Tonight's inspiration will be given by myself, and I do. I forgot about it tonight so I had to do a quick. 00:03:08
Research on what could be an inspiration. So my inspiration tonight comes from something I experienced this weekend. My first 10K 00:03:16
and I was not ready for running a 10K. I'm maybe at 4 miles without my body deciding we're done. 00:03:24
But I ran my first K 10K and. 00:03:32
It was quite difficult. It was actually really, really painful and really difficult. So my inspiration tonight is for runners. 00:03:35
Runners embody the essence of perseverance, pushing boundaries and chasing dreams with every step. 00:03:42
Their dedication to the journey, the passion they bring to the track or field or wherever they run. 00:03:47
And the resilience they display in overcoming challenges inspire us all to strive for greatness in our own pursuits. 00:03:52
And I know I was surrounded by so many people. They were just joyful to be there. 00:03:59
And it was quite dreadful for me. So I do not understand the runner's high or how people can enjoy running, but I'm going to try 00:04:03
and keep pushing my body to keep running. 00:04:08
So that's my inspiration. 00:04:14

Good evening, Mayor Perez, esteemed City Council members and staff. My name is Paul Copley and I'm the founder of the Ventura 00:05:49
County Voting Reform Project. 00:05:53
I'm here tonight to talk about what the City of Port Hueneme can do to fend off an expensive and frivolous lawsuit. The City of 00:05:58
Port Hueneme elects its City Council using a plurality at large system. What this means is that every voter gets one vote for 00:06:03
every available seat. 00:06:08
Now while this might seem like a logical and well thought out system, in reality it allows for the majority to completely dominate 00:06:14
any minority groups. 00:06:18
As long as they have 51% of the votes, they're able to control 100% of the seats. Because of this, the California Voting Rights 00:06:22
Act has made it illegal to use plurality at large elections in most circumstances. 00:06:29
Every city in Ventura County, with the exception of Port Hueneme. 00:06:36
Has transitioned to district based elections in the last few years as a result of a CVRA threat letter. 00:06:40
While many of the cities were not actually in violation of the CVRA, it is often more expensive to fight these bogus allegations 00:06:46
than to simply concede to the attorneys demands. 00:06:51
The most common solution is to transition to single winter district based elections and this is what has been implemented across 00:06:56
the county. However, at the end of last year the state Supreme Court specifically outlined another method, proportional ranked 00:07:01
choice voting. 00:07:06
For many cities and protected groups, single winter districts are not a good solution. 00:07:11
PRCV provides a much better solution. It allows cities to continue conducting at large elections, but does so in a way that 00:07:17
prevents majorities from dominating and satisfies the requirements of the CVR A. 00:07:23
For the record, I do not believe that poor Guinea is in violation of the CVRA, but unfortunately that doesn't matter. You will get 00:07:30
your letter just like every other city in Ventura County has. 00:07:35
Port Hueneme has the opportunity to act in a preventative measure, protect itself against frivolous and costly lawsuits, and 00:07:41
ensure it is in full compliance with the CVRA, And it virtually guarantees that no legitimate attorney will seek to sue the city. 00:07:49
If you want to take, If you want to wait until after the threat letter arrives to take actions, your options become severely 00:07:58
limited. 00:08:02
I strongly urge the City Council to put a discussion of proportional ranked choice voting on its next agenda and invite either 00:08:06
myself or another representative from my organization to deliver to the City Council a presentation on PRCV how it works its many 00:08:12
benefits. 00:08:17
For the City of Port Hueneme and the options for implementing it in a timely, effective and costly manner, please don't hesitate 00:08:23

I've been a Ventura County resident since the. 00:09:11
1970. 00:09:14
And Port Way, enemy resident since the early 1990s. 00:09:16
So without wasting your time, I have a fun story to tell you. I was I was in the Jacuzzi with my daughter, my granddaughter, this, 00:09:22
this this afternoon. 00:09:27
He says. Where are you going tonight? I'm going to the City Council meeting. What happens? Well, these are people that care about 00:09:33
the city of Port Hueneme. 00:09:37
And they they run the city. 00:09:42
And she said, well, why? I said, well, because they want to make the city better, she says. 00:09:45
Well, that's wonderful. 00:09:50
This is a three-year old, It was great and she's right. So a quick update. 00:09:52
We're concerned about the amount of pollution. 00:10:01
That's coming from the port. 00:10:05
And I'm here to tell you first of all. 00:10:07
Transparency. We don't have any science yet. 00:10:10
But we're we're getting closer. We do have a video that I don't want to waste your time with. 00:10:14
That was taken on March 25th of this year. 00:10:20
It was a roll on, roll off row, row boat that was had its engines on because of all of the problems at the port, we understand 00:10:25
that. 00:10:29
And it was spewing a lot of black. 00:10:35
Diesel particulate matter. 00:10:38
It's a concern to us. We still don't have our science yet. 00:10:42
But we're working on it. We're getting. 00:10:45
And that that science is important because. 00:10:48
Coming to you with these updates that aren't really. 00:10:51
Anything of any actual substance. 00:10:55
Is. It's seemingly a little bit of a waste of your time, but we want. 00:10:58

That first conversation. So we plan to have some to keep working on that throughout the year. 00:12:14

Just want to hope that whatever the port presents in terms of. 00:12:58
There are growth aspects and their future goals is that it also includes the city of port where I need me significantly and how it 00:13:03
can not just benefit the port, but the city and the communities within, because all of us working together is how we build a 00:13:08
better place to live in aggregate. 00:13:13
Not just for today, but for 10 and 20 and 30 years down the line. 00:13:18

To begin rebuilding and forging a positive and meaningful working relationship that is much more collaborative. 00:14:05
It is critical that we work together to find the right balance. 00:14:12
For the proposed strategic plan. 00:14:16
That will mutually benefit our port, our city, and your neighbors. 00:14:18
As we rebuild a cohesive partnership, we ask that you consider the following objectives. Encourage collaborative participation 00:14:22
that includes input from stakeholders. 00:14:26
Of your host city. 00:14:31
Listen to the concerns of the community you work in. 00:14:33
Develop good stewardship and good neighbor policies, not just public relation optics. 00:14:36
Satisfy the communities need. 00:14:41
Requirements relating to economic inputs, quality of life, infrastructure and safety. 00:14:43
Recognize the port and city. 00:14:49
Interdependence and build meaningful community support and stronger economic relations that will realize a long term success. 00:14:54
Encourage debate that challenge actions. 00:15:04
That are deemed not to be in the best interest of the city or the majority. 00:15:07
And work for the change where change is needed. 00:15:12
Our port is a specialty niche port. Our city is a. 00:15:16
City Forbes states that niche providers can provide far more potential. 00:15:20
And more profit with less. 00:15:26
At different rates your your operation and leaves no. 00:15:29
In what you stand for with services delivered with genuine conviction, people. 00:15:33
Will trust and pay more for that expert knowledge delivering product. 00:15:38
Products and services. 00:15:42
As the owner of a niche company, I can attest to the statement from Forbes. 00:15:44
And we have been successful for 50 years. Bigger is not always better. 00:15:48
We envision a small, successful and environmentally clean niche port working with a small, beautiful beach. 00:15:53
Host City. 00:16:01
A smart and significant competitive advantage providing less impact. 00:16:02
And greater economic benefits for wine. 00:16:07
And a sustainable future for all stakeholders. 00:16:09

So tonight is the latest installment of our quarterly recognition of employees for their years of service. 00:17:12
To my left tonight, we are honoring Aaron. 00:17:20
Wade, admire our. 00:17:23
Information Technology Manager. 00:17:24
For his 20 years of service with the city. 00:17:27
Aaron was hired on March 25th, 2004. 00:17:30
And initially held the title of MIS manager. 00:17:34
Aaron told me he was thrilled when he started with the city. 00:17:39
And he couldn't wait to share the information. 00:17:42
About his new job and his new title. 00:17:44
With all friends and family. 00:17:46
Aaron told me that during this exciting time. 00:17:48
It was a valued family member who was also a Port Hueneme resident. 00:17:51
Who looked at his business card? 00:17:55
Which again said MIS manager and asked him. 00:17:57
What is it exactly that you mismanaged? 00:18:01
Well, fortunately for Aaron, during his career in the city, his title changed. 00:18:05
So first it changed to Information Systems and Technology Manager and then ultimately to his current title. 00:18:12
Of Information Technology Manager so simplified. 00:18:19
When asked what he likes best about working for the city, Aaron says that he enjoys working with such a friendly staff. 00:18:24
He knows nearly everybody. 00:18:30
That works for the city by their first name. 00:18:32
When asked about his favorite moment in his work career. 00:18:35
Aaron gave me two examples. First, he said. 00:18:38
It was the day that former City Manager Bob Hunt. 00:18:41
Hired him and offered him the job. 00:18:44
And the second one, which is I think telling about who Aaron is as an employee, was the day that the hte. 00:18:46
Our former ERP system. 00:18:53
Was implemented. 00:18:55
And this is cited because it was something outside of Aaron's comfort zone, something he had never done a project like that before 00:18:56
and he really relished. 00:19:00
The challenge and the opportunity to take it on and was really. 00:19:04
Pleased with that accomplishment. 00:19:07
Lastly, when asked if there was anything else, I. 00:19:11
Aaron would like to share. He noted that he and his wife share an important connection, the loyalty and dedication to their 00:19:14
employers. 00:19:18
His wife is about to celebrate 34 years working with her employer, Lockheed 30. 00:19:22
She's already celebrated 34. She's almost at 35 with her employer, Lockheed Martin, and that'll happen later this year. 00:19:28
So please join me in congratulating Erin on 20 years of service with Port Whitney. 00:19:36

and other developmental disabilities require a variety of types of assistance at different points. 00:21:13
In an individual's life, and whereas our understanding of autism has grown tremendously since it was first diagnosed, as there is 00:21:20
no known cure for autism, early diagnosis and the resulting appropriate education and intervention are vital to the. 00:21:27
Future growth and development of the individual and whereas a variety of public and private organizations and agencies strive to 00:21:35
provide quality care, support or services to children and adults with ASD to enable them to live as independently as possible and 00:21:42
to reach their full potential. And whereas hope lies in a broad spectrum of treatments and in an informed public and community 00:21:49
committed to providing support and service to individuals diagnosed with autism. 00:21:56

prepared to meet their needs. 00:23:57
From challenges in education and employment to difficulties in accessing health care and community services, their world is full 00:24:02

This month we celebrate the strides we have made towards an inclusive society. 00:24:14
Autism Society of Ventura County is filled with pride and joy that the City of Port Hueneme recently added the word inclusive into 00:24:19
its City Council goals without prompting. Other cities have followed. Thank you Port Hueneme for being a leader in building 00:24:24
inclusive policy. 00:24:29
Autism Society, Ventura County and its advocacy committee will continue to push for policies that ensure individuals on the 00:24:35
spectrum have access to quality education, meaningful employment and comprehensive health care. 00:24:42
We advocate for environments that are inclusive and celebrate differences. And most importantly, we must foster a community that 00:24:49
listens and values to the voices of autistic individuals themselves. 00:24:56

Good evening, Mayor, City Council members, it's a privilege to be before you this evening. This is our annual address to the City 00:26:51
Council where we deliver a state of the port, give some updates of what's going on and look for opportunities for collaboration. 00:26:57
As you know, when we were in Washington, City Council member Mr. Martinez and and Mayor Perez, we went with this, this slogan, if 00:27:04
you will. There is no commerce without community and there's no community without commerce and it's. 00:27:11
I think very telling and true and I think we have a lot to do to work together and have exciting times ahead. So with that, I'll 00:27:18
kick off and just kind of go into what's going on at the port One. I'd like to introduce the President of our board, the first 00:27:24
Latino to actually serve as President of our Board, Selena Zacharias. She's with us this evening. 00:27:29
Yes, congratulations. I also have staff with me tonight if there are questions on our finances. Our CFO, Austin is here. Austin 00:27:36
Yang and Leticia Austin is with us ahead of our government relations program team. So we're here to answer any questions that you 00:27:41
may have after this presentation. But as a quick reminder, we are governed by five Elected Harbor Commissioners and our goal is 00:27:47
not to become a rich port. 00:27:52
We don't collect any money from the taxpayer. The money that comes into the port comes through the private sector and our 00:27:58
customers. 00:28:01
And our goal is to enrich our committee, our community by having access to the global stage for trade. So many of our customers 00:28:04
may be profit driven. We're not. We're here to make enough money to reinvest in the port so we can be a strategic global player in 00:28:11
international markets, but at the for the purpose of creating economic and social good for our community. 00:28:19
Here's some wild stats as some of If you're in the backyard of LA and Long Beach, a lot of people don't realize our play in global 00:28:28
trade. We actually move about 16 plus billion dollars worth of cargo with the number one West Coast port for banana trade and 00:28:34
actually #2 in the nation number six for containers on the West Coast #5. I love the stat. This is new. I just learned this in the 00:28:40
new study. We're #5 for total refrigerated cargo in the country moving more Chicago than the port of Long Beach. So that's a fun 00:28:46
statistic. 00:28:52
Or #16 in the United States for containers, number six for cars, and the top 10% of the nation's seaport. So this is really your 00:28:58
port that's going to work, doing all this great business internationally, creating lots of opportunity for our community. 00:29:05
In terms of how our performance is going, we are moving ahead very strong. We've realized about 80% increases in volume over the 00:29:12
last decade and revenue is up about 133% since 2012. So we brought in new business. 00:29:19
Business recover a little bit there in terms of our overall play in the economy here in Ventura County. Trade and transportation 00:30:34
strongly outport forms the overall economy of Ventura County. So we're very important to the. 00:30:41
Economic health of our county. And just to kind of talk a little bit about our strategic plan, we're hoping to adopt this by the 00:30:48
end of this fiscal year. We've been working on this for four years. We've had a lot of public meetings, Charettes open, 00:30:53
transparent processes. 00:30:57
And we are looking to adopt it probably in July or June of this year. And these are strategic pillars. So it's economic vitality, 00:31:03
infrastructure, environment, community and innovation. And I'll touch quickly on each of these and provide an update to the 00:31:08
council. 00:31:13
So in terms of economic prosperity are when the port does well, we see dividends come back in terms of jobs, tax revenues to 00:31:18
communities and economic activity. Overall economic activity is actually up 150% with our growth job creations up 144% and tax 00:31:25
revenue is up 224%. And City Council Member Hernandez, I know you've asked me to get the Economist in front of me and I will make 00:31:31
that happen. I know I owe you that. So we'll make it happen. 00:31:38
This is the economic impacts in terms of revenues coming directly to the city port, Wanimi from the businesses that work at the 00:31:46
port. This is the type of revenue generate in terms of taxes outside any other revenues that are coming in through the seaport. 00:31:52
Terms of job creation here locally drilled down to direct jobs, we employ close to 3500 people through the port customers or the 00:31:59
port itself. And I think it's important to note that about 12% of all the jobs at the port are for residents of this fine city. So 00:32:06
very important to and these are good paying jobs, high paying jobs, good quality of life paying jobs, so important stats in terms 00:32:12
of providing for our community. 00:32:19
To touch on a little bit of, I wanted to speak to partnership a little bit and the revenue sharing agreements and kind of speak to 00:32:27
some of the revenues that you'll be seeing in the future and what is this all about, so these revenue sharing? 00:32:32
Four different contracts, 3 revenue sharing agreements and a settlement agreement and over the last. 00:33:13
How many years is it Austin since it's been since 1983? 00:33:18
40 years, it's produced about $36 million in revenues for the city and this is the breakout by each individual agreement. I think 00:33:24
we're forecasting next fiscal year about 2.9 million going. 00:33:29
We make more than $13 million in revenue, $100,000 goes into the bank for the city and the port to come together and strategically 00:34:10
decide on good projects to invest in. 00:34:14
That are of mutual benefit to the city and the port, so we'll be working on the next round and we've done some good work in the 00:34:20
past. 00:34:23
I think this is a video from this year's Lego First event where we had 1500 high school students come out and the $5000 from the 00:34:26
CBF supported that event hosted at the port. So just really good stuff that we can do to uplift our community and create 00:34:32
opportunities through the CBF fund. 00:34:38
This just shows you just a snapshot of it is significant funding. We're second in line from property taxes in terms of the money 00:34:46
that goes into the general fund. So if you look here this what fiscal year 2023 is about 10.3% of your general fund is being 00:34:52
furnished by the city in that second two year property taxes. 00:34:59
Infrastructure. 00:35:38
We have about $105 million that we're putting to work through a variety of grants. We got an $80 million grant from the state. 00:35:40
We've gotten other money from BCTC, from earmarks, from our Congresswoman Julia Brownlee among others. And we're putting that 00:35:46
money to work to not only expand our opportunities in terms of creating trade and expansion, but also do it with a nod towards the 00:35:52
environment. So exciting things we're going for full port wide electrification, harbor deepening so we can bring more sand to 00:35:58
local your local beach here. 00:36:04
New stormwater systems and we're getting a we got a 850,000 earmarked from Julia Brownlee for electric sweeper, and as we all know 00:36:11
from the recent story how important that is. 00:36:15
Work on a traffic Traffic Safety enhancements at our gate green hydrogen to run our reefer plugs, which is the containers that we 00:36:20
plug in that are full of blueberries and bananas and avocados among other things. And then also we got $2,000,000 for workforce 00:36:27
development. So we can really help uplift our local community and have access to the good paying jobs affiliated with the port. 00:36:33
On the environment front, I'll just say that our blueprint to decarbonization is in front of the CEC. Now we do have robust goals 00:36:41
set in that decarbonize port operations. 00:36:46
Put our best foot forward and achieve it. 00:37:23
The gentleman talked about our air quality website. Indeed, that's been up. It has been a work in progress, but it does report 00:37:27
out. We collect data about our air every second, every day and we are now posting that live on the Internet and videos and things 00:37:35
that explain that data. I will point out that there are a lot of other actors in our community and so. 00:37:42

The, the air that we're measuring isn't all port air, right? It's all of our air and all the different actors in the community 00:37:54
that are adding to any pollution that we might see come out in this data. But we're the ones that are capturing it and we're 00:37:59
sharing it and we're doing our best to mitigate our footprint in terms of the business that we do here in your community. 00:38:05
Trucks, just quickly touch on trucks, drayage trucks or or trucks that do short haul moves. So that's a container that's coming in 00:38:13
from a port and then it will go to a distribution facility. That short move is called drayage move. So there has been a new 00:38:20
regulation that came out from ARB and all of the new purchases for these drayage trucks have to be electric starting January 1st 00:38:28
of this fiscal year of this of this calendar year, excuse me, January 1st, 2024. 00:38:36
Also, any existing trucks that are in system must be newer than 2009. They have to be 2010 or newer. This law though has been 00:38:44
challenged by a trucker association because it wasn't approved by the EPA. So it's been paused, but we suspect that it will be 00:38:52
approved by the EPA and will be live in relatively short order. But that's good news in terms of some of the impacts of the trucks 00:39:00
that move through our communities. And I'd like to report out to that. Recently, we conducted a freight study with Ventura County. 00:39:08
Transportation Commission. And from that study we learned that we're only responsible for .6% of all trucks in the county. 00:39:16
And 23% of the trucks on port when he me corridor. 00:39:24
Our freight corridor, which means 77% of the trucks, come from somewhere else. 00:39:28
Shoreside power. We know we had a hiccup here. This is the all hands on deck. 00:39:35
A press event that we had to get the money to rebuild our shoreside power system that was damaged by the storm on the 21st. As we 00:39:41
know our community here was hit pretty hard. The good news is, is that we did because of the value of the damage, $40 million. It 00:39:48
did open up the coffers for state relief disaster relief funding. So our application has been approved and the door is now open 00:39:54
for your community for public infrastructure. 00:40:01
To get fixed and repaired from the damage and access to these funds. So James, not sure we can talk offline, but you're able to 00:40:08
apply and get your application in for the library among other things that may have been impacted from the storm. 00:40:14
And we're doing our best, all hands on deck. We want to build this fast and we want to get it up, but it takes time, their lead 00:40:20
times in parts. So we're going to be honest, it's probably going to be about a year and a half. 00:40:24
Till it's rebuilt, but we're looking at other systems to reduce emissions and maybe bring those online as early as this summer if 00:40:29
we can. The bonnet system I think I mentioned is you put like a hat on the stack of a ship and it captures the emission. So we're 00:40:34
working hard to get new technologies in here why we rebuilt. 00:40:40
A lot of high school programs, So it's great to say that Fathom works is just killing it. They're doing really, really well. 00:41:19

Just to close and wrap up, you know, it's so important that we work together and do exciting things to support a community. We 00:41:30
really are and want to be part of the fabric of the community, the Port of Wenimi. We do about $300,000 in sponsorships every 00:41:38
year. We've had about 100 community food drives throughout the county or our customers have contributed £1.8 million of bananas. 00:41:45
And if you look at the picture there with the kids going like this, they come and dragging their feet, but when they leave they 00:42:25
sing cranes and boats and all kinds of cool stuff, green bananas. So it's been a very well received program and something to get 00:42:29
kids. 00:42:33
To see something right there in their backyard that they might not know about. 00:42:38
And then finally, there's just a lot of wonderful opportunities for our continued collaboration, whether it's around the annual 00:43:42
biannual dredging, excuse me, of the beaches. 00:43:46
Our annual trip to DC economic development strategies, tomorrow I'm going to be meeting with your consultant and get interviewed 00:43:51
on opportunities there. So look forward to that. Then of course on innovation environment, so we can be the first greenest port in 00:43:56

but a lot of kind of what's going on behind the scenes with this nonprofit as things get started and complying with HUD and 01:03:45

Will not be things that will be disclosed individually to individual council members or board members. It will be something that's 01:03:56
addressed at the board level when appropriate, right. And I wouldn't expect that. I would expect to follow the the process. I just 01:04:02

Article One of the organization with the role of this city manager is and there was number mention of an executive Director. So 01:04:17
that was somewhat confusing given the current structure of the Port Winneme Housing Authority. The executive structure of the 01:04:24

And if I could just add and we we did discuss that and at this point we ultimately decided. 01:04:37

property owner, as the landlord, instead of essentially going out and finding private residents who are willing to. 01:05:48
Rent or lease their properties for in return for vouchers. 01:05:56
And then what will be the meeting schedule? Will it follow council? 01:06:01
Be attached to council meetings. It's yet to be determined the way the bylaws are. 01:06:05
Written at the moment is the meeting schedule be approved by resolution of the board once things are kind of finalized and we get 01:06:11
a clear idea as to what the schedule is going to look like, but I anticipate. 01:06:16
And I've been informed by Miss Basua that at least initially, the board is going to be fairly busy, so I would anticipate a 01:06:21

the state of California create a separate department within the city that is the Housing Authority. But the Housing Authority is 01:10:00

The nonprofit is a separate private entity, OK. And just to remind everybody because we did a presentation maybe two or three 01:10:13

It's a hoop we have to jump through to be able to raise funding to either build units or acquire property or what have you to to 01:10:26
actually develop affordable housing. 01:10:32
And so just we as the city. 01:10:38
We couldn't do things like mortgage or property but the nonprofit can can mortgage a property so, so and then just to go back to 01:10:42
the question of you know is there. 01:10:46
The possibility that either the city approaches the housing group with like here's properties that maybe would be good potential 01:10:51
for you and let's have that conversation or with the housing group approach us, I expect both of those things will happen and into 01:10:57
some level. We've already had some of those initial conversations of some of the things that could be mutually beneficial to the 01:11:03
city and the housing. Wanami Housing Inc. 01:11:09
It's I I can give a little bit more information regarding kind of the reason why this is such an attractive proposition is. 01:11:15
Typically the way that HUD and everybody used to operate was that a 55 year covenant was required on a property that was offered 01:11:24
for affordable housing purposes. 01:11:28
And so HUD required a 55 year covenant. They also required numerous documents to be recorded in the chain of title like regulatory 01:11:33
agreements and whatnot that discussed. 01:11:37
How the properties had to be leveraged, how they had to be financed, how they had to be in order to ensure that those properties 01:11:41
would continue to exist and continue to be available for affordable housing purposes for the next 55 years. 01:11:46
Ultimately, what HUD has discovered over? 01:11:52
55 years of doing this is that that prevents those properties from being capable of refinance. 01:11:55
They don't appreciate the same as other properties. 01:12:00
They don't. It's it's almost impossible to continue to fund those properties and to rehabilitate them after 55 years has elapsed 01:12:02
because no bank is willing to invest in them. 01:12:07
So this is HUDS effort of getting around the 55 year covenant which renders title to the property unmarketable. 01:12:13
This now allows you to leverage increased property values in an effort to. 01:12:20
Rehabilitate those properties, modernize them. Make the appropriate ADA repairs. 01:12:24
Do the things that you otherwise couldn't do without very complicated transactions. 01:12:29
Through various banks with subordination agreements as well as regulatory agreements that took months to negotiate. 01:12:36
And still resulted in diminished value received from properties that were. 01:12:42
Essentially burdened by extensive coven. 01:12:47
And so this allows us to get around that. 01:12:50
And realize the value of these properties with the end goal of improving those properties for residents. 01:12:52

Staffs recommended the City Council authorize us to execute an. 01:15:25
UH Mou for an Organized Retail Theft Task Force with the Ventura County Sheriff's Department. 01:15:29
A little background on this in December of 2023. 01:15:38
Ventura County was named the safest large county in all of California. 01:15:41
Ventura County law enforcement officials attributed the this designation to the collaborative working relationship amongst all 01:15:46
your law enforcement agencies. 01:15:51
The partnership has provided another opportunity in the form of the Ventura County Organized Retail Theft Task Force. 01:15:57
Retail theft has become a crisis in many areas across the state and country. 01:16:05
And was estimated to cost over 110 billion across the country last year. 01:16:09
Ventura County law enforcement agencies are proactively. 01:16:15
Proposing development to join a task force to address this issue. 01:16:18
So I'm going to. 01:16:23

Good evening, Madam Mayor, council members, Mr. Vega. 01:16:28
My name is Ron Ships. I'm a captain with the Venture County Sheriff's Office. Thank you for the opportunity to talk with you and 01:16:31
give you just a brief overview of the Venture County Organized Retail Theft Task Force. 01:16:36
On September of last year, the Sheriff's Office applied for and was was awarded a $15.6 million grant. 01:16:41
Focusing specifically on organized retail theft, auto theft, auto part theft, so like catalytic converters. 01:16:47
And also cargo theft. 01:16:54
This with that grant money, we created a multi agency task force that was focused on addressing the nearly $10 million estimated 01:16:58
loss in Ventura County each year. 01:17:03
Due to organized retail theft related crimes. 01:17:09
Our grant covers a 44 month period which ends in the end of December in 2026. 01:17:13
And provides funding for salary, benefits for a total of 8 sworn positions within the task force and some non sworn professional 01:17:19
staff. 01:17:23
The sworn staff includes 2 sergeants. One is a Sergeant with the Venture County Sheriff's Office who's currently in place. 01:17:28
And then one should your Council approve the OR authorize the, the execution of this memorandum of agreement. 01:17:34
Would be from the Port Winding Police Department. 01:17:42
Starting hopefully around April 15th. 01:17:44
The task force has 8 sworn investigators who operate underneath the two sergeants, four of which will come from the Sheriff's 01:17:48
Office and are actually currently in place. 01:17:52
And then two from other agencies within the county. 01:17:57
Currently we have an agreement with the Simi Valley Police Department to fill one of those outside agency spots with a detective 01:18:01
starting April 15th. 01:18:05
This grant, amongst other things, also provides funding for a vehicle, so the the. 01:18:10
Sergeant will be driving a. 01:18:16
Funded vehicle and also other related equipment. 01:18:18
That may be necessary for any member of the task force. 01:18:22
Obviously, our overall goal is to reduce the instances of ORT organized retail theft and related crimes by 50% over the three-year 01:18:26
grant period. 01:18:30
We're going to accomplish this by signing each reported case of organized retail theft and related crimes. 01:18:37
To one of the task force investigators. 01:18:43
Utilizing intelligence LED policing principles to identify, apprehend thieves and and hold them accountable for the crimes that 01:18:45
they commit in our county. 01:18:49
The count, the task force is currently up and running with the staff that we have from the Sheriff's Office. 01:18:53
We've been operating for about a week. We have, like I said, one Sergeant from the Sheriff's Office and four senior deputy 01:18:58
investigators. 01:19:01
We've already had one success story. As of last Friday. We arrested two. 01:19:05
Out of three suspects who were involved in a multi $1000 theft from sunglass retailers in the cities of Cameroon, Thousand Oaks. 01:19:10
Additionally, I. 01:19:19
As part of that case, we kind of a byproduct was we were able to identify an online marketplace where some of these stolen items 01:19:21
are being sold. 01:19:24
Throughout the state so. 01:19:27
That's going to help us hopefully continue to curtail the problem. 01:19:29
And identify other suspects and recover stolen property. 01:19:33
So that's a brief overview of the program. I'll turn it back over to the Chief. So I appreciate the opportunity again to describe 01:19:38
the program to you and I'll be happy to answer any questions at the end of the presentation. 01:19:42

Your report or any Police Department to be a team leader on this task force. 01:19:57
We're fortunate enough to have Sergeant Baltazar Tapia amongst our ranks who has prior Task force experience. 01:20:01

Sergeant Tapia can can basically get started right away because he has prior task force experience and he has a skill set. 01:20:09
To help lead and mentor in this team again. 01:20:18
Your smallest PD in the county is being asked by the sheriff to come lead it, and that's a lot of respect from them. Appreciate 01:20:21
it. The timing is very right for this position. As you all remember, Officer Gutierrez was sworn in not too long ago. 01:20:28
His position as he's getting off field training now can replace this position with Tapia. 01:20:35
Give you a little. 01:20:41
Bit more about career development and in our personnel, we can put Senior Officer Henry Montelongo into a supervisor role to 01:20:43
replace Tapia Shift. 01:20:48
Because folks, I have a few years to get our less tenured people up and running to take this department over for the number of. 01:20:53
Retirements that are approaching. 01:21:01
In the near future, and it's a big part of what I'm doing, is succession planning and career development. 01:21:03
And as quickly and effectively as we can and this is a perfect opportunity and timing for that. 01:21:09
This is a fully funded position, equipment to vehicle. 01:21:16
Fully funded salary benefits. 01:21:20
This allows us. 01:21:23
Two, there'll be two parts to this. The first part's going to be a salary savings at first, but the second part is going to be we 01:21:25
will have an opportunity like no other. 01:21:29
To over hire for that. 01:21:34
So we don't have any gaps. 01:21:37
In our future succession planning. 01:21:39
As people retire, we will already have trained up personnel. 01:21:41
There's retirements potentially in the next one to three years and this is a three-year funded position. 01:21:44
So we can take this opportunity that is unique. 01:21:50
To try to stop the gap on vacancies and have trained people ready to take over. 01:21:53
There's a. 01:22:03
This is one more assignment in your department that we do not currently have. 01:22:04
This allows me to help recruit lateral officers to our department if I can create more assignments. 01:22:09
We have a limited number. 01:22:16
Of assignments in a small department, but this is another. 01:22:19
Assignment somebody could rotate into during their career. 01:22:22
I need a variety of assignments and this is 1. 01:22:27
Working the. 01:22:31
Organized retail theft operations in our city will bring extra resources. 01:22:33
Into our city that we don't have. 01:22:37
It'll also bring added security to our port, as some of the operations we're going to do isn't going to involve. 01:22:39
Cargo theft. 01:22:46
And talking to my federal partners, my port partners on Kristen's. 01:22:47
There's there's a lot we need to start looking into into our port and this team is going to allow us to do that. 01:22:55
Port security is something that's been on my priority list since I came back as chief. 01:23:04
And this is a big step to get us back into the footprint of the port. 01:23:09
We do not have a surveillance team, folks. We have to assemble them quickly. Borrow from others when we need one. 01:23:13
There are times when we need them. 01:23:21
Within hours. 01:23:25
This is going to be a one phone call activation of a surveillance team by calling Sergeant Tapia if we need them. 01:23:26
Another benefit that comes from this. 01:23:37
Task force assignment is a separate overtime budget that comes back to us in the city. 01:23:41
And I can utilize that. 01:23:48
To prevent even some of our shoplifting. 01:23:51
Retail theft in the North End I can actually fund. 01:23:54
Some bike patrol details. 01:23:57
In our shopping centers. With that I can fund some details at the port. With that I can fund catalytic converter thief. 01:23:59
Details with that overtime budget that also comes. 01:24:07
In our 400 plus Part 1 crimes that are reported to you last year at a prior meeting, 85% of those were property crimes. 01:24:13
Of the 85%, about a third were retail related. 01:24:21
Of the remaining 10%. 01:24:27
You had catalytic converter thefts and other vehicle park thefts, something that this task force will look into. 01:24:28
Out of another 10% of that. 01:24:36
Those thefts were stolen vehicles. Again, something else the Organized Retail Theft Team is going to look at. 01:24:38
And investigate. 01:24:45
And then something else that we need as a small PD. All small PDS do. 01:24:49
There are crimes occurring. 01:24:54
In all of our cities that are from. 01:24:56
Suspects outside the area. 01:25:00
And that is something you need a task force for. He just said they worked a case. 01:25:02
You start to, you put the. 01:25:07
Start to put the lines together. Where property's going, you realize it's outside. A good example is we just had a distraction 01:25:09
theft case on our beach this weekend. 01:25:13
And some the victims were elderly and some people drove up in a car. 01:25:18
And started talking about their jewelry and showing them jewelry they had and by the time. 01:25:23
This elderly couple realized what's going on. These people are swapping off their jewelry and they're driving away. Well, we did a 01:25:28
lot of research and to find out that suspect vehicle because we have some technology in the city. 01:25:32
And unfortunately, our suspects are out of Orange County. 01:25:38
Imagine this. You have a suspect hitting our beach here in Orange County. 01:25:42
The same day they could hit Ventura. The same day they could stop off the 101 and hit somebody at a mall in Thousand Oaks. And 01:25:47
they're going to keep going. 01:25:50
That's why you have a task force, because once 1 triggers and we get the task force going and you make a phone call. 01:25:54
They'll they'll have team members on the other side of the county. 01:25:59
That may already be watching for. 01:26:02
And a task force already set up to start looking at cameras and other stuff. 01:26:05
And if this goes to Orange County, this is a task force. That's not a tide to here. 01:26:09
They can go down to Orange County and they can do a surveillance down there on our suspects from up here. 01:26:13
Real life story just happens this weekend. These are things that are possible with the task force. 01:26:18

So as people are being. 01:27:50

However, however, so right now with your existing. 01:27:56

We are efficient and effective we are. 01:28:04
There's a couple more spots I want to create patrol detectives and the the collaterals we have. 01:28:07

Was that one more body which we just got in Officer Gutierrez? 01:28:17
So he's gonna go in to fill that. 01:28:22

For Tapia and as Tapia leaves with our laterals that we have coming in, we'll have the. 01:28:26
Opportunity to fill those last two positions and potentially. 01:28:33
Higher for Tapia's position as well, which will give us one more. 01:28:37
Over the. 01:28:42
24 to 25 officers, but it's a budget neutral position because we're getting compensated by the county task force. Great. So I'll 01:28:44
ask one more question and I'll be done, I think. 01:28:49
So everything is still going to be done. 01:28:55
And we're not over tasked taxing any of our officers to cover. 01:29:00
To until we until you hire someone else so everything's covered everything. The only person who gets over task is your chief when 01:29:05
he decides to take a bike out on Saturday. OK, and go hang out with real guppies on the pier. OK, thank you. If I could just maybe 01:29:11
add to that too. Just quickly so. 01:29:17
We had three vacancies in our Police Department. We just filled one officer, Gutierrez, so we're down to two vacancies. 01:29:24
And I think when we talk about being right sized, I think we do have the right size department. But we had operated with a lot of 01:29:32
vacancies for a long time and that's not unique. That's the problem going county wide. I think the Sheriff's Department is 01:29:38
struggling to fill positions right now. Well, all police departments are struggling to fill positions right now. 01:29:44
We've all heard about Santa Paula and their situation, for example. 01:29:50
So we're actually pretty fortunate that we're actually kind of getting back to fully staffed. Well, this is going ragging rights, 01:29:54
yeah, yeah. And so that's a rare problem to have right now. So we've we've actually built back up and so we're, I think that was 01:30:00
what Chief Federico has explained when he said by filling that position, we actually kind of reached a level we hadn't been at for 01:30:05
a while because we had the vacancies. 01:30:11
And we're actually working on recruiting another lateral officer at this time. 01:30:17
And and where we'd be. 01:30:21
Even only have one vacancy at that point, so. 01:30:24
So that's what kind of freed up the ability to do this and and then this down the line. 01:30:28
The great thing about this that even I didn't expect was. 01:30:35
This is a three-year MOU. 01:30:39
And so that three-year commitment does open up possibilities when we look at the budget to say, well if we know that that this is 01:30:41
paid for by this grant then. 01:30:45
What can we do with that, What we can actually get more services for our community so? 01:30:50

I want to preface my questions with a. 01:31:07
With the fact that I am very supportive. 01:31:09
Of regional planning regional. 01:31:12
Coordination with our local law enforcement agencies. I think it's great. 01:31:15
And the need for this task force I think is, is certainly there based on the trends that we're seeing out there. 01:31:20
In criminal activity and the organized theft. 01:31:27
And I'm glad that you mentioned. 01:31:31
The cargo security on the port because. 01:31:33
It was mentioned in the report, but I didn't know that was it was going to be referencing the port of Winemay, which is I think 01:31:37
we've needed to do that for a long time and I'm sure that they welcome the assistance. 01:31:43
I do have some similar questions though regarding. 01:31:50
Losing Sergeant Tapia, who was just recently promoted to Sergeant. 01:31:54
He has a lot of great experience, good investigative experience, one of our top cops. 01:31:58
And he's going to. 01:32:05
You know rightly go to a stellar agency now and and work on this task force, but will Gutierrez be able to match his experience? 01:32:07
How do you, how do you figure that Gutierrez isn't matching his experience? Henry bout Delongo is taking his position and then 01:32:16
Gutierrez just filling basically the officer spot to remove Henry out of there. So I feel like we're playing chess here. It would 01:32:23
be. I would love to see a diagram so that you could show us. I think that would be better. I would better be able to understand if 01:32:29
I may ask a, are we getting into personnel discussions here? Yeah, I think. 01:32:36
I think that the big picture answer, without getting into personnel issues, is that. 01:32:44
We've recently filled a position that gives us this flexibility and then I think I would encourage everybody not to talk about 01:32:48
qualifications of individual officers, but the chief is. 01:32:53
Managing those positions that we have and. 01:32:58
I know is looking at this as an opportunity to actually expand our our resources and our qualifications. 01:33:01
And so I think that's our response, but for one response, you said it. 01:33:10
A successful succession plan in any organization is chess, and it's something I've been planning since day. One night I got her. 01:33:15
So I didn't, I didn't mean to delve into personnel issues, but I just wanted to express, you know, how we feel about Sergeant 01:33:23
Tapia and his experience and. 01:33:28
And it does, You know, it is a concern. We don't want to lose that level of experience and not be able to replace it. If I can, go 01:33:33

But I would say we have a very good shot especially with the program that we're that we're creating with. 01:34:23

We're definitely going to be on the on the forefront and and have the the eye of the state of the governor in in future grant 01:34:34

them up to be prepared to take their place and to get the experience and the knowledge from them. 01:35:13
And what I've seen and what I've lived through is that. 01:35:20
3 Two or three years later, you look back and go. I wish we had figured out a way to bring somebody in to learn from this person 01:35:24
before they left. 01:35:27
And I think for us that was a legitimate concern we have looking at our officers and anticipating probably some retirements in a 01:35:31
couple years. 01:35:35
That we don't have the. 01:35:41
Budget to start. 01:35:43
Kind of giving people those experiences to be ready to replace or to step into those shoes. 01:35:45
So that is I think an important piece of this as well. And so this is an opportunity for us to do that. 01:35:50
And I think lastly just and I understand the concern about like are we losing service to our community I think. 01:35:58
That I can speak for the chief and he correct me if I'm wrong, but we believe this is a gain of more resources for the community 01:36:06
and I don't think we would we would even be proposing it if that wasn't the case so. 01:36:11

By way of quick background on September 5th of last year. 01:38:12
The council approved a list of topics that were appropriate for. 01:38:16
Citizen Advisory Commission to review. 01:38:20
The list included a review of city sponsored large scale events. 01:38:23
Consistent with that direction at their October 9th and November 13th meetings. 01:38:27
The CAC reviewed a summary of the 2023 festival. 01:38:32
And offered recommendations pertaining to. 01:38:37
To the conduct of the 2024 event. 01:38:39

In running events, we are recommending that the Council cancel the RFP. 01:40:33
And authorize the use of a staff committee to plan and manage this year's event. 01:40:38
The Police Explorer program, which offers valuable training and education to young members of the community in the field of law 01:40:43

Would be part of the program. 01:40:49
The festival provides an opportunity for the explorers to participate in crowd control. 01:40:51
Large event planning and to assist the city and other valuable. 01:40:56

During staff's preliminary investigation, it became evident that reducing the event to a one day event would not reduce 01:41:03
significantly, would not reduce expenses. 01:41:08
But would likely have a substantive impact on revenues generated both in the form of sponsorships and on site. 01:41:13

As such, staff is recommending to continue hosting A2 day festival. 01:41:22
This year, the proposed dates would be September 7th and September 8th. 01:41:26
Finally, staff is recommending A modification to the footprint of the festival. 01:41:31

And reduce the traffic impacts along Surfside Drive. 01:41:40
So there was a preliminary budget attached to the staff report, most importantly as it pertains to the city's contribution. 01:41:49
Last year, the city was asked to provide an event sponsorship of $25,000. 01:41:57
And at the conclusion of the event, the city was responsible for almost $46,000 of a deficit. So the. 01:42:03
Total contribution of those two items was approximately $71,000. 01:42:10
This year, the preliminary budget proposes A sponsorship from the city of $35,000. 01:42:15
And a $25,000 donation to the Explorers for their participation and assistance with the event. 01:42:20
So that's $60,000, representing an approximate $11,000 year over year decrease in the city's contribution to this event. 01:42:27
So in summary, the recommendation from staff includes 4 items. 01:42:38
To cancel the RFP and not award a contract to a vendor. 01:42:44
To approve the use of an employee committee to plan and manage the festival. 01:42:48
Authorize a $25,000 donation to the Explorer program. 01:42:53
And authorized the city manager to consider and accept in kind donations. 01:42:57
In lieu of fees for local nonprofits. 01:43:01

As noted earlier in the Planning concepts, we want to encourage and facilitate nonprofit organizations involvement in the festival 01:43:08
and we thought that in addition to having booths, we could use some of our local nonprofits to participate provide activities. 01:43:15

The fees that would normally be associated with being a vendor at. 01:43:27

So I'll ask Public Works, our team for Public Works to help me, but just a little bit of background is that people probably 02:02:28
noticed a couple weeks ago on March 13th. 02:02:33
All of a sudden, we closed the lane on Ventura Rd. 02:02:39
At the intersection of Ventura Road and Pearl Street. 02:02:42
And the reason we we closed the lane was that we received a report that a sinkhole was developing and we went out immediately and 02:02:46
and saw that we we had a a sinkhole developing. 02:02:52
So we took. We jumped into action. We addressed the sinkhole. 02:02:59
We repaired the pipe. 02:03:05
It was a 60 year old pipe and. 02:03:08
Which should have lasted 70 to 75 years. So you know on one hand it's it wasn't quite to its expected its life expectancy but on 02:03:12
the other hand we should. 02:03:17
Probably be we should be preparing for 60 year old pipes starting to fail. 02:03:23
I think a lot of our infrastructure is getting to that age. 02:03:27

We addressed the sinkhole and that issue, but as we were making the repair we noticed. 02:03:33
Problems along the whole section of the pipe and that it was failing. 02:03:39

And so we are trying to get that done quickly before we have more issues, before we have a major failure of the pipe because we're 02:04:08

To perform the emergency repair by exempting us from our normal formal contract procedures because of the condition of the pipe 02:04:29
