council member Martinez about going into the schools, which I did. 00:09:23
You know, 40 years ago and I think that's very important that education starts there and our relationship with with the city here 00:09:31
and the county. 00:09:35
I wish you all blessed holiday season and I thank you for this opportunity to speak. 00:09:39

Last time I was here, I was here to receive the city proclamation for Indigenous Peoples Month. 00:10:01
That night, I chose to embody the humble spirit of my Sheamus ancestors and honor my Shamash elder Julie to Might sensely by 00:10:08
purposely rising above the disrespectful words and questions from some and refrain from commenting back. Tonight, however, I speak 00:10:17
only for myself. I was stunned at what took place right before a moment where I should have been honored. 00:10:25
I, like anyone else who walks through these chambers, deserve respect. 00:10:35
The fact that I am renowned worldwide for being a positive and collaborative presence in every space I enter, always ready to work 00:10:40
together towards a common goal, is precisely why I believe Julie blesses me to receive such honorable moments. 00:10:48
My humility, dedication and commitment to the greater good are just a few reasons why I am the first Shoe Mash mentor, Art and 00:10:57
Culture Commissioner. 00:11:02
Even though I am incredibly blessed to live this journey, I am grateful to still remain humble. And because of this, I am grateful 00:11:07
to say, with or without an apology from those council members who awkwardly disrespected me, I forgive you. 00:11:15
My desire tonight isn't to focus on wrongs done, but to simply bring awareness that we are here tonight as yet another reminder. 00:11:24
We're here in a good ray to educate respectful Chumash protocol and culture sharing and to work together for the betterment of. 00:11:33
Please take the part of Rainemi, the part of Rainemi as an example. 00:11:41
Citizens that I've seen at many city events truly welcome and love our shoemash culture and our people. 00:11:50
I understand sometimes people can move with a good mind and a good heart with what they believe are good intentions and want to do 00:12:00
what's best, but taking time to learn, listen and understand. 00:12:07
Must be first, I promise you. I love the city for being my ancestor of homeland and for the city it is today. Our diversity is 00:12:16
beautiful. As a new council quickly comes abroad, Please note my prayers will be with you and I look forward to making lasting 00:12:22

Communications between government officials, including elected office holders, are a matter of public record. They can be accessed 00:12:56
by the public by simply filing a request. 00:13:01
Council Persons Hernandez emails and text messages to and from staff members. 00:13:07
In Port Hueneme, in the city of Oxnard, were the subject of such requests. 00:13:13
These communications reveal a disturbing series of actions by Councilmember Hernandez. They are included, included, but not 00:13:18
limited to #1 multiple unethical and possible illegal attempts. 00:13:24
To interfere with the hiring process of Michael Federico as chief of Police. 00:13:32
Council person Hernandez appears to have gone well beyond her role as a public figure and engaged in personal vendetta against 00:13:37
Chief Federico. 00:13:41
She has exhibited a pattern of open hostility towards chief rhetoric from the diocese and is creating a hostile work environment. 00:13:45
#2. 00:13:53
Obtaining confidential information she had no right to receive about ongoing criminal investigation. When this was discovered, she 00:13:55
refused to cooperate with ensuing investigation into the leak. The city attorney who informed her that her actions in this matter 00:14:00
went beyond the scope. 00:14:06
Of her role as a sitting council member and therefore he could not represent her in this transgression. 00:14:14
#3 Violating the chain of command requires the city required the city manager to repeatedly admonish her to stop giving staff 00:14:20
members direction. The council's role is to decide policy. 00:14:27
Not to tell city employees how to perform their duties. 00:14:34
Council person Hernandez is aware of this, but apparently doesn't believe it applies to her. 00:14:38
#4 bombarding the current city manager with more than 1800 emails in one year period. 00:14:43
Council Member Hernandez is continuing to create a hostile work environment for valued city employees and is exposing the city to 00:14:50
legal liability. 00:14:54
This is not an empty threat. In 2016 and again in 2018, council members created a hostile work environment for city employees. The 00:14:59
settlements for these actions totaled more than $800,000, and the Joint Powers Insurance Authority threatened to cancel the city's 00:15:05
insurance coverage. 00:15:11
I strongly urge the Council to take these matters seriously and ask the City attorney to obtain the records in question and 00:15:18
investigate these allegations, given that these records have already been compiled and disseminated by the cities of Port Hueneme 00:15:24
and Oxnard. 00:15:29
They should be easy to obtain in short order. Failure to do so may jeopardize the cities insurance coverage and expose the city to 00:15:35
expensive lawsuits and large settlements. Thank you. 00:15:40

Mayor, Mayor, Madam Mayor, council members, staff and my neighbors. 00:16:02
I want to thank David for coming forward with that overview of the e-mail concerns. 00:16:08
I too have reviewed. 00:16:15
Many of those emails. 00:16:18
I echo his concerns and I'm not going to go through all of his list of. 00:16:21
Concerns because he did a very good job of presenting them. 00:16:26
But 1800 emails is about 5 emails a day for 365 days in one year. 00:16:31
Can you imagine if all 5 of you. 00:16:38
Did the same staff would not have time to get anything done but just answer emails all day long? 00:16:42
And I have to also say that the tone and tenor of those emails. 00:16:48
Are micromanaging. 00:16:52
Harassing in nature. 00:16:55
And has created a hostile work environment. 00:16:57
And this is concerning not for the leadership of our our city. We've recently hired a new city manager and a new police chief and 00:17:00
we and I would say overwhelmingly. 00:17:06
The citizens really, really like them. 00:17:12
And that's important to us. 00:17:16
So there is an overwhelming support for city staff. I strongly support. 00:17:19
Council to take these matters seriously and to take appropriate action. 00:17:25
In the very near future. 00:17:30
Separately, I just want to say that the this this was, I came here only as a citizen, not representing the coalition. The 00:17:33
coalition will be coming on on December the 16th. For your organizational meeting, I would like to request a short. 00:17:42
Period of time on the agenda so that we can give you a summary of the areas that the Coalition is going to focus on for 2025. 00:17:53
And the areas that we want to collaborate with our city to help. 00:18:02

I'm here to speak about some very disturbing information that recently came to my attention regarding Councilmember Laura 00:18:27
Hernandez. All claims of misconduct that I'm going to bring up are in fact substantiated through a Public Records Request Act and 00:18:35
of emails and phone records and are not confidential in any manner whatsoever. I came before the council about a year and a half 00:18:42
ago to report that I had learned Councilwoman Hernandez was trying to interfere with the hiring process of now police Chief. 00:18:50
And express my concerns at that time. I have now learned that the interference was in fact true. Miss Hernandez has a personal 00:18:57
relationship with Chief Federico's ex-wife Maggie Tugas and her 4th husband Kenny Tugas, who also happens to be with Oxnard Police 00:19:06
Department. Because of this relationship, Miss Hernandez has or was attempting to have Mr. Federico removed from consideration. 00:19:14
For hers and Mr. Federico's ex wife's personal. 00:19:23
Personal gain. 00:19:28
This is a direct conflict of interest with the duties that you are elected to carry out, and you attempted to undermine the hiring 00:19:30
process and the background process for the position of chief. 00:19:36
Miss Hernandez also used Chief Federico's development developmentally disabled daughter as bait in an attempt to have him back out 00:19:43
of the hiring process. And by the way, this in fact has been recorded. 00:19:50
Miss Hernandez also breached confidential information regarding shooting in Port Hueneme. 00:19:57
I'm not going to go into details because it was confidential, but what was made public was that Miss Hernandez contacted the city 00:20:03
manager wanting demanding why she wasn't made aware of it, the council and the citizens. 00:20:09
When the city manager requested how she gained that information because it wasn't public knowledge, she lied and stated that it 00:20:16
was an Oxnard Police Departments press release. Well in fact it was not. And then when she was presented with this information and 00:20:22
told that they wanted the Port Hueneme Police Department wanted to interview regarding the confidential information she received, 00:20:29
she refused to cooperate. 00:20:35
Thereby stymieing an investigation. And again, she got this information directly from somebody from Oxnard Police Department. 00:20:41
Who could have only been Mr. Tugas. 00:20:50
Miss Hernandez recently filed a complaint with the city manager regarding Chief Federico Violin violating policies. 00:20:52
In allowing his daughter to ride in his city issued car. 00:20:59
I find this interesting because I came to a council meeting, oh, maybe a year and a half, two years ago to report that then public 00:21:05
information officer was driving to. 00:21:11
Simi Valley, where he lived and driving his children to and from school. She didn't care about it then. She also knew that chief 00:21:17
at the time, Chief Salinas, who, by the way, was in bed with marijuana. And again, she knew that as well. And working with him, he 00:21:24
drove his girlfriend and her children around, and she didn't seem to have a problem with that. So again, she's using her personal 00:21:31
vendetta against Chief Federico. 00:21:37
And in concert with the Tuguses to specifically target the chief of police. 00:21:45
And again, this, I don't know if it's criminal or not, but she certainly has demonstrated that she is morally, ethically, and 00:21:50
possibly don't make a face because you know what's true? It's all written down and it's all evidence and it's all in paper. 00:21:58
Thank you very much and I'll I'll be back to the next meeting to finish up. But one thing I will say, do not make her mayor Pro 00:22:09
Tem and do the new council members. Don't allow yourself with her because when she goes down, you're going to go with her. 00:22:15

Staffing changes in particular we had a retired annuity, a long time city employee who had become a retired annuity working in the 00:25:00
housing department and they. 00:25:05
Allowed time that we are able to have a retired annuity has ended and so we are making some adjustments and having some internal 00:25:13
finance employees Start learning and taking on some of those housing. 00:25:19
Finance related items. 00:25:28
Related to housing. 00:25:29
And so as part of that. 00:25:31
Housing, and in particular the Housing and Urban Development federal requirements, are fairly. 00:25:34
Complicated and and you need to know the requirements in order to do reporting correctly and items like that. And so with this 00:25:41
change, we want to send our finance senior accountant to a training for the Housing Authority. 00:25:49
To get up to speed on all of those requirements. And typically this would probably be a consent item. And however, I have sort of 00:25:59
a general rule that whenever we're sending somebody to Las Vegas, we better explain why we're sending somebody to Las Vegas. And 00:26:05
so we know how the optics of that are, but this is a training that. 00:26:12
Doesn't happen frequently and when it does happen, it's a federal training, so it happens all over the country and the last 00:26:19
training. 00:26:22
Was several months ago and it was on the East Coast. So this is actually the lowest cost option that we foresee. 00:26:26
And that it's coming up relatively timely where we can get our team trained up to be able to continue the good work in our housing 00:26:32
department. So, so with that, we're recommending that council approve. 00:26:37
Per our policy, the council needs to approve any out of state training. So we're recommending the council approve this training 00:26:45

Preface Before we begin this introduction with the fact that. 00:28:11
This brings us to full contingent on sworn police officers. If you understand what that's like in our industry right now, there's 00:28:16
no other police agency of Ventura County that can say they're fully staffed with police officers. 00:28:22
That is. 00:28:30
The combined efforts of what we've created in this Police Department, especially the past year with all the support from from 00:28:31
James and the city and this council. 00:28:36
Everything that happened for the police officers in the union even as I was arriving or prior to me arriving, but above all, 00:28:41
people want to work here where the place to work because of the support from our community. 00:28:47
Folks, if you don't understand, especially post 2020, it's not the easiest job to do in the world. But as long as you have the 00:28:54
support from the community, and if you haven't heard me say it before, I'll say it again. Public safety's teamwork. It's you and 00:28:59
us, and that's how we keep your child safe. 00:29:04
So I'm very honored to be your police chief here before you to introduce. 00:29:10
Our last hire to get us to full contingent. 00:29:14
Ladies and gentlemen, this is going to be Officer Felipe Figueroa. 00:29:18
And everybody's going to pronounce it. 00:29:23
A variety of ways. 00:29:26
But that was my best Portuguese. 00:29:31
Phil was born and raised in the Bronx, NY. 00:29:35
He's very proud of his parents and his three brothers, his father Antonio, who immigrated to the US from Portugal for better life 00:29:39
and opportunities, and his mother Luce, who's from Puerto Rico. 00:29:44
He attended JFK High School in the Bronx, which at the time was the largest population high school in the US. So I know he's got 00:29:51
some stories from high school. 00:29:54
And he was football team captain, and he led his team to championship titles before attending Colgate University, where his 00:29:59
football skills and ability brought him Patriots League Defensive Player of the Week, selected as Patriots League All Star Team 00:30:06
honors and the Hal W Lahar Trophy, awarded annually to Colgate's most valuable defensive players. 00:30:13
After college, Phil enjoyed a very long and successful Wall Street financial career in New York. 00:30:22
And in Chicago? 00:30:28
Until one day he realized Southern California winters do not include the snow. 00:30:31
He became A-Team leader with an investment firm in San Diego. 00:30:37
I'll get to the law enforcement stuff, but you can hear he's got this great background already. 00:30:42
In 2005, his son Emilio was born. He will tell you his son is his pride and joy. 00:30:47
His finance career allowed him the quality time with his son as well as coaching and volunteering in sports. 00:30:53
His son is now attending College in San Diego. 00:31:01
As I previously mentioned, Phil stellar football performance in his younger years, then you can imagine the passion that led him 00:31:04
to being a high school football coach at several high schools in San Diego County. 00:31:11
In 2020, with some major shifts in the finance world. 00:31:18
Phil made a career change and became a deputy sheriff with the San Diego Sheriff's Department. 00:31:23
Fill then lateral transferred to the Beverly Hills Police Department in 2023. 00:31:30
And then decided he wanted an even smaller city and a smaller Police Department to work for. Even Goldilocks checked all three 00:31:37
beds before she decided. You know. 00:31:41
We are happy that he did his research because he had the ability to do his research and choose where he wanted to go next. 00:31:48
Um, great. I will say great interview. He did his homework on the city, he did his homework on the police chief. He did his 00:31:57
homework on what he was stepping into. 00:32:01
And he chose to come here. 00:32:06
Him choosing law enforcement later in life was not hard for him to decide on. 00:32:11
Because as a brother-in-law enforcement and all of his brothers have served either our country or their community in some form. 00:32:17

going to give a brief presentation walking us through the background. 00:34:39

Agenda item number 9 pertains to an updated agreement between the city and the Port Hueneme Little League. 00:35:02
The recommendation is for council to authorize the city manager to execute a new agreement that would govern the leagues use of 00:35:09
bubbling springs, parks, ball fields, snack bar, community meeting room and storage area. 00:35:15
A little background, the Port Hueneme Little League is a 501C3 that serves youth in the Port Hueneme and South Oxnard community 00:35:25
and has utilized Bubbling Springs Park for decades. 00:35:30
The existing license agreement, which was initially executed in 2016, provides the league with exclusive use of the parks, ball 00:35:36
fields and associated amenities, which include the snack bar. 00:35:42
In exchange for that exclusive use, the league has maintained the fields with its volunteer labor, purchase of materials and use 00:35:48
of its own equipment and has paid the city an annual fee of $3750. 00:35:55
This year, while the park has been under renovation, the league has had to relocate its operations. 00:36:06
During that time, the city has been in communication with the league regarding the project status and in order to prepare for the 00:36:12
upcoming reopening of the park. 00:36:16
Based on those communications, the city and the league have discussed various changes to the agreement, which would see the city 00:36:21
resume responsibility for primary field maintenance. 00:36:26
Would replace the league's exclusive use with priority access to the ball fields. 00:36:31
And would prescribe specific terms of the league's use of the community room, the storage room and the concession area. 00:36:36
So a little bit about the use of the agreement. Cities and special districts commonly treat Little League organizations 00:36:45
differently than the average park user. 00:36:49
Some offer discounted permit fees, but many do use specialized agreements to establish specific terms and establish a unique fee 00:36:54
for the use of the park area. 00:36:59
Given the league's history of park use, the physical investments the league has made into the park, and the special and unique 00:37:06
community benefits its programs provide, staff is recommending to continue the practice of using an agreement to govern the 00:37:11
league's use of the park. 00:37:16
So this slide here shows the area that would be subject to the league's use under the agreement. It is included in your packets. 00:37:24
It would be an exhibit to the agreement. The one thing I'll call out at the very bottom of the the diagram there South of field 00:37:30
one, there's a shaded area. 00:37:37
This is an amendment to the version in the packet. It covers the area that is the the bullpen warm up area for that field that 00:37:43
wasn't initially highlighted on the version in your packet. 00:37:49
The proposed agreement differs from the existing agreement in a few key ways. 1st, instead of exclusive access, the agreement 00:37:57
would provide the league with priority access. 00:38:02
That means that the league would have the ability to reserve the fields for a specified number of hours before any other requests 00:38:07
for field use would be considered. 00:38:11
In the spring season, it's proposed that that would consist of 18 hours during the week and 10 hours on the weekend, and in the 00:38:15
fall it would be 12 hours during the week and eight hours on the weekend. 00:38:20
The agreement also provides for the league to be able to hold 3 tournaments during the course of the year. 00:38:26
The priority hours established are anticipated to satisfy the league's need, but if an additional need did arise, the league would 00:38:32
be available would be able to acquire additional use of the fields through the city's established permit process and pay 00:38:38
associated fees for that additional time. 00:38:44
The agreement also calls for the city's resumption of primary field maintenance tasks, though the league would continue to manage 00:38:51
field preparation tasks such as infield dragging and baseline shocking. 00:38:56
The agreement also calls for the league to be the default user of the community room between January and June, though the city 00:39:03
would reserve the ability to permit it to another third party if no conflict with the league's activities existed. 00:39:10
And the league would continue to operate the concession stand, being responsible for all operating costs. 00:39:18
And being able to retain all revenues generated from its operation. 00:39:23
As noted earlier, the fee, the $3750 annual fee that exists in the current agreement is proposed to remain unchanged in the 00:39:29
existing agreement and we would propose to bring this back to Council and re-evaluate the success of the agreement in one year's 00:39:34
time. 00:39:40
In summary, staff recommends that the City Council authorize a new agreement which revises the existing one. 00:39:48
The updated agreement is expected to have no adverse impact on league operations while a neighbor, while enabling the broader 00:39:53
community access to the newly refurbished ball fields. 00:39:58
I'm able to answer questions the council may have and I know we also have some representatives from the league that may wish to 00:40:06
speak on this issue. 00:40:10

So council member the the league traditionally operates it during league activities, but we did put language in the agreement that 00:40:33
if the city identifies a need for an outside event that would be outside of the leagues activities, that the city would bring that 00:40:40
to the league attention. And while it would depend on the date and the time and the available resources, they can't make any firm 00:40:48
commitments. They would make their best effort to accommodate such a request for an alternate event. So it could be another. 00:40:55
Alternative for fundraising, so to speak. 00:41:03
Yeah. The plan is that if they operated it for a non league activity, for a special event of some kind, they would be the 00:41:07
operators, but they would also receive and and retain any funds collected from that activity. 00:41:13
Thank you. And if I can just add there, I think that's that's one key that I just want to highlight was that, you know, I think 00:41:19
what we ended up coming up with and what we're proposing, it actually seems pretty simple and and not like a huge change from what 00:41:26
was previously there. But it was a result of many meetings. And I want to thank Annabelle and Myra from the league who who met 00:41:34
with us several times, several hours to really work through these and with the goal consistently of trying to. 00:41:41
Win win opportunities for both the city and the league. And that's like a great example. We don't have the resources to operate a 00:41:49
snack bar right now. You know, we just don't, we don't have that capacity. But we worked with the Little League and came up with a 00:41:56
proposal whereby they could actually use that as a fundraising opportunity and have another fundraising opportunity, but it still 00:42:03
provides that service to the community. And so so it was a lot of little things like that trying to find Win win. 00:42:11

That benefit both the city and the Little League. So I think I think we've done the agreement we proposed does that and we're 00:42:20
recommending we move forward with that. So. 00:42:26

So, but I know this is we're talking about a one year agreement and that's cool. And that was a key thing is, you know, the 00:43:16
agreements proposes A1 year because I think both the league and the city were kind of putting some we're doing this based on, you 00:43:23
know, mutual trust and trying to make sure we find something that works for both of us. But we talked to the league about the fact 00:43:30
that they we all might come back and say that was too much. You know, that was too. 00:43:37

But, you know, we don't want this. We don't want anybody to fail with this. We're trying to find, you know, win, win. So we'll 00:43:55
come back at the end of the year and if something didn't work for the league or doesn't work for the city, then we've agreed. 00:44:00

For being so supportive and meeting with us so many times and not having multiple emails sent out. We really appreciate that. And 00:44:40
I want to thank you guys for your consideration in in the agreement. It was scary. I'm getting kind of cold sweats right now. 00:44:48
When we started discussing all of this. 00:44:58
And feeling that after 65 years of us being at Bublé Springs Park. 00:45:01
That all of a sudden we would get this brand new park that we. 00:45:08
So activate actively tried to get the city the state. I had a walkthrough with our district representative out there after we they 00:45:13
said no snack bar. Our grant was denied and I personally walked the the park with her and couple months later we ended up getting 00:45:22
a state grant. I don't know if that was just pure luck or if she intervened. 00:45:31
But really thank everybody for the consideration knowing that other users are. 00:45:41
Wanting to come to the park that that is great. Before us having this home for 65 years, it really, you know, it scared us. It 00:45:49
scared us because we know that our community is not going to be able to afford high increases in, in, in rental fees. We cannot 00:45:59
compare 2000 Oaks or Conejo Valley or all these other leagues. I know we discussed Sunset and El Rio. They don't pay any fees. 00:46:09
For US, $3700 was like, OK, well, you know, we'll pay the fee even if even if they don't pay fees. 00:46:19
We'll pay that fee, not a problem. We'll figure whatever we need to out. It takes a lot to be able to run a league. I work like 00:46:27
364 days a year. I'll give myself one day off. But it is a big, big commitment to run the league and it's year round. I have a lot 00:46:34
of board members here today. We're going to our board meeting right after this and they can tell you that it takes the entire year 00:46:42
for us to run. 00:46:49
Organization, the reason why we asked for the snack bar, not because we want to be greedy, but it is a lot of work where we we 00:46:57
operate our fall season and we operate that snack bar because it's still revenue. We still have to pay our umpires for us to move 00:47:03
out. 00:47:09
All of our all of our equipment or it's going to be city equipment, the new stuff. But to be able to move out, it is a big process 00:47:15
for us to do that and then move back in every Sunday when we're using the the league on off days for us it being a revenue. 00:47:24
It's really important for us and we're looking forward to being able to do events there or have the city do events there because 00:47:35
we want to partner with the city. 00:47:40
And do more community events, Easter, Halloween. There's so many things that we can do and we have so many kids. I mean we have 00:47:45
about 300 kids during regular season spring and at least 150 during Fall bar. That's a lot of kids that we service. So I think 00:47:51
with that we could. 00:47:58

biggest thing that has been done in the city of Portland, me and maybe forever. I don't even know. Nobody can remember anything as 00:49:42
big as this. So I think it's great testament to our city and the the commitment that they have to the community. So thank you 00:49:47

The next item up is the update on the United States Supreme Court's decision regarding camping and public spaces. Laws or Grants 00:50:15

Council residents, first thing I want to do is introduce officer from. Officer from is our community resources officer with the 00:50:29
city and he is actually the public face of dealing with encampments on public property and he's also going to handle the clicker. 00:50:37
So that's important. Could I just add like last time I saw you had a mustache, I got this beard. 00:50:45
No shame, November. They've all kind of changed a little bit, man, every November. Where have you been? I just can't grow. I can't 00:50:55
even get. 00:50:59
So what I want to do is update the community on the Supreme Courts decision. It was last July, this past July in Grants Pass. 00:51:04
You've got my staff report, you've read the staff report, but there was a lot packed into the decision that the newspapers and 00:51:12
public really didn't pick up. So that's really where I want to focus my discussion tonight. And then officer from will discuss. 00:51:19
Where we are in terms of our anti camping ordinances and where we're going in the future. 00:51:28
So. 00:51:34
The history of the anti camping ordinances and where it really came to the forefront was about six years ago in a decision out of 00:51:36
the 9th Circuit Martin Martin versus City of Boise. 00:51:42
Where the 9th Circuit stated that the anti camping ordinances are unconstitutional as violating the 8th amendment prohibition 00:51:48
against cruel and unusual punishment, the court in the Martin versus City of Boise decision stated that. 00:51:58
These ordinances criminalize the status of being homeless. 00:52:08
Now many years ago after the City of Boise decision, there were a lot of us who were hoping that the Supreme Court would take that 00:52:13
case up, but the Supreme Court did not. So the cities were really stymied and prohibited from enforcing any of their anti camping 00:52:19
ordinances. We really were at a hands off position. 00:52:26
So another case came up through the 9th Circuit, and the 9th Circuit upheld the injunction against the ordinances, and that was in 00:52:33
the Grants Pass. Grants Pass OR? 00:52:39
And the Supreme Court decided to take that case up on review. And in a six to three decision, the Supreme Court overruled the 9th 00:52:46
Circuit. 00:52:51
But it was an interesting decision written by Justice Gorsuch. And Justice Gorsuch said that no, the anti camping ordinances do 00:52:58
not violate the 8th Amendment because there's nothing cruel and unusual about modern day incarceration, and that these ordinances 00:53:06
were not criminalizing the status of being homeless, but we're criminalizing an act. 00:53:14
And the 8th Amendment was enacted to prohibit. 00:53:23
Forms of punishment that were really outdated. You can't arrest someone for sleeping in a park illegally sleeping in a park and 00:53:28
flogging them or tar and feathering or, you know, that sort of punishment that was really outdated and out out out of favor. 00:53:38
And there's nothing, like I said, cruelty, or as Justice Gorsuch said, nothing cruel and unusual about modern day incarceration. 00:53:48
It's not that bad. I. 00:53:53
What Justice Gorsuch also stated in the decision is that not only was the 8th Amendment a particularly. 00:53:59
Weak argument to invalidate these ordinances, but he really questioned why. 00:54:09
The plaintiffs in the case had not raised the issue of due process or unlawful searches and seizures that those would have 00:54:15
probably been more effective arguments to invalidate the ordinances. But that's not what the court was was given. You know, they 00:54:23
had to deal with the arguments that they were given. It was just interesting comments out of Justice Gorsuch, almost inviting. 00:54:31
A challenge on a due process argument and a. 00:54:41
Unlawful search and seizure argument. And we have to remember that we are in the 9th Circuit, so we don't want to be the test case 00:54:46
with whatever we do. We don't want to be the test case. 00:54:51
So. 00:54:57
What we are after the decision the city attorneys and as well as staff I know please we've been working with our neighbors in 00:54:58
Ventura County to come up with a consistent approach on how to deal with homelessness and anti camping and to keep. 00:55:08
To keep our approach in line with the the Grants past decision. 00:55:20
So what we have to pay attention to is like I discussed distinguishing between conduct and status, you're doing an act versus the 00:55:27
status of being homeless. 00:55:33
The court did discuss how the federal courts are particularly. 00:55:41
Ineffective in dealing with local health and safety issues, that that's really something that the local jurisdictions should be 00:55:47
dealing with, not federal courts. Justice Gorsuch also discussed the importance of cities providing supportive services and 00:55:55
resources to the homeless individuals. The punitive measures alone are not going to solve the problem. 00:56:03
And we also have to remember the Grants Pass only addressed. 00:56:13
Anti camping ordinances on public spaces. It has nothing to do with private spaces or encampments on private spaces. It doesn't 00:56:19
address that at all. 00:56:24
So. 00:56:31
After the grant passed decision, Governor Newsom issued an executive order where he acknowledged Grants Pass and he ordered he 00:56:32
ordered state agencies and encouraged local jurisdictions to address these crises in alignment with the California Department of 00:56:39
Transportation policy. 00:56:46
To address encampments on state property and it's whenever feasible. 00:56:54
You have to have site assessment in advance of any sort of removal operation. 00:56:59
To determine if an encampment has. 00:57:04
An imminent if there's an imminent threat to life, health or safety such that you could immediately remove the people, you know, 00:57:09
you think of the floods, you know, you anticipated floods coming through the area fires. We were accustomed to fires. And in that 00:57:18
instance, the governor's order is that you can immediately remove people where the where there are no exigent circumstances. 00:57:27
The governor wants us to post notice. 00:57:36
Notices to vacate at least 48 hours prior to removal. 00:57:39
To also to contract with service providers for outreach for persons experiencing homelessness at the encampment and collecting and 00:57:44
holding for at least 60 days the personal property collected at the removal site that is not a health or safety hazard. 00:57:53
And with that, I'm going to turn it over to Officer from and thank you for handling the clicker. 00:58:02
Of course. All right. So this is a quick overview of things that we already have in place. This is our municipal code. These are 00:58:07
some main sections that mainly focus on the beach. So you have 42104213 and 4311. We also have another section which we'll 00:58:15
address, but that'll come in in a later slide. But it, like I said, so 4210 addressing camping on beach park perimeter. 00:58:23
Picture kind of states it perfectly. There was a gentleman in the rocks right there. 00:58:32
That community that we had out with us during that outreach was our backpack medicine. So it's just a various collection of 00:58:36
individuals that all meet together, everyone from behavioral health advocates to nurses from BCMC. It's a huge organization and we 00:58:42
do it every month, so. 00:58:48
That's a quick overview of that. 00:58:55
So our mission Grants Pass gives us a tool in dealing with camping and public spaces, but our mission to assist the homeless 00:58:59
remains, which includes contact and connect chronic homeless individuals with social service providers, work collaboratively with 00:59:05
Ventura County Homeless Task Force. That's a newly formed task force within the county. We've had three meetings. It's a 00:59:12
collection of almost every agency in the county, not only police agencies, but Oxnard Fire as well as Ventura County Fire. 00:59:18
And a bunch of other behavioral health agencies. It's a really great meeting. 00:59:26
There's probably 50 or 60 of us in these meetings and it's just a collaborative effort of addressing this issue. Backpack 00:59:30
medicine, that was the the picture in the previous slide where we go out there and we do it once a month and just outreach 00:59:35
services to whoever we can see. We start at the beach and just make our way all the way up north to the far corner at like 00:59:41
Victoria and Hemlock. So excuse me. 00:59:46
The next one is VCMC drug detox and rehab services. That's fairly new. We've actually had a success story with that as well. The 00:59:52
first day Chief emailed me that we actually had this program. The next day we had or actually was the same day we had an 00:59:59
individual who we got into drug rehab and. 01:00:05
For alcohol and they actually were given to take it back to Georgia where he was from and he's doing great now. So we also have 01:00:12
Ventura County Behavioral Health to identify those eligible for city or county social services. They're awesome. It's led by James 01:00:20
Boyd. He's a great guy and he really works his his rear off to to help whoever he can. 01:00:29
And so just basically change the behavior through enforcement, mental health assistance and advocacy. 01:00:38
So city statistics in total the Police Department has received this is this year as of November 7th of this year. So we've 01:00:44
received 13,717 total calls for service. That's every call, every traffic stop, everything that in any dispatcher or even officer 01:00:51
initiated call. That's the the total calls we've had as of November 7th of the 13,717, there were 315 transient specific calls 01:00:58
based. 01:01:05
Call type of the 13,717. There were 68 encamons specific calls. 01:01:13
With a total of 17 arrests for transient related call types in total, 2.7% of the total calls for service were transient or 01:01:19
encampment related combined. 01:01:23
In our last point in time count for our homeless, there were 44 total unhoused homeless individuals for this year. 01:01:30
Out of approximately 2358 unhoused individuals in the county in California is obviously a lot more in the state. At a 181,399, our 01:01:38
city accounted for 1.8% of the Ventura County total. 01:01:46
This reflects the efforts our team makes in taking a compassionate but proactive approach towards connecting those in need with 01:01:55
the appropriate services. That's all just due to our outreach, and the task force has really helped us a lot with that. 01:02:01
So this little graph is just a graduated enforcement model to change behavior. So when we first contact an individual, it really 01:02:09
starts with advising of offenses. We don't want to come down at like a hammer and just see something and just immediately just 01:02:16
throw the book at them. So we start with referring to appropriate services, coordinated outreach efforts with Ventura County 01:02:22
behavioral health and service provider service providers. Aside from behavioral health, we have. 01:02:28
Mercy House, Salvation Army, we have a bunch of other outreach services to hopefully get them shelter housing. 01:02:36
The one stops the great resource as well, the one in Oxnard as well as the one in Ventura by the hospital. 01:02:42
If we do get another call out on this individual citations if behavior continues, so continue push towards appropriate services, 01:02:49
coordinated outreach efforts and refer to appropriate services. The hard part is a lot of these individuals that we do contact are 01:02:55
very resistive to services. And so we just continue that approach to say, hey, these these are things that are there for you. 01:03:02
They're free. I can I've driven people myself in the back of my patrol car all the way up to Ventura to the one stop myself. 01:03:09
So we offer that I'm willing to drive wherever they want to go to get these services, but there is a resistance there and a 01:03:17
hesitant. So if this continues, we can arrest if the behavior continues. So coordinate with our outreach services for better 01:03:22
outcomes with services request stay away orders. Basically that's something new that we're going to be addressing. Stay away 01:03:28
orders in the sense of. 01:03:34
In one of our reports we can say at the bottom the subject should be should stay away from. 01:03:41
A certain location so refer to appropriate services as well. Officer from would you mind taking a question for mayor Pro Tem? 01:03:47

If you were to take someone in and they have agreed to get support. 01:03:58

In the back and I took all of her belongings up to the one stop and I literally walked her in and I was like, where do you want to 01:04:37
start? We had that conversation of what do you need? And so started with, you know, a few medical things and then there was some 01:04:43
food things that she needed. And then it ultimately ended with getting her back to the city because this is where she considers 01:04:50
home, but it's just continued follow up from there as well. Hey, are you going to I know that this individual. 01:04:57
Receives behavioral health treatment and so are you taking, are you getting your prescribed medications? Are we following up with 01:05:04
that so we can? 01:05:07
I'm lucky enough to where I can really do a lot of follow up and just keep track of and making sure that they're getting the help 01:05:11
that they need. But it really it's case by case. It's just identified by their needs. Let me just ask the question, absolutely the 01:05:17
same question in a different way. If someone you someone asked for help, they met the criteria, would they go right into the 01:05:23
services that they need? 01:05:29
Yes, Depending on what they need, yes. 01:05:36
Depending on. Can you help me with that? 01:05:39
Correct. Yeah, it depends on what's available. 01:05:41
Right. So if they need like for example, substance abuse treatment, we can, I can take them up to Ventura County, the VCMC, 01:05:44
Ventura County Hospital and we get them immediately, get them right in, no questions asked. It gets a little tricky with housing 01:05:50
because it depends on availability. So Mercy House, Salvation Army, they have very strict guidelines of what they can and can't 01:05:57
take. So it depends on how many beds they have available, things like that. So yes, we can get them the help they need. 01:06:03

I have been surprised and I think people would be surprised. 01:06:17
To here, because we'll get calls and people will say things like, you know, I've seen this person around town and why isn't 01:06:22
anybody helping them? And I have been surprised at how many services that we do. 01:06:27
Not only make available, but we, we, you know, push and we try to get them, you know, get people into those services. And I would 01:06:33
say, I think we can accurately say that more often than not, if you see someone and you say why isn't somebody helping them, it's 01:06:40
because they've turned down the offer of help. And so the issue usually is not that we can't get them help, it's whether they'll 01:06:46

OK, so moving forward, immediately after the Grants Pass decision, the city's Police Department, City's attorney's office and City 01:07:33
Manager's office met with the County of Ventura and other cities within Ventura County to ensure collaboration. Enforcement of 01:07:39
these ordinances require a collaboration between these agencies. The local agencies agreed to work together to draft and implement 01:07:45
and take camping ordinances to ensure a consistent approach across Ventura County. 01:07:51
And this we continue to work with these agencies to develop a unified approach and additional ordinances may be presented in the 01:07:58
future. 01:08:01
We have been looking at other cities ordinances and looking for adoption and potential adoption of those ordinances as well. But 01:08:06
this is a good time that I would like to bring up something that we already have in place. So the municipal code under section 01:08:13
3970 to 3978, it really defines camping and this also applies to not only the beach, it's public space. So in our municipal code, 01:08:20
camp means direct maintain or occupy a camp facility for the purpose of human habitation. 01:08:28
And camp facilities includes one or more of the following items tents, huts, other temporary physical shelters, cots, beds, 01:08:36
sleeping bags, hammocks or bed rolls. 01:08:40
And then 3972, it is unlawful for any person to sleep camp or store personal property, including camp facilities and paraphernalia 01:08:46
in or on restricted public property. So these are things I 3970 to 3978, it's just a bunch of definitions for the most part, but 01:08:53
it really outlines what we're allowed to enforce on public property. 01:09:00
Let me just make a comment on that the. 01:09:07
The City of Boise decision out of the 9th Circuit really prohibited the city from enforcing any of these ordinances the whole 01:09:11
3970. 01:09:16
Group of ordinances. And so with grants passed, we are now able to start enforcing those. However, we want to take into 01:09:21
consideration the governor's order. We also want to take into consideration what our local partners are doing. And the reason for 01:09:29
that is because we've seen this happen in other areas if one jurisdiction becomes very aggressive. 01:09:37
And starts just arresting people and hauling them off. The city over is going to start busing their people in. So you don't want 01:09:45
to be in that situation. So we want to work collaboratively. 01:09:51
And cooperatively with all of our neighbors and all of the city attorneys, because I attend all their meetings, we're all in 01:09:57
agreement on that, that we really need to have a unified approach to the anti camping ordinances. 01:10:05

Homeless count, last I heard it was 19, so this year alone was 44. I know that was earlier in the year. It fluctuates. Sometimes 01:11:32
we see some new faces, sometimes they just come and go or they're passing through. I probably say it's a lot less than 44, but 01:11:40
there's no official count as of right now. And so the city really relies on the county resources. 01:11:48
And providing the services that homeless individuals need. 01:11:58
Do we expect to continue in that manner to rely on county or will there be any grant money or any funding at the city level to 01:12:02
assist? 01:12:07
In these efforts as of right now, our, our county partners are incredible. James Boyd and his team with Backpack medicine 01:12:12
specifically and how proactive he is and just open his phone is open. I feel like 24 hours a day. So he, he works his tail off and 01:12:19
he's passionate and the team that he's put together is something I personally want to keep. 01:12:25
And I don't see any any need to change what's already working for us. Yeah, James deserves a hero's award for sure. But thank you 01:12:32
for the good work. We've come a long ways in our program in assisting the homeless. I think when I came on board in 2018-2019, 01:12:38
there was nothing. 01:12:44
Councilman Martinez and I worked on doing the state of the homeless here in the city and some things started happening under 01:12:52
direction of Chief Salinas and you guys have just taken it further. So thank you. 01:12:57

And also the chair of the Wine EMI HOA Coalition Safety Committee subcommittee. 01:13:33
Are I'm very sympathetic to the plight of the homeless and the needs to address where required by law. 01:13:39
But our community is impacted directly. We have 134 homes. 01:13:50
We are directly adjacent to the Mandalay Village Marketplace shopping center and the Oliveira Plaza shopping center were separated 01:13:57
by a 12 inch block wall. We have a 5 foot set back on our homes. They're basically 0 lot line homes, so our residents are 01:14:03
approximately 5 feet away from. 01:14:09
A 12 inch wall that separates them from everything that happens behind that shopping center. 01:14:16
I am one house removed from the block wall and our house from our house. In the backyard or indoors, we can hear screaming and 01:14:21
yelling. 01:14:27
I don't know what these people are screaming about, but the profanity and the language used is terribly upsetting. And if it was 01:14:33
in any other context, you would suspect that there was about to be some kind of violence. And maybe there is. I call when that 01:14:39
happens. I call the police and they're, you know, hopefully they respond. I don't know what happens because it's on the other side 01:14:45
of the wall, but I hear the same voices. Maybe there are 47 people. 01:14:51
But if there are five of them living behind our property, they're they're there and they have been there for years. 01:14:58
And if you Google the Mandalay Village marketplace on Google Maps, which I've done. 01:15:04
There are three different positions that you can see in this wheelhouse entrance, and every single one of those photos has has a 01:15:11
different person panhandling. They're going back for several years. 01:15:16
That's the public face of the Mandalay Village marketplace is that wheelhouse entrance and other areas. The private face is what 01:15:21
my 134, most mainly seniors of some, some people are younger. 01:15:28
Who are very concerned about people not only the noise but also jumping on the wall, jumping over the wall into their yards, 01:15:35
jumping on the wall and onto their roofs. 01:15:40
And I don't know if these are homeless people, and if I use that word, I stand corrected. These are people who are committing 01:15:47
actions that are illegal. They're trespassing, and I believe that they may be using drugs as well. Whatever's been done in the 01:15:55
past and up until now to try to enforce and regulate back there has not succeeded. 01:16:03
A new approach is needed and as the representative for the Coalition and for my HOAI, stand ready to work with the police. 01:16:12
Needed and to work with the shopping centers management as well. First Washington Realty. So I am here to help and I'm also here 01:16:21

I live in the Pacific Collection adjacent to Mandalay Village Marketplace and all of a Plaza. 01:16:57
In my neighborhood and throughout Port Wanimi, in the course of my daily life, I'm repeatedly faced with situations that are 01:17:03
unsightly, unsanitary and unsafe. 01:17:08
We have a small population of unruly individuals who have been allowed to disrupt our neighborhoods with panhandling. 01:17:14
Camping, loitering, and intimidation. 01:17:20
They impose a general blight on our community and expose us all to unwanted hazards including needles, drug paraphernalia, trash 01:17:23
and human waste. 01:17:28
I applaud the Port Hueneme Police Department for guiding many unhoused individuals to seek available shelters and assistance at 01:17:35
rehab and mental health facilities. However, there remain many unhoused who choose not to avail themselves of these services. 01:17:42
Therefore, I'm here tonight to ask you to review, strengthen, and encourage enforcement of laws and ordinances that will address 01:17:49
the ongoing impacts of these disruptive individuals. 01:17:54
The United States Supreme Court recently overturned the lower court ruling of Grant Pass V Johnson, which had previously prevented 01:18:01
cities from enforcing their public camping laws. But the Supreme Court didn't stop there. They also made it clear that an 01:18:07
individual who violates local laws and ordinances should not be excused from accountability just because of their underlying 01:18:14
condition, whether it was unhoused, drug addicted, or suffering mental health issues. 01:18:20
It is important that we actively address these situations across our city and demand accountability in order to restore order to 01:18:27
our public and private spaces. 01:18:32
We, as residents of Portland, Amy, ask your help in making our city safer and more livable for all. 01:18:38

Our ordinance as it exists now and as we foresee it, as we're drafting new ordinances, really focuses on acts as opposed to status 01:18:52
of being homeless. And that's what Grants Pass discuss. That's what Grants Pass allowed to allow the cities to start regulating in 01:19:02
that area again. And it's very, I think it's very important to make that distinction between the. 01:19:12
Being homeless and the conduct that can be regulated. Also, I'm a city manager. I'd like to also note the difference between 01:19:22
public spaces and private property. 01:19:28
A lot of the issues we have in our city unfortunately, take place on private property, which this law does not govern whatsoever. 01:19:34
Yeah. And what I will note on that level is that we do make efforts to work with private property owners to try to help educate 01:19:41
them on hard, you know, hardening their property. That might not be the. 01:19:48
The right word, but you know what measures they can take to try to make sure that encampments don't, you know, start in their on 01:19:55
their private property, for example. So that is something we we do and we plan to continue to do. But that is a limit of the 01:20:01

I've lived in our community for 27 years. I support whatever the tools the city, the Police Department can legally use to help 01:20:34
keep our communities safer. We are affected by the pan handlers and unhoused at our local shopping centers, primarily in our area. 01:20:41
We are having the most problems with the Mandalay Village Marketplace. 01:20:49
Where the Ralph's shopping center is, I know there are no easy solutions, but it is very disturbing to drive by or walk into the 01:20:56
shopping center and pass by. Pan handlers at the entrances, carts and debris behind the stores, disheveled RV's parked throughout 01:21:04
the center with the unhoused loitering around. It feels very unsafe, especially if we want to walk over at night to enjoy one of 01:21:11
our restaurants or go to Starbucks. I can't imagine. 01:21:19
That the tenants are happy about this either. We really want to support our local businesses, but some of us find ourselves 01:21:26
shopping in Oxnard and Ventura instead of locally. Therefore, there is no revenue that comes in for the city. I appreciate officer 01:21:33
from and team for being proactive and offering services to the young house, but more needs to be done. We want everyone to feel 01:21:40
safe and of course have a safe place to live. 01:21:47
The shopping center management companies, The city. 01:21:55
And police as well as a community all need to work together for solutions. 01:21:58

Are participated in public drug use and so I would hope that we could kind of look at it that way like hey if somebody's publicly 01:23:40
intoxicated on crystal meth or whatever I think they should be arrested and given a chance to sober up in my neighborhood just 01:23:48
last night I saw three new faces that I've never seen before and I've been seeing. 01:23:56
Bedding material stuffed in coral trees and and we we see that quite frequently and. 01:24:05
You know, I think it's. 01:24:14
I think it's a good idea to throw those things away when when we do come across them. But the underlying problem is still there. 01:24:17
And I was with Chief the other night and just the other night he got a call from an individual who's in penitentiary. 01:24:24
And he, this individual called chief to thank him for trying to help him. And the guy is locked up because he was on drugs and 01:24:32
he's made a vow to get his life together. So I would just hope that we're constantly engaged in these folks. 01:24:40
Constantly offering them to help well, at the same time executing some level of tough love. And I think the fact is that 2.7 of 01:24:49
the 13,000 calls are homeless related. I think many of us have given up. 01:24:57
You know the there's a guy sleeping on the sidewalk for three weeks. There's this other guy that's been on the beach for a few 01:25:07
years. I haven't seen him for a couple months and I know he's refused services. 01:25:12
And just yesterday, 2 persons in the Santa Clara River were severely injured when a a propane canister exploded because it was 01:25:19
improperly being used. So the safety issue is really important and I know that. 01:25:26
You have a very tough job and. 01:25:35
What our residents are asking for is, you know, constant interaction, constant offering the hand to help. And you know, it's like 01:25:38
a salesman, you get rejected 100 times and then to get one and it's a very rewarding and then sometimes I believe. 01:25:48
Public property versus private property is can be a red herring in some cases, for example. 01:25:59

House of Gaines closed. Well, now that, and I'm going to say the drug addicts have taken over the, the left side of the building 01:26:09
and they're hiding behind bushes and you have to like look for them to see them, but they're there. But again, I, I look at it as 01:26:16
I think these are just people who are dedicated to drugs. And if that's the case, you know, let's try to give them an opportunity 01:26:23
like the phone call the chief got the other night from a person that's in Ventura County jail sobering up and and trying to take. 01:26:31
Services so I know that there's no way to solve this problem, but I just want to encourage you to keep trying, keep making those 01:26:38
connections and always, always offer to help the persons you come in contact with. Council member Hernandez. 01:26:46

Surfrider and give essentially what we're looking for as staff is the next step on this proposal to move forward would involve 01:28:18

I'm here representing a Surfrider Ventura County with this proposal for enhancing coastal resilience and habitat at the Wyoming 01:29:24

manager for the Surfrider Foundation. 01:29:49
OK, so our proposal and the reason for the proposal and the benefits, we want to share information and benefits on the proposed 01:29:56
Wyoming Beach Park Dune Restoration Community project with the City Council and the staff to give an explanation of why this is 01:30:03
important for the city. And you know personally why it's important to me. I am, as I said, out on Ormond Beach quite a bit. I'm 01:30:11
involved with the city of Oxnard on the. 01:30:18
Plan there and I just saw an opportunity to do something beneficial with the dunes that are in front of well between the Chumash 01:30:26
Creek and the Alaska 261 Memorial. There exist existing dunes that I think we can enhance to the communities benefit. 01:30:37

All right, so a little bit of background on who we are. At Surf Rider, we are committed protecting and enjoying the world's ocean, 01:31:14
waves and beaches for everyone through our powerful activist network. We have over 200 chapters and clubs across our network, 01:31:21
including the Ventura County chapter and we tackle a range of critical initiatives including plastic pollution, ocean protection, 01:31:27
clean water, beach access, and coast and climate. 01:31:34
Today's work focuses on the Coast and Climate Initiative, which aims to address the challenges of climate change and ensure the 01:31:41
resilience of our coastal communities and ecosystems. 01:31:46
And so this year, the Surfrider Foundation launched this new program. The Climate Action Program is designed to support chapters 01:31:52
to create healthier, more resilient coastlines. Really, the goal for the program is to address impacts of climate change on our 01:31:58
coast while empowering communities to take meaningful actions. Through this initiative, we're supporting the Ventura County 01:32:04
chapter and others to implement restoration projects to enhance coastal resilience, protect the ecosystems and communities that 01:32:09
depend on them. 01:32:15
And so although this program is new, Surfrider is not. 01:32:22
We're not new to restoration. Chapters have been leading have been leading impactful projects for over 20 years. Chapters have 01:32:28
planted over 500,000 plants across many different projects over the last 20 years and the Ventura County chapter through the 01:32:35
Surface Point project is a shining example of this work that we have been doing for a long time. 01:32:42
The Surfrider Ventura County Chapter led the dune restoration efforts at Surfers Point, planting the vegetation and removing 01:32:50
invasive species and maintaining the area for years. These efforts have helped the dune ecosystem there heal into the thriving, 01:32:58
resilient habitat we see today, again showcasing the power of community LED restoration. And building on that, we're excited to 01:33:05
share more details about the proposed project to restore dunes here in Port Hueneme with a plan crafted by The Coastal. 01:33:13
Consultants, they also put together the dune restoration plan for Surfers Point and so with their help, we put together a plan to 01:33:20
create healthy, resilient dunes in Port Hueneme. 01:33:27
So I'll go ahead. So our project goal is to engage the community to restore 2 1/2 acres of dune ecosystems that we need Beach 01:33:40
Park, promoting biodiversity, enhancing natural coastal protection through collaborative sustainable conservation efforts. And 01:33:48
we'll go a little bit more into detail in the following slides. 01:33:57
Could we have that door shut please, because it's really distracting to thank the speaker. Thank you, Sir. 01:34:09
OK. So I want to talk a little bit about the current conditions and why we think it's important to do this project. As I said, I'm 01:34:17
out at this location just about every day and I saw an opportunity to help restore these dunes. The dunes, as I pointed out, are 01:34:27
between Chumash Creek over here on the right of the screen, which is east and then West to the Alaska 261 Memorial. 01:34:36
So it sort of runs between parking lot B, parking lot C and Chamash Creek. The area is existing dunes already and so the idea here 01:34:46
is to enhance them. Currently we have quite a few non-native species like ice plant and Bermuda grass. We have a lack of 01:34:56
topography and native vegetation in many areas. So on both. 01:35:05
On either side, the dunes come out fairly far and we just kind of want to fill in the gap, is what we're proposing to do. 01:35:15
And then we also have increasing vulnerability to flooding with rising sea levels and storm surge, and we know that dunes can help 01:35:23
prevent that next slide. 01:35:29
So this map I think is probably one of the a good one to orientate everyone into what we're thinking about doing. So in the middle 01:35:37
of the screen sort of in front of parking lot, see you can see purplish hash marks. That's what we're proposing to do some sand 01:35:45
fencing and then the can pinkish areas. 01:35:53
Are access points, so we spoke with Public Works and with other members of the city. 01:36:01
Staff about this project a few months ago and one of the big concerns was access. And as a resident and somebody who knows a lot 01:36:07
of surfers and a lot of people that like to go to the beach, we recognize the fact that that we don't want to cut off access. So 01:36:14
it's important for public safety, public works, as well As for people who are going to the beach or looking to check out the 01:36:21
waves. They like to stand on top of the dunes and and look from there. 01:36:28
So the proposal is to again to remove the invasive plants and expand native species. 01:36:35
And leverage those existing native species when they when they seed as seed sources because naturally they will recede themselves. 01:36:42
But we want to give them the opportunity to do so. Additionally, we will be planting more seeds as we go on through the project. 01:36:48
We want to build a wider dunes. And I want to emphasize for anybody living in Omser Site 3, we're not proposing to build the dunes 01:36:54
up. 01:37:01
In fact, with the removal of the ice plant, the experts say that that ice plant actually builds taller dunes. 01:37:07
And so the dunes may go down a little bit, but we just want to extend the area out. As you can see with the kind of hash marks 01:37:14
there, there's sort of Cove areas that we want to fill in. So we would put in sand fencing and plants to trap the blowing sand. 01:37:24
And we want to enhance the visitor experience with signage. So we would put up, we want to protect the some of the areas from 01:37:33
getting trampled, trampled while. 01:37:39
Remove or with with still having access to the beach. So we are proposing to put up what we call temporary or symbolic fencing, 01:37:45
which is posting cable. It's not a fence, it's just a post with cable and then putting in signage indicating that this is a 01:37:52
restoration area and additional signage with information about why this is important and what we're doing and, and things like 01:37:58
that. 01:38:04

So as Carla mentioned, we've worked with the coastal restoration consultants on a plan which I believe you all have. 01:38:14
And they've outlined the the existing species and the topography and a plan for for the project. 01:38:26
So Surfrider, Ventura County is has gotten a few grants and we're proposing a. 01:38:36
Paying for the project ourselves, so this wouldn't cost the city or the taxpayers any money. We're planning on year one to two 01:38:43
would be the project implementation and that does depend on permits and when we would get the permits and of course your approval. 01:38:51
Years 3 and out would be project monitoring and maintenance, so sign maintenance, fence maintenance, going back in and removing 01:39:00
any more invasive species as well as planting more seeds. 01:39:06
So again the key actions removing non-native plants and planting natives, installing the symbolic fencing and signs and. 01:39:14
Putting in the the sand fencing and monitoring the the progress of via the consultants, they would be coming out. We again would 01:39:25
be paying for them to come out and look at what our progress is and suggest any further actions. 01:39:32
OK, so again, the heart of the climate Action program lies in these nature based solutions like restoration led by our dedicated 01:39:40
volunteers and community members. Our goal is also to build a community that is not only knowledgeable about coastal resilience, 01:39:47
but also is actively engaged in protecting and restoring coastlines. We have begun some initial outreach and we'll be working with 01:39:54
many different community groups, including the local Audubon Society, schools and residents and. 01:40:02
We're also initiating outreach to the Chumash people to strengthen our collective impact. By building these partnerships and 01:40:10
expanding our collaboration, we're hoping to create lasting solutions and restore this area and empower local communities. 01:40:18
And so I, like Joan said earlier, we're fully funding this project through grants and donations covering all cost and materials 01:40:27
for tools and professional guidance. So this means that there's no financial burden on city or taxpayers, although we are 01:40:34
requesting some support from the City of Port Hueneme to provide free parking for our volunteers during restoration events and 01:40:42
that would be about 8 to 10 times that first. 01:40:49
Year and then about two to four times the following years on weekend days, depending on the maintenance needs for the following 01:40:57
years. And we're also requesting dumpsters about 6 to 8 times for that first year and two to four times per year for the following 01:41:03
years, again, depending, depending on what the maintenance maintenance needs are. And this the dumpsters are for removing invasive 01:41:10
plants. 01:41:16
Predisposing invasive plants as well as any trash that we might find during our events. 01:41:24
And again, this project is truly community driven with local volunteers leading the work, making this a cost effective project. 01:41:30
And at the same time, restoration experts are on hand to help provide some guidance to ensure we're using best practices and we 01:41:35
have long term success. 01:41:41
So what do we want to do this? Why should you approve us doing this? We believe that this project has environmental and community 01:41:48
benefits. Healthy dunes help provide natural barriers against storm surge and erosion and protect infrastructure and the coast. 01:41:57
They also play a critical role in supporting native plants and wildlife and improving the ecosystems. 01:42:07
These dunes are considered environmentally sensitive habitat. 01:42:17
And so it is even more critical just in that aspect to help provide a little help to the dunes to help that that area flourish. 01:42:21
The project aligns with climate, excuse me, adaptation strategies by restoring natural barriers against sea level rise. And we do 01:42:30
believe that community engagement helps. 01:42:38
Residents have some stewardship in this, and we're also looking at educational. 01:42:47
Opportunities for schools and other community groups. 01:42:53
So either through tours, education, or just having people come out and pull weeds. 01:42:59
And then the economic and social impact, so tourism and recreation, we know that that's something that the city is looking at here 01:43:06
and Healthy dunes provide. 01:43:11
And enhance the area so when you meet. Beach park offers a variety of features and we believe that the dunes is just one more 01:43:17
feature to attract tourists and. 01:43:22
And help with recreation. Dune enhancement will complement these features. 01:43:30
And, umm. 01:43:36
We do also believe that nature based, nature based defenses for the coast reduce spending and costs that are caused by erosion. 01:43:41
They're also a little bit more cost effective, quite a bit more cost effective and more effective at protecting the coastline from 01:43:48
erosion and storm surge. 01:43:56
And we all know that that getting out in nature helps with our health, mental health. And so we see this as an opportunity to just 01:44:05
enhance the beach, park a little bit and provide that mental health. 01:44:11

supporting a more resilient future for our community. Again, like we've been saying throughout this whole presentation, dunes 01:44:27

backside, if you're walking towards the beach, there's a lot of ice plants. So we're not touching the empty lots and we're not 01:45:35
touching the backside of those dunes. We're really focusing on that area that's encircled and there is ice plant in there. 01:45:43
But it's not as much as what's on the backside of the dunes. So would you won't be removing the ice plant in front of the blue 01:45:50

the place out there and it's it's beautiful and and I'd like to see a lot more of it. It's actually seeds very well. I've seen 01:46:37
other restoration projects using that. It is really pretty. One. Does it go dormant at times? It does kind of dormant. And then 01:46:45
there's another plant that we see out there that has really long roots. 01:46:52
And it has trumpet like looking flowers. Is that a trumpet vine perhaps there is a beach morning glory out there that you may be 01:47:00
thinking of. Pink flower, I think so, yeah. So the prominent plants out there are the primrose, the morning glory, the San Rubina, 01:47:08
which is most of it's red out there, but some of it is yellow. And the beach Burr, which is a really important plant, although if 01:47:15
you're wearing flip flops when it's going. 01:47:22
Seed, you'll curse at it. Yeah. And then and then I noticed on those dune areas too, there are a couple. 01:47:30
I don't want to say trees, but they're bushes that are non-native and got there somehow. Would you be removing those? Right. So 01:47:37
what are the bigger ones was removed earlier by the city. There is a one at the very Far East side that we will be removing. We're 01:47:45
just going to use loppers and persistence over several years with I think we'll probably take care of it. 01:47:54

So if you walk out there again, the east and the West points, we're not going any farther out than the farthest point there, but 01:48:40
we want to fill in. So if you go out there, there's sort of coves which is just sand and we would like to use the sand fencing to 01:48:46
trap the sand with the prevailing wind. So mostly westerly winds that are coming through and it just helps collect it is what the 01:48:52

But the the fencing just helps speed that process up. 01:49:05

maybe this question is for a city attorney, city manager. Are we going to need any kind of formal agreement between the city and 01:49:27
Surfrider before we move forward on this? 01:49:34
Yeah. And that's the one point I was going to make after comments was that I do anticipate that we there, there's still, still 01:49:41
some steps including going through the Coastal Commission. So we will bring an item back at some point in the future with all of 01:49:48
the detail. 01:49:54
This was intended to get that feedback to move forward, but it's not. We don't have an agreement or anything like that at this 01:50:03
point. 01:50:06
So that would be prepared and would come back with that note. I wanted to note that we had identified 3 concerns, two of which 01:50:10
we've already worked through with Coastal or Surfriders. But we just wanted to sort of identify the things that, that we noted and 01:50:18
that we wanted to make sure that the council was aware that we addressed. And one was the request for access for both the public, 01:50:25
but also for for maintenance purposes, which is reflected on this map. 01:50:33
That Surf Riders is accommodating second, and we noted this in the staff report was in that agreement. We want to note that. 01:50:41
The city in its various master plans, has identified the need for more amenities in that area particular. Potentially Lot C could 01:50:52
end up having more amenities and things like that. So we want to make sure that it's understood that. 01:51:01
That this project wouldn't prevent any of those future improvements and we just want to make sure that that's clear. And then a 01:51:10
Third Point was during that process, my recommendation and suggestion would be I think as part of it, we would partner with surf 01:51:17
riders to do some educational information for the neighbors so that they understand that this isn't, I think to Jones very simple 01:51:24
explanation is this isn't planning to be built, you know, up. 01:51:31
And it's not intended block reviews. So I think that would be a third thing we'd look to do. So that's all stuff we can do. 01:51:39
When we formalize and get the approval from Coastal Commission and we could make those. 01:51:46
Either clearing the agreement or we can do some of that outreach. 01:51:53

Moving to the next item is to authorize the issuance of a request for for proposals to conduct water, wastewater and solid waste 01:58:53
rate studies. 01:58:57

It's never fun to talk about. 01:59:06
Doing our analysis of our rates because typically rates don't go down, they typically increase. And so we're always sensitive to 01:59:10
that. And we, we have really tried hard to keep our wastewater, solid waste and water utility rates competitive and low, but at 01:59:18
the same time. 01:59:26
We are not immune to the cost increases that everybody sees across the board now and those cost increases impact. 01:59:35
The services that we're trying to provide as well. And so it is prudent about every three to five years, each city typically 01:59:45
should do a rate study. And the first step is the rate study itself to determine whether the rates need to be adjusted. 01:59:54
We have done a rate study five years ago for water, the water utility in 2019, but the wastewater and the solid waste rate studies 02:00:05
were last completed in 2915 years ago. It doesn't doesn't feel like 15 years ago, but but it is and they're just way overdue. At 02:00:15
some point we we should be looking at those every like I said, three to five years and 15 years is way too long. 02:00:25
In the staff report, we note the the fund balances of each of those utilities. And no surprise, the water fund has, you know, some 02:00:35
reserves, the other two that haven't been adjusted for 15 years are starting to run out of reserves and run out of a fund balance. 02:00:42
So, so it's part of just the doing our due diligence and doing what's prudent to make sure that we can provide these utilities to 02:00:49
our residents. 02:00:56
And provide the the. 02:01:04
The best and safe wastewater, solid waste and water utilities is making sure that we're analyzing those rates and making sure that 02:01:07
they're appropriate into the future. So we would anticipate, and it's fairly typical in most cities, you do a analysis every five 02:01:14
years. And if the rates are good, you don't need to adjust them, but you at least do that analysis every five years to make sure 02:01:22
you're watching it. And we do anticipate trying to get on to that. 02:01:29
Five year cycle into the future, step one is starting with putting out an RFP to get a expert in the field to analyze our rates 02:01:37
and and give us a report on an analysis on those rates that we bring back to council. So by approving. 02:01:47
Authorizing staff to move forward with that process, it doesn't mean that we are starting a rate increase process. It's simply 02:01:58
approving getting the expert contracted to analyze those rates and we'll bring that recommendation back with with the 02:02:06
recommendation at that time of weather to start a rate increase process. So, so we recommend doing that at this time. 02:02:15
And we would again return. 02:02:24
At a future City Council meeting, I would anticipate, I think the the report that we put together noted that we expect the RFP to 02:02:27
be complete. 02:02:33
To have responses to the RFP by January 15th. And so we'd expect the analysis to take a couple months. So we'd probably return 02:02:41
with that analysis to council probably March or April of 2025. So, so that would be the the timeline that we'd be moving forward 02:02:50

helping our residents understand the importance of doing this and maintaining our our fund balances so that we could proceed with 02:04:12
the preventive maintenance and all those other things that are necessary to keep it safe and vibrant. We can bring that back. 02:04:20

crossed that would go smoothly. So it looks like it did and we should be moving forward. They had estimated that if everything 02:10:22
moved forward well now that the dredge could potentially start towards the end of this month. So it looks like we're kind of on 02:10:28
