October is filled with events, initiatives that can inspire positive action, reflection and community spirit. Some of these 00:00:57
examples are Breast Cancer Awareness Month, National Bullying Prevention Month, World Mental Health Day, Indigenous Peoples Day, 00:01:03
International Day of the Girl, World Food Day and. 00:01:09
Domestic violence awareness Domestic violence awareness. These events offer an opportunity for reflection, action, community 00:01:16
building, inspiring people to contribute to important causes. And finding inspiration is a personal journey and it comes from 00:01:24
experience, environments or reflections that resonate within you. So I would encourage everyone to find something that you can be 00:01:31
inspired by and just come out and join it. Join whatever 'cause it is and support whatever inspires you. 00:01:38
We now move on to public comments, public comments not pertaining to items on the agenda. Comments are limited to three minutes. 00:01:50

After Councilmember Gammos e-mail to me, the City Manager reached out to me via e-mail stating in short, that another resolution. 00:03:29
Was drafted to now include the POW flag which is honored by all and me included. Yet this was done to self adjust as to not 00:03:36
exclude other group other groups. 00:03:41
Yet my request to fly the Christian flag has been ignored or simply not given consideration. Riverside Council has voted 00:03:47
unanimously, unanimously to go flag neutral, simply and clearly because the intentional division that has been caused in their 00:03:55
city. Your representation, your representation Council is to fully serve all people at all times equally. And this is the result, 00:04:02
A resolution that is worthy of a lawsuit to write your political ambitions and to get your counsel back. 00:04:09
To serve the community without further intentional division. 00:04:18
It is shameful, to say the least, that this entire Council, including the ones with religious backgrounds, would allow such a 00:04:22
resolution to fully. 00:04:26
Resolution without fully considering its impact on city, in the city and those who live within it and who are opposed to it, I'm 00:04:32
going to skip the rest of this. My point is, is that the resolution that you made, there was a resolution that was made on July 00:04:39
1st, 2024. And in it exclusively right here, it says the policy outlines a procedure for the City Council to review requests to 00:04:46
display commemorative flags below the city flag at City Hall. 00:04:53
During the requested time when you did that, you created a public forum. 00:05:01
Now what you want to do? 00:05:06
With your new resolution that came from the city manager via corpspendence with me is you excluded that now and you're trying to 00:05:09
make it a government speech. 00:05:15
So I have no choice but to litigate this in court with you because what it has done and what it's continuing to do is to create a 00:05:22
separation within this community that is unjust. And why you don't see that is beyond me. Why do you think that the Riverside City 00:05:28
Council, all five members said enough of this? 00:05:34
It causes division within a community. That's exactly what it's done here. I am not against the LGBTQ community whatsoever. I know 00:05:40
them. 00:05:44
I help them, I feed them, I service them when they need help. 00:05:48
You created the problem each one of you individually has. 00:05:52

Now you can take, you can do a lawsuit, whatever you want to do, go ahead and do it. I'm just telling you that as a practicing 00:06:26
lawyer of 40 years, I'm well aware of what is legal and what is not legal. And this council in its flag resolution policy 00:06:33
exercised its First Amendment right, just like you have a First Amendment right. Well, it doesn't seem to apply right now. 00:06:41
Sure it does. There is a policy in place. Policy is different than law. 00:06:49
That's not, that's not accurate at all. It sure is. No, it's not, Sir. Yes, any local policy. Ma'am does not trump state law. 00:06:54
It does not is being fully compliant. You wrote it in your resolutions. I have your resolutions right here during during public 00:07:01

Mayor, Mayor Pro Tem, the City Council and staff, thank you so much for allowing me to comment tonight. I sent the City Council 00:07:37
and the Mayor, Mayor Pro Tem, and the city Manager an e-mail last week requesting your assistance with a public works permit for 00:07:43
my residential construction project. 00:07:49
I would like to summarize my request. My husband and I are currently completing a remodel of our home in Port Hueneme. We 00:07:56
converted the original 2 car garage into a granny flat for my mother. 00:08:02
And now we're conducting a remodel on the main house. We added a bedroom, and as a result of adding that bedroom, building and 00:08:08
safety said we had to add. 00:08:13
A new two car garage, which we did. My general contractor submitted a public works permit request for a new. 00:08:17
Driveway approach to the new garage in accordance with approved plans. He met with Public Works last week and was told that we now 00:08:26
must demo and reconstruct the entire existing driveway approach. Our lot is positioned at the end of a cul-de-sac and has a 00:08:34
reverse pie shape. I did submit all of this in my e-mail to you and then I also brought paper copies tonight for you to review. 00:08:42
It has an unusually small frontage footprint, but very wide at the back. 00:08:51
We have a shared driveway because of the position in the cul-de-sac as well as the size of the lot and the layout of the lot with 00:08:58
our next door neighbor. Poor guy just moved in next door to a giant construction project and now we're going to have to RIP up his 00:09:05
approach, which is potentially going to limit his ability to actually park on his driveway. 00:09:13
Narrowing the approach for him because I understand that we can't actually use part of our property. 00:09:22
To give him that extra approach room. So there are also 2 water meters for our main house and the granny flat, as well as one for 00:09:28
our neighbor positioned in the same approach. We just had the third water meter added. 00:09:35
And all three meters will need to be moved and or modified. I don't believe the code requirement to remove the existing approaches 00:09:42
equitable because it doesn't account for the unique property footprint of my lot at the end of a cul-de-sac with the strange 00:09:49
reverse reverse pie shape. I'm concerned that this will be a burden on my next door neighbor during the demolition and 00:09:55
reconstruction phases and that he won't have access to his full driveway. 00:10:01
And a reconstructed approach will potentially limit his ability to utilize the driveway once the new approaches created. 00:10:09
We are requesting a variance to allow the existing approach to remain in place. I've provided copies and you guys have my e-mail. 00:10:16

Thank you. And although we can't get into details since it's not on the agenda, I've asked the Public Works Department to review 00:10:27
the matter and update us. So thank you. 00:10:32
And there is one last public comment, which is written last month. I spoke at the City Council meeting and asked for help with the 00:10:38
epidemic of graffiti incidents in Miranda Park and Surfside Village. The perpetrators were hitting the area multiple times a week, 00:10:45
leaving tags as large as 8 foot high and 20 foot long. City workers and volunteers from Surfside Village immediately responded to 00:10:52
these incidents and were usually able to cover them within a couple hours. While our efforts quickly eliminated the. 00:10:59
Similar tags showed up in a day or so. The situation was out of control. I'm happy to report that the cycle ended. It's now been a 00:11:06
few weeks since we have experienced a major attack. It's hard to know why the attacks ended, but I suspect that Port Hueneme 00:11:12
Police Department efforts to stop these outrageous incidents have been effective. Thank you. On another note, homeless numbers 00:11:18
have increased. Many of these individuals appear to be under the influence of hard drugs or experienced psychotic episodes. It's 00:11:24
getting creepy. 00:11:30
When Amy has devoted precious resources to holding events that bring people here, few of the folks who attend these events will 00:11:36
return when they experience psychotic people wandering around aimlessly yelling at invisible enemies, or drugged out people laying 00:11:41
on the ground who look like they might be dead. 00:11:47
The primary reason for this increase is that the city of Oxnard has once again decided to allow massive encampments in and around 00:11:53
Ormond Beach. Oxnard pushed homeless people out of North Oxnard into South and Central Oxnard. There are no homeless people in the 00:11:59
collection or any of the upscale neighborhoods near it. There are hundreds of people occupying Ormond Beach, starting fires, 00:12:05
trashing sensitive wetlands, and posing a threat to anyone entering the area. 00:12:11
Wanami Beach is the closest area to where these encampments exist, and many of these people migrate here to spend the day or roam 00:12:19
around in the streets in the middle of the night. 00:12:23
Unless something changes, it's a matter of time until we experience a replay of 2019 when hundreds of dangerous vagrants were 00:12:27
encamped on Ormond Beach and came into Waimea to steal anything insight and attack innocent people. Anyone who thinks that the 00:12:33
homeless crisis in California is going to be resolved in the next decade is living in a fantasy world. Cities that allow homeless 00:12:39
people to live in the streets will attract more homeless people. History has shown that offering services to treatment resistant 00:12:45
homeless people has failed miserably. 00:12:51
In part because they were allowed to keep living on the streets thanks to our recent court decision, grants passed versus Johnson. 00:12:57
Cities can now enforce urban camping bans. I urge the council to authorize PHPD to aggressively enforce the ordinance. We can't 00:13:04
solve homelessness, but we can make it uncomfortable for folks to migrate here and create a safe and secure environment for our 00:13:11

Mayor, can I just add something? So I just wanted to explain to everybody and kind of make a note and apologize for that brief 00:15:09

our housing board members to come out and everything just for a consent calendar. But I wanted to explain that the reason we did 00:15:22
that is that the disbursements. 00:15:28
There's requirements by state law and and our own fiscal policies to. 00:15:35
Basically share those with the public in a specified period of time and not to go too long without sharing those. So that's why we 00:15:42
had to bring the disbursements to council today, even though there wasn't any other agenda items. So, so apologize for the short 00:15:49
meeting, but it was an effort to be transparent and appreciate everybody accommodating it. Thank you. We have no business items 00:15:55

Each quarter of the city we'd like to celebrate and recognize employees who reach milestones. And this quarter we celebrate Mr. 00:17:55
Aurelio Reyes, who for serving 20 years with the city. And unfortunately Mr. Reyes couldn't be here today, but I call Director 00:18:01
Camarillo to introduce Mr. Rios to the Council. 00:18:07
Good evening Mayor, Mayor Pro Tem, council, members of the audience and staff. 00:18:26
As Mr. Lee mentioned, Aurelio could not be here tonight with us, but he did take the opportunity to fill out the sheet that is 00:18:32
handed out to all the employees that get this recognition. So I will give you the answers that he supplied for us when asked what 00:18:40
is his favorite moment. 00:18:48
Or what he liked most about working for the city. His response was that he enjoyed this and sincere appreciation received from his 00:18:59
managers and his team alike. 00:19:05
He's made many friends, he's working with great people over the years and has gained a lot of knowledge and been able to develop 00:19:12
his leadership throughout those years. 00:19:18
When asked what his most memorable moments were, he stated his best memorable moments have been sharing camaraderie, camaraderie 00:19:24
with his fellow coworkers, being able to train all the new incoming drivers, and being able to lead by example. 00:19:34
That becoming the earning the solid waste lead position was by far his best accomplishment here that he's had with his years at 00:19:46
the city. 00:19:51
And that he will continue to strive to lead the division and those that he's in charge of to the best of his ability and give the 00:19:57
best customer service to the residents and customers. 00:20:03
When asked if there was anything that he wanted to address to the City Council, he said that receiving this service award fills 00:20:11
him with great pride and gratitude and he wanted to thank you all for acknowledging his loyalty and contributions made over the 00:20:19
years. And he's very thankful for the the award and it's. 00:20:26
He feels like it's a testament to the stronger relationship he's built with the city and his time here and. 00:20:34
Aside from that, I mean, I've had the pleasure of working with Aurelio for all 20 years he's been here for the last about 12 or so 00:20:42
much closer. 00:20:46
With my involvement with solid waste over the years, Aurelio isn't a man of a lot of words. 00:20:52
Very quiet, very kind. 00:21:00
But he, as he mentioned, he does take great pride in his work. He's he's really a great guy who cares about making sure that the 00:21:05
people that he's working with and others have everything that they need to succeed. And so I'd like to. 00:21:15
Ask you to join me in recognizing 2 decades of service to the city. 00:21:26
Director Cameron, on behalf of the City Council, please let him know that we appreciate his dedication to our city. The 20 years 00:21:36
is a long time and so we understand that he he chose our city to continue working here. He could have left at any time. So we 00:21:43
appreciate the fact that he's still here after 20 years. And that certificate obviously is recognition of that. 00:21:49

The next presentation is the Breast Cancer Awareness Proclamation, which will be read by Councilmember Gama. 00:22:02
Thank you, Mayor Perez. So I have a connection with breast cancer. Actually, I don't have breast breast cancer. I have the gender 00:22:08
equivalent prostate cancer I've been treating for. 00:22:14
Eight years now and I'm doing well and so this I think it's fitting that I get to read this proclamation. Breast Cancer Awareness 00:22:22
Month October 2024. Whereas considerable progress has been made in the fight against breast cancer, it still remains the most 00:22:29
frequently diagnosed type of non skin cancer and the second leading cause of cancer deaths among women in our community. And 00:22:36
whereas this year alone an estimated 310 + 1000 women. 00:22:43
And 2800 men in the United states will be diagnosed with invasive breast cancer and nearly 42,000 lives will be lost and whereas 00:22:50
knowing what may contribute to breast cancer, it. 00:22:56
Is an important part of its prevention risk factors for breast cancer include family personal history, radiation therapy to the 00:23:04
chest for previous cancers, obesity and certain generic changes and whereas getting regular screenings may help lower the chances 00:23:11
of developing breast cancer in women and men are encouraged to talk with their healthcare provider about the risk and what they 00:23:18
can do to mitigate them. And whereas, thanks to early detection and better treatments, mortality. 00:23:26
Rates for breast cancer have steadily decreased in the last decade. And WHEREAS, during National Breast Cancer Awareness Month, we 00:23:33
stand with our mothers, daughters, sisters, and friends, and we recognize all who have joined their loved ones in fighting their 00:23:39
battle, as well as the advocates, researchers, and healthcare providers whose care and hard work gives hope to those living with 00:23:45
breast cancer. And WHEREAS. By educating ourselves and supporting innovative research, we will improve the quality of life for all 00:23:51
Americans affected by. 00:23:57
Breast cancer and one day defeat this terrible disease. And whereas a city, excuse me and whereas the Port Hueneme Police 00:24:04
Department is committing to raising awareness and helping support all those affected by breast cancer. Now, therefore, let it be 00:24:11
proclaimed that the City Council of Port Hueneme hereby recognizes October 20. 00:24:18
24 as breath. 00:24:26
Cancer Awareness Month in the city of Paroni and encourages the community to help raise awareness and support in the fight against 00:24:28
breast cancer. My sister's. 00:24:33
Had stage 4 breast cancer and it wasn't looking good when she started her treatment and I was 15 years ago and she's defeated and 00:24:40
she's with us and she's couldn't be happier and she she too. 00:24:45
Works very hard to spread awareness and thank you for bringing this up, Chief. 00:24:52
Yes, thank you Council, the as it was mentioned, the Police Department will be donning our pink patches, our ribbons. I do dual 00:24:58
because if we have both domestic violence and our cancer awareness month, but they'll also be other symbols on our uniforms, cars 00:25:06
and we have participated in some community cancer awareness events. We will continue to. 00:25:14
Participate more. However, we did ask this year. 00:25:22
One of our local community, Winnie me community heroes to receive this Becky, come on up here for the reason of I wanted to 00:25:26
receive the proclamation because not only is she, as I refer to her, the Duchess of Waimea, not only is she my spirit animal and 00:25:35
all her positivity, but she's been involved in Relay for Life and cancer awareness for many years. This last year she did a lot. 00:25:43
As one of the coordinators for the West County Relay to get many representatives from the local cities involved. 00:25:52
To step up and speak and even helped us squeeze in a couple of teams last minute. And you know, she's the quiet, humble one who 00:26:00
gets all the stuff done behind the scenes. And I just want to say thank you. And we think you should receive this proclamation for 00:26:05
all the work you've done. 00:26:10

The next presentation is for Domestic Violence Awareness Proclamation, and before you read that, Councilmember Hernandez, I would 00:27:20
like to make a request to dedicate this in the memory of Jessica to Noko, who was a recent victim of domestic violence in Simi 00:27:27
Valley and who had a lot of family and friends that came out for a vigil at Winnie Me Pier last about a week ago. 00:27:34

So October is Domestic Violence Awareness Month, and the city would like to. 00:27:47
Provide this proclamation to the families of miss and all the victims of domestic violence and the women and the children who are 00:27:54
in the crossfire of these incidents. Whereas October is designated as domestic violence awareness month and Whereas domestic 00:28:02
violence is a crime which effects all races, cultures and social demographics, and whereas domestic violence has a profound impact 00:28:09
on families and the community and whereas children that. 00:28:16
Up in violent homes are believed to be abused and neglected at a higher rate than the national average. 00:28:24
And whereas only a coordinated community effort will put a stop to this atrocious crime. And whereas Domestic Violence Awareness 00:28:30
Month provides an excellent opportunity. 00:28:35
For residents to learn more about preventing domestic violence and show support for the numerous organizations and individuals who 00:28:39
provide critical advocacy services and assistance to victims and Whereas the Port Hueneme Police Department, City of Port Hueneme 00:28:47
and community based organizations are in a position to provide education, information, and services to assist victims in the 00:28:54
understanding that they have the right to be safe, feel safe and live free from. 00:29:02
Violence at home and in the workplace and whereas we all must continue to help and advocate for victims and the criminal justice 00:29:09
system and law enforcement must continue to hold offenders accountable and whereas we will continue our efforts to end violence in 00:29:17
our homes, schools and communities. Now therefore be it proclaimed that the City Council Port Hueneme hereby recognizes October 00:29:24
2024 has Domestic Violence awareness month in the city of Port Hueneme and. 00:29:32
Urges the community to participate in programs and outreach efforts aimed towards educating and supporting those who are victims 00:29:40
of domestic violence. Proclaim this 7th day of October 2024 and as as mentioned, your Police Department not only shows our 00:29:47
symbolism with our our purple ribbons and and other symbols, but you know, we continue the assertiveness on patrol with addressing 00:29:54
domestic violence and and calls for service. 00:30:01
Our detectives continue aggressively prosecuting, working with the District Attorney's office to do so. 00:30:09
And and advocating along the way. But Speaking of advocating, I asked our. 00:30:14
This is actually we're a unique agency to have our own in-house victims advocate for the poor morning Police Department, and 00:30:22
that's Pat Majors and Pat's been with us for. 00:30:27
For the RPD alone for 20 years, but let's talk about many, many years beyond that at assisting other agencies here in the county 00:30:32
and and working with victims and. 00:30:37
Amongst the support and guidance of resources and helping. 00:30:44
Those involved in the investigations get through the court journey and get restraining orders. She's there for them because it 00:30:50
takes a special caring person and a special heart to. 00:30:56
Do the support through the time of contact from the police all the way to the time of court and trial. So we'd like Pat to receive 00:31:03

Pulls it back out to sea and has to pull it out far enough that it doesn't just float right back. And then we have to do the same 00:35:44

Towed out to the ocean so that it'll sink and the wildlife will take care of it and it ends up feeding a bunch of sharks. But it 00:36:33

The I was able to talk to the project leader and they towed it 26 miles out in the ocean and they let it. 00:36:45

Over the last year we've done, we've had a couple discussions at council about the efforts we were implementing regarding Traffic 00:37:45
Safety and traffic improvements, but also we had a couple conversations about pedestrian safety. And a few months back we had a 00:37:53
conversation talking about doing a pedestrian safety campaign and the council had asked for some more information and so. 00:38:01
We're bringing back information on both, both some of the efforts that we've implemented. 00:38:10
And it's we're sort of trying to. 00:38:15
Show everybody the holistic approach we took towards addressing the traffic issues and we've really kind of looked at all options 00:38:18
to do that. And then also we have some information related to some of the pedestrian issues that were that we've seen and then 00:38:24
we're proposing doing a pretty. 00:38:31
Simple pedestrian safety campaign that would allow us to partner with our partner agencies like the the Port and the Base and 00:38:39
others. 00:38:43
To really get the word out, school kids and all those things to get the word out about pedestrian safety. So, so we have a slide 00:38:49
here to start it off and it lists some of the traffic measures we've implemented this year. Things like reinstating the traffic 00:38:55
division in our Police Department, including reinstating motorcycle enforcement, commercial traffic enforcement, and bringing the 00:39:01
parking enforcement team in house into the Police Department so that they could work with hand in hand with the traffic team and 00:39:07
focus on. 00:39:13
Things like line of sight and visibility issues that that really make a difference on traffic and pedestrian safety. We've 00:39:20
installed, our public works team has installed striping crosswalks and rapid flashing beacons in different locations throughout 00:39:24
the city to really try to. 00:39:29
Increase awareness of some of these issues and provide some safe areas for people to cross streets and things like that. We also 00:39:36
about within the last year reduced speed limits on several streets, including Channel Islands Blvd. 00:39:42
And we did the traffic study to justify that reduction in speed limits and we've updated ADA accessibility ramps and especially at 00:39:49
some key locations right next to the schools so that it's just safer and you don't have the trip and fall hazards for people to 00:39:56
walk across the streets in some key areas. 00:40:02
We've installed the truck route signs around the city to try to make sure that the trucks are adhering to the designated routes. 00:40:09
Before we have those signs, we'd find that the trucks would be on the wrong streets, so we've been trying to put them in the right 00:40:14
places. I. 00:40:18
And then we've created programs for a stop sign request program, a speed hump request program, and then most recently the 00:40:24
installation of the rubber medians to prevent Donuts. And that's still in the pilot phase, but we're getting good feedback that 00:40:30
people feel like it's working. So we'll we'll come back to council at the end of the pilot to really walk through that. But we 00:40:36
created all of those programs to try to help address traffic issues. 00:40:43
And then, as I mentioned a moment ago, a few months back, the council talked about doing a pedestrian safety campaign but 00:40:50
requested more data and information. And so one of the things we wanted to do in this report was provide some of that information. 00:40:56
And we'll keep it pretty high level at this point. I think there's a lot of data out there, but we. 00:41:03
Pulled our Tim's transportation injury mapping system data, which is sort of the the standard public facing data on accidents and, 00:41:12
and things like that. And looking at our map, it's pretty obvious this is the data from the last five years that the most of those 00:41:19
dots that reflect accidents and and they'll show the numbers that talk about how many accidents at each of those locations are on 00:41:27
Channel Islands Blvd. and Ventura Road. And I don't think that. 00:41:34
Anybody those are sort of the the arteries of Port Hueneme. And so we we have had accidents on those streets. This goes back to 00:41:42
2019. So over five years about 260 accidents across the city, most of them in those areas. But we've been doing things like I 00:41:48
mentioned over the last year to try to address that and we've lowered the speed limits and we've added striping and we've added 00:41:55
crosswalks so. 00:42:02
We're expecting to see that make impacts and for these numbers to drop in the future. 00:42:09
And relevant to pedestrian data, out of those 262 reported incidents, about 30, three were bicycle or pedestrian involved. And so 00:42:16
this next slide shows the locations of those bicycle and pedestrian incidents. And so you can see similarly that most of those 00:42:24
incidents happen on Channel Islands Blvd. and Ventura Rd. very similarly. 00:42:32
One interesting thing that we saw when we started to look at this data is that there a lot of these actually happened near our bus 00:42:40
stops. 00:42:44
It makes sense in a way because you're, you're guaranteeing that pedestrians and people and bicyclists and everybody are in that 00:42:48
area for these accidents to happen and they're generally kind of high trafficked areas. So that led us to, when we were talking 00:42:57
about what we could do to address that, we talked about doing. 00:43:05
A The pedestrian safety campaign that the City Council had discussed previously. 00:43:15
But focusing it on educational information at the bus stops on our poster boards that we have at our bus stops, having safety tips 00:43:19
on those poster boards and and including those on our bus stops is something we can do that's relatively easy and low cost and we 00:43:26
can include it there. But also getting these out to and even handouts out to the partner agencies like the Navy base, the Port of 00:43:34
Waimea and local. 00:43:41
Schools to get out to people that may be walking every day. And at that last council meeting when we talked about this, we talked 00:43:49
about, you know, how could we get people to maybe wear more reflective items. And so the idea we came up with that's a very low 00:43:55
cost is focused on the school kids, which is the slap bracelets that if anybody is familiar with the slap bracelets that you kind 00:44:01
of slap onto your wrists and the, and kids usually love those. 00:44:08
We can order high visibility snap bracelets and distribute those with our every time our officers go out to the schools or every 00:44:15
time we have an event like a touch or truck event, we can give those out to kids. 00:44:20
And encourage them to want to wear high visibility items so. 00:44:26
Like I said, our report was intended. We wanted to report back on some of the efforts and then talk about this next recommend 00:44:34
doing this next step, which is this pedestrian safety campaign and ordering these high visibility bracelets to distribute out 00:44:40
events. They're less than $0.50 per bracelet. So we were planning to to spend a minimal amount of of money to get those and hand 00:44:47
them out at our upcoming events and and our school visits. So. 00:44:54

Yes. And I'm going to introduce our Finance Director, Lupe Acero to to walk us through. And just note that I really appreciated 00:50:00
the efforts of Mississippi Arrow and our Community and Economic Development Director, Tony Stewart on this. They worked through 00:50:07
the RFP process essentially with the goal of reducing costs for our cannabis businesses and I think they've been able to do that 00:50:13
pretty well, but. 00:50:20
Misses Sarah will walk us through how they did that. Thank you. Good evening, Mayor, Mayor Pro Tem, City Council staff and 00:50:28

Of the public, I am going to provide you some highlights on the process for our recommendation tonight to award the RFP for audit 00:50:36
services for our cannabis businesses. 00:50:42
The annual development agreements actually call for two audit services a year. In the past we've done 1. You know, audits are very 00:50:50
time consuming and comprehensive. We did get a little bit not behind, but we had a gap in in during COVID, so we had some catching 00:50:55
up to do. 00:51:01
The Cannabis Initial Cannabis RFP that was issued in 2018 when the agreements were first signed, was awarded to HDL companies. 00:51:09
They were the ones that were conducting all of the audits on an annual basis of all of the businesses. 00:51:20
And costs have gone up as everything else has gone up. So currently, cannabis businesses are paying $10,000 per audit. And this is 00:51:28
for traditional, you know, your traditional walk in cannabis business, but it's $10,000 per audit. 00:51:37
Staff issued an RFP request for proposal for a full scope audit, which is what we have currently right now, which is what HDL is 00:51:48
doing is a full scope revenue audit and an attempt to get some competitive pricing from other business firms and companies that 00:51:57
that perform audits in in the effort to reduce costs for the businesses. We receive 4 responses from 4 different farms. 00:52:06
And as City Manager mentioned, the review committee, which was myself, Tony Stewart, Community and Economic Development Director 00:52:16
and two of my staff, Angela Kusick and Diana de Costa, who are very involved with the cannabis businesses were part of the 00:52:23
committee. We reviewed all of the responses and we had follow up interviews with all of the. 00:52:31
Agencies or firms that responded during the interviews we requested. 00:52:40
A change of scope to further reduce the cost. So if we went from a full scope revenue audit to a limited scope audit and we 00:52:47
requested all of the respondents to provide us a cost proposal for a limited scope audit. And really a limited scope audit is less 00:52:55
extensive and is less expensive. So really what it does, it's still looking at critical records. 00:53:03
But not it's eliminating some of the audit steps that the audit firm would do. 00:53:12
We're still looking at the core documents which are your point of sale, which is your register. 00:53:17
We're still requesting for them to look at the tax returns that they file with the with the. 00:53:24
State agencies and then their general Ledger, so they're there, their records, so tying all those out. 00:53:30
They're not looking at, for example, bank statements, they're not looking at purchases, they're not looking at inventory. So 00:53:38
that's really your difference. So they're limiting the scope, just focusing on the core documentation. 00:53:45
And based on our review for the limited scope audit, we're proposing to award this audit. 00:53:52
To Booth Management Consulting, this is a large international firm that very reputable that has over 25 years of experience and 00:54:03
they do audits compliance various businesses throughout the US. 00:54:12
Including the Washington State Department of Commerce, they were involved with some cannabis. 00:54:23
Audits with them and. 00:54:28
Their prices were extremely competitive. 00:54:33
So we were looking at that was actually one of the main reasons for doing this. I just want to mention kind of as businesses have 00:54:35
been down overall in the state just overall because of I think market saturation, but specifically in part why anemia. The 00:54:43
businesses here have experienced significant decreases in sales and obviously more cost pressures. 00:54:51
The cost that we receive, the cost estimate for this audit or the proposal is $18180.00. So under 2000 for a traditional. 00:54:59
Business and then 17164 businesses under three and a half, $1,000,000. So that's some of our business is traditional walk-in 00:55:11
businesses are under 3.5 and then it certainly applies to all of the delivery businesses which are much smaller. 00:55:19
One note I have here for our businesses and we do plan to have a meeting with our businesses to ensure that they have proper 00:55:30
record keeping because that certainly could increase the cost of the audit. If an auditor comes in and they don't have all of the 00:55:37
records in place or they're not able to get documentation and they spend more than what is reasonable amount of time, it could 00:55:43
cost them more for the audit. 00:55:49
We're comfortable because most businesses have gone through at least the one audit, if not more. 00:55:56
And so they're they're aware of what records were requested during these audits. We're also comfortable because we've already seen 00:56:02
some of the findings that would they experienced in the last couple of audits and and that's the reason we're comfortable with the 00:56:07
limited scope audit. 00:56:12
And again, we'll have a meeting, that's our intent to have a meeting with our businesses to make sure that they have all the 00:56:21
records. We're probably providing a list of records and documents that they should have available. 00:56:26
Their recommendation for tonight is to authorize City Manager to award the contract for cannabis revenue audit services, the 00:56:34
limited scope audit to booth management consulting BMC and again, they're anticipating that this will significantly reduce cost 00:56:42
for the local businesses. 00:56:49

that businesses. So it's not going to exceed 10,000 overall. It is a professional service, but because this was also brought to 00:57:30
council when we talked, I think it was maybe last fall about you know, working with businesses to reduce costs. One of the one 00:57:38
other area was allowing the excise tax. 00:57:45
Deduction reduction from their what they pay the city and this was another component to do an RFP and secure. 00:57:53
Another audit firm, so it's probably hovering around there. Depending on how many audits they do, we May 13 or 14 businesses. So 00:58:01
we'd probably get right up to the limit. The limit typically is $25,000. So it's close, but we talked about it. But like Mr. Sarah 00:58:08
mentioned, we had brought the RFP to the council initially. So we also wanted to kind of close the book. And then also 00:58:16
importantly, we're recommending going from a full scope to a limited scope and we think we have good reason to. 00:58:23
Do that, but that's still the council's call to say I was just curious and then you answered my other question about the number of 00:58:31
businesses that would be subject to these services. 00:58:36
So that answers that and then. 00:58:45
And then you refresh my memory that we did approve the RFP, right? OK, so where is the? 00:58:47

money coming in, $10,000 probably didn't seem that much. And then as we all knew we we were anticipating the competition coming in 01:00:45
and other cities coming in. And I think it's, it's really a testament to our city. 01:00:53
Past and present that were trying to work with these. 01:01:03
Entities and trying to help them as best we can and I think that's a very sizable reduction to them that I know it's appreciated 01:01:08
but you know it's competitive out there and. 01:01:15
We had what, 13 and maybe three years from now we might not have 13. So I think it's a great effort on the staff's behalf to, to 01:01:22
work with our local businesses to try to help them be successful. So thank you, Director. Sarah, just for the record, 'cause I I 01:01:30
expect that you already do, but I just want to confirm that the limited scope, you have full confidence. 01:01:38
In what you're going to be provided, will disclose it full transparency of all the information that you need. 01:01:47
To satisfy whatever requirements for each business. Yes, that's correct. They're looking at the court documentation and so that is 01:01:53
correct. And if I can add one thing I was going to add is that. 01:02:00
We do have. 01:02:07
Very different sized cannabis businesses and we have a few that are that are doing well and that are very large and that that 01:02:10
still produce a lot of revenue for the city. And then there's several though that aren't and several that are struggling. And we 01:02:16
had talked about it that I think there's a couple that honestly the $10,000 audit fee is more than they're going to generate in 01:02:22
revenue to us. And so you know, the logic of telling them to pay $10,000 to audit, you know, $7000 that they're going to pay the 01:02:28
city. 01:02:34
And so one of those things was going through a full audit every year is going to require weeks of a staff person that they may or 01:03:11
may not have at that point. So, so to me, this was a win win because it's not reducing any revenue to the city. It's strictly the 01:03:18
fee that a business has to pay to the auditor. So it's not impacting the city and in that way, but it's making their lives a 01:03:26
little bit easier and reducing their costs at a time that I think they could. 01:03:33
Use it. 01:03:40
And then like Mrs. Sarah said, because we just finished an audit and we just walked through all these with them in depth over the 01:03:42
last year, we're comfortable that they now have those processes in place. So but we'll we'll be able to keep spot checking those 01:03:49
things. And I mean, it's an really giving the businesses an opportunity to have their records in place. 01:03:56
If we run into, well not us, but if the audit firm runs into challenges with this type of scope and we're not able to get 01:04:05
comfortable that we can't validate the sales, we may come back to council and. 01:04:11
Go back to full scope audit, which will be a little bit more expensive, OK. 01:04:18

Just to confirm, the audit is also going to include the 1% tax revenue on in terms of like how they disperse that money? No, that 01:04:31

So the 1%, how we handle that now, well, we've implemented is we've created a process now where a finance staff person we have 01:04:48
works with them and gets a report from them I. 01:04:54
We're trying to do it monthly, but it's a battle, right. It's a hit and miss with some businesses, but it's on the form now and 01:05:01
the monthly form that they complete on a monthly basis for them to include where that 1% donation who it was made out to and and 01:05:07
provide us the support. And it's really a tracking that finances tracking it and reaching out to the businesses when we're missing 01:05:13

So sort of Step 2 in the process we actually the Council had discussed. 01:06:20
The CBF previously and had identified the 1st $113,000 in projects, but there was still the question of the last $30,000 in 01:06:27
projects. So we're back tonight with the full list. And just as a little bit of background and a reminder more, maybe more for the 01:06:35
public that the community benefit fund is the fund created in our agreement between the city and the port and. 01:06:43
Essentially, when we had a new agreement in 2015 or a settlement agreement in 2015. 01:06:52
The port agreed to contribute $100,000 annually and then it was subject to inflation. So that's how we get to a number of $143,000 01:06:58
this year. But they contribute that money annually for projects that the city and the port meet together. The we each have a 01:07:05
committee, we meet together and we identify projects in key category shoreline protection community to develop development 01:07:12
opportunistic endeavors. 01:07:20
Or the fantastic category of other projects which really narrows it down. But so, so we we got together this year, we came up with 01:07:27
our initial list, which is everything on this slide other than that bolded item, everything else we had already talked about at 01:07:35
the Council and we had agreed with the port on that initial $113,000. 01:07:42
We had $30,000 left that we were trying to come to an agreement on. We, we at our council meeting previously had wanted to, we had 01:07:51
identified focusing on public safety and mental health Wellness projects when we went back recently and we had our committee 01:07:58
meeting with the port, the port. 01:08:05
Noted essentially that they had been aware that we were working on an economic development plan and that they wanted to work with 01:08:13
the city on that economic development plan. 01:08:18
And so as that joint committee, we agreed to recommend that. 01:08:22
Well, let me add that at that meeting I noted that we just adopted a plan and now we have to figure out how to pay for it. So we 01:08:29
it was opportunistic to the city because we're looking for funding to to implement some of those things. 01:08:35
And so we talked about that and we talked about recommending to the council and their committees recommending to their board that 01:08:42
we earmark that $30,000 for an economic development plan implementation funding. The specific project is not noted, but the idea 01:08:49
was that I would come back and and meet with our community and economic development Director, Tony Stewart and go through our plan 01:08:57
and recommend the. 01:09:04
Projects that we thought could be funded with that money that would also benefit the city and the port, and then we would meet. 01:09:12
With the port CEO and see if that's something they're interested in. When we found a project that worked for both parties, then 01:09:20
we'd each come back to our boards. So, so it's not a specific project yet, but it's essentially funding a project from our 01:09:27
economic development plan. And so with that I believe and the committee is. 01:09:34

committee came to the consensus that we were recommending. 01:09:49
Allocating that $30,000 towards the economic development plan if ever, if the Council and the Board agree to it, this would 01:09:55
represent our project list for this year. And so we are recommending moving forward with this as the project list and we can 01:10:02

Well, actually, I mean, because there's no, there's no specifics. There's actually category. Ironically, this is actually probably 01:10:22

and environmental well-being. So this actually economic development falls right into that category too in the settlement 01:10:40
agreement, we don't have any. 01:10:46
It's not specific yet. Yeah. So we, we, we're going to get creative and try and figure out how to. 01:10:53
It's going that direction. So we'll bring a project back that well, we'll try to find one that we think is mutually beneficial to 01:11:00
the port, check with the port CEO and make sure that we find one that's mutually beneficial. And then we'll each bring it back to 01:11:06
our boards to recommend to fall in line with our economic development plan that we recently approved. OK. 01:11:13
And justice as an example, because there were a lot of things in that plan, but, you know, there's things that I think could be 01:11:20
mutually beneficial, like, you know, enhanced updated signage that reflects both the city and the port and in certain areas and 01:11:26
things like that that that I think would fall in line. But the economic development plan was pretty broad. It even included some 01:11:32
like food truck events and things like that. So. 01:11:38
We can go through that and try to find the one that gets both the city and the port excited about working together. 01:11:45
Just reminded me, I think I heard you say earlier like getting port trucks to go the designated route. 01:11:52
Is there a designated route or are the port trucks supposed to go down Waimea to Rice or or specifically port trucks? It's our 01:12:00
that we have our commercial truck routes and so it includes most port trucks, but it's not only the port trucks and so commercial 01:12:08
trucks, yeah, we do have commercial truck routes that we that we've adopted and signed so. 01:12:16

So we have a couple of slides in the city manager's report. We just wanted to highlight some recent events and some upcoming 01:14:25
events and recent events. We've had quite a few. We September 21st we had our coastal cleanup day and we collected somehow 42150 01:14:33
lbs of trash and recyclables and. 01:14:40
As noted here, we cleaned with our partners 3 miles of coastline and included some unusual items such as a whole couch, which I 01:14:49
did not see this year. Last year I had seen the couch, but this year I missed it. I was working the booth, I missed the couch. So, 01:14:56
so thank you to everybody who joined us for that And another successful Coastal Cleanup day and the pictures there that we posted 01:15:04
online to we had our junior ROTC come out and they they were a force out there. 01:15:11
It was a good event. 01:15:18
And then this weekend we had our Touch a truck event and it just continues to grow. It was it was a pretty large crowd. I think we 01:15:20
estimate about 1500 kids came out and that doesn't count the families with them. It's just the kids that we were handing out our 01:15:28
passports to the booth passports. So is our third annual Touch of truck. They keep getting bigger and I think more successful. And 01:15:35
then I think the exciting thing for us is more and more agencies are. 01:15:43
Wanting to participate in it, we had, our goal had been to get the Navy to participate and we did it this year. And I think that 01:15:50
they were really happy with it and more eager to participate next year. So, so it's all all good stuff. And then there's a couple 01:15:57
rumors that a couple other cities are reaching out to our team asking how to do this. So it might grow from there where you might 01:16:05
start seeing some other Touch of Truck events in the county, which is always, it's always good, just more community events. 01:16:12
And then the other thing that launched this last week is our community emergency response team training, our cert training. We had 01:16:20
a pretty full class as you can see in the photo on the right, we had 28 participants. And it's a very impressive because because 01:16:27
it's, it's actually a little bit of a time commitment when these people are all part committing to participate in this for the 01:16:35
next several weeks and so six weeks. 01:16:42
And so they will be working on that for the next six weeks. I think they'll finish. I think it was right before Thanksgiving. At 01:16:50
one point it was going to end on Thanksgiving and we thought that would be a terrible way to spend Thanksgiving. So, so cert is 01:16:59
training is underway now. So, and thank you to our Police Department and our fire department for all the work on that. 01:17:07
We wanted to give a quick reminder. I think we're kind of getting through this, but we had we're upgrading all our financial 01:17:18
systems and it's always change and, and, and change is always not preferred. And so about September 10th, our new system, our 01:17:25
utility billing payment went online utility billing system. 01:17:33
The feedback we're getting once people get used to it is I think we're hearing that people like it and that it they like it a 01:17:41
little more than the old one, but it's just that initial change. 01:17:46
I think that we're trying to get the word out on. A lot of the word we're trying to get out is if you signed up for autopay before 01:17:50
September 10th and you just set it and forget it. 01:17:55
You will have to remember one time to reset it and then you can set it and forget it all over again. So we're just trying to 01:18:01
remind people who may not have heard that that's going on and if and any anything set prior to September 10th needed to be reset 01:18:08
now for for this new portal. So. 01:18:15
And credit to the finance department who is set up, we've set up a kiosk in the front of City Hall and they actually are walking 01:18:23
people through pretty constantly walking people through setting it up with the hope that most of them are setting up auto pay and 01:18:30
they have to do it once here and then never have to do it again. So. 01:18:36
And then we have a couple upcoming events. One is the Spooktacular Celebration, which is another one that Rick has put on that 01:18:44
just keeps growing and has gotten more popular over the years. That's on October 23rd from 5:00 to 8:00 PM. This this year we'll 01:18:51
have music, photo booths, treats, pumpkin patch, maze, train ride, face painting, carnival games, and more at Miranda Park. 01:18:58
And so that's coming up. We also, I think 4 days before that on October 19th, have the, I think it's the last movie in the park 01:19:06
series this year it was Wonka at Booker Park. And that's a free event that we invite our community out to. 01:19:15
And then the notice on the right is good news, but it's we're also just letting people know that the construction is going to be 01:19:25
happening. And so people are aware that we're doing our walk sidewalk repairs at the beach and that's going to include the new 01:19:32
concrete pad and walkway to the swing set, which is now going to be we're moving forward with the installation at the beach. So 01:19:38
that work is all going to be happening over the next. 01:19:45
45 days or so. 01:19:54
And I wanted to quickly note and the next slide will show that we, we. 01:19:57
May have an item on this on the next agenda depending how it's how it's going. But we wanted to give a quick dredging update. It's 01:20:04
not on the agenda. So I can just briefly note that we, we as in the city, the port and the harbor were notified recently of some 01:20:11
potential issues at the state and federal level, which potentially could lead to delays to not just our dredging project, but all 01:20:19
dredging projects that were scheduled in the state of California. 01:20:26
And so we, the city, the port and the harbor have been working together diligently and immediately to start contacting all of our 01:20:34
state and federal representatives and starting to contact the Corps of Engineers and the State Water Control Quality Control Board 01:20:40
to really bring attention to this and try to get it resolved as quickly as possible to avoid any any potential delay. And so we've 01:20:47
had several. 01:20:53
Meetings and several conversations with the different folks involved. 01:21:00
And today, with a thank you to Congresswoman Brownlee's office, who sent a letter urging everybody to get involved in and solve 01:21:04
the issue, we have been, I think, making progress on it. And so we've been notified at this point that the Army Corps of Engineers 01:21:12
are expecting to issue their projects project solicitation this week. And so that would be a big step. And we think that's a good 01:21:19
sign. But the city port in the harbor. 01:21:27
Gonna plan to stay on it and keep meeting and keep pushing just to try to make sure that that we keep the project on track. It's 01:21:34
just when a project involves state. 01:21:40
Regions, counties, cities, every other board in between. And then also, you know, even the federal government, but with the US 01:21:47
Army Corps of Engineers, there's a lot of possible little hiccups. So we're all just going to try to work together to really keep 01:21:54
it on track. So, so for now, that's the update. And then as noted, it's there on the the end of this slide for the next meeting if 01:22:01
we need to give more of an update and, and take some actions on it. 01:22:08
We'll, we'll put an item on the agenda for that purpose. We're hoping that's not the case. We're hoping that it's sort of resolved 01:22:16
in an on track before that time. But it's noted on the slide for October 21st along with a few items presentations. We're planning 01:22:23
to do our Down syndrome Awareness month, National Community Planning Month proclamation, and then the district attorney's office 01:22:31
is offering to do presentations to each city on gun violence restraining. 01:22:38
Which has become a tool that they're really using. It's one of those things and they'll go through it. But I think five years ago 01:22:46
they'd have like 1A year across the county and now there's 50-60 a year. And so it's really becoming more of a tool that they're 01:22:53
using and they've they've asked to come to a presentation on that and it's an opportunity to educate the community on it and that 01:23:00
this option even exists out in the world and then. 01:23:07
So those are the presentations we have planned, business items we're bringing back our Wanami Beach Fest wrap up report. 01:23:14
And the bringing back the item that came to council a few months ago, we were asked to do more research on the no smoking 01:23:21

You know, this dredge thing, I thought we had it wrapped up. It's been a cycle every two years. And you know, last year we, we 01:26:08
felt victorious because for the first time in 20 cycles, we actually got the amount of sand that we need to get in order to mimic 01:26:16
Mother Nature. And so I just, I know I really appreciate the work that's going on, but it's, it's just shocking to. 01:26:25
Hear that because of a rule, they're not going to let our dredge project go forward, obviously. 01:26:34
The port and city manager Vega have worked it out, but just imagine if like every two years you had to negotiate for your 01:26:41
allotment of oxygen to sustain yourself. And, and I say that jokingly but seriously because Wayne Beach. 01:26:48
Will not be sustained if we don't get that 4.2 million cubic yards of sand every two years. And I hope before the day comes when 01:26:56
I'm no longer a City Council person that it'll be etched in stone and then we won't have to go through this process every two 01:27:02

interesting comments made about how native vegetation can't be our priority, that we, we have to start working Better Together 01:28:13
more collaboratively between the water agencies and the cities. 01:28:19

I also attended the Military Appreciation Night with the West Ventura County Business Alliance and had an opportunity to meet some 01:28:31
of our residents who serve on our who serve our military and live here in Port Hueneme. We got to meet the person in charge of the 01:28:38
canine unit on the Navy base. They got a lot of dogs there. It's pretty impressive and it was just a great evening overall just 01:28:45
realizing the the things that. 01:28:52
Our service men and women do for our community and and that's because of the Navy base here. 01:29:00
That we have the benefit of their expertise and their talents and they do give back even though they don't. 01:29:07
Always stay here and they move on. They do give back to our community while they're here. So that was very much appreciated to 01:29:13

part of it and what it did was basically released and shared with over 400 attendees the American Community Survey data that was 01:30:44

September. So there's new data out there on our demographics and I think that's really good for all of us to know. 01:30:59
That that's a good reason that that's a new resource available to all of us and when we want to learn more about our our community 01:31:06

One of the points that it showed is that the real household income growth in Southern California has outpaced national growth over 01:31:16
the past year and in fact the last decade and it's reflecting long term economic well-being for the region's median household. So 01:31:23
that's a positive thing that this data is is now showing. And then coincidentally, Bill Fulton who did our economic development 01:31:30
plan was the events keynote speaker. So he's well respected and well known and well qualified and. 01:31:38

Umm, I also attended online at the Institute of Local Government session offering on public meetings. 01:31:51
They discussed updates to the Brown Act and new legislation. And I do have some questions which I'll have for the our city 01:31:57

From credit reporting and I've never thought of that because I, I have medical. So, but for the residents, people who have to pay 01:33:02
their medical debts and, and they can become quite enormous, it just hurts them and sets them back. It's, it's regressive and it 01:33:09
sets them back if they have to, if that's reflected on their credit report. So that was really nice to hear that she, she worked 01:33:16
